which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To terminate the Yucca Mountain licensing proceeding and require the Director of the Office of Management and Budget to submit to Congress a study on the economic viability and job-creating benefits of alternative uses of the Yucca Mountain site, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0EA4FAC090E14592ACCD14138A183472"><section section-type="section-one" id="H860490103ABC49A59E8B47D47901A44E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jobs, Not Waste Act of 2024</short-title></quote>.</text></section><section id="H6D1F244303254CFB91AB37F87FA941C5"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id936e8284c1114b14b134de15a92fb1f9"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide547f752632b4ea88b9fd82886e601e1"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Environment and Public Works of the Senate;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4b81718277a94795bdf8d3c864ed1c72"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcfa34df5ec034992b378d6dc5f367ee9"><enum>(C)</enum><text>the Committee on Energy and Commerce of the House of Representatives.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec9f5f3f78df4cc1b967bdb881e4ce95"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddf89806b1b0941cca57f17316269f5d7"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide02b3a929bcb4663acd78922fbf42cc3"><enum>(4)</enum><header>Yucca Mountain site</header><text display-inline="yes-display-inline">The term <term>Yucca Mountain site</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text></paragraph></section><section id="H99A7A9DFA167417BBF335D1AF61EED87"><enum>3.</enum><header>Termination of the Yucca Mountain licensing proceeding</header><subsection commented="no" display-inline="no-display-inline" id="idc79b38b641224cc0b3c51784aa1a134d"><enum>(a)</enum><header display-inline="yes-display-inline">Repeals</header><paragraph commented="no" display-inline="no-display-inline" id="id092bf44818dd413c9c388c3a2ffb9040"><enum>(1)</enum><header>Nuclear Waste Policy Act provision</header><text display-inline="yes-display-inline">Section 160 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10172">42 U.S.C. 10172</external-xref>) is repealed.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe071621a40b40288cce4e99a4eecda3"><enum>(2)</enum><header>Public Law 107–200</header><text display-inline="yes-display-inline">Public Law 107–200 (<external-xref legal-doc="usc" parsable-cite="usc/42/10135">42 U.S.C. 10135</external-xref> note; 116 Stat. 735) is repealed.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idce228d0357894a078da821cab7326f50"><enum>(b)</enum><header>Termination</header><text>Effective on the date of enactment of this Act—</text><paragraph commented="no" display-inline="no-display-inline" id="id74276122f1e5421194ec28bed9790298"><enum>(1)</enum><text display-inline="yes-display-inline">the application for a construction authorization for a repository at the Yucca Mountain site filed with the Commission by the Secretary is withdrawn; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48d5c011f7e4474cb3ec2c92bdcc0024"><enum>(2)</enum><text>the Commission licensing proceeding for the proposed repository at the Yucca Mountain site is terminated.</text></paragraph></subsection><subsection id="id1eea7bfd8aa14d04a7d102aeaa28776d"><enum>(c)</enum><header>Prohibition on future consideration</header><text>Notwithstanding any other provision of law, beginning on the date of enactment of this Act, the Secretary shall not consider (or reconsider) the Yucca Mountain site for the location of a repository.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide169d2de4de945acbc0916e482eb1baf"><enum>(d)</enum><header>Reclamation and mitigation</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall take all reasonable and necessary steps—</text><paragraph commented="no" display-inline="no-display-inline" id="idef5e1d0fa39c4ec99ff1f03ff630305c"><enum>(1)</enum><text display-inline="yes-display-inline">to reclaim the Yucca Mountain site; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0d3790ac451c425ba4860efdeeb121e3"><enum>(2)</enum><text display-inline="yes-display-inline">to mitigate any significant adverse environmental impacts caused by site characterization and other activities associated with the filing of the application for a construction authorization referred to in subsection (b)(1).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idc19f4d50baa14c3dbc0cd0503d5f7f72"><enum>4.</enum><header display-inline="yes-display-inline">Study on the economic benefit of alternative uses of the Yucca Mountain site</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall submit to the appropriate committees of Congress, and make available to the public, a study on the economic viability and job-creating benefits of alternative uses of the Yucca Mountain site as described in the report of the Government Accountability Office numbered GAO–11–847 and dated September 2011, including—</text><paragraph id="H094621EB090B488E8C415CA29BD18EA9"><enum>(1)</enum><text display-inline="yes-display-inline">defense activities, such as a command facility for unmanned aircraft systems;</text></paragraph><paragraph id="H5BCB605FE7D44E03A2ADEECCC3EE0069"><enum>(2)</enum><text display-inline="yes-display-inline">a secure electronic data center;</text></paragraph><paragraph id="HD15C77F95A6E4558A3BA9290D8B761C7"><enum>(3)</enum><text display-inline="yes-display-inline">the development of renewable energy sources; and</text></paragraph><paragraph id="H9E0E26E68C7A49099D778FA34E189610"><enum>(4)</enum><text>scientific research.</text></paragraph></section></legis-body></bill>
