higher education shall be ineligible for funds under the Higher Education Act of 1965 due to campus disorder.</official-title></form><legis-body><section id="idd8ff954870c7400d83f235090348e729" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Encampments or Endowments Act</short-title></quote>.</text></section><section id="S1" section-type="subsequent-section"><enum>2.</enum><header>Ineligibility due to campus disorder</header><subsection commented="no" display-inline="no-display-inline" id="id4841b2088fe546289844a9c33ebcf4d7"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Part B of title I of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011">20 U.S.C. 1011 et seq.</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id0298bd7b69be4f2f9f106dcde7475035"><section id="id458b021acd0947feafa8caafca979c29"><enum>124.</enum><header>Ineligibility due to campus disorder</header><subsection id="id29b6de6ec77c48b4bb61663c05c589f0"><enum>(a)</enum><header>In General</header><text>Notwithstanding any other provision of law, no institution of higher education shall be eligible to receive funds under this Act (including funds for Federal student assistance under title IV) or participate in programs under title IV if the Secretary determines that the institution of higher education has failed to disestablish any permanent encampment on the institution's campus if occupants of the encampment, whether or not affiliated with the institution of higher education—</text><paragraph id="ida113a51f0460471dbae91dd2705e58c8"><enum>(1)</enum><text>have attempted to interfere with a core function of the institution of higher education; or</text></paragraph><paragraph id="idb47b17c1066e49dba6909d773f6b7c3b"><enum>(2)</enum><text>have obstructed the ingress or egress of students.</text></paragraph></subsection><subsection id="idc03f9a67e5e14cd98f218438a88f6fa7"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idafad7fe0a02243e89cf97abe08295382"><enum>(1)</enum><header>Campus</header><text>The term <term>campus</term> has the meaning given the term in section 485(f)(6).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcff7544fa5784cbea3485add597bbb78"><enum>(2)</enum><header display-inline="yes-display-inline">Core function of a university</header><text>The term <term>core function of a university</term> means classroom instruction, research, and academic ceremonies performed as part of the matriculation, education, or graduation of students, including commencement ceremonies.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11b9cca2bdb340d79524f7a9fb3d8152"><enum>(3)</enum><header>Encampment</header><text>The term <term>encampment</term> means any establishment on the campus of the institution of higher education containing any tent, lean-to, shack, or other structure erected for the purpose of maintaining a temporary or permanent place to live or reside, or where any bedding, sleeping bag, stove, or collection of personal belongings has been placed for the purpose of maintaining temporary or permanent habitability.</text></paragraph><paragraph id="id3d2b12a4b1b84c07b3fbcdc9768a2938"><enum>(4)</enum><header>Permanent encampment</header><text>The term <term>permanent encampment</term> means any encampment existing on the campus of the institution of higher education for 7 days or more.</text></paragraph></subsection><subsection id="id8B1466592D93474E8AB4E5ABA8A94810"><enum>(c)</enum><header>Regaining eligibility</header><text>On the date that is 5 years after the date on which an institution is declared ineligible under this section, that institution may submit an application to the Secretary containing a request to regain such eligibility, and the Secretary shall consider such request.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id2f56f52568844e7c9637489401474ab0"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall take effect on the date of enactment of this Act, and ineligibility with respect to any grant, loan, or work assistance provided under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>) due to a violation of subsection (a) shall apply on or after July 1, 2025.</text></subsection><subsection display-inline="no-display-inline" commented="no" id="idFC77B3DF81F442A0B288E965029879AE"><enum>(c)</enum><header>FAFSA determinations</header><text>The Secretary of Education shall continue to receive and process the Free Application for Federal Student Aid for continuously enrolled students (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/4969">section 4969</external-xref> of the Internal Revenue Code of 1986, as added by section 3), in order to make a determination about the covered Federal financial assistance amount (as defined under such section) for such students.</text></subsection></section><section id="idCE5716EA974A42C18C44E947B86B9C15"><enum>3.</enum><header>Excise Tax on the Endowments of Certain Disqualified Colleges and Universities</header><subsection id="id830fe11a2ac94097affee3b2f3ea9fae"><enum>(a)</enum><header>In general</header><text>Subchapter H of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/42">chapter 42</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF4862E9A823E41E8A98FAE1F799D550D"><section id="id7083AF01A08E4F0EBFEDB09054B6262C"><enum>4969.</enum><header>Excise tax on endowment income of certain disqualified colleges and universities</header><subsection id="id0694109c6fb04dc2ba349f4d41c84777"><enum>(a)</enum><header>Tax imposed</header><text>There is hereby imposed on each disqualified educational institution for any taxable year a tax equal to 50 percent of the aggregate fair market value of the assets of the institution at the end of the preceding taxable year.</text></subsection><subsection id="id8FA173D7EEB84003B470C5094D0A18E5"><enum>(b)</enum><header>Disqualified educational institution</header><text>For purposes of this section, with respect to a taxable year—</text><paragraph id="id11B4496FE26C477384D094208ABC1079"><enum>(1)</enum><header>In general</header><text>The term <term>disqualified educational institution</term> means an eligible educational institution (as defined in section 25A(f)(2)) which is ineligible to receive funds under the Higher Education Act of 1965 (including funds for Federal student assistance under title IV of such Act) or participate in programs under title IV of such Act pursuant to section 124 of such Act.</text></paragraph><paragraph id="id4AB9A2F6BFB349C393842B4276086717"><enum>(2)</enum><header>Exception</header><text>An institution shall not be treated as a disqualified educational institution for the taxable year if such institution—</text><subparagraph id="id6A547C22CF244EA7BF20D6CB7733C177"><enum>(A)</enum><text>for the academic year ending with or within the taxable year, provides grant funds for all continuously enrolled students of the institution in an amount equal to the covered Federal financial assistance amount for such students, and</text></subparagraph><subparagraph id="id56CA1C6B15A548B6BE593F5E08F9E32F"><enum>(B)</enum><text>demonstrates such assistance to the Secretary of Education.</text></subparagraph></paragraph></subsection><subsection id="idb0abfd9e11e74408a790a5a6fd4a5980"><enum>(c)</enum><header>Assets</header><text>The rules of section 4968(d) shall apply for purposes of this section.</text></subsection><subsection id="idAE2B3BB95F6F436FADB6395879121FBF"><enum>(d)</enum><header>Continuously enrolled students</header><text>For purposes of this section, the term <term>continuously enrolled student</term> means a student who—</text><paragraph id="idF301DB2F2AF0491BAD9BCFE65BB66104"><enum>(1)</enum><text>is enrolled at an institution of higher education when that institution was determined to be ineligible for Federal student assistance pursuant to section 124 of the Higher Education Act of 1965; and</text></paragraph><paragraph id="idD533BDE632EE40D9A374FA45CF91C662"><enum>(2)</enum><text>has continued enrollment in the same degree program at that institution.</text></paragraph></subsection><subsection id="idB263F0C879D34F91B79222F2C3BF6902"><enum>(e)</enum><header>Covered Federal financial assistance amount</header><text>For purposes of this section, the term <term>covered Federal financial assistance amount</term> means the amount of Federal financial assistance under title IV of the Higher Education Act of 1965 (including through grants, loans, and work assistance) for which a student who is a continuously enrolled student in a disqualified educational institution would have been eligible, with respect to an applicable award year, if the disqualified educational institution were participating in the financial assistance programs under such title IV, as calculated based on a student's submission of the Free Application for Federal Student Aid and in accordance with part F of such title IV.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id7b248bda76bd4038957195d69ecf5d32"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subchapter H of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/42">chapter 42</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new item:</text><quoted-block style="OLC" id="id65f24387-5e6e-4a01-8d0e-9e92bd992c4c"><toc><toc-entry level="section" idref="id7083AF01A08E4F0EBFEDB09054B6262C">Sec. 4969. Excise Tax on the Endowments of Certain Disqualified Colleges and Universities.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id46E6162B993B41118D83157AED915049"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years ending after July 1, 2025.</text></subsection></section></legis-body></bill>
