<committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Department of State and the Department of Defense to engage with the Government of Japan regarding areas of cooperation within the Pillar Two framework of the AUKUS partnership, and for other purposes. </official-title></form><legis-body><section id="id604b38b12eee453baac3db5e52fcb567" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coordinating AUKUS Engagement with Japan Act of 2024</short-title></quote>.</text></section><section id="id1b90ba6e380c4b84804f59c6a7d36d7b"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ide05c66d154d242ba92849d490c7c7d66"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id7b497e043bcd42d0bed827badcc71fc5"><enum>(A)</enum><text>the Committee on Foreign Relations and the Committee on Armed Services of the Senate; and</text></subparagraph><subparagraph id="idb5001cdc62fc4c5cbe6fdd6d3a1c8a1b"><enum>(B)</enum><text>the Committee on Foreign Affairs and the Committee on Armed Services of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idd9f51cf25b6f4c2f8d30e3007133869a"><enum>(2)</enum><header>AUKUS official</header><text>The term <term>AUKUS official</term> means a government official with responsibilities related to the implementation of the AUKUS partnership. </text></paragraph><paragraph id="id2f3d23e6807448cb9af9e1123260b9a6"><enum>(3)</enum><header>AUKUS partnership</header><text>The term <term>AUKUS partnership</term> has the meaning given that term in section 1321 of the National Defense Authorization Act of Fiscal Year 2024 (<external-xref legal-doc="usc" parsable-cite="usc/22/10401">22 U.S.C. 10401</external-xref>).</text></paragraph><paragraph id="id00e18b5be6024339aaf51bce416eafa6"><enum>(4)</enum><header>Commerce Control List</header><text>The term <term>Commerce Control List</term> means the list maintained pursuant to part 774 of title 15, Code of Federal Regulations (or successor regulations).</text></paragraph><paragraph id="id89cb34f17902408faa5ebc5c6789e54a"><enum>(5)</enum><header>State AUKUS Coordinator</header><text>The term <term>State AUKUS Coordinator</term> means the senior advisor at the Department of State designated under section 1331(a)(1) of the National Defense Authorization Act for Fiscal Year 2024 (<external-xref legal-doc="usc" parsable-cite="usc/22/10411">22 U.S.C. 10411(a)(1)</external-xref>). </text></paragraph><paragraph id="iddd9294fdd932430bb1ca55d5feeac781"><enum>(6)</enum><header>Defense AUKUS Coordinator</header><text>The term <term>Defense AUKUS Coordinator</term> means the senior civilian official of the Department of Defense designated under section 1332(a) of the National Defense Authorization Act for Fiscal Year 2024 (<external-xref legal-doc="usc" parsable-cite="usc/22/10412">22 U.S.C. 10412(a)</external-xref>). </text></paragraph><paragraph id="id352bb49cab594109bd7e4a2cd96173b2"><enum>(7)</enum><header>Pillar Two</header><text>The term <term>Pillar Two</term> has the meaning given that term in section 1321(2)(B) of the National Defense Authorization Act of Fiscal Year 2024 (<external-xref legal-doc="usc" parsable-cite="usc/22/10401">22 U.S.C. 10401(2)(B)</external-xref>).</text></paragraph><paragraph id="idaca5d838f56342deb8bfd18cd71d04ae"><enum>(8)</enum><header>United States Munitions List</header><text>The term <term>United States Munitions List</term> means the list set forth in part 121 of title 22, Code of Federal Regulations (or successor regulations).</text></paragraph></section><section id="id2ca955cdfa1f47fd8a06e7d3e0b976a5"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id2e71341276ea4470a240899ec2856d38"><enum>(1)</enum><text>the United States should continue to strengthen relationships and cooperation with allies in order to effectively counter the People’s Republic of China;</text></paragraph><paragraph id="id57082cc8769b4f4681f6e8f389bd0e99"><enum>(2)</enum><text>the United States should capitalize on the technological advancements allies have made in order to deliver more advanced capabilities at speed and at scale to the United States military and the militaries of partner countries;</text></paragraph><paragraph id="id29428422c47344a6bae4c91fb10f3c42"><enum>(3)</enum><text>the historic announcement of the AUKUS partnership laid out a vision for future defense cooperation in the Indo-Pacific among Australia, the United Kingdom, and the United States;</text></paragraph><paragraph id="idff26291342d547029b12dbd714fc0bf7"><enum>(4)</enum><text>Pillar Two of the AUKUS partnership envisions cooperation on advanced technologies, including hypersonic capabilities, electronic warfare capabilities, cyber capabilities, quantum technologies, undersea capabilities, and space capabilities;</text></paragraph><paragraph id="id7a0647eaa27c45ea9fab3e2c05792504"><enum>(5)</enum><text>trusted partners of the United States, the United Kingdom, and Australia, such as Japan, could benefit from and offer significant contributions to a range of projects related to Pillar Two of the AUKUS partnership;</text></paragraph><paragraph id="idb734bdb62cd34be8ab4dccb3231398e2"><enum>(6)</enum><text>Japan is a treaty ally of the United States and a technologically advanced country with the world’s third-largest economy;</text></paragraph><paragraph id="id2862e8f99e994aca8fe8f1b490b11ac2"><enum>(7)</enum><text>in 2022, Australia signed a Reciprocal Access Agreement with Japan to facilitate reciprocal access and cooperation between the Self-Defense Forces of Japan and the Australian Defence Force;</text></paragraph><paragraph id="idaee3cf6ee9b84da8a5d2cb1b0b2a2fc5"><enum>(8)</enum><text>in 2023, the United Kingdom signed a Reciprocal Access Agreement with Japan to facilitate reciprocal access and cooperation between the Self-Defense Forces of Japan and the Armed Forces of the United Kingdom of Great Britain and Northern Ireland; </text></paragraph><paragraph id="id51f8006f12dd4ced9d468a2acfd29f26" commented="no"><enum>(9)</enum><text>in 2014, Japan relaxed its post-war constraints on the export of non-lethal defense equipment, and in March 2024, Japan further refined that policy to allow for the export of weapons to countries with which it has an agreement in place on defense equipment and technology transfers; </text></paragraph><paragraph id="id9b83e36e09354552a2e390c3eccdc106" commented="no"><enum>(10)</enum><text>in 2013, Japan passed a secrecy law obligating government officials to protect diplomatic and defense information, and in February 2024, the Cabinet approved a bill creating a new security clearance system covering economic secrets; and</text></paragraph><paragraph id="ide3b85e810d514008a6fbacc5efc9b9dd"><enum>(11)</enum><text>in April 2024, the United States, Australia, and the United Kingdom announced they would consider cooperating with Japan on advanced capability projects under Pillar Two of the AUKUS partnership. </text></paragraph></section><section id="id2fe8e142c39048c88d9a401f420f9cca"><enum>4.</enum><header>Engagement with Japan on AUKUS Pillar Two cooperation</header><subsection id="id023df3c1a53643d09bfe6b423cef68d4"><enum>(a)</enum><header>Engagement required</header><paragraph commented="no" display-inline="no-display-inline" id="id31592530b2624de09bba2bdb92fb9eab"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 90 days after the date of the enactment of this Act, the State AUKUS Coordinator and the Defense AUKUS Coordinator shall jointly engage directly, at a technical level, with the relevant stakeholders in the Government of Japan—</text><subparagraph id="ide1e4c14fe1824f1983bd6c3a711873e5"><enum>(A)</enum><text>to better understand the export control system of Japan and the effects of the reforms the Government of Japan has made to that system since 2014;</text></subparagraph><subparagraph id="id86533c55c56e42568249eb3fadce181b"><enum>(B)</enum><text>to determine overlapping areas of interest and the potential for cooperation with Australia, the United Kingdom, and the United States on projects related to the AUKUS partnership and other projects;</text></subparagraph><subparagraph id="idef0a83b4032344098596f3aa9be9cdf0"><enum>(C)</enum><text>to identify areas in which the Government of Japan might need to adjust the export control system of Japan in order to guard against export control violations or other related issues in order to be a successful potential partner in Pillar Two of the AUKUS partnership; and</text></subparagraph><subparagraph id="id69bce3903ce04745956ddd53fb488b49"><enum>(D)</enum><text>to assess the Government of Japan’s implementation and enforcement of export controls on sensitive technologies with respect to the People’s Republic of China, including the implementation of export controls on semiconductor manufacturing equipment.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id10e067e073a94b9dbd7917ececeea731"><enum>(2)</enum><header>Consultation with AUKUS officials</header><text>In carrying out the engagement required by paragraph (1), the State AUKUS Coordinator and the Defense AUKUS Coordinator shall consult with relevant AUKUS officials from the United Kingdom and Australia. </text></paragraph></subsection><subsection id="id8d4377c95ed34b7b99b3d7bd656ca1da"><enum>(b)</enum><header>Briefing requirement</header><text>Not later than 30 days after the date of the engagement required by subsection (a), the State AUKUS Coordinator and the Defense AUKUS Coordinator shall jointly brief the appropriate congressional committees on the following:</text><paragraph id="id21aa3fcaa6a840bfaea41187532e3093"><enum>(1)</enum><text>The findings of that engagement.</text></paragraph><paragraph id="id15acc2aa4b0442b381d3d09c33d134a9"><enum>(2)</enum><text>A strategy for follow-on engagement.</text></paragraph></subsection></section><section id="idad5c38c65630460d9045a58fea747eb0"><enum>5.</enum><header>Assessment of potential for cooperation with Japan on AUKUS Pillar Two</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of State, with the concurrence of the Secretary of Defense, shall submit to the appropriate congressional committees a report assessing the potential for cooperation with Japan on Pillar Two of the AUKUS partnership, detailing the following:</text><paragraph id="idbbb5a28ac11a41c885cfd608a9d57752"><enum>(1)</enum><text>Projects the Government of Japan is engaged in related to the development of advanced defense capabilities under Pillar Two of the AUKUS partnership.</text></paragraph><paragraph id="idfb663c47df854ddebebf49b37f714848"><enum>(2)</enum><text>The average and median length of time it takes to approve licenses to export products on the United States Munitions List and the Commerce Control List to Japan.</text></paragraph><paragraph id="ide190134f0dc14be08c55f4fb24c6fb11"><enum>(3)</enum><text>Areas of potential cooperation with Japan on advanced defense capabilities within and outside the scope of Pillar Two of the AUKUS partnership. </text></paragraph><paragraph id="idb1f40612fe8c4bc9b3cfd09a6c28a262"><enum>(4)</enum><text>The Secretaries’ assessment of the current export control system of Japan, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9012d142e47d47c1805bf043e58231d4"><enum>(A)</enum><text display-inline="yes-display-inline">the procedures under that system for protecting classified and sensitive defense, diplomatic, and economic information; </text></subparagraph><subparagraph id="id73a52300683246d3bcf9d8f6562a88aa"><enum>(B)</enum><text>the effectiveness of that system in protecting such information; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide063b7845c624a23a2bd9034d0dc43b0"><enum>(C)</enum><text display-inline="yes-display-inline">such other matters as the Secretaries consider appropriate.</text></subparagraph></paragraph><paragraph id="id93935b888aca4d22bd3f0f0d3574cb38"><enum>(5)</enum><text>Any reforms by Japan that the Secretary of State considers necessary before considering including Japan in the privileges provided under Pillar Two of the AUKUS partnership.</text></paragraph><paragraph id="idbf34358a82b6460488651b0d53ed3f8e"><enum>(6)</enum><text>Any recommendations regarding the scope and conditions of potential cooperation with Japan under Pillar Two of the AUKUS partnership.</text></paragraph><paragraph id="id834d7ffd2d6d45888155aaeeab9b9ee9"><enum>(7)</enum><text>A strategy and forum for communicating the potential benefits of and requirements for engaging in projects related to Pillar Two of the AUKUS partnership with the Government of Japan.</text></paragraph><paragraph id="id828fd7e50fb043d081729b69e11a2b50"><enum>(8)</enum><text>Any views provided by AUKUS officials from the United Kingdom and Australia on issues relevant to the report, and a plan for cooperation with such officials on future engagement with the Government of Japan related to Pillar Two of the AUKUS partnership. </text></paragraph></section></legis-body></bill>
