direct the Secretary of Housing and Urban Development to award grants to provide financial assistance to certain educators to make down payments on certain homes, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE9DA73DD6B734A4188F9AA0D26D6EABD"><section section-type="section-one" id="H1C0D488749C34C75B494B037A9A38833"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Educator Down Payment Assistance Act of 2024</short-title></quote>.</text></section><section id="id7dedc3f78fe14a258b4ec82942ca8d2b"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" id="HF7916688181B4C5787A853AB9FA2532C"><enum>(1)</enum><header>Eligible dwelling</header><text display-inline="yes-display-inline">The term <term>eligible dwelling</term> means a residential property with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2775d36290d945039ab6754defba1e43"><enum>(A)</enum><text display-inline="yes-display-inline">not more than 4 dwelling units; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf182e808e5aa49c48d0da7e21ff2a945"><enum>(B)</enum><text display-inline="yes-display-inline">an apartment;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc8c5a4ed4d8b40afbf33d33f03a18837"><enum>(C)</enum><text display-inline="yes-display-inline">a condominium; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id01dfdca588e340e0914e43766e07cb05"><enum>(D)</enum><text display-inline="yes-display-inline">a manufactured dwelling unit.</text></subparagraph></paragraph><paragraph id="HDFEBAF2F679A4A0A9457F5AFB4D409FA"><enum>(2)</enum><header>Eligible educator</header><text display-inline="yes-display-inline">The term <term>eligible educator</term> means a public elementary or secondary school teacher, principal, paraprofessional, school leader, or other staff who—</text><subparagraph id="H9330D669A8E742C596A19AABE96186B7"><enum>(A)</enum><text>is a first-time homebuyer;</text></subparagraph><subparagraph id="H8B1A82D398F54CE4B8F8CB76EEE22E85"><enum>(B)</enum><text display-inline="yes-display-inline">has served in their position or another position in the educational system for not fewer than a total of 3 years (without regard to whether such years were consecutive); </text></subparagraph><subparagraph id="H20BFAFB7C8BE4E828781870AB04A8A9A"><enum>(C)</enum><text>has a qualifying income; and</text></subparagraph><subparagraph commented="no" id="H484319E3004B482FAEDB31CE15C2D6A3"><enum>(D)</enum><text>is in good standing.</text></subparagraph></paragraph><paragraph id="HDD894C843EBD4950BD479EBF131F8667"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H0657271276FB404FA47845E2F33DDEAC"><enum>(A)</enum><text>a unit of local government;</text></subparagraph><subparagraph id="H71E37686A0DE471E83698B64C82B8876"><enum>(B)</enum><text>a State housing finance agency; or</text></subparagraph><subparagraph id="H52F54266111145619D302F8474D42557"><enum>(C)</enum><text>a local educational agency.</text></subparagraph></paragraph><paragraph commented="no" id="HFEB65BDE9454444D9BCC2DA2A3401CDD"><enum>(4)</enum><header>Eligible residential mortgage loan</header><text>The term <term>eligible residential mortgage loan</term> means a residential mortgage loan that—</text><subparagraph commented="no" id="H977F666A57E34D169467312771242507"><enum>(A)</enum><text display-inline="yes-display-inline">meets the underwriting requirements and dollar amount limitations for acquisition by the Federal National Mortgage Association or the Federal Home Loan Mortgage Corporation; </text></subparagraph><subparagraph commented="no" id="H86935B2E897C44279F82B29625894E14"><enum>(B)</enum><text>is made, insured, or guaranteed under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>) or title V of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1471">42 U.S.C. 1471 et seq.</external-xref>);</text></subparagraph><subparagraph id="H62CB7DEA14EF4800A440C8317F81D89B"><enum>(C)</enum><text display-inline="yes-display-inline">is made, insured, or guaranteed under title VIII of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4221">25 U.S.C. 4221 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" id="HF78ECDA98AEF40208730BD81CD128855"><enum>(D)</enum><text>is a qualified mortgage, as defined in section 129C(b)(2) of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1639c">15 U.S.C. 1639c(b)(2)</external-xref>); or</text></subparagraph><subparagraph commented="no" id="H172E45927E264675A5BC4D2317CF8DC8"><enum>(E)</enum><text>is guaranteed under section 184 of the Housing and Community Development Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-13a">12 U.S.C. 1715z–13a</external-xref>).</text></subparagraph></paragraph><paragraph id="H9A13E591EEB74E479201FDAB00916492"><enum>(5)</enum><header>Emergency event</header><text>The term <term>emergency event</term> includes—</text><subparagraph id="HC93ED774C5F148D3BA7C78D14CAB094D"><enum>(A)</enum><text display-inline="yes-display-inline">military deployment;</text></subparagraph><subparagraph id="H9EC074B060FE4DC980C9A254A6304F87"><enum>(B)</enum><text>divorce;</text></subparagraph><subparagraph id="H8954D8791F7B4C608E48A2523D5E9104"><enum>(C)</enum><text>death of an eligible educator or spouse; and</text></subparagraph><subparagraph id="HC5FCECA5082E4BF4A53927A2EEC8B030"><enum>(D)</enum><text>other similar unforeseen events as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="H09E474A0F7E84BD2BBF0CFEAC86A6ED9" commented="no"><enum>(6)</enum><header>ESEA terms</header><text>The terms <term>elementary school</term>, <term>local educational agency</term>, <term>other staff</term>, <term>secondary school</term>, and <term>Secretary</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph commented="no" id="HA643267940C142AEB7E671F4B54DF5D8"><enum>(7)</enum><header>First-time homebuyer</header><text>The term <term>first-time homebuyer</term> has the meaning given the term in section 92.2 of title 24, Code of Federal Regulations (as in effect on the date of the enactment of this Act), except that any reference in such section to the American Dream Downpayment Initiative shall be deemed to be a reference to the grant program established under this section.</text></paragraph><paragraph commented="no" id="H36E4DFBB246945FFB8A2E4771BC12A80"><enum>(8)</enum><header>Good standing</header><text display-inline="yes-display-inline">The term <term>good standing</term> means that, with respect to an eligible educator and during the 3-year period beginning on the date on which the educator submits an application under section 3(b), such educator has not received disciplinary action from the local educational agency that serves the school at which such educator works as an educator.</text></paragraph><paragraph id="HFE9712CB82F949A5B9526D187F53E968"><enum>(9)</enum><header>Qualifying income</header><text display-inline="yes-display-inline">The term <term>qualifying income</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4ce5de15a8f24b05b3e0da7c5a2aaaf5"><enum>(A)</enum><text display-inline="yes-display-inline">an income that is not greater than 120 percent of the area median income in which the eligible dwelling to be purchased is located; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id877438872ac5458ba7a82203c876fb80"><enum>(B)</enum><text>if the Secretary determines that the area described in subparagraph (A) is a high-cost area, an income that is not greater than 180 percent of the median income of such area.</text></subparagraph></paragraph><paragraph id="H8CB8E5D92CEF41C98817C1706F44EC82" commented="no" display-inline="no-display-inline"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development. </text></paragraph></section><section id="H1CF01882848E47A2973CEB69D6F1D010"><enum>3.</enum><header>First-time homebuyer down payment assistance program</header><subsection commented="no" id="H1505E038ECB24E7E856B88052434393D"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Housing and Urban Development shall award grants, on a competitive basis, to eligible entities to provide financial assistance to eligible educators in accordance with subsection (d).</text></subsection><subsection id="H6693329FF18B4490A5E705959AE314D6"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity seeking a grant under this section shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate, including an assurance that such entity will use an existing, or establish a new, down payment assistance program to provide financial assistance to eligible educators.</text></subsection><subsection id="H594EF2B96C6F43118D64F734C658A87A"><enum>(c)</enum><header>Geographic areas</header><text display-inline="yes-display-inline">In the case of a geographic area that is served by an eligible entity that is a unit of local government and an eligible entity that is a local educational agency, the Secretary may only award a grant to 1 such entity in such geographic area.</text></subsection><subsection id="H63553816A3F14DCA86791FC09D556D07"><enum>(d)</enum><header>Use of amounts To provide financial assistance</header><paragraph id="H41FDBB0530EA4EA8BC7CC752A6314375"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under subsection (a) shall use such grant funds to provide financial assistance to eligible educators.</text></paragraph><paragraph id="H084FEB5FFB4745148E0F8AA06E98F86D"><enum>(2)</enum><header>Application</header><text>An eligible educator seeking a financial assistance under this subsection shall submit to the eligible entity an application in such form, at such time, and containing such information as the eligible entity determines appropriate, including an assurance that such educator will—</text><subparagraph id="HA420AF26F4014A20A26E4A41C0113D33"><enum>(A)</enum><text>complete the housing counseling required under paragraph (8); and</text></subparagraph><subparagraph commented="no" id="H6CD42A31FFE64AD2BAC4525C228CDB98"><enum>(B)</enum><text>use an eligible residential mortgage loan to purchase an eligible dwelling.</text></subparagraph></paragraph><paragraph commented="no" id="H1BAA54090BDB437088943C6C94E358AD"><enum>(3)</enum><header>Use of financial assistance</header><text>An eligible educator who receives financial assistance under this subsection shall use such financial assistance to pay, with respect to the purchase of an eligible dwelling using an eligible residential mortgage loan, for—</text><subparagraph commented="no" id="H1AB3004C5C9F4618BAEEF981E08E31A3"><enum>(A)</enum><text>direct down payment costs associated with such purchase;</text></subparagraph><subparagraph commented="no" id="HC5EB36F5C8DE48F68F863982D918EABC"><enum>(B)</enum><text>closing costs associated with such purchase; and</text></subparagraph><subparagraph commented="no" id="H0B637E38AEC441D381212C07F51AA459"><enum>(C)</enum><text>costs related to reducing the rates of interest on such eligible residential mortgage loan associated with such purchase.</text></subparagraph></paragraph><paragraph commented="no" id="HB6D26F31BF114E059D79651B0BEDAD50"><enum>(4)</enum><header>Amount of financial assistance</header><subparagraph commented="no" id="H721D6D371DB14253BCE5E6D5C20E059F"><enum>(A)</enum><header>In general</header><text>Except as provided under subparagraph (B), the amount of financial assistance awarded to an eligible educator under this subsection may not be greater than $25,000.</text></subparagraph><subparagraph commented="no" id="H47669CFD80B34374B5822276045E6FED"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">In the case of an eligible educator purchasing an eligible dwelling that is located in an area described in section 305(a)(2) of the Federal Home Loan Mortgage Corporation Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1454">12 U.S.C. 1454(a)(2)</external-xref>), the amount of financial assistance awarded to an eligible educator under this subsection may be greater than $25,000.</text></subparagraph></paragraph><paragraph commented="no" id="H342E4587AF8F41F78645C2F7DD9B0A34"><enum>(5)</enum><header>Limitation</header><text>An eligible educator may only receive financial assistance under this subsection 1 time.</text></paragraph><paragraph commented="no" id="H962EC8FA2E454C6E9B96130C0FC1830B"><enum>(6)</enum><header>Additional funds</header><text display-inline="yes-display-inline">An eligible entity may award financial assistance under this subsection to an eligible educator who is receiving funds from other sources, including other State, Federal, local, private, public, and nonprofit sources, for the purpose of purchasing an eligible dwelling.</text></paragraph><paragraph id="H3F44CFBC074E4B11A65F8DDBED45CA65"><enum>(7)</enum><header>Occupancy requirement</header><subparagraph commented="no" id="H89FC6098984D41B7A59776DDA335BF15"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible educator who is awarded financial assistance under this subsection shall use the eligible dwelling purchased using such financial assistance as a primary residence for a period of not fewer than 3 years beginning on the date on which the eligible educator receives financial assistance under this subsection.</text></subparagraph><subparagraph id="HDF990F9A4AE2444D8BDCA0507C7093AF"><enum>(B)</enum><header>Enforcement</header><clause id="H49D1EEEC3F6B4F96B1F25D446903710F"><enum>(i)</enum><header>Return of funds</header><text>An eligible educator who does not comply with the requirement under subparagraph (A) shall return to the eligible entity the total amount of the financial assistance awarded to such educator under this subsection.</text></clause><clause id="HF759C88FB3A94B3D97CC5E0E673E0FEA"><enum>(ii)</enum><header>Timing</header><text>Such funds shall be returned in accordance with clause (i) not later than 1 year after such educator ceases to use such dwelling as a primary residence in violation of the requirement under subparagraph (A).</text></clause><clause id="H898E48828CCB472F886609F53FDE0AEA"><enum>(iii)</enum><header>Exception</header><text display-inline="yes-display-inline">An eligible educator who does not comply with the requirement under subparagraph (A) due to an emergency event shall not be required to return financial assistance under clause (i).</text></clause></subparagraph></paragraph><paragraph id="HDABCD60669754CB99F59946874DB4676"><enum>(8)</enum><header>Service requirement</header><subparagraph id="H424D946EFDA04662A8D78CB0287026DB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible educator who is awarded financial assistance under this subsection shall be required by the Secretary to continue in their role as a public elementary or secondary school teacher, principal, paraprofessional, school leader, or other staff for not less than 3 years after the date on which the eligible educator is awarded financial assistance.</text></subparagraph><subparagraph id="H52F37B7D3E944160B163DE7D8CD335EF"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply if an eligible educator is a military spouse, as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/45AA">section 45AA(d)(1)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph></subsection><subsection id="H715270666CB64962A6E0CF9060E9BF70"><enum>(e)</enum><header>Reporting requirements</header><text display-inline="yes-display-inline">The Secretary shall submit to Congress an annual report that includes include a breakdown of financial assistance provided under this section, by demographic breakdown, mean income, and mean purchase price.</text></subsection><subsection id="H9B137BD2FB8D4D048192DC57B6124827"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $30,000,000 for each of fiscal years 2025 through 2030.</text></subsection></section></legis-body></bill>
