<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4257</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240502">May 2, 2024</action-date><action-desc><sponsor name-id="S303">Mr. Thune</sponsor> (for himself, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S373">Mr. Cassidy</cosponsor>, <cosponsor name-id="S375">Mr. Daines</cosponsor>, and <cosponsor name-id="S384">Mr. Tillis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the Internal Revenue Service from allowing IRS personnel to use a personal device, including a mobile device, to access, process, transmit, or store taxpayer information.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring No Devices Bear Your Own Data Act</short-title></quote> or the <quote><short-title>END BYOD Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id10d0301b69a14caaaa6f457f71c9b08d"><enum>2.</enum><header>Prohibiting IRS personnel from using personal devices for business purposes</header><subsection commented="no" display-inline="no-display-inline" id="idf5626fe169644b52a48f3b7303354129"><enum>(a)</enum><header>In general</header><text>The Secretary may not establish, permit, or administer any program (regardless of whether such program was established before, on, or after the date of enactment of this Act) which allows any individual described in subsection (b) to use a personal device to access, process, transmit, or store any taxpayer information which is subject to restrictions on disclosure pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103</external-xref> of the Internal Revenue Code of 1986.</text></subsection><subsection id="idb40f94aac5e54b8082a7f4b6e1941c0b"><enum>(b)</enum><header>Covered individuals</header><text>An individual is described in this subsection if such individual is—</text><paragraph commented="no" display-inline="no-display-inline" id="idA13A9F010C464D8094DE542791BD9EF9"><enum>(1)</enum><text display-inline="yes-display-inline">an employee of the Internal Revenue Service; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id33EC4549F982493CB2B0ED87AC019B9A"><enum>(2)</enum><text>an employee of an entity that is a party to a contract with the Internal Revenue Service whose job duties involve working under such contract; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7C74A4A360464696A0E18E91C7DF5156"><enum>(3)</enum><text>a volunteer with the Internal Revenue Service. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf603c8e2dfb0452aa978ffb5128dff94"><enum>(c)</enum><header display-inline="yes-display-inline">Other definitions</header><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="ide3bf6d5259654024abf21d7e1f0969e3"><enum>(1)</enum><header display-inline="yes-display-inline">Personal device</header><text>The term <term>personal device</term> means any electronic device (including mobile devices, smartphones, tablet computing devices, or laptop computing devices) which—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaa96b02625aa45779ec818ce2a01a366"><enum>(A)</enum><text display-inline="yes-display-inline">is the personal property of an individual described in subsection (b); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbd0b3ecb267e41e6a6b2706ded0e1f97"><enum>(B)</enum><text>has not been furnished to an individual described in subsection (b) by the Internal Revenue Service or any other Federal agency; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06be6fb4624c4c1991e3fe09105d87fa"><enum>(C)</enum><text>in the case of an individual described in subsection (b)(2), has not been furnished to such individual by their employer (except in the case of an individual who is self-employed).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id656b115940ed45d9b0d49827a1a514f4"><enum>(2)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Treasury or the Secretary's delegate.</text></paragraph></subsection></section></legis-body></bill>
