<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4225</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240501">May 1, 2024</action-date><action-desc><sponsor name-id="S411">Mr. Marshall</sponsor> (for himself and <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the District of Columbia Home Rule Act to require any individual who votes in a municipal election of the District of Columbia to be a United States citizen and to provide proof of citizenship.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Demanding Citizenship in DC Elections Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id527e6494dc0d4464ba4be021cd917cbf"><enum>2.</enum><header>Proof of citizenship required to vote in District of Columbia municipal elections</header><subsection id="id77a9aa258bd447369af61de1873f80df"><enum>(a)</enum><header>In general</header><text>Title IV of the District of Columbia Home Rule Act (1–201.01 et seq., D.C. Official Code) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB8B6D4C4836844449761A453127D84D7"><part id="idf172995534c94dc89662fd52b728debd" style="OLC"><enum>G<?LEXA-Enum G?></enum><header>Voting requirements</header><section id="id5a49a8dd54944e9f8fd95e3e827d0b42"><enum>497.</enum><header>Proof of citizenship required to vote in local elections</header><subsection id="id78D0296D26064AA48388E93B263708D7"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>local election</term> means—</text><paragraph id="id25dc9d66f6ea4c31875bb666b7eae05b"><enum>(1)</enum><text>an election for—</text><subparagraph id="id50965ebbbc3641a29546982a97b10e67"><enum>(A)</enum><text>Mayor;</text></subparagraph><subparagraph id="idce7c5aa21eb249ae95cdc4103c44f076"><enum>(B)</enum><text>Chairman or member of the Council;</text></subparagraph><subparagraph id="idced140febe7b4368ae6bd3fa79b3f149"><enum>(C)</enum><text>Attorney General;</text></subparagraph><subparagraph id="idb03fb74e631a405381ec62e6d45833ac"><enum>(D)</enum><text>Member of the State Board of Education; or</text></subparagraph><subparagraph id="idb9dac854d4e340308027b62c46a7c93d"><enum>(E)</enum><text>Advisory Neighborhood Commissioner; or</text></subparagraph></paragraph><paragraph id="id162b44bcd85949e8a5c54f5caae665fa"><enum>(2)</enum><text>an initiative, referendum, recall, or charter amendment measure on a District ballot.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id10b92954f231439382f3c324b1429906"><enum>(b)</enum><header>Proof of citizenship required</header><text display-inline="yes-display-inline">An individual may not vote in a local election unless the individual—</text><paragraph commented="no" display-inline="no-display-inline" id="ida3d7f54ccb164208b780449aaf63a063"><enum>(1)</enum><text display-inline="yes-display-inline">is a citizen of the United States; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida389c66cbbed4615ba3760331bea0de2"><enum>(2)</enum><text display-inline="yes-display-inline">demonstrates proof of such citizenship to the Board of Elections.</text></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idefc16d9f8aee4101a48293493792dd6f"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id939914f75133409e97e0f8c8f8e5336f"><enum>(1)</enum><header display-inline="yes-display-inline">Table of contents</header><text>The table of contents for the District of Columbia Home Rule Act is amended by inserting after the item relating to section 496 the following:</text><quoted-block style="OLC" id="id1a299944-7247-4c2b-b966-389182be2adb"><toc><toc-entry level="part" idref="idf172995534c94dc89662fd52b728debd">PART G—Voting requirements </toc-entry><toc-entry level="section" idref="id5a49a8dd54944e9f8fd95e3e827d0b42">Sec. 497. Proof of citizenship required to vote in local elections.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1007101398a943f5ae10bde9f6c65816"><enum>(2)</enum><header display-inline="yes-display-inline">Conforming repeal</header><text>The Local Resident Voting Rights Amendment Act of 2022 (D.C. Law 24–242) is repealed, and each provision of law amended by that Act is amended to read as it read on the day before the effective date of that Act.</text></paragraph></subsection></section></legis-body></bill>
