which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require social media platforms to verify that all individuals who create an account on the platform are age 16 or older, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making Age-Verification Technology Uniform, Robust, and Effective Act</short-title></quote> or the <quote><short-title>MATURE Act</short-title></quote>.</text></section><section id="id6b9d32cc6d2a434794398d1fb1802ef0"><enum>2.</enum><header>Requiring social media platforms to verify that account holders are of appropriate age</header><subsection id="id1f1ce46f741b4d678b1eb6c4375fdfc4"><enum>(a)</enum><header>Requirement</header><paragraph id="idb72ca6b39ecc4b33afff79a009f626e3"><enum>(1)</enum><header>In general</header><text>Except as provided in subsection (c), beginning on the date that is 6 months after the date of enactment of this Act, the operator of a social media platform shall not allow an individual to create an account on the platform unless the individual is age 16 or older, as verified by the platform using an age verification process that meets the requirements specified in paragraph (2).</text></paragraph><paragraph id="ide7679983d10b4d92a58fa1da4c93829f"><enum>(2)</enum><header>Age verification process requirements</header><text>The requirements specified in this paragraph are, with respect to an age verification process and a social media platform, that the platform require any individual who attempts to create an account on the platform to provide the platform with—</text><subparagraph id="id6841b47905684c359876d041e8a7d598"><enum>(A)</enum><text>the individual’s full legal name;</text></subparagraph><subparagraph id="id7c39d0e76b234bd5a3dbcb3d91c37cef"><enum>(B)</enum><text>the individual’s date of birth; and</text></subparagraph><subparagraph id="ideec18e3ed669469d916b5cecf0e550aa"><enum>(C)</enum><text>a scan, image, or upload of government-issued identification of the individual that verifies the information required under subparagraphs (A) and (B).</text></subparagraph></paragraph></subsection><subsection id="id4dd97d1dbf8946d6b35d0c0764ae233e"><enum>(b)</enum><header>Use of data collected for age verification purposes; deletion of data</header><paragraph id="id73581fc7e08f4a19acbb6dbfe55ac917"><enum>(1)</enum><header>In general</header><text>The operator of a social media platform shall not sell, transfer, or use any information collected from an individual for the purpose of verifying the individual’s identity and age for any other purpose.</text></paragraph><paragraph id="ideb27305f755545c49eec06432eaaa120"><enum>(2)</enum><header>Deletion of data</header><text>If an account on a social media platform is deleted (whether at the request of the account holder or otherwise), the operator of the social media platform shall delete any information collected from an individual for the purpose of verifying the individual’s identity and age not later than 30 days after the date of such deletion.</text></paragraph></subsection><subsection id="id3636c3663d4d49e5a2c2964b366b25c2"><enum>(c)</enum><header>Application to existing accounts</header><text>The operator of a social media platform may continue to allow an individual to maintain and use an account on the platform without verifying that the individual is age 16 or older as required under subsection (a) if—</text><paragraph id="id2d8dd083d9fb435893621270d2c89c94"><enum>(1)</enum><text>the account was created by the individual before the date that is 6 months after the date of enactment of this Act; and</text></paragraph><paragraph id="id9a66d8385b1f460eac06713d59b4962f"><enum>(2)</enum><text>no other individual uses the account.</text></paragraph></subsection></section><section id="id5ef34b3001334f6f85c6891dc3d03451"><enum>3.</enum><header>FTC compliance audits</header><subsection id="id8bee47cdfc904ebcb45ba29d3ad874ac"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and not less frequently than every 6 months thereafter, the Commission shall conduct an audit of each large social media platform by comparing the age verification information associated with a randomly selected sample of all accounts created on the platform since the last audit was conducted under this section (or, in the case of the first audit conducted under this section, since the date that is 6 months after the date of enactment of this Act) to State and Federal records to confirm that the individuals creating such accounts are age 16 or older.</text></subsection><subsection id="id11bfe47ca7f64139b18f15c3267f32a8"><enum>(b)</enum><header>Compliance standards</header><text>An operator of a large social media platform shall not be considered to be in violation of the requirements of section 2(a) if—</text><paragraph id="id3b36bb3f45de4f9f9522a83c312c6aee"><enum>(1)</enum><text>with respect to the first and second audits conducted under this section, the Commission determines that 90 percent of the accounts reviewed under the audit are accurate and in compliance with the requirements of such section;</text></paragraph><paragraph id="id031557c06e014a14b8928992bd84eca2"><enum>(2)</enum><text>with respect to the third and fourth audits conducted under this section, the Commission determines that 95 percent of the accounts reviewed under the audit are accurate and in compliance with the requirements of such section; and</text></paragraph><paragraph id="idad1ea8a47d4846399620414ca85796ea"><enum>(3)</enum><text>with respect to the fifth audit and any subsequent audit conducted under this section, the Commission determines that 100 percent of the accounts reviewed under the audit are accurate and in compliance with the requirements of such section.</text></paragraph></subsection></section><section id="id93302316bc484f39aaa79cb31fd0dc82"><enum>4.</enum><header>Enforcement</header><subsection id="ida6b188c33c304fc1903fa7f35456ed0d"><enum>(a)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of section 2 shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></subsection><subsection id="id3d6d728b046e43718e0f9851fd98d0d3"><enum>(b)</enum><header>Powers of the commission</header><paragraph id="ida36ac21f86a04ad5b4702c28ef4cf058"><enum>(1)</enum><header>In general</header><text>The Commission shall enforce section 2 in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></paragraph><paragraph id="idb714c2887aa44350b28b5a0bd14563a2"><enum>(2)</enum><header>Privileges and immunities</header><text>Any person who violates section 2 shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></paragraph><paragraph id="id5a355b07fa0748bd9dfa9f535184b33f"><enum>(3)</enum><header>Effect on other laws</header><text>Nothing in this Act shall be construed to limit the authority of the Commission under any other provision of law.</text></paragraph></subsection><subsection id="idd6b21da1b13c4361890aa6da264913dd"><enum>(c)</enum><header>Private right of action</header><paragraph id="id1FC2D707BEB6469A9A258E3AEDC1C305"><enum>(1)</enum><header>In general</header><text>Any parent or guardian of an individual less than 16 years of age to whom a social media account is provided in violation of this Act may bring a civil action against the social media company in an appropriate district court of the United States or a State court of competent jurisdiction for—</text><subparagraph id="id2721fa229e11450c8f7c7327c06ef17f"><enum>(A)</enum><text>injunctive relief;</text></subparagraph><subparagraph id="id1de8ad2b6c3b439b96ea60dac67e238e"><enum>(B)</enum><text>damages; and</text></subparagraph><subparagraph id="id79e7387d90fa4b488382872de960934a"><enum>(C)</enum><text>attorney’s fees and costs. </text></subparagraph></paragraph><paragraph id="idB6923A75A8C84E1895C42E77B249AB7F"><enum>(2)</enum><header>Application</header><text>Paragraph (1) shall apply to any violation that occurs after the fourth audit described in section 3(b)(2).</text></paragraph></subsection></section><section id="ide113c013aa4c4ffdb353d3c574d1691a"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id1204408388d946909e4f6dd13acf6cdc"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="id89869e0822444b47ae5c9545ddc36ad4"><enum>(2)</enum><header>Government-issued identification</header><text>The term <term>government-issued identification</term> means, with respect to an individual, a government-issued document that demonstrates the individual’s identity and age, including—</text><subparagraph id="id7972494d113f497298782386cdad4a39"><enum>(A)</enum><text>a passport or visa;</text></subparagraph><subparagraph id="id8adda069b1e44006814cb546e334173d"><enum>(B)</enum><text>a birth certificate;</text></subparagraph><subparagraph id="id2d04c1999a5b4beca3bb31de8e200ae3"><enum>(C)</enum><text>a driver’s license; </text></subparagraph><subparagraph id="id374be8a2bc89401186c28b8314a0c735"><enum>(D)</enum><text>an identification card issued by a State; or</text></subparagraph><subparagraph id="idDC2D513CC53E41D099B541767D3DBDA8"><enum>(E)</enum><text>another document determined appropriate by the Commission.</text></subparagraph></paragraph><paragraph id="id71287733a8c846c89263f86415623489"><enum>(3)</enum><header>Social media platform; large social media platform</header><subparagraph id="id8630fb040e1f48e883509d6814bfcacf"><enum>(A)</enum><header>Social media platform</header><text>The term <term>social media platform</term> means any electronic medium, such as Facebook, Instagram, YouTube, or Twitter (as such services existed in 2023), a live-chat system, or an electronic dating service that—</text><clause id="id474956096fb647318d09e082c74e0406"><enum>(i)</enum><text>primarily serves as a medium for users to interact with original content generated by other third-party users of the medium;</text></clause><clause id="id3e5d7195605c44bab69b1b3e713d9fe4"><enum>(ii)</enum><text>enables users to create accounts or profiles specific to the medium or to import profiles from another medium; and</text></clause><clause id="id70a4c5bc6bb4449fb04223b28a536f33"><enum>(iii)</enum><text>enables 1 or more users to generate original content that can be viewed by other third-party users of the medium.</text></clause></subparagraph><subparagraph id="idb18c76acd0574103b2379b528ebe2fdc"><enum>(B)</enum><header>Large social media platform</header><text>The term <term>large social media platform</term> means a social media platform that—</text><clause id="idfa1def94f3f141a19cd9aa2e956c9b13"><enum>(i)</enum><text>averages more than 1,000,000 unique users on a monthly basis; or</text></clause><clause id="idc0167ac3e82e4983830a34a45ffe59b0"><enum>(ii)</enum><text>has more than 1,000,000 user accounts.</text></clause></subparagraph><subparagraph id="id15c35469a8f34eadb395f165b69ccdaa" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Exclusion</header><text>The term <term>social media platform</term> shall not include a platform that only permits users to interact via a predetermined set of phrases, emoticons, or nonlinguistic symbols. </text></subparagraph></paragraph></section></legis-body></bill>
