which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide reliable and evidence-based food and energy security.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food and Energy Security Act</short-title></quote>.</text></section><section id="id4a2543ac9f7643abb38e0bd6dc5dceca"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id0659f4ff68204900820a981b2cb0d1af"><enum>(1)</enum><header>Agricultural or closely related business</header><text>The term <term>agricultural or closely related business</term> means a for-profit or not-for-profit entity that is involved in—</text><subparagraph id="id2DDADD83555D49B8BC17BD7DD8D7002A"><enum>(A)</enum><text>the production of agricultural products or livestock; or</text></subparagraph><subparagraph id="idA54622B3FDA541BABAF764020DA2EA3B"><enum>(B)</enum><text>the supply chain of an entity involved in the production of agricultural products or livestock.</text></subparagraph></paragraph><paragraph id="idea237ac9a28245df970ef168565cc70e"><enum>(2)</enum><header>Energy or closely related business</header><text>The term <term>energy or closely related business</term> means a for-profit or not-for-profit entity that is involved in—</text><subparagraph id="idE321AE2318114831BBDA394E13CD4BB7"><enum>(A)</enum><text>the production, development, or marketing of electricity, fuel (including biofuels), or other related products; or</text></subparagraph><subparagraph id="idE0CD6A27E70C4A14B7307588F2ACFD63"><enum>(B)</enum><text>the supply chain of an entity involved in the production, development, or marketing of electricity, fuel (including biofuels), or other related products.</text></subparagraph></paragraph><paragraph id="idf7f6debc4cd44f50aea2af31974998af"><enum>(3)</enum><header>Federal regulator</header><text>The term <term>Federal regulator</term> means—</text><subparagraph id="ida59b9bfd7d5f477bb2ec7a62cabdbc10"><enum>(A)</enum><text>the Board of Governors of the Federal Reserve System;</text></subparagraph><subparagraph id="id7ed298f1256147118cf434275763c217"><enum>(B)</enum><text>the Office of the Comptroller of the Currency;</text></subparagraph><subparagraph id="idb82b3074f70c465082a2a543c32e65bc"><enum>(C)</enum><text>the Federal Deposit Insurance Corporation;</text></subparagraph><subparagraph id="id9579d98d5f2943a389ddf217cd9db10f"><enum>(D)</enum><text>the Financial Stability Oversight Council;</text></subparagraph><subparagraph id="idbe0d229982f84b269457f6f155a0850d"><enum>(E)</enum><text>the National Credit Union Administration;</text></subparagraph><subparagraph id="id0dc914e0b5db48fdb90192b0feb93ae9"><enum>(F)</enum><text>the Bureau of Consumer Financial Protection;</text></subparagraph><subparagraph id="ide5877342590b40beac3e2b406cbc0419"><enum>(G)</enum><text>the Commodity Futures Trading Commission; and</text></subparagraph><subparagraph id="idc63f1cc36a0a4348bd2d1565d7e0613c"><enum>(H)</enum><text>the Securities and Exchange Commission.</text></subparagraph></paragraph></section><section id="id73405cad7dcb44c895d7a229d9d75eba"><enum>3.</enum><header>Regulations and guidance</header><subsection id="idfd4554b1223c4caaba93da683332958e"><enum>(a)</enum><header>In general</header><text>As part of any public notice of a proposed regulation, final regulation, or guidance that could affect, directly or indirectly, the extension of capital to or investments in an agricultural or closely related business or an energy or closely related business, a Federal regulator shall provide a detailed analysis of the estimated impact the regulation or guidance would have on food prices, electricity prices, and fuel prices, as applicable, including a description of the methodology and variables used in the estimates.</text></subsection><subsection id="ida655a6b1d48843e18d85aae504888417"><enum>(b)</enum><header>Contents</header><text>The estimated impacts required under subsection (a) shall include how the proposed regulation or guidance would, as applicable, affect—</text><paragraph id="id1ab6fed30984492284b3756129c3eaa4"><enum>(1)</enum><text>food prices (broken down by the applicable expenditure categories listed in the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor) over 1 year, 3 years, 5 years, and 10 years;</text></paragraph><paragraph id="idb6effc2427de4d9d9ccdddc48fb4083a"><enum>(2)</enum><text>electricity prices (broken down by the applicable expenditure categories listed in the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor) over 1 year, 3 years, 5 years, and 10 years; and</text></paragraph><paragraph id="id9374f857306149f7bba4c0f0c8929831"><enum>(3)</enum><text>fuel prices (broken down by the applicable expenditure categories listed in the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor) over 1 year, 3 years, 5 years, and 10 years.</text></paragraph></subsection></section><section id="id952b19a520e24a2bbde648a678a887e8"><enum>4.</enum><header>Prohibition</header><text display-inline="no-display-inline">A Federal regulator shall not implement any regulation or guidance that could affect, directly or indirectly, the extension of capital to or investments in an agricultural or closely related business or an energy or closely related business if—</text><paragraph id="idf39e2d25b50243ebbe6f77f8f7257539"><enum>(1)</enum><text>the analysis of estimated impacts under section 3 estimate that implementation of the regulation or guidance would result in an increase in food prices, electricity prices, or fuel prices; and</text></paragraph><paragraph id="idac6be5e8f1bd414792c9729f45bb560e"><enum>(2)</enum><text>the annualized rate of increase in the Consumer Price Index for All Urban Consumers most recently published by the Bureau of Labor Statistics of the Department of Labor is 4.5 percent or greater.</text></paragraph></section><section id="idffe2d12506884688bd9c408122c93c1e"><enum>5.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed as affecting any regulation or guidance of a Federal regulator that was implemented before January 1, 2023.</text></section></legis-body></bill>
