which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Water Resources Development Act of 1986 to improve compensatory mitigation, and for other purposes. </official-title></form><legis-body><section id="idd5166aff3a964640880a514b203a30a1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Corps Civil Works Compensatory Mitigation Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id9e04f392b2c844e88891538371b511dd"><enum>2.</enum><header>Fish and wildlife mitigation</header><text display-inline="no-display-inline">Section 906 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2283">33 U.S.C. 2283</external-xref>) is amended—</text><paragraph id="idac38316f6d8643c394390cc7f135b001"><enum>(1)</enum><text>in subsection (d)(3)(B)(iv)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbf2ebdc1e655416cb5cb11bd1f491a24"><enum>(A)</enum><text>in subclause (I), by inserting <quote>or contract (as defined in subsection (i)(1))</quote> after <quote>instrument</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id817593180da64432b0bbf3053f5c6e99"><enum>(B)</enum><text>in subclause (II), by inserting <quote>or contract (as so defined)</quote> after <quote>instrument</quote>;</text></subparagraph></paragraph><paragraph id="ida99a20d8b1ce42c49b06a8afcf27750d"><enum>(2)</enum><text>in subsection (i)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9adbeeed41f741b3a4b8f8c7dbee7922"><enum>(A)</enum><text>by redesignating paragraphs (1) through (4) as paragraphs (2) through (5), respectively;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide39cd946f270448db7787518c9c09364"><enum>(B)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9F922B10105B48B998F9F6CA4D4FBD09"><paragraph commented="no" display-inline="no-display-inline" id="id45fdfb60c7854e3caffeb26dda786a26"><enum>(1)</enum><header>Definition of contract</header><text>In this subsection, the term <term>contract</term> means an agreement between the Secretary and a mitigation provider that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idebaecc0f9b1b48c7a68e50c2f6843354"><enum>(A)</enum><text display-inline="yes-display-inline">uses accepted Corps of Engineers District-level mitigation practices described in part 332 of title 33, Code of Federal Regulations (or successor regulations); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06f9f32548e948dba1af1e59c09b6320"><enum>(B)</enum><text>prioritizes implementation of an existing restoration plan developed by a State, local, or regional entity that covers the area or resources affected by the civil works project that is the subject of the third-party arrangement.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf99ada7d8a7248d7b5cedbb58f0154f9"><enum>(C)</enum><text>in subparagraph (A) of paragraph (2) (as so redesignated)—</text><clause commented="no" display-inline="no-display-inline" id="id6971b820d10a403b97000f76cb878a72"><enum>(i)</enum><text>in clause (i), by striking <quote>and</quote> at the end; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1d6ce00c05ba498db4e920304d74052c"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id24863844EB8D4AC690B108FBECC2C73B"><clause commented="no" display-inline="no-display-inline" id="idc120cc771c8c460c950a5bda9ec0a532"><enum>(iii)</enum><text>the purchase of credits under part 332 of title 33, Code of Federal Regulations (or successor regulations) in accordance with section 332.4(c)(6) of that title (or a successor regulation) through a contract to satisfy the mitigation plan required under subsection (d); and</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide245de42499546d29305355fa040483c"><enum>(D)</enum><text>in paragraph (3) (as so redesignated), by striking <quote>paragraph (1)</quote> and inserting <quote>paragraph (2)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf7b4fa37620444898400b41e48cefa7a"><enum>(E)</enum><text>in paragraph (4) (as so redesignated), in the matter preceding subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="id0a1b664db5b04ab6b96a7d85c2d20f5a"><enum>(i)</enum><text>by inserting <quote>the Secretary shall ensure that</quote> before <quote>contributions</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idab056251d7b048b7bfbc10571bbcf4e8"><enum>(ii)</enum><text>by striking <quote>may</quote>; and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id171232f24f804599890c9ab1551f397b"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEE3EEABF90324DC79187652E21C94820"><subsection commented="no" display-inline="no-display-inline" id="idd43222bca73c4517ace47deed21a3f0d"><enum>(l)</enum><header>Compliance</header><text>In carrying out this section, the Secretary shall ensure compliance with this section and with the final rule of the Corps of Engineers and the Environmental Protection Agency entitled <quote>Compensatory Mitigation for Losses of Aquatic Resources</quote> (73 Fed. Reg. 19594 (April 10, 2008)) or any subsequent rule.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
