which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Precursor Chemical Destruction Initiative to promote bilateral counterdrug interdiction efforts with the governments of specified countries, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Destruction Initiative for Stored Precursors Overseas and Safe Enforcement Act</short-title></quote> or the <quote><short-title>DISPOSE Act</short-title></quote>.</text></section><section id="ida171ff3fcb354161bf158e989e23fec8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idddc3f255314c4d5c962853593eceaed8"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbb218014015f4dd08f2aa22fb8bca7e1"><enum>(A)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf021620cc3e54bd785abb420a43cd7c1"><enum>(B)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0979b1273288409f8c9fdf910e9df9df"><enum>(C)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1e476b53d7a34f02be04574e78df9815"><enum>(D)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="id691b148025154485ba7539c87db157fd"><enum>(2)</enum><header>Beneficiary countries</header><subparagraph commented="no" display-inline="no-display-inline" id="id685b474692bb40ee87d5fab8860990db"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Except as provided in subparagraph (B), the term <term>beneficiary countries</term> means Colombia, Mexico, and Peru.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0da76bb712444df48facfa9c35fd9edc"><enum>(B)</enum><header>Updates</header><text>The Secretary of State, in consultation with the Attorney General and the Secretary of Defense, may add or remove 1 or more countries from the list of beneficiary countries under subparagraph (A) after providing written notification of such changes to the appropriate congressional committees.</text></subparagraph></paragraph><paragraph id="id7a9d960bac6c4677b7aff9eed9c7b861"><enum>(3)</enum><header>Listed chemical</header><text>The term <term>listed chemical</term> has the meaning given such term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph></section><section id="id85800736a0a849889cf2cda6bdc2e5be"><enum>3.</enum><header>Authorization of Precursor Chemical Destruction Initiative</header><subsection id="idbeda2af6dc4f4e61b202224335b7f667"><enum>(a)</enum><header>Establishment</header><text>The Secretary of State, in coordination with the Secretary of Defense and the Attorney General, may carry out the <quote>Precursor Chemical Destruction Initiative</quote> in beneficiary countries to achieve the purposes described in subsection (b).</text></subsection><subsection id="idf74d1d543e4442de891fe1c147a67a7a"><enum>(b)</enum><header>Purposes</header><text>The purposes described in this subsection are—</text><paragraph id="id7f98f43473364c10a53ed01d963e8288"><enum>(1)</enum><text>improving and increasing rates of seizure and destruction of listed chemicals in beneficiary countries;</text></paragraph><paragraph id="ida00fd45b4c614e42b5ece7d5b345eaed"><enum>(2)</enum><text>alleviating the backlog of seized listed chemicals and disposing the hazardous waste generated by illicit drug trafficking in beneficiary countries in an environmentally safe and effective manner;</text></paragraph><paragraph id="ide8046f638fac4037b99b539919162a57"><enum>(3)</enum><text>ensuring that seized listed chemicals are not reintroduced into the illicit drug production stream within beneficiary countries;</text></paragraph><paragraph id="idb112fd3fb57c457296a6e53e56b412c4"><enum>(4)</enum><text>freeing up storage space for future listed chemical seizures within beneficiary countries; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd4e88d8feb3a4b088ba07967bd241cb5"><enum>(5)</enum><text>reducing the negative environmental impact of listed chemicals.</text></paragraph></subsection></section><section id="id2a0716b444ce4b4e85ced2bb7e2ee5f3"><enum>4.</enum><header>Implementation plan; progress updates</header><subsection id="id6f333e74792049a1afdb0ba59c52f00c"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State, in coordination with the Attorney General and the Secretary of Defense, shall submit an implementation plan to the appropriate congressional committees that includes a timeline and stated objectives for actions to be taken in beneficiary countries in support of the Precursor Chemical Destruction Initiative.</text></subsection><subsection id="id7a40a55d021d417a8399865d90b09f69"><enum>(b)</enum><header>Elements</header><text>The implementation plan required under subsection (a) shall include—</text><paragraph id="idf943ee23d298442d917a80a7ed5ddf44"><enum>(1)</enum><text>a multi-year strategy with a timeline, overview of objectives, budgetary projections, and anticipated outcomes for the region and for each beneficiary country;</text></paragraph><paragraph id="id578ec123858b40edab55a52d2b887578"><enum>(2)</enum><text>specific, measurable benchmarks to track the progress of the Precursor Chemical Destruction Initiative towards accomplishing the outcomes referred to in paragraph (1);</text></paragraph><paragraph id="id594f5426ea87415d9b7edbc04b9412de"><enum>(3)</enum><text>a plan for the delineation of the roles to be carried out by the Department of State, the Department of Justice, the Department of Defense, and any other Federal department or agency in carrying out the Precursor Chemical Destruction Initiative; and</text></paragraph><paragraph id="idebf53edca15b462d9e2ccfd36c1516e8"><enum>(4)</enum><text>a plan for addressing security and government corruption and providing updates to the appropriate congressional committees on the results of such efforts.</text></paragraph></subsection><subsection id="id0a11b9ae55c64a7cb95227d0864fbea8"><enum>(c)</enum><header>Annual progress update</header><text>Not later than 1 year after the submission of the implementation pursuant to subsection (a), and annually thereafter, the Secretary of State, in coordination with the Attorney General and the Secretary of Defense, shall submit to the appropriate congressional committees a written description of the results achieved by the Precursor Chemical Destruction Initiative, including—</text><paragraph id="id41c4e99ca1454d04a37e0325137c64dc"><enum>(1)</enum><text>the implementation of the strategy and plans described in subsection (b);</text></paragraph><paragraph id="idc094ab24ecfb4dd4b33c2b531c545536"><enum>(2)</enum><text>compliance with, and progress related to, meeting the benchmarks referred to in subsection (b)(2); and</text></paragraph><paragraph id="id7f42d005fe69416ba32cb4d0025115f4"><enum>(3)</enum><text>the type and quantity of listed chemicals destroyed by each beneficiary country.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id71567697e8834728b4d7074b7a122daf"><enum>5.</enum><header>Funding</header><text display-inline="no-display-inline">The Secretary of State shall use amounts otherwise appropriated for International Narcotics Control and Law Enforcement programs managed by the Department of State to carry out this Act.</text></section></legis-body></bill>
