<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4151</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240417">April 17, 2024</action-date><action-desc><sponsor name-id="S413">Mr. Padilla</sponsor> (for himself, <cosponsor name-id="S287">Mr. Cornyn</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S391">Mr. Young</cosponsor>, and <cosponsor name-id="S229">Mrs. Murray</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Atomic Energy Act of 1954 and the Nuclear Energy Innovation and Modernization Act to clarify existing requirements relating to fusion machines, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fusion Energy Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id00f0f1a5e9d74a93a6f42d886ebeb933"><enum>2.</enum><header>Clarification on fusion regulation</header><subsection id="HB4D2EDB295644336896FC1B3F09EF6AE"><enum>(a)</enum><header>Definitions of fusion machine and byproduct material</header><text display-inline="yes-display-inline">Section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>) is amended—</text><paragraph id="H9AA2DB2A69C04EB3903902637C593858"><enum>(1)</enum><text>in subsection e. (3)(B)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide1efd1907ca44808b63fbe6cf42865cb"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by inserting <quote>, including by use of a fusion machine</quote> after <quote>particle accelerator</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbf52738f0e464af3ba6f93fce23ce5fb"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (ii), by inserting <quote>if made radioactive by use of a particle accelerator that is not a fusion machine,</quote> before <quote>is produced</quote>;</text></subparagraph></paragraph><paragraph id="id20c3fc32ec704eb6bb9b5e3569d328b5"><enum>(2)</enum><text>in each of subsections ee. through hh., by inserting a subsection heading, the text of which comprises the term defined in the subsection;</text></paragraph><paragraph id="id566a4ab5d38946aa8958cc7dcda01c9e"><enum>(3)</enum><text>by redesignating subsections ee., ff., gg., hh., and jj. as subsections jj., gg., hh., ii., and ff., respectively, and moving the subsections so as to appear in alphabetical order;</text></paragraph><paragraph id="iddb51a93a8bf943a6818a478c719779e9"><enum>(4)</enum><text>in subsection dd., by striking <quote>dd. The</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ideea19751743f48e9b419700bb1f4c7ea"><subsection id="id97FF06C96FB141B1B8248B15D1F5E8A2"><enum>ee.<?LEXA-Enum a.?></enum><header>High-Level radioactive waste; spent nuclear fuel</header><text>The</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idf337aedd7de844e4b6f6e624fc2dc5a6"><enum>(5)</enum><text>by inserting after subsection cc. the following:</text><quoted-block id="id3762A860996E41918DBB5888321C3D44" display-inline="no-display-inline" style="OLC"><subsection id="id5540C4EAD64F4356A241F5546073C718"><enum>dd.<?LEXA-Enum a.?></enum><header>Fusion machine</header><text>The term <term>fusion machine</term> means a machine that is capable of—</text><paragraph id="H9780C4A78CEE4D93A7282C6C933BEAC8"><enum>(1)</enum><text display-inline="yes-display-inline">transforming atomic nuclei, through fusion processes, into different elements, isotopes, or other particles; and</text></paragraph><paragraph id="H7A9418A0D2644E79A9BFC3F6D4D548ED" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>directly capturing and using resultant products, including particles, heat, or other electromagnetic radiation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2FD38D0A55E842BCB72DAA09193FC984" commented="no"><enum>(b)</enum><header>Technology-Inclusive regulatory framework</header><paragraph id="H1767BDF4C5B84298A4FC8DED8730C90E"><enum>(1)</enum><header>In general</header><text>Section 103(a) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>) is amended—</text><subparagraph id="H8CC0A56CE9A64BB2A00AE4F91D406BF3"><enum>(A)</enum><text>in paragraph (4)—</text><clause id="id1767285c9e804c3db14d15b46d15f627"><enum>(i)</enum><text>by striking <quote>inclusive,</quote> and inserting <quote>inclusive</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id57e3c36086294662b4bdf2c8163677d8"><enum>(ii)</enum><text>by inserting <quote>(other than new nuclear fusion reactor license applications)</quote> before the period at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="id839e842094b3465b9594ae5a81806081"><enum>(iii)</enum><text>by striking <quote>Not later</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5A59104EDF254232B620BF20A994859C"><subparagraph commented="no" display-inline="no-display-inline" id="id1110918309c34e1e8df3d0311db74b47"><enum>(A)</enum><header>Advanced nuclear reactors other than fusion reactors</header><text>Not later</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="id90da4ba23a9b450d8e936888a75072d3"><enum>(iv)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text><quoted-block style="OLC" id="HC16981C3BA4F4ABB98B7ED7C062D0124" display-inline="no-display-inline"><subparagraph id="HEADC68676C614720B010D93E9E9BBCE3"><enum>(B)</enum><header>Fusion machines</header><text display-inline="yes-display-inline">Not later than December 31, 2027, the Commission shall complete a rulemaking to establish a technology-inclusive regulatory framework for optional use by fusion machine applicants for new fusion machine license applications. </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H3FADF5E426B94DA3BEFCF8335098C769" commented="no"><enum>(B)</enum><text>in paragraph (5)(B)(ii), by inserting <quote>and fusion machine license applications</quote> after <quote>commercial advanced nuclear reactor license applications</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a30422cb68a499bac27fd401833deb0"><enum>(2)</enum><header display-inline="yes-display-inline">Definition</header><text>Section 3 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>) is amended—</text><subparagraph id="id3d5e06aabc314ea2af837c88012c955f"><enum>(A)</enum><text>by redesignating paragraphs (8) through (15) as paragraphs (9) through (16), respectively; and</text></subparagraph><subparagraph id="idf22c3efd201e47cbb2caf3d2cab09f0f"><enum>(B)</enum><text>by inserting after paragraph (7) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf245f8c754da41d6aca2ef3ea2f5496b"><paragraph id="id9ef9f58c19b74e0b99c968179c15a03b"><enum>(8)</enum><header>Fusion machine</header><text>The term <term>fusion machine</term> has the meaning given the term in section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HAC00A79C94A549C4936F3F17D6FB9602"><enum>(c)</enum><header>Report</header><paragraph commented="no" display-inline="no-display-inline" id="id01bfa8458dd941bc9029fbc110703473"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="idab3346a22d86419a8dc2e3affe4b8dc9"><enum>(A)</enum><header>Agreement State</header><text>The term <term>Agreement State</term> has the meaning given the term in section 3 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idca6ef2ea719249848764115448fae7a1"><enum>(B)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory Commission.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id98ccdbac45494e08bff5217ae25d6b88"><enum>(C)</enum><header>Fusion machine</header><text display-inline="yes-display-inline">The term <term>fusion machine</term> has the meaning given the term in section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00f7d8ad00f94dd0aa1bb8623dbd26ae"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission shall submit to Congress a report on—</text><subparagraph id="HFBEC402D3BCF4F5294BA45BE6F3A5D5D"><enum>(A)</enum><text display-inline="yes-display-inline">the results of a study, conducted in consultation with Agreement States and the private fusion sector, on risk- and performance-based, design-specific licensing frameworks for mass-manufactured fusion machines, including an evaluation of the design, manufacturing, and operations certification process used by the Federal Aviation Administration for aircraft as a potential model for mass-manufactured fusion machine regulations; and</text></subparagraph><subparagraph id="HEC966040E8BA4DB996DC0E0A015DE1D4" commented="no"><enum>(B)</enum><text>the estimated timeline for the Commission to issue consolidated guidance or regulations for licensing mass-manufactured fusion machines, taking into account—</text><clause commented="no" display-inline="no-display-inline" id="idca2af9cc462f450b86705246749d91de"><enum>(i)</enum><text display-inline="yes-display-inline">the results of that study; and</text></clause><clause commented="no" display-inline="no-display-inline" id="iddb13d1dadfae43e294757e9a994d3d86"><enum>(ii)</enum><text display-inline="yes-display-inline">the anticipated need for such guidance or regulations.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
