which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Water Infrastructure Finance and Innovation Act of 2014 with respect to the total amount of Federal assistance for projects in States experiencing severe drought and projects in historically disadvantaged communities, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6401EC368ADA4BF3906EF64E81E3BFAE"><section id="id2ebbabb2ad7a4d909f839c48092ae4d6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drought Relief Obtained Using Government Help Today Act of 2024</short-title></quote> or the <quote><short-title>DROUGHT Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" id="H36FE45D5BD4A42C79095E8CE8BFBD790"><enum>2.</enum><header>Federal assistance for certain water infrastructure projects</header><text display-inline="no-display-inline">Section 5029(b)(9) of the Water Infrastructure Finance and Innovation Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3908">33 U.S.C. 3908(b)(9)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HA582C94253734BE7A9955375E913E45C"><subparagraph id="H9C49FC5F351D4D269DED783E21525D60"><enum>(D)</enum><header>Exceptions for certain projects</header><clause id="H2CF60BC05BA14C0AABAEBA18A5F91EDD"><enum>(i)</enum><header>Projects in States experiencing severe drought</header><text>Notwithstanding subparagraph (A), the Administrator may finance up to 90 percent of the costs of a project described in paragraph (6) or (7) of section 5026 located in—</text><subclause commented="no" display-inline="no-display-inline" id="id85641f25080e4ed8950c4ded492b8d0b"><enum>(I)</enum><text>a State that has been designated as D2 (severe drought) or greater according to the United States Drought Monitor for a minimum of 4 weeks during any of the 3 years preceding the date on which assistance is provided for the project under this subtitle; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="iddf9a01fc1fa3429ea0e136aade929e7a"><enum>(II)</enum><text>a county for which a drought emergency has been declared by the applicable Governor at any time during the 3-year period preceding that date.</text></subclause></clause><clause id="H30840CA18B5E4DB69FB8380732739F9D"><enum>(ii)</enum><header>Projects in historically disadvantaged communities</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), the Administrator may finance up to 90 percent of the costs of a project described in paragraph (6) or (7) of section 5026 that serves a community that—</text><subclause commented="no" display-inline="no-display-inline" id="id7e01bb2f726047e5a36970f15d454f6f"><enum>(I)</enum><text display-inline="yes-display-inline">is designated as disadvantaged, underserved, or financially distressed by— </text><item commented="no" display-inline="no-display-inline" id="id9106a255b99d41f2a99cb127ce0a34a3"><enum>(aa)</enum><text display-inline="yes-display-inline">the Climate and Economic Justice Screening Tool of the Council on Environmental Quality; or</text></item><item commented="no" display-inline="no-display-inline" id="idbe492d1ea46d422b8cb743a6862f91a2"><enum>(bb)</enum><text>the Administrator pursuant to a water infrastructure program of the Environmental Protection Agency, including water infrastructure grant programs, clean water and drinking water grant programs, and other grant programs under the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>) and the Federal Water Protection Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>); or</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idb3f4fff8b7d74717916a6240a921442d"><enum>(II)</enum><text display-inline="yes-display-inline">meets the affordability criteria established by a State pursuant to section 1452(d)(3) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(d)(3)</external-xref>) or section 603(i)(2) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(i)(2)</external-xref>).</text></subclause></clause><clause id="H306266FC1468479DB454988069265B14"><enum>(iii)</enum><header>Priority</header><text>In carrying out this subparagraph, the Administrator shall prioritize financing for projects that—</text><subclause id="H99F6BB82BBDB47D9B835B6B9D8E29F78"><enum>(I)</enum><text>are located in a State that is experiencing severe drought, as described in subclause (I) of clause (i), or a county for which a drought emergency has been declared, as described in subclause (II) of that clause; and</text></subclause><subclause id="H4D2634CC7EE549E88F095CCF97D7F6B8"><enum>(II)</enum><text>serve a community that is designated as disadvantaged, underserved, or financially distressed, or meets affordability criteria established by a State, as described in clause (ii).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
