Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Chuckwalla National Monument and expand Joshua Tree National Park in the State of California, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD62758C0FBC747A4A05418FAB354F42F"><section section-type="section-one" id="H81E06ACF0589406485B8BA01D926615F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chuckwalla National Monument Establishment and Joshua Tree National Park Expansion Act of 2024</short-title></quote>.</text></section><section id="H232903A2921F4A37A5316949F096BD57"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="idad170320f34d4b6db06a086f6385a238"><enum>(1)</enum><text display-inline="yes-display-inline">the land designated as the Chuckwalla National Monument by this Act—</text><subparagraph id="id69e53f701e8a4afa86f66636d1e1eb61"><enum>(A)</enum><text>is an area of national significance and historical and scientific interest requiring protection; </text></subparagraph><subparagraph id="HCF963103C59F43B19E4FE5DEE5227176"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id8eefcb68be514fd8bf0d8df167b6c7c0"><enum>(i)</enum><text>is the ancestral homeland of the Iviatim, Kwatsáan, Maara’yam, Nüwü, Pipa Aha Macav, and other Tribal people, including the present-day Cahuilla, Chemehuevi, Mohave, Quechan, and Serrano Indian Tribes; </text></clause><clause commented="no" display-inline="no-display-inline" id="id370b181ccabd43018aeb894dbe4b38fd" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">continues to be regularly accessed and used by the Indian Tribes referred to in clause (i); and</text></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="id43572eb605054d55ab2346750c0a8319"><enum>(iii)</enum><text>will continue to be used by the Indian Tribes referred to in clause (i) in the future;</text></clause></subparagraph><subparagraph id="ida43459e16f3148bd833007d1e2331a2a"><enum>(C)</enum><text>contains a complex trail system that—</text><clause commented="no" display-inline="no-display-inline" id="id25615de40d83477eb627523ae4a2fd77"><enum>(i)</enum><text display-inline="yes-display-inline">was established by Native Americans for various uses, including spiritual, travel, trade, and communication; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id7db48a7750884280aa00137c7341e5a8"><enum>(ii)</enum><text display-inline="yes-display-inline">connects to regions outside of the boundaries of the Monument, including Avi Kwa Ame;</text></clause></subparagraph><subparagraph id="HE2CE90DFD5E446CFB3DAC803380E94D2"><enum>(D)</enum><text>includes sacred sites, historic properties, traditional cultural places and landscapes, sacred items, objects of cultural patrimony, human remains, religious sites, geoglyphs, petroglyphs, and pictographs with significant value to the survival and well-being of Tribal people and the knowledge systems of Tribal people;</text></subparagraph><subparagraph id="H48FBDC0AEBC142F983482B7171CA03B4"><enum>(E)</enum><text>includes plants, wildlife, water sources, and minerals that are connected together as part of a greater cultural landscape; </text></subparagraph><subparagraph id="H6C85FEE884A644259A4232F54C929451"><enum>(F)</enum><text>has nationally significant biodiversity, due to the location in the transitional zone where the Sonoran Desert and Mojave Desert come together;</text></subparagraph><subparagraph id="H45469CF03DA94F2992F08606FB81141F"><enum>(G)</enum><text>is home to a wide variety of topography and elevation, leading to distinct microclimates and ecosystems;</text></subparagraph><subparagraph id="HE4D4F7027623420DA3A0AFAC73FE7AF0"><enum>(H)</enum><text>is largely intact, undeveloped, and adjacent to other federally protected areas, such as Joshua Tree National Park, the Indian Pass Wilderness, and the Palen/McCoy Wilderness;</text></subparagraph><subparagraph id="H010E8610DD6A42399936D109DA379EC1"><enum>(I)</enum><text>is a refuge for over 150 plant species, many of which cannot be found anywhere else, including—</text><clause id="H5784FAD389614B9E814CD6A1DC45EC85"><enum>(i)</enum><text>Munz’s cholla, the largest endemic cacti in the State, which is located on the Chuckwalla Bench;</text></clause><clause id="H3A041C2CE0F94AD886C096C5E199FF99"><enum>(ii)</enum><text>the California fan palm, a plant managed and used extensively by Tribal people for thousands of years, which is found in oases at Corn Springs, the Mecca Hills Wilderness, and other locations in which tectonic movements allow groundwater to seep up; </text></clause><clause id="H4252DE99B39F44DBBCCCF3D4D176841C"><enum>(iii)</enum><text>the triple-ribbed milk-vetch, which is listed as endangered under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide29b61743cfb4f498234101d86f0adbf"><enum>(iv)</enum><text display-inline="yes-display-inline">other sensitive species, including Emory’s crucifixion thorn and Mecca-aster; </text></clause></subparagraph><subparagraph id="HFE3CE5E66F0C42629E59ABB21C59144D"><enum>(J)</enum><text>hosts—</text><clause commented="no" display-inline="no-display-inline" id="ida00479a9d6d54b41b0cdf9efb7f7e20f"><enum>(i)</enum><text display-inline="yes-display-inline">some of the most extensive microphyll woodlands (which are small-leaf trees, such as ironwood and palo verde) in the State in places such as Milpitas Wash, a habitat critical to the survival of Tribal people; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id639dea5ca331474880c3d6a2bbff5819"><enum>(ii)</enum><text display-inline="yes-display-inline">many wildlife species, including the burro deer and migrating birds;</text></clause></subparagraph><subparagraph id="H0D4447BD2FEC40B18638F20E6AE68B48"><enum>(K)</enum><text>offers—</text><clause commented="no" display-inline="no-display-inline" id="id33887aebeedc4489b9e90393993f894c"><enum>(i)</enum><text display-inline="yes-display-inline">core habitat and essential migration pathways for wildlife, including over 50 sensitive animal species, including—</text><subclause id="H91E0079C58AE445893D5DBE1F7C77722"><enum>(I)</enum><text>critical habitat for the Agassiz’s desert tortoise, which is listed as threatened under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text></subclause><subclause id="H883002F5A7F142E4892ABC94416EA6C1"><enum>(II)</enum><text>critical habitat for the desert bighorn sheep, which is an iconic species with declining numbers;</text></subclause></clause><clause id="HA3234F8BB0624FF8B8792C0DDEFD8B9D"><enum>(ii)</enum><text>habitat in microphyll woodlands for large numbers of resident and migratory birds, which is crucial amid the otherwise major decline in bird numbers recorded in North America over the 50-year period preceding the date of enactment of this Act; and</text></clause><clause id="H5DA167F3C5324E59A13DBC8F2924FAF1"><enum>(iii)</enum><text>former habitat for the endangered Sonoran pronghorn in the Chuckwalla Bench, the site of a multi-year reintroduction effort that is already underway;</text></clause></subparagraph><subparagraph id="HF68BD2D92EAF448D9C6AB7EBC0D1BF8A"><enum>(L)</enum><text>offers important glimpses into key periods in regional history, such as—</text><clause id="HDB97B1439227425BA5432BA126293B08"><enum>(i)</enum><text>the gold seekers who used an existing Indigenous route to establish what is now the Bradshaw Trail in the 1870s; and</text></clause><clause id="HA62BB49C319545E9923513502DF6D806"><enum>(ii)</enum><text>the invaluable training of more than 1,000,000 soldiers from across the United States during the period from 1942–1944 in which the land was part of the Desert Training Center, which is also known as the <quote>California-Arizona Maneuver Area</quote>, including Patton’s Hill, which was used by General Patton for observing training maneuvers; </text></clause></subparagraph><subparagraph id="H87CC079628844BFAA784EBF2A4BDA329"><enum>(M)</enum><text>provides outstanding outdoor recreation opportunities to local communities and visitors, including hiking, horseback riding, motorized vehicle use and mountain biking on designated routes of travel, wildlife viewing, hunting, climbing, rockhounding, picnicking, and camping;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1963e63f3bce49a6bcf6dff08b5ddc12"><enum>(N)</enum><text display-inline="yes-display-inline">offers inexpensive access to public land for disadvantaged communities, including the farming and farm laboring communities of the eastern Coachella Valley and Blythe regions; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18a2d33207d1411ebaa694420ff8dd8d"><enum>(O)</enum><text>is near or adjacent to solar Development Focus Areas that have some of the best solar energy potential in the world, the development and operation of which is critical to meeting the urgent need of the United States to decrease greenhouse gas emissions; and</text></subparagraph></paragraph><paragraph id="H2E7D3B303F934775AB4BB3A9C0930B7A"><enum>(2)</enum><text>the Indian Tribes referred to in paragraph (1)(B)(i) have a longstanding relationship to the land on which the Monument is located, acting as stewards of the land since time immemorial, with obligations to care for the cultural, spiritual, and natural resources provided to those Indian Tribes by the land, including sacred places, plants, wildlife, water sources, and minerals. </text></paragraph></section><section id="H5D09D583B3E24B7FA611C21E22655456"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HF9A88E579D4E4887A3B6816A13E004B4"><enum>(1)</enum><header>Advisory Council</header><text>The term <term>Advisory Council</term> means the Chuckwalla National Monument Advisory Council established under section 6(a).</text></paragraph><paragraph id="H7F8EA6FA18CA45B6BF7326E8D410B58D"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Chuckwalla National Monument Tribal Commission established under section 5(a). </text></paragraph><paragraph id="id54294ed23e6f40e9bfcbad9cc6ee59ad"><enum>(3)</enum><header>Culturally affiliated Indian Tribe</header><text>The term <term>culturally affiliated Indian Tribe</term> means an Indian Tribe that is determined by the Secretary to have a cultural connection to the Monument.</text></paragraph><paragraph id="H8D8BB2DE76A24F258FDC6FADE992C134"><enum>(4)</enum><header>Desert Renewable Energy Conservation Area Plan</header><text>The term <term>Desert Renewable Energy Conservation Area Plan</term> means the Record of Decision for the Desert Renewable Energy Conservation Plan Land Use Plan Amendment to the California Desert Conservation Area Plan, Bishop Resource Management Plan, and Bakersfield Resource Management Plan by the Bureau of Land Management, dated September 2016.</text></paragraph><paragraph id="id592fc2462585414f9b5b5e36732080b1"><enum>(5)</enum><header>Development Focus Area</header><text>The term <term>Development Focus Area</term> means a Development Focus Area designated in the Desert Renewable Energy Conservation Area Plan/Land Use Plan Amendment to the California Desert Conservation Area Plan, Bishop Resource Management Plan, and Bakersfield Resource Management Plan prepared by the Bureau of Land Management and dated September 2016.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0e4b5c5f0f5d4043be1aca73e1bc41d7"><enum>(6)</enum><header>Electric utility facility</header><subparagraph commented="no" display-inline="no-display-inline" id="id8e28abb83cb84f628be3cd0c5af1b3cf"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>electric utility facility</term> means any infrastructure associated with or necessary for the siting, construction, or operation and maintenance of electric transmission or distribution lines.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id611e4a2f670c4bef8b266a6e9a829079"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>electric utility facility</term> includes an electric substation, a communication facility, a tower, a pole, a line, a ground wire, a communications circuit, and any other similar or related infrastructure.</text></subparagraph></paragraph><paragraph id="H2AA2C80D34C34CF19D2AD7F72ED32A17"><enum>(7)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means the governing body of any Indian Tribe, band, nation, pueblo, village, community, component band, or component reservation individually identified (including parenthetically) on the most recent list published by the Secretary under section 104(a) of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131(a)</external-xref>).</text></paragraph><paragraph id="HA4191A6407B24CFDBC15886DC31C25C1"><enum>(8)</enum><header>Management plan</header><text>The term <term>management plan</term> means the management plan for the Monument developed under section 4(c)(17).</text></paragraph><paragraph id="H3121BABC61EC48AE9C85F367BFC4D94F" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Proposed Chuckwalla National Monument and Joshua Tree National Park Expansion</quote> and dated March 14, 2024. </text></paragraph><paragraph id="H81164B49F38E4D0AB62317AFD4DB657F"><enum>(10)</enum><header>Monument</header><text>The term <term>Monument</term> means the Chuckwalla National Monument established by section 4(a). </text></paragraph><paragraph id="HCBE1548CE07E4869B4D377A02672D16E"><enum>(11)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H79FCB824578D4C879AB85E5384CD638D" commented="no" display-inline="no-display-inline"><enum>(12)</enum><header>State</header><text>The term <term>State</term> means the State of California.</text></paragraph></section><section id="H4661F9B140654F9399B6249E410E8639"><enum>4.</enum><header>Designation of chuckwalla national monument</header><subsection id="H8F067DD788AE403E8E8594A59D6AB755"><enum>(a)</enum><header>Establishment</header><text>Subject to valid existing rights, there is established the Chuckwalla National Monument in the State, consisting of approximately 621,000 acres of Federal land administered by the Bureau of Land Management, as generally depicted on the Map.</text></subsection><subsection id="H2B353517685E44B6B399B6445EBAD8D6"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Monument is to conserve, protect, and enhance for the benefit and enjoyment of present and future generations, through cooperative and collaborative management with culturally affiliated Indian Tribes, the ecological, scenic, wildlife, recreational, cultural, historical, natural, educational, and scientific resources of the Monument.</text></subsection><subsection id="H0A9F3CF454C148D584AE6C2A9CCF020D"><enum>(c)</enum><header>Management</header><paragraph id="HF2E3726EEAE14EBCB7ADF47FAE8BC12D"><enum>(1)</enum><header>In general</header><text>The Secretary—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf027102015dc4e8c8432598f22ca2347"><enum>(A)</enum><text display-inline="yes-display-inline">shall manage the Monument—</text><clause id="H022E8561E0BE49F9866D798FD57DB203"><enum>(i)</enum><text>in a manner that conserves, protects, and enhances the resources of the Monument;</text></clause><clause id="H5AE8A649FBFA48808F8ACAA008B576F0"><enum>(ii)</enum><text>in accordance with—</text><subclause id="H317F61BEAD304E9ABC15DBAEC57A8031"><enum>(I)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text></subclause><subclause id="HA0851669A90444ADA5D362012FC68587"><enum>(II)</enum><text>this section; and</text></subclause><subclause id="H978ADD4466C7455FB5A21B9EEF7358F8"><enum>(III)</enum><text>any other applicable law (including regulations);</text></subclause></clause><clause id="H193CB7EAA122424EB7D8AA9F74460159"><enum>(iii)</enum><text>in cooperation and collaboration with culturally affiliated Indian Tribes; and</text></clause><clause id="HACAC0F922CB247678ED9BEB6D8786B3D"><enum>(iv)</enum><text>as a component of the National Landscape Conservation System; and</text></clause></subparagraph><subparagraph id="H1EBF07B19E6548559B0F7A8493F23F00"><enum>(B)</enum><text>shall only allow uses of the Monument that—</text><clause commented="no" display-inline="no-display-inline" id="id89d3308dcf22423aa370daeae68d8ce6"><enum>(i)</enum><text>are described in or otherwise consistent with this section; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id26b4ed11f60a4efd8ad09c76bdf67e81"><enum>(ii)</enum><text display-inline="yes-display-inline">in the determination of the Secretary, would further the purpose described in subsection (b).</text></clause></subparagraph></paragraph><paragraph id="id0fdb9d1f3ffe45249aeb4d21ebe1f3cf"><enum>(2)</enum><header>Agreements and partnerships</header><text>To the maximum extent practicable and in accordance with applicable laws, on request of a culturally affiliated Indian Tribe, the Secretary shall enter into agreements, contracts, and other cooperative and collaborative partnerships with the culturally affiliated Indian Tribe with respect to management of the Monument under relevant Federal authority, including—</text><subparagraph id="id9f1b814fabc04b5984fb2af7066e8743"><enum>(A)</enum><text>the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>);</text></subparagraph><subparagraph id="id6884d0b462b242389bb0470321c067dd"><enum>(B)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text></subparagraph><subparagraph id="idfc329f24b5bc440b805ac056b9cd58db"><enum>(C)</enum><text>Executive Order 13175 (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301</external-xref> note; relating to consultation and coordination with Indian Tribal governments);</text></subparagraph><subparagraph id="idbcc1c29ec81b4b5082f5473dfb7fe937"><enum>(D)</enum><text>Secretarial Order 3342, issued by the Secretary on October 21, 2016 (relating to identifying opportunities for cooperative and collaborative partnerships with Federally recognized Indian Tribes in the management of Federal lands and resources); and</text></subparagraph><subparagraph id="id9113f5e47d364808ad01353b2bafbafc"><enum>(E)</enum><text>Joint Secretarial Order 3403, issued by the Secretary and the Secretary of Agriculture on November 15, 2021 (relating to fulfilling the trust responsibility to Indian Tribes in the stewardship of Federal lands and waters). </text></subparagraph></paragraph><paragraph id="HDB7CAD63335347B08F78340137E1111B"><enum>(3)</enum><header>Native american access and use</header><subparagraph id="H87C5E053A28946AAAC302C31CAA40BF9"><enum>(A)</enum><header>Access</header><text>The Secretary shall ensure access to the Monument by members of a culturally affiliated Indian Tribe for traditional cultural purposes and activities.</text></subparagraph><subparagraph id="H0B25A1D5134043308512B599FC13C71A"><enum>(B)</enum><header>Temporary closure</header><text>In carrying out this paragraph, the Secretary, on the request of a culturally affiliated Indian Tribe, may temporarily close to the general public use of 1 or more specific portions of the Monument to protect the privacy of traditional cultural activities in the temporarily closed portion by members of the culturally affiliated Indian Tribe. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd7f35045232f4b0a86045bb3ff78cc06"><enum>(C)</enum><header>Applicable law</header><text display-inline="yes-display-inline">The access and use by members of a culturally affiliated Indian Tribe under this paragraph shall be consistent with the purpose and intent of <external-xref legal-doc="public-law" parsable-cite="pl/95/341">Public Law 95–341</external-xref> (commonly known as the <quote>American Indian Religious Freedom Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/1996">42 U.S.C. 1996 et seq.</external-xref>). </text></subparagraph></paragraph><paragraph id="HC7AA4BEAA39245599479B45BDAF37E8A"><enum>(4)</enum><header>Recreation</header><text>The Secretary shall continue to authorize and enhance recreation in the Monument, including camping, hiking, backpacking, sightseeing, nature study, horseback riding, hunting, hang gliding, climbing, mountain biking and motorized recreation on authorized routes, and the noncommercial collecting of rocks, minerals, and semi-precious gemstones, if the recreational use is consistent with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0fc6d313e52f4c64b1d9c4207e9dd9ce"><enum>(A)</enum><text display-inline="yes-display-inline">the purpose described in subsection (b);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22575bebb081462bb1186607d9bd6b4e"><enum>(B)</enum><text display-inline="yes-display-inline">this section;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38b6ad87b26544fa8f98bce870cfa353"><enum>(C)</enum><text display-inline="yes-display-inline">other applicable law (including regulations);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id308c58e86daa439f95e448cb3d2b8116"><enum>(D)</enum><text display-inline="yes-display-inline">applicable management plans; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id83e896ed3c084484809f120779a34e8d"><enum>(E)</enum><text display-inline="yes-display-inline">input from the Commission regarding potential impacts to culturally sensitive sites and resources.</text></subparagraph></paragraph><paragraph id="H6A77422CDF2E49CB962D9ACE14D4712C"><enum>(5)</enum><header>Motorized vehicles</header><subparagraph id="H80E3335DB10A4AA79242F4190F0BFCAC"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the use of motorized vehicles within the Monument shall be permitted only on routes designated for the use of motorized vehicles by the transportation management plan prepared under paragraph (17)(D).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id566332e13200462b8dfe090443817534"><enum>(B)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), the use of motorized vehicles within the Monument may be permitted if the use is necessary—</text><clause commented="no" display-inline="no-display-inline" id="id3210dabfa7514935ad6ed297ca1b0e2c"><enum>(i)</enum><text display-inline="yes-display-inline">for administrative purposes; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3943f87263764e83b1e1f03a3c18cc43"><enum>(ii)</enum><text display-inline="yes-display-inline">for constructing or servicing, consistent with paragraphs (1) and (7)—</text><subclause commented="no" display-inline="no-display-inline" id="id3a2218d6f3724104a7cf88683adee562"><enum>(I)</enum><text display-inline="yes-display-inline">electric utility facilities (including electric transmission facilities and electric distribution facilities); or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id63d4f7da584b4db7a10b39cd9dba6800"><enum>(II)</enum><text display-inline="yes-display-inline">renewable energy projects near or adjacent to the Monument; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id911a6eb0f31f4f06a2652808708c7dc2"><enum>(iii)</enum><text display-inline="yes-display-inline">to respond to an emergency.</text></clause></subparagraph><subparagraph id="H824FEEC3C7E34480B48D3E34BD5FACD0"><enum>(C)</enum><header>Interim management</header><clause id="idc07377275ce645ae8020916f2b447c07"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), until the date on which the transportation management plan required under paragraph (17)(D) is completed, the use of motorized vehicles in the Monument shall be permitted only on—</text><subclause commented="no" display-inline="no-display-inline" id="idff6e699de6a04fcd9ac10a80d4b2bc9f"><enum>(I)</enum><text display-inline="yes-display-inline">the routes that are legally designated for such use on the date of enactment of this Act; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id76742468ad78427ca607af77f63a1de3"><enum>(II)</enum><text display-inline="yes-display-inline">any routes necessary for a purpose described in subparagraph (B), including the purposes described in clause (ii) of that subparagraph, subject to the requirements of that subparagraph. </text></subclause></clause><clause id="HBA6550B8A380413A9F6590BA882518D0"><enum>(ii)</enum><header>Limitation</header><text>Nothing in clause (i) prevents the Secretary from closing roads, trails, or areas to motorized vehicles—</text><subclause commented="no" display-inline="no-display-inline" id="idcd09128bb0434047aa0587b9b71b5198"><enum>(I)</enum><text display-inline="yes-display-inline">to protect natural or cultural resources; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id390bfcfc97cf433499339a070e29c55e"><enum>(II)</enum><text display-inline="yes-display-inline">for public safety.</text></subclause></clause></subparagraph></paragraph><paragraph id="H981F5DC0254446F1B5DA73EE36CF5EFD"><enum>(6)</enum><header>Grazing</header><text>The Secretary shall not establish any new allotments for livestock grazing that include any Monument land (whether leased or not leased for grazing on the date of enactment of this Act).</text></paragraph><paragraph id="H7927C253E5A14BEC8303009FF4291EC6"><enum>(7)</enum><header>Existing easements and rights-of-way</header><subparagraph commented="no" display-inline="no-display-inline" id="idbcfd6f53935940029018383757e9532e"><enum>(A)</enum><header>Effect</header><text display-inline="yes-display-inline">Nothing in this Act precludes the renewal, assignment, or enlargement of, or interferes with the operation, maintenance, replacement, modification, upgrade, or access to, existing—</text><clause commented="no" display-inline="no-display-inline" id="iddfa06e1ad5ce449a83cefedc7e1405a8"><enum>(i)</enum><text display-inline="yes-display-inline">flood control facilities, electric utility facilities (including electric transmission facilities and electric distribution facilities), pipeline facilities, and telecommunications facilities within the Monument; </text></clause><clause commented="no" display-inline="no-display-inline" id="id85aa352b40b64a0cb0296930fdb08e86"><enum>(ii)</enum><text display-inline="yes-display-inline">roads or highway corridors within the Monument;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5fc1e52043ac477ca29ecfdd87054000"><enum>(iii)</enum><text display-inline="yes-display-inline">seismic monitoring facilities within the Monument; or </text></clause><clause commented="no" display-inline="no-display-inline" id="idb4b59b16598743289ba950a1e5168e39"><enum>(iv)</enum><text display-inline="yes-display-inline">other water infrastructure, including wildlife water developments or water district facilities, within or adjacent to an existing authorization boundary of the Monument. </text></clause></subparagraph><subparagraph id="ida0c40d47ad624d758d1f8101661f8d8c"><enum>(B)</enum><header>Expansion of existing facilities; new facilities</header><text>To the extent consistent with the proper care and management of objects of historical and scientific interest at the Monument and subject to the authorities of the Secretary and other applicable law—</text><clause commented="no" display-inline="no-display-inline" id="idfcbc148c53684251aeb14553a17db563"><enum>(i)</enum><text display-inline="yes-display-inline">existing flood control facilities, electric utility facilities (including electric transmission facilities and electric distribution facilities), pipeline facilities, telecommunications facilities, and seismic monitoring facilities and other water infrastructure, including wildlife water developments or water district facilities, may be expanded within the Monument; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id2ac0e3bfbbe14c09bee13df470c09704"><enum>(ii)</enum><text display-inline="yes-display-inline">new flood control facilities, electric utility facilities (including electric transmission facilities and electric distribution facilities), pipeline facilities, and telecommunications facilities are permitted within the Monument.</text></clause></subparagraph></paragraph><paragraph id="HBB4C46B5D6FF4006BC78038DBD9AD7AD"><enum>(8)</enum><header>Acquisition of valid existing rights</header><text>The Secretary may acquire through exchange, donation, or purchase from a willing seller valid mining claims or other valid existing rights within the Monument that the Secretary determines, after consultation with the Commission or a culturally affiliated Indian Tribe, threatens cultural resources within the Monument.</text></paragraph><paragraph id="HE57B718BF1C745159E70BD15B67628FF"><enum>(9)</enum><header>Withdrawal</header><text>Subject to valid existing rights, all Federal land located in the Monument is withdrawn from—</text><subparagraph id="HABBA598BA3B94002AB14D5BF652D7145"><enum>(A)</enum><text>all forms of entry, appropriation, and disposal under the public land laws;</text></subparagraph><subparagraph id="HD190F21B1E084CB2A05065F04A9865AF"><enum>(B)</enum><text>location, entry, and patent under the mining laws; and</text></subparagraph><subparagraph id="HCB76CF44E8CF46A9B58F55A9E530B4F6"><enum>(C)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></subparagraph></paragraph><paragraph id="HF1AE7E68AD66449BB8AA50F872D0C253"><enum>(10)</enum><header>Adjacent management</header><subparagraph id="H28DD605DABF645C1BF796ACE6E157D9E"><enum>(A)</enum><header>In general</header><text>Nothing in this Act creates a protective perimeter or buffer zone around the Monument.</text></subparagraph><subparagraph id="H89B207B7AD8F4CDEA9909D0959B59ECD"><enum>(B)</enum><header>Activities outside the monument</header><clause commented="no" display-inline="no-display-inline" id="id9f2bb0f170ce46e7ba123a88b4dcdcfe"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The fact that an activity or use on land outside the Monument can be seen or heard within the Monument shall not preclude the activity or use outside the boundary of the Monument.</text></clause><clause commented="no" display-inline="no-display-inline" id="id544e1499a2b046c0b2a2248f889d2f43"><enum>(ii)</enum><header>Development Focus Areas</header><text>The development and operation of renewable energy facilities, related energy storage facilities, and associated infrastructure, including electric utility facilities (including electric transmission facilities and electric distribution facilities), in Development Focus Areas near or adjacent to the Monument shall not be affected by the establishment or management of the Monument.</text></clause></subparagraph><subparagraph id="id84691f9e17a3449c8b07e0a2bd6960ed"><enum>(C)</enum><header>Savings provision</header><text>Nothing in this section affects renewable energy development (including related energy storage or electric utility facilities, including electric transmission facilities and electric distribution facilities) on any land near or adjacent to the Monument.</text></subparagraph></paragraph><paragraph id="H2CB39C310DDB426D8D90A0E0B123FC6D"><enum>(11)</enum><header>Military activities</header><text>Nothing in this Act precludes—</text><subparagraph id="HF1EA8BD825EC458382678AAD660E9EB7"><enum>(A)</enum><text>low-level overflights of military aircraft over the Monument;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53ad0f6aa49c42d0b66de0b434fc4635"><enum>(B)</enum><text display-inline="yes-display-inline">the landing and takeoff of military aircraft in designated landing zones in accordance with all aviation safety regulations; </text></subparagraph><subparagraph id="HD944B7EB09084F91B7C2AAA36C5CDBAD"><enum>(C)</enum><text>the designation of new units of special airspace over the Monument; </text></subparagraph><subparagraph id="H716CC2ABF26F4CBA8D94AC60094DEF89"><enum>(D)</enum><text>the use or establishment of military flight training routes over the Monument; or</text></subparagraph><subparagraph id="H9A558CAA3C8D4CE9A9FB994B5E54B911"><enum>(E)</enum><text>the use of Federal land within the Monument for off-road or off-trail training pursuant to agreements between the Secretary and the Secretary of Defense.</text></subparagraph></paragraph><paragraph id="H2AA2FDB81313469C973D38121878EFF1"><enum>(12)</enum><header>Treaty rights</header><text>Nothing in this Act alters, modifies, enlarges, diminishes, or abrogates the treaty rights of any Indian Tribe, including off-reservation reserved rights.</text></paragraph><paragraph id="H75F270D148934AF88347654D80BD2FBB"><enum>(13)</enum><header>Jurisdiction over fish and wildlife</header><subparagraph id="HA5305F13E6EE457A8810361757E06F75"><enum>(A)</enum><header>In general</header><text>Nothing in this section diminishes the jurisdiction of the State with respect to fish and wildlife management, including the regulation of fishing and hunting within the Monument.</text></subparagraph><subparagraph id="H7846CFFC348A462A9DF9145AAAC0739E"><enum>(B)</enum><header>Limitations</header><clause id="H310EF73ABD48426BB750B369B8D65B14"><enum>(i)</enum><header>Regulations</header><text>Subject to clause (ii), the Secretary may designate by regulation areas in which, and establish periods during which, for reasons of public safety, administration, or compliance with applicable laws, no hunting, fishing, or trapping will be permitted in the Monument.</text></clause><clause id="HF4DB5C9D5B774C0EA079A1ECE92557B9"><enum>(ii)</enum><header>Consultation</header><text>Except in emergencies, the Secretary shall consult with the appropriate State agency before promulgating regulations under clause (i) that close a portion of the Monument to hunting, fishing, or trapping.</text></clause></subparagraph><subparagraph id="idab765e0efc584b25b2cfbd20c1643f13" commented="no"><enum>(C)</enum><header>Fish and wildlife management activities</header><text>Management activities (including the use of motorized vehicles by appropriate State agencies, subject to applicable laws (including regulations)) to maintain, enhance, or restore fish and wildlife populations and the habitats to support fish and wildlife populations may be carried out within the Monument.</text></subparagraph></paragraph><paragraph id="HD7FCC996A33A4288A02711318F6A4C39"><enum>(14)</enum><header>Wildlife water development projects</header><text>In accordance with applicable law (including regulations), the Secretary may authorize structures and facilities, including maintenance of existing structures and facilities, for wildlife water development projects, including guzzlers, in the Monument, if—</text><subparagraph id="HD0FE1EFE82E34BB3A7486B64A4D4D6ED"><enum>(A)</enum><text>the structures and facilities are necessary to fulfill the purpose described in subsection (b);</text></subparagraph><subparagraph id="HF90089C85CCE404DBD98308A2A2B70CD"><enum>(B)</enum><text>the structures and facilities would, as determined by the Secretary, promote healthy, viable, and more naturally distributed wildlife populations; and</text></subparagraph><subparagraph id="H06DEE7095C1F477B9F8BB196B4C23AE4"><enum>(C)</enum><text>the visual impacts of the structures and facilities on the Monument can reasonably be minimized.</text></subparagraph></paragraph><paragraph id="H4E3769DC60444D2B8D1F6FBE4784042D"><enum>(15)</enum><header>Map; legal description</header><subparagraph id="HF5A2F61D20D84B2E8DA7C1454A5A7A7C"><enum>(A)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a map and legal description of the Monument.</text></subparagraph><subparagraph id="H7A57FB61A2AA4E0394C47871840B6DE2"><enum>(B)</enum><header>Corrections</header><text>The map and legal description submitted under subparagraph (A) shall have the same force and effect as if included in this Act, except that the Secretary may correct any clerical or typographical errors in the legal description and the map, including to ensure that there is no overlap between the Monument and Development Focus Areas.</text></subparagraph><subparagraph id="H9C3BA9EF951C45B5B2AE86C758FCA1F9"><enum>(C)</enum><header>Conflict between map and legal description</header><text>In the case of a conflict between the map and the legal description submitted under subparagraph (A), the map shall control.</text></subparagraph><subparagraph id="HD74E11F55D974FDDAFE6D2E31281F7DC"><enum>(D)</enum><header>Availability of map and legal description</header><text>Copies of the map and legal description submitted under subparagraph (A) shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text></subparagraph></paragraph><paragraph id="H79FB00E4F85E48E69194A46177FDFA0E"><enum>(16)</enum><header>New rights-of-way</header><text>Nothing in this Act prevents the Secretary from approving new rights-of-way within the Monument that the Secretary determines, in consultation with applicable State and local agencies and culturally affiliated Indian Tribes, are consistent with—</text><subparagraph id="HADEC9FA0302449F69A988F7D3008AF6A"><enum>(A)</enum><text>this Act;</text></subparagraph><subparagraph id="HCA9C1587CE92417C82C65EF84CD3674C"><enum>(B)</enum><text>applicable laws (including regulations);</text></subparagraph><subparagraph id="H9705358FBC854517B6EB7677A834350A"><enum>(C)</enum><text>the Desert Renewable Energy Conservation Area Plan;</text></subparagraph><subparagraph id="H6F1243ADD5E34F4690BC34139E5FC8CC"><enum>(D)</enum><text>the purpose described in subsection (b);</text></subparagraph><subparagraph id="HD6B5FE5270BA47DBA2CD6E4EF06B5F38"><enum>(E)</enum><text>the management plan; and</text></subparagraph><subparagraph id="idda713c51ee8048849cdb63aa7564af5e"><enum>(F)</enum><text>the care and proper management of objects of historical and scientific interest within the Monument.</text></subparagraph></paragraph><paragraph id="H8CCD54CF34ED4F2AB299AC0ABC119AE2"><enum>(17)</enum><header>Management plan</header><subparagraph id="HF50D32F9EE824976944705F989E2168A"><enum>(A)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall develop a comprehensive plan for the long-term management of the Monument.</text></subparagraph><subparagraph id="H789CB2133B464546B94BE8603C9D0CA3"><enum>(B)</enum><header>Consultation required</header><text>The Secretary shall—</text><clause commented="no" display-inline="no-display-inline" id="idabf7a5369e724dafa5054fd3f00bf204"><enum>(i)</enum><text display-inline="yes-display-inline">in developing the management plan, consult with—</text><subclause commented="no" display-inline="no-display-inline" id="idb56317e145904d0d90b0dd754762d40a"><enum>(I)</enum><text display-inline="yes-display-inline">culturally affiliated Indian Tribes;</text></subclause><subclause id="H99F9F38827514F4893A8C25D8679C52F"><enum>(II)</enum><text>appropriate State and local governmental entities;</text></subclause><subclause id="H56F52492F68A45E886C16B141E8A6222"><enum>(III)</enum><text>the Advisory Council;</text></subclause><subclause id="H92DB8BB182284C7A8793280BE422D6DA" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text>members of the public; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id019707585f264d31ba5362960847817b"><enum>(V)</enum><text display-inline="yes-display-inline">affected renewable energy developers and local electric utility companies; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf4529c71936c4a4d8ceaf75d07aac01a"><enum>(ii)</enum><text display-inline="yes-display-inline">in making management decisions relating to the Monument, consult with culturally affiliated Indian Tribes.</text></clause></subparagraph><subparagraph id="H3CABC65B6B874925B106EE67849AE2AC"><enum>(C)</enum><header>Requirements</header><text>The management plan—</text><clause commented="no" display-inline="no-display-inline" id="id6d3a9ca53e01463aa041678e6d5a5d38"><enum>(i)</enum><text display-inline="yes-display-inline">shall—</text><subclause id="H9BB24BA1F92349F49CAC9ECEEFDDC0ED"><enum>(I)</enum><text>assess opportunities to improve recreational opportunities within, and access to, the Monument in a manner that—</text><item commented="no" display-inline="no-display-inline" id="idf52012db2e704d69979b263d322ff49d"><enum>(aa)</enum><text display-inline="yes-display-inline">conserves, protects, and enhances resources of the Monument resources; and</text></item><item commented="no" display-inline="no-display-inline" id="id7064cc865bc54964932223573f17ac99"><enum>(bb)</enum><text display-inline="yes-display-inline">furthers the purpose described in subsection (b);</text></item></subclause><subclause id="H121D3A5D2AD94949AFDB83D985857027"><enum>(II)</enum><text>incorporate traditional ecological knowledge; and</text></subclause><subclause id="H75EB8DB6DF4743B28EFAAEB5A5756FB4"><enum>(III)</enum><text>identify opportunities to interpret Monument resources for members of the public; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id2c9267ab40b94e44a8d2f5921216d5d1"><enum>(ii)</enum><text>shall not—</text><subclause commented="no" display-inline="no-display-inline" id="idc0d23818624d47d7a82717c49f6958de"><enum>(I)</enum><text display-inline="yes-display-inline">impact renewable energy projects in Development Focus Areas near or adjacent to the Monument; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idbcff17b8d66e4499a2d247ca253fde54"><enum>(II)</enum><text>interfere with the development of renewable energy (including related energy storage facilities or electric utility facilities, including electric transmission facilities and electric distribution facilities) or colocated telecommunications facilities on land near or adjacent to the Monument.</text></subclause></clause></subparagraph><subparagraph id="idc040d95cc65b48ac9dbd6f661f20ff13"><enum>(D)</enum><header>Transportation management plan</header><text>For the purposes of protecting and restoring objects of historical and scientific interest within the Monument, as part of the management plan, the Secretary shall include a transportation plan that—</text><clause commented="no" display-inline="no-display-inline" id="iddfca7e9b52134ad3b9cf1a212902c820"><enum>(i)</enum><text display-inline="yes-display-inline">designates the routes and trails on which motorized vehicle use and nonmotorized mechanized vehicle use will be allowed within the Monument; </text></clause><clause commented="no" display-inline="no-display-inline" id="id783e6cb77dfb4635823ddaf3400c21c8"><enum>(ii)</enum><text display-inline="yes-display-inline">provides that—</text><subclause commented="no" display-inline="no-display-inline" id="id115ebf7812784b8bbab92659ba683792"><enum>(I)</enum><text display-inline="yes-display-inline">except as provided in subclause (II) or for emergency or authorized administrative purposes, including appropriate wildlife management, motorized vehicle use in the Monument shall be permitted only on routes and trails existing as of the date of enactment of this Act; </text></subclause><subclause id="idb854e31a182447768c1724ab6190959d"><enum>(II)</enum><text>notwithstanding subclause (I), the Secretary may designate additional routes or trails for motorized vehicle use in the Monument after the date of enactment of this Act for the purposes of public safety needs, access to existing or new electric utility facilities or infrastructure, or protection of objects of historical and scientific interest within the Monument; and</text></subclause><subclause id="id2c59a94a28c54daa8fbfffb88c60821f"><enum>(III)</enum><text>the Secretary shall monitor motorized and non-motorized vehicle use and designated roads and trails to ensure proper care and management of objects of historical and scientific interest within the Monument. </text></subclause></clause></subparagraph><subparagraph id="H16840F8994CE4C2BB788741649038EB3"><enum>(E)</enum><header>Incorporation of plans</header><text>In developing the management plan, to the extent consistent with this section, the Secretary may incorporate any provision of an applicable land and resource management plan.</text></subparagraph><subparagraph id="H756DB7F9C1724B1BB35A79848B2F8703"><enum>(F)</enum><header>Effect</header><text>If there is a conflict between this section and the Desert Renewable Energy Conservation Area Plan, the more restrictive provision shall control.</text></subparagraph></paragraph><paragraph id="H0277298A05D947FD937F654265EE9324"><enum>(18)</enum><header>Wildfire</header><text>In accordance with this Act and applicable law (including regulations), the Secretary may take any measures within the Monument that the Secretary determines to be necessary to control fire, insects, and diseases, including, as the Secretary determines to be appropriate, the coordination of the activities with a State or local agency.</text></paragraph><paragraph id="HD7E5D43D8E30427FA1DB1E646480A0FE"><enum>(19)</enum><header>Incorporation of acquired land and interests</header><text>Any land or interest in land within the boundary of the Monument that is acquired by the United States after the date of enactment of this Act shall—</text><subparagraph id="HF21B1ADC1F36466F964820008EC14A7A"><enum>(A)</enum><text>become part of the Monument;</text></subparagraph><subparagraph id="H4B0AA0ECEAB84B00A3F26240B73D3D7C"><enum>(B)</enum><text>be withdrawn in accordance with paragraph (9); and</text></subparagraph><subparagraph id="H1E3D108F27ED40DC973F97B141DF2B6A"><enum>(C)</enum><text>be managed in accordance with—</text><clause id="H6F42FDE51E1B474BA6F295BD093D41A9"><enum>(i)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text></clause><clause id="H318B54935A1C4EA193AEFD9CCD589A2B"><enum>(ii)</enum><text>this section; and</text></clause><clause id="HF606E25805B9448482685302B95F4399"><enum>(iii)</enum><text>any other applicable law (including regulations). </text></clause></subparagraph></paragraph></subsection></section><section id="H810027F329404B13909268981E6A286D"><enum>5.</enum><header>Chuckwalla National Monument Tribal Commission</header><subsection id="H4358C18F564A455CB8B4560D7287F424"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a commission, to be known as the <quote>Chuckwalla National Monument Tribal Commission</quote>.</text></subsection><subsection id="H3C7D27DBDB2147318338FE69326EF074"><enum>(b)</enum><header>Membership</header><paragraph id="HB1ACA94E93CD4D279FCB47416B79E9F0"><enum>(1)</enum><header>Makeup</header><text>The Commission shall include a representative from each culturally affiliated Indian Tribe.</text></paragraph><paragraph id="H6A7D2BA075334C4291409A89F0045F7D"><enum>(2)</enum><header>Process</header><text>The Secretary shall conduct government-to-government consultation with each culturally affiliated Indian Tribe to determine the membership of the Commission.</text></paragraph></subsection><subsection id="H5C60BA27221044089CBFE2A80D44D8F2"><enum>(c)</enum><header>Duties</header><paragraph id="HD753E4A36B734D458C1034A8A30BA227"><enum>(1)</enum><header>Duties of the commission</header><text>The Commission shall inform, and provide input to, the development and implementation of the management plan.</text></paragraph><paragraph id="HA368DB9EAF9B4EADA988AFCF556E301E"><enum>(2)</enum><header>Duties of the secretary</header><text>The Secretary shall—</text><subparagraph id="HA261D33527A14B229AF6DDB1FB5BCF55" commented="no"><enum>(A)</enum><text>consult with the Commission on—</text><clause commented="no" display-inline="no-display-inline" id="id4400ecc2f0d547de9b4c2d057572d2d8"><enum>(i)</enum><text display-inline="yes-display-inline">the development of the management plan; and </text></clause><clause commented="no" display-inline="no-display-inline" id="idff3f4df0733c47eca0414f8366ca7d90"><enum>(ii)</enum><text display-inline="yes-display-inline">providing guidance and recommendations to the Secretary on management decisions relating to the Monument;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaf1cc26912e844f682739560ad778afb"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that the management plan sets forth parameters for the continued meaningful engagement by the Commission in the implementation of the management plan; and </text></subparagraph><subparagraph id="H3C301E7837BC4D449DB151307C8B2BD4"><enum>(C)</enum><text>incorporate into the management plan—</text><clause id="HD84207B143B841768F4A6239B85F17E1"><enum>(i)</enum><text>the traditional and historical knowledge and special expertise of the Commission; </text></clause><clause id="H1DCE6CD67F444A43BE511156DF47EFCA"><enum>(ii)</enum><text>public education and interpretation for traditional place names and the cultural significance of land within the Monument, as the Secretary and the Commission determine to be appropriate; and</text></clause><clause id="HC8B3EC9E9CB945A8B417A4E57EC9114D"><enum>(iii)</enum><text>address funding, capacity building, and infrastructure for culturally affiliated Indian Tribes.</text></clause></subparagraph></paragraph></subsection><subsection id="H4445129B55A44E0DA25BCA339EA80312"><enum>(d)</enum><header>Procedures</header><text>The Commission shall establish any rules and procedures for the Commission that the Commission determines to be necessary.</text></subsection></section><section id="HC718BEF88B1742BDBB7D7C6252C1F353"><enum>6.</enum><header>Chuckwalla National Monument Advisory Council</header><subsection id="HC1984B8052494C6E86F96AB82B94A540"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish an advisory council, to be known as the <quote>Chuckwalla National Monument Advisory Council</quote>.</text></subsection><subsection id="HA67C1CD3617D49228B2301C15D452FA9"><enum>(b)</enum><header>Duties</header><text>The Advisory Council shall advise the Secretary with respect to the development of the management plan.</text></subsection><subsection id="HA00B723083AE43D3AE93DF236F5BA950"><enum>(c)</enum><header>Applicable law</header><text>The Advisory Council shall be subject to—</text><paragraph id="HC3DF9F26F34E4A74B5CF32E10260B52D"><enum>(1)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code (commonly known as the <quote>Federal Advisory Committee Act</quote>);</text></paragraph><paragraph id="H7CC8A0064C7649E797D3F409AA37DF0A"><enum>(2)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text></paragraph><paragraph id="H28FFE27B07114F089ECFB652A9D49925"><enum>(3)</enum><text>any other applicable laws.</text></paragraph></subsection><subsection id="HD27D6B6D7DBD478D8473178DBB95A674"><enum>(d)</enum><header>Membership</header><text>The Advisory Council shall consist of 19 members, to be appointed by the Secretary, of whom, to the extent practicable—</text><paragraph id="H747D1A943D724D249DDC80EE4AAEF9A9"><enum>(1)</enum><text>1 member shall be appointed after considering the recommendations of the Riverside County Board of Supervisors;</text></paragraph><paragraph id="H83FE12D4B35B478CB3AA97B8361288B0"><enum>(2)</enum><text>1 member shall be appointed after considering the recommendations of the Imperial County Board of Supervisors;</text></paragraph><paragraph id="H959F00514C044984B6A89D8D8EAECA4B"><enum>(3)</enum><text>1 member shall be appointed after considering the recommendations of the Secretary for Natural Resources of the State; </text></paragraph><paragraph id="id198a12f6ed8843d5808eb16b596db938"><enum>(4)</enum><text>1 member shall be appointed to represent the Department of Defense; and </text></paragraph><paragraph id="HA2ACDEC188D14C13BA9E415B328660DF"><enum>(5)</enum><text>8 members shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="ideaed896de46949048ea0a3da7cc7b8cb"><enum>(A)</enum><text display-inline="yes-display-inline">reside in, or within reasonable proximity to, Riverside or Imperial County in the State; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfa6f4df0f4674c6abcdbb313dc9225e9"><enum>(B)</enum><text display-inline="yes-display-inline">have backgrounds that reflect—</text><clause id="H9218972C5B714C0BB4BC66EF93FB4BF9"><enum>(i)</enum><text>the purpose described in section 4(b); and</text></clause><clause id="H9A9D6BFC84AC49C0961052EE2F444ABC"><enum>(ii)</enum><text>the interests of persons affected by the planning and management of the Monument, including representatives of—</text><subclause commented="no" display-inline="no-display-inline" id="id1fb73d16b8a14d23bfb6bf1fb9741bc6"><enum>(I)</enum><text display-inline="yes-display-inline">the renewable energy industry;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf7c5b4dd8b0a4344b5361be917db7fc7"><enum>(II)</enum><text display-inline="yes-display-inline">electric utilities;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id83c6c83f3016419e9ee93bf725ebc87d"><enum>(III)</enum><text display-inline="yes-display-inline">private land owners; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id382076849f194876992272ba3775ecde"><enum>(IV)</enum><text display-inline="yes-display-inline">nongovernmental organizations managing land for conservation purposes; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id44b43d3bfe0e473c888b83ff5e9c595a"><enum>(V)</enum><text display-inline="yes-display-inline">environmental, recreational, tourism, or other non-Federal land interests. </text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H9CCFCCCCFFB5468DA6D0935FF8A76D41"><enum>(e)</enum><header>Representation</header><text>The Secretary shall ensure that the membership of the Advisory Council is fairly balanced in terms of—</text><paragraph commented="no" display-inline="no-display-inline" id="id01eaf54023544a3194be122c6967a94b"><enum>(1)</enum><text display-inline="yes-display-inline">the points of view represented by the Advisory Council; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4512ce97ad84c40932a0660b91a2333"><enum>(2)</enum><text display-inline="yes-display-inline">the functions to be performed by the Advisory Council.</text></paragraph></subsection><subsection id="HEAD280FA10714FC7B9299946E5D37C4F"><enum>(f)</enum><header>Terms</header><paragraph id="H8394BDAC1BD447F1917E5C4C3A60B798"><enum>(1)</enum><header>Staggered terms</header><text>A member of the Advisory Council shall be appointed for a term of 3 years, except that, of the members first appointed—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9a8d8d45fcfa43dea1d3b08fc4e396be"><enum>(A)</enum><text display-inline="yes-display-inline">5 shall be appointed for a term of 1 year; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c6b75666d8a47848c16ca273dc5060e"><enum>(B)</enum><text display-inline="yes-display-inline">5 shall be appointed for a term of 2 years.</text></subparagraph></paragraph><paragraph id="H0373E42F807243558C75549337AEC27E"><enum>(2)</enum><header>Reappointment</header><text>A member may be reappointed to serve on the Advisory Council on the expiration of the term of the member.</text></paragraph><paragraph id="HDF80154B9D8E41C59FA57C2826825177"><enum>(3)</enum><header>Vacancy</header><text>A vacancy on the Advisory Council shall be filled in the same manner in which the original appointment was made.</text></paragraph></subsection><subsection id="HA57DC8126E9846CE8CEE4E5E32FBD61C"><enum>(g)</enum><header>Quorum</header><paragraph commented="no" display-inline="no-display-inline" id="id511ab080c3d94d66a8ce9e7d59b58de3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">8 members of the Advisory Council shall constitute a quorum.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62d65e4865654f90bbe5b47be1900136"><enum>(2)</enum><header>No effect on operations</header><text display-inline="yes-display-inline">The operations of the Advisory Council shall not be impaired by the fact that a member has not yet been appointed if a quorum has been attained under paragraph (1).</text></paragraph></subsection><subsection id="H8B7767E7B22645B5AD1E58360EE5F332"><enum>(h)</enum><header>Chairperson and procedures</header><text>The Advisory Council shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idea2cc05514044783bccd7d8d9f4b84be"><enum>(1)</enum><text display-inline="yes-display-inline">elect a chairperson from among the members of the Advisory Council; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1901e41cd48d4234bb1f63b45c60888b"><enum>(2)</enum><text display-inline="yes-display-inline">establish any rules and procedures for the Advisory Council that the Advisory Council determines to be necessary.</text></paragraph></subsection><subsection id="H6066A28E0FD24359ADE42B8FB87CC8FE"><enum>(i)</enum><header>No compensation</header><text>A member of the Advisory Council shall serve without pay.</text></subsection><subsection id="HCDFF999FA5DE4697B04CF04FC186BA17"><enum>(j)</enum><header>Termination</header><text>The Advisory Council shall terminate on—</text><paragraph commented="no" display-inline="no-display-inline" id="id50fb488e27254be4a9abbdb6107d1d42"><enum>(1)</enum><text display-inline="yes-display-inline">the date on which the management plan is officially adopted by the Secretary; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7762f298484642abbf24d486ba6b32c3"><enum>(2)</enum><text>such later date as the Secretary determines to be appropriate.</text></paragraph></subsection></section><section id="id548680e8a37242cd8da02276106a5483" commented="no"><enum>7.</enum><header>Ethnographic study and cultural resources survey</header><subsection id="idadfb5ff0f5fd4497886b932cb907ac30" commented="no"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary—</text><paragraph commented="no" display-inline="no-display-inline" id="id22c979c4a12249b5a6cd035d8ff5e2ca"><enum>(1)</enum><text display-inline="yes-display-inline">after consultation with the culturally affiliated Indian Tribes, shall conduct, or enter into a contract with a third party to conduct, an ethnographic study of land within the Monument and public land adjacent to the Monument that is not within a Development Focus Area to assess the importance of the land studied to the culturally affiliated Indian Tribes and the religious, spiritual, and cultural practices of the culturally affiliated Indian Tribes; and</text></paragraph><paragraph id="ide0bc1e54c5bf4c458b298e42bf26f590" commented="no"><enum>(2)</enum><text>after consultation with the culturally affiliated Indian Tribes and a review of any applicable data, studies, and reports in the possession of the culturally affiliated Indian Tribes, shall conduct, or enter into a contract with a third party to conduct, a cultural resources survey of the land within the Monument and public land adjacent to the Monument that is not within a Development Focus Area to identify specific sites that contain cultural, religious, spiritual, and archaeological resources of importance to the culturally affiliated Indian Tribes.</text></paragraph></subsection><subsection id="ida4ca4ec6b38040f9a02849838f09f0b9" commented="no"><enum>(b)</enum><header>Participation of culturally affiliated indian tribes</header><text>In conducting an ethnographic study or cultural resources survey under subsection (a), the Secretary shall coordinate with, and provide for the participation of, each culturally affiliated Indian Tribe, including through the conduct of interviews with members of each culturally affiliated Indian Tribe.</text></subsection><subsection id="id6a217fc5ba2b40239d6dca8c8f0e7dd5" commented="no"><enum>(c)</enum><header>Applicable law</header><text>The Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>) shall apply to burial sites identified under subsection (a).</text></subsection><subsection id="idf4c4cfd8b6ef4b4f93e8326154432ce6" commented="no"><enum>(d)</enum><header>Submission of results to culturally affiliated Indian Tribes</header><text>Not later than 1 year after the date on which the ethnographic study and the cultural resources survey are completed under subsection (a), the Secretary shall submit to culturally affiliated Indian Tribes the results of the ethnographic study and the cultural resources survey for review and comment.</text></subsection><subsection id="ida426049c4e5c4d3aab9465f53401781b" commented="no"><enum>(e)</enum><header>Report</header><text>Not later than 2 years after the date on which the ethnographic study and the cultural resources survey are completed under subsection (a), the Secretary shall submit to the appropriate committees of Congress a report describing the results of the ethnographic study and the cultural resources survey completed under that subsection.</text></subsection><subsection id="id2ce83ec5b6c44336a53dc31d9cd41e7b"><enum>(f)</enum><header>Public availability of information</header><paragraph commented="no" display-inline="no-display-inline" id="id691d30d81362442c9a63057eda70cb72"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), information relating to the nature and specific location of a cultural resource located on land adjacent to the Monument that is obtained from an ethnographic study or cultural resources survey conducted under subsection (a) shall be exempt from disclosure under section 552 of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>) and any other applicable law.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbb9e6a4d95d4431d858efa6e3fbf4804"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the Secretary, in consultation with the culturally affiliated Indian Tribes, may disclose information described in that paragraph if the Secretary determines that the disclosure—</text><subparagraph commented="no" display-inline="no-display-inline" id="id409ccfca1c26457e98bdd6f90fb8b7c2"><enum>(A)</enum><text display-inline="yes-display-inline">would—</text><clause commented="no" display-inline="no-display-inline" id="idc0e14e05c6f240fd81773deb1a5b050d"><enum>(i)</enum><text display-inline="yes-display-inline">further the protection of the cultural resource; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id883235dabd134cb19801b8f98d43f3ae"><enum>(ii)</enum><text>be in accordance with other applicable laws; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2fb6b287e8b8473e878c2c730da908b1"><enum>(B)</enum><text display-inline="yes-display-inline">would not create a risk of harm to, or theft or destruction of, the cultural resource or the site at which the cultural resource is located.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6ba4ec1c99384185aefbc27faf0af720"><enum>(g)</enum><header>Savings provision</header><text>Nothing in this section, including the ethnographic study or the cultural resources survey conducted under subsection (a), affects—</text><paragraph commented="no" display-inline="no-display-inline" id="id5da176b827ba44df808db3ef3a99425a"><enum>(1)</enum><text>the development of renewable energy projects in a Development Focus Area;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf42fae3b31ba43f4984a4dd6194ebd52"><enum>(2)</enum><text display-inline="yes-display-inline">any requirements for that development that may be imposed based on the findings of any study required under other law prior to that development;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide2ed09b063bb48ae9102b6a8a2aa0bc9"><enum>(3)</enum><text>existing requirements for that development under section 306108 of title 54, United States Code (formerly section 106 of the National Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470f">16 U.S.C. 470f</external-xref>)) or any other applicable law; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id755da084981d430da45aa814da2ec3be"><enum>(4)</enum><text display-inline="yes-display-inline">any existing responsibility of the Bureau of Land Management or any renewable energy company to conduct ethnographic studies prior to development in a Development Focus Area.</text></paragraph></subsection></section><section id="HC076233B95CC454BB41CA19AE1D8EF5C"><enum>8.</enum><header>Expansion of Joshua Tree National Park</header><text display-inline="no-display-inline">Section 402 of the California Desert Protection Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/410aaa-22">16 U.S.C. 410aaa–22</external-xref>) is amended, in the first sentence, by inserting after <quote>October 1991 or prior,</quote> the following: <quote>and including the approximately 17,842 acres of land depicted on the map entitled <quote>Proposed Chuckwalla National Monument and Joshua Tree National Park Expansion</quote> and dated March 14, 2024,</quote>. </text></section></legis-body></bill>
