which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the establishment of a pilot program to expand early child care options for members of the Armed Forces and their families.</official-title></form><legis-body><section id="id414ac212db1448e5b0f31939fb1fc107" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Access to Child Care for Military Families Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="idef910acea67546708c643172fe267716"><enum>2.</enum><header display-inline="yes-display-inline">Pilot program to expand early child care options for members of the Armed Forces and their families</header><subsection id="id4816c770aacf466aa4f5830d42674b40"><enum>(a)</enum><header>In general</header><text>The Secretary of Defense shall direct the Secretaries of the military departments to carry out a pilot program to improve the access of members of the Armed Forces and their families to high quality early child care opportunities by establishing partnerships with eligible child care providers—</text><paragraph commented="no" display-inline="no-display-inline" id="id488e2dccd3e34f03a0c0b98dec164423"><enum>(1)</enum><text display-inline="yes-display-inline">to increase the capacity of those providers; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f567c8d5e0345a3a26d35bb27560c43"><enum>(2)</enum><text display-inline="yes-display-inline">to improve early child care workforce development; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9cb38386851c4c1e86690a7987a0a23e"><enum>(3)</enum><text display-inline="yes-display-inline">to increase recruitment and retention of employees for eligible child care providers.</text></paragraph></subsection><subsection id="id72f340a2da294e2bb43e9c7bb621aa17"><enum>(b)</enum><header>Selection of eligible child care providers and networks of such providers</header><paragraph id="ida3412a29203e4439bfe2efa0c15d6407"><enum>(1)</enum><header>In general</header><text>Under the pilot program required by subsection (a), the Secretary shall direct the Secretaries of the military departments to enter into a total of 12 partnerships with eligible child care providers, or networks of such providers, to, in communities under the jurisdiction of such secretaries—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf946389007d74ef0858f963ac04b172a"><enum>(A)</enum><text display-inline="yes-display-inline">increase the number of early child care slots available to members of the Armed Forces and their families; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide6b8dd1de73a446eb73b5bd21f114fc6"><enum>(B)</enum><text display-inline="yes-display-inline">facilitate recruitment and retention of employees for eligible child care providers; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8ef91136253f4750a87a3c9178c2e1bb"><enum>(C)</enum><text display-inline="yes-display-inline">provide additional professional development opportunities for such employees.</text></subparagraph></paragraph><paragraph id="id25b1ec8e1a574521864aeb26445edf1a"><enum>(2)</enum><header>Limitation</header><text>The Secretary may direct the Secretaries of the military departments to enter into not more than one partnership with each eligible child care provider, or network of such providers, under the pilot program required by subsection (a).</text></paragraph><paragraph id="id0f11d113a4194a8d9618c33560b5405a"><enum>(3)</enum><header>Locations</header><text>In selecting eligible child care providers or network of such providers with which to enter into partnerships under the pilot program required by subsection (a), the Secretary—</text><subparagraph commented="no" display-inline="no-display-inline" id="id12aa88da349b48439693539d15ee58d4"><enum>(A)</enum><text display-inline="yes-display-inline">shall direct the Secretaries of the military departments—</text><clause id="id658b2f450bb540df90ffa68d192d5b6b"><enum>(i)</enum><text>to ensure that—</text><subclause id="idc9b60303cb70489db941a23210c9646c"><enum>(I)</enum><text>each partnership is based at a different military installation; and</text></subclause><subclause id="id660fd39a8a4e4e64af5c42299c4d152b"><enum>(II)</enum><text>at least one partnership is based at—</text><item id="id91a7dfb17d674ecc92578983b82e8eb7"><enum>(aa)</enum><text>a Navy installation that is not a Marine Corps installation;</text></item><item id="idfa0aefec3ebf46a3b2ca55eb95b2765e"><enum>(bb)</enum><text>a Marine Corps installation;</text></item><item id="idd5346e5ced4641378c208d9259529c46"><enum>(cc)</enum><text>an Army installation;</text></item><item id="id687425dc706c48ccad142bbbe048446c"><enum>(dd)</enum><text>an Air Force installation that is not a Space Force installation;</text></item><item id="idb48e9d6741a747878529ae3eccb16d82"><enum>(ee)</enum><text>a Space Force installation; and</text></item><item id="id1fa3b40a90544383a9be3c2c14d27a2e"><enum>(ff)</enum><text>a joint military installation; and</text></item></subclause></clause><clause id="idbda2c55d30694840b83080f6536efb98"><enum>(ii)</enum><text>to consider—</text><subclause commented="no" display-inline="no-display-inline" id="idb1ca9b66bf5546228d9b5f986269c931"><enum>(I)</enum><text display-inline="yes-display-inline">geographic diversity and population demographics to reflect the inclusion of multiple communities across the United States;</text></subclause><subclause id="ida20208b47f834686a52739883ec8101c"><enum>(II)</enum><text>the appropriate qualifications, consistent with Department of Defense regulations and training requirements and under applicable State and local laws, to provide services to meet the needs of eligible children; and</text></subclause><subclause id="id2d67b34a135c4754b86ba3235f774a0a"><enum>(III)</enum><text>existing resources available to the eligible child care providers or networks of such providers to train and support employees for eligible child care providers; and</text></subclause></clause></subparagraph><subparagraph id="id4b68d3bb20ce489e8bcf58caab170f63"><enum>(B)</enum><text>may authorize the Secretaries of the military departments to establish partnerships in communities near military installations with military child development centers or other existing early childcare programs of the Department of Defense, including the Military Child Care in Your Neighborhood program. </text></subparagraph></paragraph></subsection><subsection id="id19c77108e3d34e69ba84d0d3cb62c7e2"><enum>(c)</enum><header>Authorized functions</header><text>In carrying out the pilot program required by subsection (a), the Secretary may—</text><paragraph commented="no" display-inline="no-display-inline" id="id75496c70912941bc902e5b25d14d8c97"><enum>(1)</enum><text display-inline="yes-display-inline">direct the Secretaries of the military departments—</text><subparagraph id="id327105adcc6347758d7447b2f49b46d0"><enum>(A)</enum><text>to identify gaps between existing early child care needs and available eligible child care providers in communities where such Secretaries are considering establishing the pilot program; </text></subparagraph><subparagraph id="idc87d799d6061417bb0ec60186196ee7c"><enum>(B)</enum><text>to use resources of the Department of Defense to support eligible child care providers in recruitment and retention of employees, including through professional development and financial incentives for such employees; and</text></subparagraph><subparagraph id="id96b200c1ea5143e39be080955497f191"><enum>(C)</enum><text>to seek to enter into an interagency partnership with a Federal agency with the ability to place national service participants and volunteers trained in education services, including senior volunteer programs, at military child development centers, including such a center at an installation selected for a partnership under subsection (b)(3), in accordance with applicable national service laws and with all the benefits accorded to such participants and volunteers; and</text></subparagraph></paragraph><paragraph id="idec303bfcb11b48858f0df34107cb457a"><enum>(2)</enum><text>provide training and resource subsidies to eligible child care providers and networks of such providers participating in partnerships established under subsection (b). </text></paragraph></subsection><subsection id="id68af599ddfea459a9f5d66982b8b5328"><enum>(d)</enum><header>Assurance of not reducing early child care availability for nonmilitary families</header><paragraph commented="no" display-inline="no-display-inline" id="idf9eed4aab0244f0892d9c343c69faa7d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As a condition of entering into a partnership under subsection (a), an eligible child care provider or network of such providers participating in a partnership established under subsection (b) is required to provide assurances that the provider or network will not—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd7cbfa82056844dabb6edece32ceb2fd"><enum>(A)</enum><text display-inline="yes-display-inline">reduce early child care slots for nonmilitary families after entering into the partnership; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8291b777baea46ab949fe9b7359aca7c"><enum>(B)</enum><text display-inline="yes-display-inline">enter into the construction of new child care facilities.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id240f4305f783491cb769625348bea7e6"><enum>(2)</enum><header>Assessments</header><text>Not later than 180 days after the pilot program commences under paragraph (1)(A) of subsection (h), and every 180 days thereafter until the pilot program terminates under that subsection, the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id31f9c5d5714c47daabbcac239cd2a702"><enum>(A)</enum><text display-inline="yes-display-inline">assess whether each eligible child care provider or network of such providers with which the Secretary of a military department entered into a partnership under subsection (b)—</text><clause commented="no" display-inline="no-display-inline" id="id9627d8d5827540b580a3f768795aae4f"><enum>(i)</enum><text display-inline="yes-display-inline">is providing the assurances required by paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9f737fa7dcda4652b706467508d300e1"><enum>(ii)</enum><text>has not reduced early child care slots for nonmilitary families; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb1eed4896f4e434598de0c6a3dcabdac"><enum>(B)</enum><text>if the Secretary determines that the provider or network of providers is not providing such assurances or has reduced such slots—</text><clause commented="no" display-inline="no-display-inline" id="id5abf66e7d2c8496f9f23b5d84ca7d0af"><enum>(i)</enum><text display-inline="yes-display-inline">notify the provider or network that the provider or network has 90 days to restore the slots; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6fe63ca398ca436888130a4353d72e6e"><enum>(ii)</enum><text>if the provider or network does not restore the slots during that 90-day period, terminate the partnership.</text></clause></subparagraph></paragraph></subsection><subsection id="id6beac9be6c5e4de3b8224aaf88eaa025" commented="no"><enum>(e)</enum><header>Location of pilot program</header><text>The Secretary shall direct the Secretaries of the military departments to ensure that, pursuant to a partnership entered into under the pilot program required by subsection (a), the program is administered at or near the site of the eligible child care provider or network of such providers with which the Secretary entered into the partnership at or near a military installation.</text></subsection><subsection id="id03974cd41da1400b9460be7080a55f6c"><enum>(f)</enum><header>Administration</header><text>Not later than 30 days after the date of the enactment of this Act, the Secretary shall direct the Secretaries of the military departments to develop one centralized administrative system to carry out the pilot program required by subsection (a), which may include information on—</text><paragraph id="id1a9fcd35b9344541b038355ca00d5514"><enum>(1)</enum><text>available military child development centers at military installations at which partnerships are established under the pilot program;</text></paragraph><paragraph id="id41bee43f9d484deeb289fb0536d08639"><enum>(2)</enum><text>the number of early child care education slots available or needed at such installations;</text></paragraph><paragraph id="id4d4cda9e9d3440a1886adee929e7d37c"><enum>(3)</enum><text>the fees and costs associated for parents participating in the pilot program; and </text></paragraph><paragraph id="idd0b250a62a594424b274daae21cd5a85"><enum>(4)</enum><text>other relevant administration and technical assistance matters.</text></paragraph></subsection><subsection id="id0e2acad5e36e4b838716f734308fa45f"><enum>(g)</enum><header>Reporting requirements</header><paragraph id="id18d2e09776f749c4bf06ecea29d8ef66"><enum>(1)</enum><header>Briefings by secretary of defense</header><subparagraph id="id2175522d619f4e72a1d9ead365f960d2"><enum>(A)</enum><header>Initial briefing</header><text>Not later than 180 days after the pilot program required by subsection (a) commences under subsection (h)(1)(A), the Secretary shall direct the Secretaries of the military departments to provide a briefing to the appropriate committees of Congress on the implementation of the pilot program, including—</text><clause id="idfc3a92691f92468e94a16ff8b32c489b"><enum>(i)</enum><text>the demonstrated need for eligible child care providers in the locations of the pilot program, including—</text><subclause commented="no" display-inline="no-display-inline" id="id34dd80c739af462e90c715abc6cd1c26"><enum>(I)</enum><text display-inline="yes-display-inline">the number of such providers present at the start of the pilot program relative to the number of eligible children requiring care; and</text></subclause><subclause id="id3d01b8aff15e48fb891f2a0f76a06b95"><enum>(II)</enum><text>data on children served through the pilot program, disaggregated by criteria such as—</text><item id="idafc6f50fe2b4405a8dc08c456c594ad7"><enum>(aa)</enum><text>the number of infants and toddlers served;</text></item><item id="id7b8947cbef744a52941dc31e5286fa78"><enum>(bb)</enum><text>providers offering early child care during nontraditional or extended hours;</text></item><item id="idbdb056fb59214f4da48470dc132ad33f"><enum>(cc)</enum><text>early child care in rural communities; and</text></item><item id="idf60749ad05b047408a93ca93175f9f2c"><enum>(dd)</enum><text>inclusive early child care services for children with disabilities;</text></item></subclause></clause><clause id="id4be5392d55db402d9d137e1f72001ea9"><enum>(ii)</enum><text>the change in the number of eligible child care providers as a result of the pilot program;</text></clause><clause id="idddfe274241aa433387215b2b9913dd4e"><enum>(iii)</enum><text>the change in early child care education capacity for members of the Armed Forces and their families and an assessment of unmet need for such education;</text></clause><clause id="id303f7faba4d94980812513ba1cdf21d5"><enum>(iv)</enum><text>an assessment of the efficacy of the pilot program; and</text></clause><clause id="ide0a5204645144d5d820855e53f0a4207"><enum>(v)</enum><text>an assessment of the impact of the pilot program on early child care availability in communities in which the pilot program is operating, including the impact of the pilot program on—</text><subclause commented="no" display-inline="no-display-inline" id="ideddbb0b56c9f4bd2beffdcffc051da30"><enum>(I)</enum><text display-inline="yes-display-inline">eligible child care providers operating before the commencement of the pilot program; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb52cc9ac758e49dd87fb188e95d58ce1"><enum>(II)</enum><text display-inline="yes-display-inline">the number of early child care slots available to nonmilitary families, compared to the number of such slots available before the commencement of the pilot program.</text></subclause></clause></subparagraph><subparagraph id="id6ba383d58c604e82aa3b2aba166787bf"><enum>(B)</enum><header>Annual briefings on progress</header><text>Not later than one year after the pilot program required by subsection (a) commences under subsection (h)(1)(A), and annually thereafter until the termination of the pilot program under subsection (h), the Secretary shall direct the Secretaries of the military departments to provide a briefing to the appropriate committees of Congress on the progress of the pilot program.</text></subparagraph></paragraph><paragraph id="id0ec8e0bc6d5a4d99b71e5b538636da4e"><enum>(2)</enum><header>Final report by secretary of defense</header><text>Not later than 120 days after the termination under subsection (h) of the pilot program required by subsection (a), the Secretary shall direct the Secretaries of the military departments to submit to the appropriate committees of Congress a final report on the pilot program.</text></paragraph><paragraph id="id5cd7d08ac80f4fdba0f24298917e0824"><enum>(3)</enum><header>Reports by government accountability office</header><subparagraph id="idc68f5c40ceb7402994d27c2e9bd3004f"><enum>(A)</enum><header>Progress report</header><text>Not later than 4 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the appropriate committees of Congress an interim report on the progress of the pilot program required by subsection (a).</text></subparagraph><subparagraph id="id1201b832abcf40eabdb90835c423d5dd"><enum>(B)</enum><header>Final report</header><text>Not later than 120 days after the termination under subsection (h) of the pilot program required by subsection (a), the Comptroller General shall submit to the appropriate committees of Congress a final report on the pilot program.</text></subparagraph></paragraph></subsection><subsection id="id4339adc79248424eb8b9205db21fbafb"><enum>(h)</enum><header>Duration of pilot program</header><paragraph id="id44307269c22b433f95ba3fc90b7af28c"><enum>(1)</enum><header>In general</header><text>The pilot program required by subsection (a) shall—</text><subparagraph id="id5035f8e6bab54d6291ed432fd672b5ab"><enum>(A)</enum><text>commence not later than January 1, 2026; and</text></subparagraph><subparagraph id="id465d9186e1f54686b4ab0e4664745398"><enum>(B)</enum><text>unless extended in accordance with paragraph (2), terminate on December 31, 2030.</text></subparagraph></paragraph><paragraph id="id581cbb36f9cf44fca82d5129994462ac"><enum>(2)</enum><header>Extension</header><text>The Secretary may direct the Secretaries of the military departments to extend the pilot program required by subsection (a) to terminate not later than December 31, 2032, if the Secretary notifies the appropriate committees of Congress not later than June 30, 2030, of the intention of the Secretary to extend the pilot program, along with a description of the benefits of extending the pilot program.</text></paragraph></subsection><subsection id="id19ebc7ec90c941a6987089f4dcfbd6cd"><enum>(i)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idf8dc8fbbc1b7470c82c95bb5454ebfc2"><enum>(1)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id67c160de9f524932b7b226842131fe14"><enum>(A)</enum><text>the Committee on Armed Services of the Senate; and</text></subparagraph><subparagraph id="id1ac2e7e8aeaa40889e3fd9c6dab70f3c"><enum>(B)</enum><text>the Committee on Armed Services of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id22e104af0445463896ccd0f4e14ceeef"><enum>(2)</enum><header>Child care employee</header><text>The term <term>child care employee</term> has the meaning given that term in section 1800 of title 10, United States Code. </text></paragraph><paragraph id="idebec8f3b47744bbba77a6ca33e4961ef"><enum>(3)</enum><header>Eligible child</header><text>The term <term>eligible child</term> means—</text><subparagraph id="id7c9af8d501974442a2c7bad54de60aed"><enum>(A)</enum><text>an infant or toddler;</text></subparagraph><subparagraph id="id60bb67cf649148d7a76349b0b1e81ca3"><enum>(B)</enum><text>a three- or four-year-old; or</text></subparagraph><subparagraph id="idfbf0fc4cc9674583abd176336169ee99"><enum>(C)</enum><text>a school-aged child.</text></subparagraph></paragraph><paragraph id="idde71b04c2d55474c942760f31b51b614"><enum>(4)</enum><header>Eligible child care provider</header><text>The term <term>eligible child care provider</term> has the meaning given that term in section 658P of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858n">42 U.S.C. 9858n</external-xref>). </text></paragraph><paragraph id="idc9d50631b9d64f63904502fc532186cf"><enum>(5)</enum><header>Military child development center</header><text>The term <term>military child development center</term> has the meaning given that term in section 1800 of title 10, United States Code.</text></paragraph></subsection></section></legis-body></bill>
