which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To strengthen Federal efforts to counter antisemitism in the United States.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Countering Antisemitism Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id761f8a3fd2b84795a79e1814c520425a"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="iddfcd5873efb74bb1842701f5a85742fe"><enum>(1)</enum><text>Antisemitism, which is often called <quote>the oldest hatred</quote>, is a serious and growing danger for Jews in the United States and around the world.</text></paragraph><paragraph id="iddecb4bb2ec4247c4975b2af4b5908d6d"><enum>(2)</enum><text>In 2022, the Federal Bureau of Investigation found that anti-Jewish hate crime incidents increased by more than 37 percent from 2021 to 2022.</text></paragraph><paragraph id="id163ecf7a0f0f4dd88e964b5499923548"><enum>(3)</enum><text>In 2022, the Anti-Defamation League reported nearly 3,700 antisemitic incidents in the United States, including assault, vandalism, and harassment, which is a 36-percent increase from 2021 and represents the highest number on record of antisemitic incidents reported by the Anti-Defamation League, and the American Jewish Committee reported that 25 percent of Jewish Americans were personally targeted by antisemitism in 2023.</text></paragraph><paragraph id="idb0e5a422467541b9b22b5bf23a840c81"><enum>(4)</enum><text>Jewish Americans are facing an unprecedented rise in antisemitic incidents following the October 7, 2023, Hamas terrorist attacks on Israel.</text></paragraph><paragraph id="id13c2d27be746417b98229f260bd83912"><enum>(5)</enum><text>Rising antisemitism is in part being driven by the spread and amplification of antisemitic comments, tropes, and conspiracies on social media platforms, which can lead to physical acts of harassment, assault, and vandalism.</text></paragraph><paragraph id="id6917fe18ba6845f7946425f2b45ee8f9"><enum>(6)</enum><text>Holocaust denial and distortion, including intentional efforts to excuse or minimize the impact of the Holocaust, dishonor Holocaust victims and survivors, and reinforce the need for advancing accurate and comprehensive Holocaust education globally.</text></paragraph><paragraph id="id27bf89ae2a414a8db1293e718ff25a29"><enum>(7)</enum><text>Protecting the history of the Holocaust and recognizing and confronting Holocaust denial and distortion are critical to preventing antisemitism.</text></paragraph><paragraph id="id9fb5761052f14756b3b85f307a009ba6"><enum>(8)</enum><text>Jewish houses of worship are increasingly the targets of violent attacks in the United States, as evidenced by the deadly assaults on synagogues in Pittsburgh, Pennsylvania, in 2018 and Poway, California, in 2019.</text></paragraph><paragraph id="idbef19858eed246f4b9747c21c0af4d70"><enum>(9)</enum><text>Antisemitic incidents have increased dramatically in many educational settings over the past several years, with many Jewish students facing discrimination or a hostile environment at schools, yet these incidents remain underreported.</text></paragraph><paragraph id="id28be05aebb0a4e1d926a0ce45aab7e0e"><enum>(10)</enum><text>The Department of Education’s Office for Civil Rights is tasked with ensuring that all students are protected on campus, yet there is a backlog of discrimination complaints that remain pending before the Office for Civil Rights.</text></paragraph><paragraph id="id3ff3c23f4c7b464a83e157e937bbb065"><enum>(11)</enum><text>On May 25, 2023, the Biden Administration issued the U.S. National Strategy to Counter Antisemitism, which outlines the Administration’s whole-of-society approach to tackle antisemitism and includes actions for Federal agencies to take and calls to action for Congress.</text></paragraph><paragraph id="idf15d53b11ee849fcb20451dace3d47bd"><enum>(12)</enum><text>Antisemitism can have unique characteristics, including the evolving use of conspiracy theories that blame the various ills of society on Jews or attribute to individual Jews a variety of evil and harmful characteristics, and including the portrayal of Jews as too powerful or controlling and deserving of hatred and mistrust. Antisemitism can also exist when individual Jews are held responsible for the policies of the Israeli government, or attacked, disparaged, or demonized based on their real or perceived connection to, affiliation with, or support for, the state of Israel as a Jewish state. Antisemitism can manifest distinctively and require a tailored response.</text></paragraph><paragraph id="ide3214551a4994b51be94560c6f4d4c58"><enum>(13)</enum><text>While antisemitism most directly and intensely threatens Jewish Americans, it also undermines democracy and threatens the safety and rights of all Americans.</text></paragraph></section><section id="id477d9ccce5f24daf967e93b386ad031f"><enum>3.</enum><header>Statement of policy and sense of Congress</header><subsection commented="no" display-inline="no-display-inline" id="ide78622f52dd044d8ba0245817428c54b"><enum>(a)</enum><header display-inline="yes-display-inline">Statement of policy</header><text display-inline="yes-display-inline">It is the policy of the United States to—</text><paragraph id="id9d6751fe136f4700a5d6941ea15e18b8"><enum>(1)</enum><text>raise awareness and educate the United States public about the history of Jewish Americans and antisemitism in all of its forms and various manifestations;</text></paragraph><paragraph id="id408ca3ec4f7f40a1a89cabd7a7445680"><enum>(2)</enum><text>use all available authorities to oppose antisemitism; and</text></paragraph><paragraph id="id2d2dc62515dd4ad1806417edab74b9d7"><enum>(3)</enum><text>ensure that the implementation of Federal Government strategies to counter antisemitism are ongoing and multi-year whole-of-government and whole-of-society efforts, including through close and consistent collaboration between the Federal Government, the private sector, civil society, faith leaders, and community leaders.</text></paragraph></subsection><subsection id="id052a05fc443541ee9c177f4deb887da4"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the non-legally binding working definition of antisemitism adopted in 2016 by the 31 member states of the International Holocaust Remembrance Alliance, a definition which the United States has embraced—</text><paragraph id="id149c89b33fa84b53add337e3ee4bc8ca"><enum>(1)</enum><text>is a valuable tool to raise awareness and increase understanding of antisemitism; and</text></paragraph><paragraph id="id4c7769c6daa142a9ad28c4af4e60db21"><enum>(2)</enum><text>should be utilized by Federal, State, and local agencies. </text></paragraph></subsection></section><section id="id81f4a2b82f714c378ed56d25db9a5743"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this section</text><paragraph commented="no" display-inline="no-display-inline" id="id7f2d091eb9674022b409c9aa16db31e1"><enum>(1)</enum><header>Antisemitism</header><text display-inline="yes-display-inline">The term <term>antisemitism</term> has the meaning given the term in section 3 of the Never Again Education Act (<external-xref legal-doc="usc" parsable-cite="usc/36/2301">36 U.S.C. 2301</external-xref> note).</text></paragraph><paragraph id="idfcfdac1b26624a7d9139746dbb628066"><enum>(2)</enum><header>Relevant agency</header><text>The term <term>relevant agency</term> means—</text><subparagraph id="id8ab257ea093340bcb635a1fd34089664"><enum>(A)</enum><text>the Domestic Policy Council;</text></subparagraph><subparagraph id="id00be6628ccb44dec9e6f272fac44b66a"><enum>(B)</enum><text>the Department of State;</text></subparagraph><subparagraph id="id56329f66ac944f03a3fddc7e01fe017b"><enum>(C)</enum><text>the Office of the Special Envoy to Monitor and Combat Antisemitism of the Department of State;</text></subparagraph><subparagraph id="idd91b392769e14a8e8968f62d22b7df10"><enum>(D)</enum><text>the Department of Homeland Security;</text></subparagraph><subparagraph id="idb84aca742e3c4a859db6c27616bec9f6"><enum>(E)</enum><text>the Department of Justice;</text></subparagraph><subparagraph id="id077bafce55f8490d866956ef2325e6cf"><enum>(F)</enum><text>the Federal Bureau of Investigation;</text></subparagraph><subparagraph id="id11c9c00f060e40f587a3ac696ef689be"><enum>(G)</enum><text>the Department of Education;</text></subparagraph><subparagraph id="id28386ff2003c4d3ead6f0f1f3cf0bb36"><enum>(H)</enum><text>the National Counterterrorism Center;</text></subparagraph><subparagraph id="idd810af71b6c04b1e9c133630794d6e3e"><enum>(I)</enum><text>the United States Holocaust Memorial Museum;</text></subparagraph><subparagraph id="id8a321a82d42b40ad963454626e31cb5d"><enum>(J)</enum><text>the Department of Health and Human Services;</text></subparagraph><subparagraph id="ide9afe8ad03e544d0873cd246ad4bb817"><enum>(K)</enum><text>the Equal Employment Opportunity Commission;</text></subparagraph><subparagraph id="id55fbd564c47f4fed8ea763a192a0048d"><enum>(L)</enum><text>the Small Business Administration;</text></subparagraph><subparagraph id="id40975a4fc02f4aa1b41f194f19c385c7"><enum>(M)</enum><text>the Department of Housing and Urban Development;</text></subparagraph><subparagraph id="ide96714e788284e53b172d7957389982e"><enum>(N)</enum><text>the Department of Transportation;</text></subparagraph><subparagraph id="iddef4e3ed6abb4646aba8a0d404a7ccb7"><enum>(O)</enum><text>the Department of Agriculture;</text></subparagraph><subparagraph id="id12674b3594a5479ebbf98c953cad0474"><enum>(P)</enum><text>the Corporation for National and Community Service;</text></subparagraph><subparagraph id="id25f8d903f70a4a2681c24050006cf17e"><enum>(Q)</enum><text>the National Endowment for the Arts;</text></subparagraph><subparagraph id="iddd7da44511e24275aeaa09bfa308e28c"><enum>(R)</enum><text>the National Endowment for the Humanities;</text></subparagraph><subparagraph id="id55b486116663451c8d026f1811835d76"><enum>(S)</enum><text>the Department of the Interior;</text></subparagraph><subparagraph id="id41c43ce55ba54141918f522bd4df6fc2"><enum>(T)</enum><text>the Department of Veterans Affairs;</text></subparagraph><subparagraph id="ida52bf685f45147868480fc5ddaa8598d"><enum>(U)</enum><text>the Department of Defense;</text></subparagraph><subparagraph id="id2746b470e1be4a9bb756fb612f3a982c"><enum>(V)</enum><text>the Department of the Treasury;</text></subparagraph><subparagraph id="idb5bcb993f4a044dcad7bd1c714581647"><enum>(W)</enum><text>the Office of the Director of National Intelligence;</text></subparagraph><subparagraph id="id2cf56b2dbdde49d1a4bf81960faf1286"><enum>(X)</enum><text>the Institute of Museum and Library Services;</text></subparagraph><subparagraph id="idec047696fc1a484ea9219a19f9051eaf"><enum>(Y)</enum><text>the Office of Personnel Management;</text></subparagraph><subparagraph id="ideba9cac06edc476e9277151035b1c489"><enum>(Z)</enum><text>the United States Mission to the United Nations;</text></subparagraph><subparagraph id="id4940ff6d07704ad8803736ccf9febea0"><enum>(AA)</enum><text>the General Services Administration;</text></subparagraph><subparagraph id="id5f35c934bb6943d09694143782962b2b"><enum>(BB)</enum><text>the Department of Commerce;</text></subparagraph><subparagraph id="id3bfe2ff1f2004286b1e9523ef2aa6726"><enum>(CC)</enum><text>the Department of Labor;</text></subparagraph><subparagraph id="id16d9b77ca1554bd8a9ab3209406e8b43"><enum>(DD)</enum><text>the National Science Foundation; </text></subparagraph><subparagraph id="id0df0980ca946429cabaa7dd3bb17ea2e"><enum>(EE)</enum><text>the Smithsonian Institution; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfe14f9f20fd044a2b7f81a33b034f4c6"><enum>(FF)</enum><text>the Office of Faith-Based and Neighborhood Partnerships of the White House.</text></subparagraph></paragraph><paragraph id="id388836dbc88644e28df7e241ba5f85f6"><enum>(3)</enum><header>U.S. National Strategy to Counter Antisemitism</header><text>The term <term>U.S. National Strategy to Counter Antisemitism</term> means the document entitled <quote>U.S. National Strategy to Counter Antisemitism</quote> issued by the White House on May 25, 2023. </text></paragraph></section><section id="id7e63533b7133456ca2746bc4ac000b2b"><enum>5.</enum><header>National Coordinator to Counter Antisemitism</header><subsection id="idf50b9b559c814336b3fc62eb97e4522f"><enum>(a)</enum><header>Establishment</header><text>There is established within the Executive Office of the President the position of National Coordinator to Counter Antisemitism (in this section referred to as the <quote>National Coordinator</quote>). The individual serving in the position of National Coordinator shall not have, or be assigned, duties in addition to the duties of the position of National Coordinator.</text></subsection><subsection id="id9bda74d3701a49c7a9a11261b30676c2"><enum>(b)</enum><header>Duties of the National Coordinator</header><text>Subject to the authority, direction, and control of the President, the National Coordinator shall—</text><paragraph id="id6d1fdb83b96e46e88400cac3b0f2972d"><enum>(1)</enum><text>serve as the principal advisor to the President on countering domestic antisemitism;</text></paragraph><paragraph id="id5d3d29ffb1e4475b8da14df11882ba7e"><enum>(2)</enum><text>coordinate Federal efforts to counter antisemitism, including ongoing and multi-year implementation of Federal Government strategies to counter antisemitism, across the relevant agencies;</text></paragraph><paragraph id="id42ccd0cad1b14fbe813de424a15d4fb0"><enum>(3)</enum><text>conduct a biennial review of the implementation of Federal Government strategies to counter antisemitism for a period of 10 years, including—</text><subparagraph id="idc0365d1075584cba968afd818e52f0e6"><enum>(A)</enum><text>an evaluation of all actions that have been implemented; and</text></subparagraph><subparagraph id="id349f14ea007a4510b0e3265d6b4d6fd3"><enum>(B)</enum><text>recommendations for any updates to those actions, as necessary; and</text></subparagraph></paragraph><paragraph id="id87c488ae4e734b698751bbedcf93b0a2"><enum>(4)</enum><text>review the internal and external antisemitism training and resource programs of the relevant agencies and ensure that such programs include training and resources to assist relevant agencies in understanding, deterring, and educating people about antisemitism.</text></paragraph></subsection></section><section id="idfffe14e0c2314cae9dfc5a60b9db2608"><enum>6.</enum><header>Interagency Task Force to Counter Antisemitism</header><subsection id="idf3dd6038ae9b4e119e5fc3b5d08370f6"><enum>(a)</enum><header>Establishment</header><text>The President shall establish an Interagency Task Force to Counter Antisemitism.</text></subsection><subsection id="id0015f9e9c0fd45fb874c4ae019d20399"><enum>(b)</enum><header>Appointment</header><text>The President shall appoint the members of the Task Force, which shall include representatives from the relevant agencies.</text></subsection><subsection id="ideace130dea3a49e68c0b135aa226c7a8"><enum>(c)</enum><header>Chair</header><text>The National Coordinator established in section 5(a) shall be the Chair of the Task Force.</text></subsection><subsection id="idcf1b8435b1194712909b7bcf98e53cf4"><enum>(d)</enum><header>Activities of the Task Force</header><text>The Task Force shall carry out each of the following activities:</text><paragraph id="idddc50ff2ecec4fdca0ebbde03137afff"><enum>(1)</enum><text>Coordinate implementation of Federal Government strategies to counter antisemitism.</text></paragraph><paragraph id="ide9a6148f8f3244e9a34b146118e057ab"><enum>(2)</enum><text>Measure and evaluate the progress of the United States in the areas of—</text><subparagraph id="id03c6cde97d794f71b92d8e2b7eaf1a0a"><enum>(A)</enum><text>providing education about antisemitism;</text></subparagraph><subparagraph id="id79eb4041d77a41fb8fb9dfcfa99c09d0"><enum>(B)</enum><text>countering antisemitism; and</text></subparagraph><subparagraph id="idb048e365421f47438a6b82d50d31f9da"><enum>(C)</enum><text>providing support, protection, and assistance to individuals and communities targeted by antisemitism.</text></subparagraph></paragraph><paragraph id="idcc078bc1a16c445681fac69633a9d08a"><enum>(3)</enum><text>Create and implement interagency procedures for collecting and organizing data, including research results and resource information from relevant agencies and researchers, on domestic antisemitism, while—</text><subparagraph id="id1a60f8a9113c48659e9c2ea09040d945"><enum>(A)</enum><text>respecting the confidentiality of individuals targeted by antisemitism; and</text></subparagraph><subparagraph id="id51291b682aa44331a66fabd68201afc9"><enum>(B)</enum><text>complying with any Federal, State, or local laws affecting confidentiality, such as laws applying to court cases involving juveniles.</text></subparagraph></paragraph><paragraph id="id7fe79fea4a3f48108813305a1c648cc3"><enum>(4)</enum><text>Measure and evaluate the use of the Nonprofit Security Grant Program of the Department of Homeland Security established under section 2009 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/609a">6 U.S.C. 609a</external-xref>) to secure Jewish nonprofit organizations that are at high risk of terrorist attack.</text></paragraph><paragraph id="id81c146c5d9234fde8bfc5a579fb9f3d4"><enum>(5)</enum><text>Engage in consultation with Congress, nonprofit organizations, and Jewish community advocacy organizations, among other entities, to advance the purposes of this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc24c6bbdde434b6aa0843d4fe134a689"><enum>(e)</enum><header>Activities of the Chair</header><text>Not later than 6 months after the date of enactment of this Act, and every 6 months thereafter until the date that is 10 years after the date of enactment of this Act, the Chair of the Task Force shall provide a briefing on the activities of the Task Force to—</text><paragraph commented="no" display-inline="no-display-inline" id="idd0294bab3db941878080b319fbe5220e"><enum>(1)</enum><text display-inline="yes-display-inline">the majority leader and minority leader of the Senate; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id97cb694f56ea4a80a9df1ce0334835c1"><enum>(2)</enum><text>the Speaker and minority leader of the House of Representatives.</text></paragraph></subsection></section><section id="id49c00e7e7251460c8bf573beac2d324b"><enum>7.</enum><header>Reports on implementation of U.S. National Strategy to Counter Antisemitism</header><subsection id="id55d1b8433ec54b6eb76d3aff0379386b"><enum>(a)</enum><header>Reports from relevant agencies</header><text>Not later than 90 days after the date of enactment of this Act, the head of each relevant agency, in coordination with the National Coordinator to Counter Antisemitism, shall submit to Congress and make publicly available a report detailing how the relevant agency is implementing the U.S. National Strategy to Counter Antisemitism, which report shall include each of the following:</text><paragraph id="id91e8a06b1ec64c2b91a99b56204239b6"><enum>(1)</enum><text>Detailed descriptions of any programs, activities, or policies established to carry out the strategy.</text></paragraph><paragraph id="idfc69e09bdc4c4badba1ce5a8842532d3"><enum>(2)</enum><text>Identification of the obstacles to implementation.</text></paragraph><paragraph id="id115e10683d304b50bce85fa7d13d186f"><enum>(3)</enum><text>Opportunities for improved coordination, during the implementation, with other relevant agencies, State and local authorities, civil society, community and faith leaders, the private sector, and individual citizens, as relevant.</text></paragraph></subsection><subsection id="idd128eae393d142f99b70b6946fba421a"><enum>(b)</enum><header>Annual threat assessment</header><paragraph id="id9055b72d48a84760bdc91ed1210b4e25"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, and annually thereafter until the date that is 10 years after the date of enactment of this Act, the Director of the Federal Bureau of Investigation, the Secretary of Homeland Security, and the Director of the National Counterterrorism Center, in coordination with the National Coordinator to Counter Antisemitism, shall jointly produce an annual threat assessment of antisemitic violent extremism.</text></paragraph><paragraph id="iddf656a183e024ed4b408b02232c51274"><enum>(2)</enum><header>Contents</header><text>Each threat assessment required under paragraph (1) shall include, for the period covered by the report—</text><subparagraph id="idb86eb16a1be64d4c9e4ec6db3bb9dc9f"><enum>(A)</enum><text>an overview of transnational violent extremist ideologies that include antisemitic components, including international and domestic extremism;</text></subparagraph><subparagraph id="ide292de28c33c44e08b4662b6b9945088"><enum>(B)</enum><text>a review of the violence committed on behalf of the ideologies described in subparagraph (A), including—</text><clause commented="no" display-inline="no-display-inline" id="ide1547a2f5ed4449386f43078175e90b0"><enum>(i)</enum><text display-inline="yes-display-inline">violent acts committed with explicit antisemitic sentiment;</text></clause><clause id="id25fde4dad55848e5bbe3ae90ad3554b9"><enum>(ii)</enum><text>an overview of propaganda facilitating the spread of those ideologies, including an in-depth assessment of the antisemitic components of the propaganda; and</text></clause><clause id="id858aa8af771443bbb8ac2cc653846a44"><enum>(iii)</enum><text>the commonalities of the threat across several different violent extremist ideologies;</text></clause></subparagraph><subparagraph id="idd3308308f26b4260bb50f4c19697bf1d"><enum>(C)</enum><text>an assessment of the threat that antisemitic violence described in subparagraphs (A) and (B) poses to the United States homeland, United States citizens abroad, and United States military personnel; and</text></subparagraph><subparagraph id="id27cd442dca3b4f6da01ce11ca471e83a"><enum>(D)</enum><text>an overview of how antisemitic violent threats impact the interests and the global standing of the United States.</text></subparagraph></paragraph><paragraph id="idc2e99147b7b64a94a0558b3cd6b4d511"><enum>(3)</enum><header>Dissemination</header><subparagraph id="ide63d8cbbc4e14b4489884f09091ea5e3"><enum>(A)</enum><header>In general</header><text>The Director of the Federal Bureau of Investigation, the Secretary of Homeland Security, and the Director of the National Counterterrorism Center, in coordination with the National Coordinator to Counter Antisemitism, shall submit each threat assessment required under paragraph (1), including any classified annexes, to—</text><clause id="id1c5f069599f541929ee23c6a3326f871"><enum>(i)</enum><text>the Committee on Armed Services of the Senate;</text></clause><clause id="id2280eceb55154805a6462b045a750565"><enum>(ii)</enum><text>the Select Committee on Intelligence of the Senate;</text></clause><clause id="id87fea58ade6b42a0b252ee7d2c74b638"><enum>(iii)</enum><text>the Committee on the Judiciary of the Senate;</text></clause><clause id="id83230cd1c1014ff8a20c4c24a4529b05"><enum>(iv)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></clause><clause id="id07eb7152784e48b798aa5c405ac618f9"><enum>(v)</enum><text>the Committee on Appropriations of the Senate;</text></clause><clause id="id8c1404ba53c64a92ae893a6c5441853f"><enum>(vi)</enum><text>the Committee on Armed Services of the House of Representatives;</text></clause><clause id="id3f42aa0fc5e74340b387fbfffd8555d4"><enum>(vii)</enum><text>the Permanent Select Committee on Intelligence of the House of Representatives;</text></clause><clause id="id5cd7fba16fec4793ae8b246c43a4a01c"><enum>(viii)</enum><text>the Committee on the Judiciary of the House of Representatives;</text></clause><clause id="id97fbf717da664d29bfbde4f63effe12a"><enum>(ix)</enum><text>the Committee on Homeland Security of the House of Representatives; and</text></clause><clause id="id7611fe2ef2524772a6103bbe1d496428"><enum>(x)</enum><text>the Committee on Appropriations of the House of Representatives. </text></clause></subparagraph><subparagraph id="idaeaaf6fbe8b04683ac01c1f793f27496"><enum>(B)</enum><header>Declassified version</header><text>The Director of the Federal Bureau of Investigation shall make publicly available a declassified version of each threat assessment required under paragraph (1) on the public website of the Federal Bureau of Investigation concurrently with the version submitted under subparagraph (A).</text></subparagraph></paragraph><paragraph id="idfb006ae4e22a4f5d946e44d885af9ded" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Limitation</header><text>No version of the threat assessment required under paragraph (1) shall include personally identifiable information.</text></paragraph></subsection></section><section id="id824e673240044b24b7efaf4954acadf8"><enum>8.</enum><header>Online antisemitism, holocaust denial, and distortion</header><subsection id="id8e5870cc0c5d4466ac575673df139aa5"><enum>(a)</enum><header>Study</header><text>In order to assess steps to counter the spread of antisemitism online, not later than 180 days after the date of enactment of this Act, and every year thereafter for a period of 10 years, the National Coordinator to Counter Antisemitism, in conjunction with the Interagency Task Force to Counter Antisemitism, shall conduct a study and prepare a report that shall include each of the following: </text><paragraph id="idc530f9f037a14fd9b9ecf4de40f21975"><enum>(1)</enum><text>An analysis of the prevalence of online antisemitic content, including Holocaust denial and Holocaust distortion content.</text></paragraph><paragraph id="idbbbef53fc81e4c28837881152e7acb36"><enum>(2)</enum><text>Recommendations to Congress to counter the spread of antisemitism online, including options for greater transparency requirements relating to algorithmic systems, content moderation, enforcement of community standards, accountability for individuals, and accountability for online platforms.</text></paragraph></subsection><subsection id="id578a51c05a384dc99857d5e1153b0a57"><enum>(b)</enum><header>Report</header><text>The National Coordinator to Counter Antisemitism shall make the report available to the Committee on Commerce, Science, and Transportation of the Senate, the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Energy and Commerce of the House of Representatives, and the Committee on Oversight and Accountability of the House of Representatives.</text></subsection></section><section id="ideea22ff08b0d4c1cbdd356feab6c792b"><enum>9.</enum><header>Countering antisemitic discrimination in higher education</header><subsection commented="no" display-inline="no-display-inline" id="id694125f014d840b7a99359d7c899d266"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section: </text><paragraph commented="no" display-inline="no-display-inline" id="id8fdce9b864d349559654b9c6b63640d8"><enum>(1)</enum><header display-inline="yes-display-inline">Covered institution</header><text>The term <term>covered institution</term> means a college, university, or other postsecondary institution, or a public system of higher education that receives Federal funds.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc2455cdca8cf476f96afef0fa8fd402d"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text></paragraph></subsection><subsection id="ida9a5b7c6e3174e45851c2dd7311f3fba"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Department of Education should expeditiously issue a proposed rule pursuant to Executive Order 13899 (84 Fed. Reg. 68779; relating to Combating Anti-Semitism).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf6f1dc04260145beb6ed74761830b7f8"><enum>(c)</enum><header display-inline="yes-display-inline">OCR Designee</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall designate a senior officer or senior employee of the Office for Civil Rights (in this section referred to as the <quote>Designee</quote>). The Designee shall—</text><paragraph id="idb8e91c3a39a4459692fac0f5c73d5993"><enum>(1)</enum><text>serve as the Secretary's primary advisor on the Department of Education's efforts to counter antisemitic discrimination at covered institutions;</text></paragraph><paragraph id="id30a2d51e83b54835a448507e6a2f566e"><enum>(2)</enum><text>oversee the Department of Education's efforts to increase awareness of antisemitic discrimination at covered institutions, including by proactively providing information to students at covered institutions about how to file complaints of discrimination with the Department of Education;</text></paragraph><paragraph id="id1de92b8c755b4028bab93398e796be0c"><enum>(3)</enum><text>remind covered institutions of their legal responsibility under title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>) to provide all students, including those who are or are perceived to be Jewish or Israeli, a school environment free from discrimination based on race, color, or national origin, including shared ancestry or ethnic characteristics;</text></paragraph><paragraph id="id57a3464c8b7c47c6a59791dba932bf8d" commented="no"><enum>(4)</enum><text>ensure that students at covered institutions who have experienced discrimination based on national origin (including shared ancestry or ethnic characteristics) and desire to file a complaint of discrimination with the Department of Education have the information and resources to do so; and</text></paragraph><paragraph id="id6f59cae088c74dd384f0e5f3d1818cb3"><enum>(5)</enum><text>make recommendations to the Secretary on the Department of Education's efforts to counter antisemitic discrimination in higher education.</text></paragraph></subsection><subsection id="idec19b196529d43ad8db82e064314f73b"><enum>(d)</enum><header>Reporting</header><paragraph id="idec33cbd8f59f42ad86437fdd5c48b85a" commented="no"><enum>(1)</enum><header>In General</header><text>Beginning not later than 180 days after the date of enactment of this Act and every year thereafter for a period of 10 years, the Designee shall submit a report to Congress containing information about each complaint received by the Office for Civil Rights of the Department of Education that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idee6e4fa8e4f54aae9a428640ab3639b3"><enum>(A)</enum><text display-inline="yes-display-inline">concerns discrimination under title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>) on the basis of national origin (including shared ancestry or ethnic characteristics) at a covered institution; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91d2b21312314b20a97b1983a790f2ff"><enum>(B)</enum><text>is outstanding as of the date of completion of the report and was received 6 months before such date or earlier.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18897116f49748a6bc65d6fd8ac898e6"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each report described in paragraph (1) shall include—</text><subparagraph commented="no" display-inline="no-display-inline" id="id44f010e156d24e05ad561878ad5d6b15"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to each complaint, the status of the complaint, including—</text><clause id="id994d73b1b07f45b687041b0c81722f88" commented="no"><enum>(i)</enum><text>the reasons the complaint has not been resolved; and</text></clause><clause id="id521e55cefe6b453394e6eee70fce29ae" commented="no"><enum>(ii)</enum><text>an estimated timeframe for the resolution of the complaint; and </text></clause></subparagraph><subparagraph id="id818e582c89634668bdcdf393b3f3fe10" commented="no"><enum>(B)</enum><text>the Designee’s activities to—</text><clause commented="no" display-inline="no-display-inline" id="id4c6817fc130f4b96984dc6c25de0e25a"><enum>(i)</enum><text display-inline="yes-display-inline">increase awareness of antisemitic discrimination at covered institutions; and </text></clause><clause commented="no" display-inline="no-display-inline" id="idaa30c754e3ac41399a590f6a6165fa6b"><enum>(ii)</enum><text display-inline="yes-display-inline">provide information to students at covered institutions on how to file complaints of discrimination with the Department of Education.</text></clause></subparagraph></paragraph><paragraph id="id77afd35ef6fb494bb2395127d5b815f4" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Availability</header><text>Each report described in paragraph (1) shall be made available to the National Coordinator to Counter Antisemitism and the Interagency Task Force to Counter Antisemitism. </text></paragraph></subsection></section><section id="id9dcd2b2a8204450e9c3ee0c7108ef341"><enum>10.</enum><header>Holocaust education and antisemitism lessons</header><subsection id="id33623a759c754c7aba852f84daf5cb17"><enum>(a)</enum><header>Study</header><text>Beginning not later than 180 days after the date of enactment of this Act, the Director of the United States Holocaust Memorial Museum (referred to in this Act as the <quote>USHMM Director</quote>) shall conduct a study on Holocaust education efforts in States, local educational agencies, and public elementary schools and secondary schools. Such study shall include an examination of—</text><paragraph id="ide8cad53581c74dc7922292a42587920a"><enum>(1)</enum><text>all States;</text></paragraph><paragraph id="id202b42b295d9406cbf209a810b45630c"><enum>(2)</enum><text>a nationally representative sample of local educational agencies; and</text></paragraph><paragraph id="id357da8bbd9744ed0a74d0827b56f45d6"><enum>(3)</enum><text>a representative sample of public elementary schools and secondary schools served by the local educational agencies being studied.</text></paragraph></subsection><subsection id="idd519f8e0c18340b4a7f2d2c6caeb9508"><enum>(b)</enum><header>Elements</header><text>In conducting the study under subsection (a), the USHMM Director shall—</text><paragraph id="id1336ef18f70c4f0dadf603701f6e54cc"><enum>(1)</enum><text>determine whether States and local educational agencies being studied require Holocaust education as part of the curriculum taught in public elementary schools and secondary schools;</text></paragraph><paragraph id="iddd7b7f875f3840228bd4b1dd02b91010"><enum>(2)</enum><text>identify States and local educational agencies being studied that have optional Holocaust education as part of the curriculum taught in public elementary schools and secondary schools;</text></paragraph><paragraph id="id63c96a9afa834b5a8519ad3c4456ae9c"><enum>(3)</enum><text>identify each State’s standards and the requirements of the local educational agencies being studied relating to Holocaust education and summarize the status of the implementation of such standards and requirements, including—</text><subparagraph id="id7fceddab8c33461aa987c26e7760fba7"><enum>(A)</enum><text>any centralized apparatus at the State or local level that collects and disseminates Holocaust education curricula and materials;</text></subparagraph><subparagraph id="id7d6ee8e1f1724c18bc57a59b685f1f68"><enum>(B)</enum><text>any Holocaust education professional development opportunities for pre-service and in-service educators;</text></subparagraph><subparagraph id="idcf48291cdd3644319dbab165699ea39e"><enum>(C)</enum><text>the involvement of informal educational organizations in implementing Holocaust education, including museums and cultural centers;</text></subparagraph><subparagraph id="id2fc5b478bf284ffcab72af666ce42419"><enum>(D)</enum><text>an assessment of the challenges or gaps that may prevent educators from fulfilling Holocaust education requirements;</text></subparagraph><subparagraph id="id4a73232c1bf44ff99710ffa0eea9ff2a"><enum>(E)</enum><text>the identification of training and resources needed to support educators teaching about the Holocaust; and</text></subparagraph><subparagraph id="id5ea63ecd78df463cac31235614b1f011"><enum>(F)</enum><text>the adoption of United States Holocaust Memorial Museum resources by—</text><clause id="id6c369a7fdcde44889c96aa7b1f8c31db"><enum>(i)</enum><text>entities at the State or local level that disseminate Holocaust education curricula; or</text></clause><clause id="id43f3b3101a9b450c92611dd463892bc4"><enum>(ii)</enum><text>local Holocaust museums and centers;</text></clause></subparagraph></paragraph><paragraph id="iddb7a5d7bb70943d5bcd17e22a57d8348"><enum>(4)</enum><text>determine—</text><subparagraph id="id5efdc0756b894a5781650460708bfa25"><enum>(A)</enum><text>the range of intended outcomes from a Holocaust education unit at the State and local educational agency level; and</text></subparagraph><subparagraph id="id44dd086a9c824d2d9660a8c181084c9d"><enum>(B)</enum><text>the methods educators are using that result in successfully achieving intended learning outcomes, which may include—</text><clause id="idc3df60fcbd374b0abd4f1e6b8b66756c"><enum>(i)</enum><text>in-class discussion;</text></clause><clause id="idc434cf92eae94f8a969c7cd68771a9ca"><enum>(ii)</enum><text>educational activities conducted outside the classroom, including homework assignments and experiential learning involving State and local organizations, such as museums and cultural centers;</text></clause><clause id="idd531d9187581445faf81bccd81118f33"><enum>(iii)</enum><text>project-based learning;</text></clause><clause id="idbe87475fdfd54d9d96ec52984d2b3e3c"><enum>(iv)</enum><text>educational materials and activities that are developmentally appropriate and taught through a trauma-informed lens; and</text></clause><clause id="id2cb4918963ea467f8c03bb6641407a22"><enum>(v)</enum><text>integration of lessons from the Holocaust across the curriculum and throughout the school year;</text></clause></subparagraph></paragraph><paragraph id="idb2d33b0171334d19b752a38d8dbaa3b9"><enum>(5)</enum><text>identify the types of instructional materials used to teach students about the Holocaust, including the use of primary source material;</text></paragraph><paragraph id="id100e448bb94d4359bcfb6b6e033f9351"><enum>(6)</enum><text>identify—</text><subparagraph id="idc94354a9aadd4c36b7c0be218a3c5b43"><enum>(A)</enum><text>in what disciplines the Holocaust is being taught;</text></subparagraph><subparagraph id="id77085e16ea1240359f106f5c9afb9e6f"><enum>(B)</enum><text>the amount of time allotted in the required curriculum to teach about the Holocaust; and</text></subparagraph><subparagraph id="idaf0b8ed0c48b4203a752137450570c82"><enum>(C)</enum><text>the comprehensiveness of the Holocaust education curriculum taught in public elementary schools and secondary schools, as indicated by the extent to which the curriculum addresses all elements and aspects of the Holocaust and is based on reliable educational resources, such as resources provided by the United States Holocaust Memorial Museum; and</text></subparagraph></paragraph><paragraph id="id1ba1a816ee9d44df94762dc716d72a50"><enum>(7)</enum><text>identify the approaches used by public elementary schools and secondary schools to assess outcomes using traditional and nontraditional assessments, including assessments of—</text><subparagraph id="id067a79db57d04af0877a7ff88171574f"><enum>(A)</enum><text>students’ knowledge of the Holocaust; and</text></subparagraph><subparagraph id="ida3e908bd046947b3b6feb95e4b571842"><enum>(B)</enum><text>students’ ability to identify and analyze antisemitism, bigotry, hate, and genocide in historical and contemporary contexts.</text></subparagraph></paragraph></subsection><subsection id="idbba1d8a9f20b449d92c0e86cda4023cb"><enum>(c)</enum><header>Report</header><paragraph id="idb60586dd69564974a2bd5e38bc147c28"><enum>(1)</enum><header>In general</header><text>Following the completion of the study under subsection (a), the USHMM Director shall prepare and submit to Congress a report on the results of the study.</text></paragraph><paragraph id="id06dc5ec4e787412fa466ff32087d4965"><enum>(2)</enum><header>Deadline for submittal</header><text>The report under paragraph (1) shall be submitted not later than the earlier of—</text><subparagraph id="idb2a976a89af24b89aed41978752e07de"><enum>(A)</enum><text>180 days after the completion of the study under subsection (a); or</text></subparagraph><subparagraph id="id034e8e6f87024fa0ac1fa2cb8cf4291f"><enum>(B)</enum><text>3 years after the date of enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="id99ae2e22701544129e733ec62a540cb5"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idd51ed08637094e00be2ff61b6b188113"><enum>(1)</enum><header>ESEA terms</header><text>The terms <term>elementary school</term>, <term>local educational agency</term>, <term>secondary school</term>, and <term>State</term> have the meanings given those terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="id8cb83af944cb4b4db5955103e548e338"><enum>(2)</enum><header>Holocaust</header><text>The term <term>Holocaust</term> has the meaning given that term in section 3 of the Never Again Education Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/141">Public Law 116–141</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/36/2301">36 U.S.C. 2301</external-xref> note).</text></paragraph><paragraph id="id939c8efad4b7473fa3fa03da88b64514"><enum>(3)</enum><header>Holocaust education</header><text>The term <term>Holocaust education</term> means educational activities that are specifically intended—</text><subparagraph id="iddd97d2844e5a4c59b0cdbf30030b8901"><enum>(A)</enum><text>to improve students’ awareness and understanding of the Holocaust;</text></subparagraph><subparagraph id="id0eb6ad93e74d43e18635be04bb425996"><enum>(B)</enum><text>to educate students on the lessons of the Holocaust as a means to raise awareness about the importance of preventing genocide, hate, and bigotry against any group of people; and</text></subparagraph><subparagraph id="idb4cfba87c50e4820b62d9c148e0fa6b5"><enum>(C)</enum><text>to study the history of antisemitism, its deep historical roots, the use of conspiracy theories and propaganda that target the Jewish people, and the shapeshifting nature of antisemitism over time.</text></subparagraph></paragraph><paragraph id="id791da1c39a30417780284301e09305db" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Project-based learning</header><text>The term <term>project<added-phrase>-</added-phrase>based learning</term> means a teaching method through which students learn by actively engaging in real-world and personally meaningful projects.</text></paragraph></subsection></section><section id="idDEB81D65E90F497BAD2F9B4E0F2B4387"><enum>11.</enum><header>Nonprofit security grant program</header><text display-inline="no-display-inline">Section 2009 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/609a">6 U.S.C. 609a</external-xref>) is amended—</text><paragraph id="id3B54CF381D6742AB9DD4873306DCD695"><enum>(1)</enum><text>by redesignating subsection (i) as subsection (k); and</text></paragraph><paragraph id="id77A446A1820C47F6A6E5414B94025ABE"><enum>(2)</enum><text>by inserting after subsection (h) the following:</text><quoted-block id="id906686B12C934DB9A9CAFF37C02C7999" display-inline="no-display-inline" style="OLC"><subsection id="idCF6565CFECE642E4853C166D009353AE"><enum>(i)</enum><header>Sufficient personnel and resources</header><text>The Administrator shall ensure that the Federal Emergency Management Agency has sufficient personnel and resources to carry out this section.</text></subsection><subsection id="id77FBF9D52BFC416B992047F3864F5A0E"><enum>(j)</enum><header>Publicly available information</header><text>Not later than 1 year after the date of enactment of this subsection, and annually thereafter, the Administrator shall make publicly available information relating to, with respect to the previous fiscal year—</text><paragraph id="id6537360461F84D4EB90EE1038B6A17D3"><enum>(1)</enum><text>the number of applications received for a grant under this section;</text></paragraph><paragraph id="idD74F7E57CBC644B3B1A0318BE3CDC9FB" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the number of grants awarded under this section;
