which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Export Enforcement Coordination Center in the Department of Homeland Security, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Export Controls Enforcement Improvement Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id5aebc2b699434ea4ae02df4fd5b136de"><enum>2.</enum><header display-inline="yes-display-inline">Establishment of Export Enforcement Coordination Center</header><subsection id="id4d0e8ec9dbd54ae6b4383362d248f2ea"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall establish, within the Department of Homeland Security for administrative purposes, an interagency Federal Export Enforcement Coordination Center (in this Act referred to as the <quote>Center</quote>).</text></subsection><subsection id="idfd4bacea150f42938603cd0497dd8bc2"><enum>(b)</enum><header>Purposes</header><text>The Center shall coordinate on matters relating to export enforcement among the following:</text><paragraph id="idae303562de8b4c0686753a42a31657b0"><enum>(1)</enum><text>The Department of State.</text></paragraph><paragraph id="id703bbaeec65c41ffabae59e212a0c503"><enum>(2)</enum><text>The Department of the Treasury.</text></paragraph><paragraph id="idb46ba78d47ed4cc1b19fc8f227dc5fa4"><enum>(3)</enum><text>The Department of Defense.</text></paragraph><paragraph id="id0fd57de1f21b40d887b61aa0080d42ab"><enum>(4)</enum><text>The Department of Justice.</text></paragraph><paragraph id="id73caee65801f4aa586562313d4b6e4c8"><enum>(5)</enum><text>The Department of Commerce.</text></paragraph><paragraph id="idb0a807f84aeb47ea8575fb31bd430b59"><enum>(6)</enum><text>The Department of Energy.</text></paragraph><paragraph id="id35c1dd26a4a2487db3c112789bb828af"><enum>(7)</enum><text>The Department of Homeland Security.</text></paragraph><paragraph id="id43bff903e3514da68ee98002da08263d"><enum>(8)</enum><text>The Office of the Director of National Intelligence.</text></paragraph><paragraph id="id60a7843099d94086ac85ff83a465de17"><enum>(9)</enum><text>Such other executive branch departments, agencies, or offices as the President, from time to time, may designate.</text></paragraph></subsection><subsection id="idc6e1370b3e25454fb59ab47f59b3bd33"><enum>(c)</enum><header>Functions</header><text display-inline="yes-display-inline">The Center shall—</text><paragraph id="id45c6c89bf88c4014a1603b3053d7a7d3"><enum>(1)</enum><text>serve as the primary forum within the Federal Government for executive departments and agencies—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6dea76a714534fabb6f369bbe440dc40"><enum>(A)</enum><text display-inline="yes-display-inline">to coordinate and enhance the export control enforcement efforts of those departments and agencies; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc60fc7f228364909a1b32f82a5b15199"><enum>(B)</enum><text display-inline="yes-display-inline">to identify and resolve conflicts that have not been otherwise resolved in criminal and administrative investigations and actions involving violations of the export control laws of the United States;</text></subparagraph></paragraph><paragraph id="idc032c9d19d224429b65bb5f6a3aa002c"><enum>(2)</enum><text>serve as a conduit between Federal law enforcement agencies and the intelligence community (as defined in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003(4)</external-xref>)) for the exchange of information related to potential violations of United States export controls;</text></paragraph><paragraph id="idb54457ef2e144f7d97b3144d751a6d68"><enum>(3)</enum><text>serve as a primary point of contact between enforcement authorities and agencies engaged in export licensing;</text></paragraph><paragraph id="idb75da95184bd4d8893832411c130247a"><enum>(4)</enum><text>coordinate law enforcement public outreach activities related to United States export controls; and</text></paragraph><paragraph id="id2fc91f008c0a4cfea5293492137bf620" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text>establish governmentwide statistical tracking capabilities for United States criminal and administrative export control enforcement activities, to be conducted by the Department of Homeland Security with information provided by and shared with all relevant departments and agencies participating in the Center. </text></paragraph></subsection><subsection id="id57d2415a83d34f3d8ea03a2943281642"><enum>(d)</enum><header>Director; other personnel</header><paragraph commented="no" display-inline="no-display-inline" id="id9c281979f6034d8fafff30ea2951732e"><enum>(1)</enum><header>Director</header><subparagraph commented="no" display-inline="no-display-inline" id="idcd2c51685e044e89bed7b426d739ad61"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Center shall have a Director, who shall be a full-time senior officer or employee of the Department of Homeland Security, designated by the Secretary of Homeland Security. </text></subparagraph><subparagraph id="idd1affeb5cc6947188c5a5bede5e99823"><enum>(B)</enum><header>Functions of Director</header><text>The Director shall—</text><clause commented="no" display-inline="no-display-inline" id="idce9c45eb67e34c6389760e598f80a7cb"><enum>(i)</enum><text display-inline="yes-display-inline">convene and preside at meetings of the Center;</text></clause><clause commented="no" display-inline="no-display-inline" id="id13b6fd13551a41d99e7f89c28c515b8b"><enum>(ii)</enum><text display-inline="yes-display-inline">determine the agenda for those meetings; </text></clause><clause commented="no" display-inline="no-display-inline" id="id324102b5eeb74cd3be7e42eed1eccef4"><enum>(iii)</enum><text display-inline="yes-display-inline">direct the work of the Center; and</text></clause><clause id="id36a655f019ab4673acc5ed71f584987e" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">as appropriate to particular subject matters, organize and coordinate subgroups of the members of the Center. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide890b6e41b8f41569e2552c0afcfc46e"><enum>(2)</enum><header>Deputy Directors</header><text display-inline="yes-display-inline">The Center shall have 2 Deputy Directors, who shall be full-time senior officers or employees of the Department of Commerce and the Department of Justice, designated by the Secretary of Commerce and the Attorney General, respectively, detailed to the Center and reporting to the Director. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a9303e0a2c84910beecb6afcdd9c3de"><enum>(3)</enum><header>Intelligence community liaison</header><text display-inline="yes-display-inline">The Center shall have an Intelligence Community Liaison, who shall be a full-time senior officer or employee of the Federal Government, designated by the Director of National Intelligence, and detailed or assigned to the Center.</text></paragraph><paragraph id="iddde7ace1092047a9a797b67e2e40c711"><enum>(4)</enum><header>Staff</header><subparagraph commented="no" display-inline="no-display-inline" id="ide9c48131476e4a4081ff63ba4fd2a808"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Center shall have a full-time staff reporting to the Director. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfcc68755753640879049100ce3e049aa"><enum>(B)</enum><header>Detailees</header><text display-inline="yes-display-inline">Executive departments and agencies specified in subsection (b) shall detail or assign their employees to the Center.</text></subparagraph></paragraph></subsection><subsection id="idb9fe69e59555489da7266b4ad41abbad"><enum>(e)</enum><header>Administration</header><text display-inline="yes-display-inline">The Department of Homeland Security shall operate and provide funding and administrative support for the Center to the extent permitted by law and subject to the availability of appropriations.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id17f0a210be294880806737aca9ef0a5f"><enum>(f)</enum><header>Website</header><text>The Director of the Center may establish a publicly accessible website for the Center with a domain name that is independent of websites of the Department of Homeland Security.</text></subsection></section><section id="id2d6a4b53777a4e23b1daad6381d48deb"><enum>3.</enum><header>Unlawful transshipment and diversion of exports</header><subsection id="ide99db78217ef4fc098765a149c220f53"><enum>(a)</enum><header>In general</header><text>The Center shall—</text><paragraph id="id1396d60528054c768d9edf7993506b35"><enum>(1)</enum><text>serve as a primary forum for the coordination of export control enforcement efforts focused on unlawful transshipment and diversion of exports; and</text></paragraph><paragraph id="id6059acace9f3421a8f8f10340861f32c"><enum>(2)</enum><text>develop best practices for executive departments and agencies to improve efforts to combat the unlawful transshipment and diversion of exports.</text></paragraph></subsection><subsection id="idc38e2237dedc42f1af8d1d3e0c01f283"><enum>(b)</enum><header>Areas of focus</header><text>In carrying out the duties described in subsection (a), the Center shall focus its efforts on, among other matters—</text><paragraph id="iddc6aa902ea96446cb93ecd6c42cb183a"><enum>(1)</enum><text>sensitive technologies, including technologies relating to—</text><subparagraph id="id46a07250b4174e97a7feb90838a3e44c"><enum>(A)</enum><text>semiconductors; </text></subparagraph><subparagraph id="id141509a4d1aa4d0eab2d888ff316d75c"><enum>(B)</enum><text>the development of advanced artificial intelligence capabilities; and</text></subparagraph><subparagraph id="id12fb5c205de04038a2bf98f4b4ee0303"><enum>(C)</enum><text>the development of quantum technology components and capabilities; and </text></subparagraph></paragraph><paragraph id="ida3ac7190140044469617ab4c3bec295e"><enum>(2)</enum><text>the unlawful transshipment and diversion of exports to— </text><subparagraph id="id28161f74287f4be78ad37f325b7946bf"><enum>(A)</enum><text>the People’s Republic of China;</text></subparagraph><subparagraph id="id17832dcae4f24b99b2e6ccdcfb8410e2"><enum>(B)</enum><text>the Russian Federation;</text></subparagraph><subparagraph id="idae23620d04ce499f97a8c9417929a256"><enum>(C)</enum><text>the Islamic Republic of Iran; and</text></subparagraph><subparagraph id="id80d86bee3b22496d886032b0991fb910"><enum>(D)</enum><text>the Democratic People’s Republic of Korea. </text></subparagraph></paragraph></subsection><subsection id="id899dd07c2f3642c8bfb45f83f64e2044"><enum>(c)</enum><header>Notice to the private sector</header><text>In carrying out the duties described in subsection (a), the Center shall develop best practices for and support the dissemination of specific and actionable information about transshipment and diversion risks to relevant private sector entities on a timely basis, as appropriate.</text></subsection></section><section id="idd4427df2aee44c1a895bf5dcec10f338"><enum>4.</enum><header>Reports on postings of United States and foreign law enforcement officials</header><subsection id="ida62bb9283a514b3b86d9f4001ac5bb6b"><enum>(a)</enum><header>Report on foreign postings of law enforcement agents</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of the Center shall submit to Congress a report that includes—</text><paragraph id="id7a736852ab6b4f5d93b39517d334ee0d"><enum>(1)</enum><text>an assessment of the value of increasing the number of law enforcement officials posted in foreign countries to enhance export control enforcement efforts focused on the unlawful transshipment and diversion of exports;</text></paragraph><paragraph id="id07d89943296f48c0a9c6cb64109bff86"><enum>(2)</enum><text>an analysis of specific countries, regions, and shipping routes that pose a heightened risk with respect to such transshipment and diversion; and</text></paragraph><paragraph id="id28ad6a3360424e368b32ef44fcacece1"><enum>(3)</enum><text>an assessment of resources required to increase the number of law enforcement officials posted in foreign countries pursuant to paragraph (1).</text></paragraph></subsection><subsection id="id6badffe2ef3c4e6185a687158dbc19cd"><enum>(b)</enum><header>Report on postings of foreign officials at the center</header><text>Not later than one year after the date of the enactment of this Act, the Director of the Center shall submit to Congress a report that includes—</text><paragraph id="id17928855bb5c45318dafe2a7863c9622"><enum>(1)</enum><text>an assessment of the value of hosting foreign law enforcement or other officials at the Center;</text></paragraph><paragraph id="id5a218e0bd560469aba1d015efdaeb3e6"><enum>(2)</enum><text>an assessment of which countries would provide the most value for the United States Government in posting officials at the Center; and</text></paragraph><paragraph id="id65324670b1e3470c865cd7c24f12bf86"><enum>(3)</enum><text>an assessment of what, if any, changes to statute, regulation, or policy would be required to host foreign officials at the Center. </text></paragraph></subsection></section><section id="idb853d38cc0694354ab8837be3b70ac65"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Secretary of Homeland Security for fiscal year 2025 $25,000,000 for the costs of establishing the Center.</text></section></legis-body></bill>
