which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act to modify the definition of <quote>small refinery</quote> for purposes of the Renewable Fuel Program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Energy in Rural America Act</short-title></quote>.</text></section><section id="id2FB2BDE58C16498FB551F782AD3F4EB4"><enum>2.</enum><header>Small refineries under the Clean Air Act</header><subsection commented="no" display-inline="no-display-inline" id="id5c53c630918e4bb286798c2253adf1fa"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of small refinery</header><text>Section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>) is amended by striking subparagraph (K) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id93E869FCC08345A6A68E653AEA7857EB"><subparagraph id="id22831B7D221A45E596F3EB1440818224"><enum>(K)</enum><header>Small refinery</header><text>The term <term>small refinery</term> means a refining company—</text><clause id="id6A48301B28314D928CDA05A4321C9641"><enum>(i)</enum><text>for which the average aggregate daily crude oil throughput for a calendar year (as determined by dividing the aggregate throughput for the calendar year by the number of days in the calendar year) produced by all refineries owned by that company, including any subsidiaries of that company, does not exceed 200,000 barrels; or</text></clause><clause id="id7451A3F78E7043B389363F19BB1F0A51"><enum>(ii)</enum><text>that employs not more than 1,500 employees.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idb45ab50cb77945ac8043fe6f54386f35"><enum>(b)</enum><header>Small refinery exemption</header><paragraph commented="no" display-inline="no-display-inline" id="id5cdcfb2f22f14367a08aa25fad84f4e5"><enum>(1)</enum><header display-inline="yes-display-inline">Methodology required</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Energy shall develop methodology to be used by the Administrator of the Environmental Protection Agency for purposes of evaluating petitions submitted under section 211(o)(9)(B)(i) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(9)(B)(i)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id47ff1b4c977a479a9ad3848d0721f65e"><enum>(2)</enum><header>CAA amendment</header><text display-inline="yes-display-inline">Section 211(o)(9)(B) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(9)(B)</external-xref>) is amended by striking clause (ii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2175E941A8704CA9B56165D4E9B6076D"><clause commented="no" display-inline="no-display-inline" id="idc227c6420bf54f9e9d32abbe4847102c"><enum>(ii)</enum><header>Evaluation of petitions</header><text>In evaluating a petition under clause (i), the Administrator shall—</text><subclause commented="no" display-inline="no-display-inline" id="idb8a5970c0f7f4d1b81cf91eed0b3687f"><enum>(I)</enum><text>use methodology developed and approved by the Secretary of Energy pursuant to section 2(b)(1) of the <short-title>Supporting Energy in Rural America Act</short-title>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1a8a1b966268487283155b5f51a1c5b8"><enum>(II)</enum><text>in consultation with the Secretary of Energy, consider—</text><item commented="no" display-inline="no-display-inline" id="ida096178d9e834398ba1dbc9165e0ea4b"><enum>(aa)</enum><text>the findings of the study under subparagraph (A)(ii); and </text></item><item commented="no" display-inline="no-display-inline" id="id166a052b58634239a853cb81a420b027"><enum>(bb)</enum><text display-inline="yes-display-inline">other economic factors.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
