which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for a pilot program to improve contracting outcomes, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Contracting Outcomes Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id9046d912234e40129858c0a3f528efe3"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph commented="no" display-inline="no-display-inline" id="idb51f7247b7b242dbb49a51c79d5867d0"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id83c7f9a0260f41fcb3672d9d6c14990e"><enum>(2)</enum><header>Chief Financial Officer Act Agency</header><text>The term <term>Chief Financial Officer Act Agency</term> means an agency listed in section 901(b) of title 31, United States Code.</text></paragraph><paragraph id="id511ca58912ec43948112c51fc9f22582"><enum>(3)</enum><header>Cost avoidance</header><text>The term <term>cost avoidance</term> refers to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb726d134cbec4231824682637dcf4a04"><enum>(A)</enum><text display-inline="yes-display-inline">reductions in the need for increased funding if present management practices continued;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8e63e00ce4d4ea78f24b95b66aed2b5"><enum>(B)</enum><text display-inline="yes-display-inline">unfunded requirements that were avoided; and</text></subparagraph><subparagraph id="idd1b6c7386c064c82a26b4507257767d5"><enum>(C)</enum><text>productivity gains, such as reduction in required labor hours, reduction in contract duplication, and use of shared contract programs. </text></subparagraph></paragraph><paragraph id="id5d1bdea55acd43a790c696769310410a"><enum>(4)</enum><header>Cost savings</header><text>The term <term>cost savings</term> means reductions to budget lines or funded programs resulting from a new policy, process, or activity with no adverse impact on mission.</text></paragraph><paragraph id="id09d31f3d0ae542ba80297a673a3c3e01"><enum>(5)</enum><header>End user</header><text>The term <term>end user</term> means the internal stakeholder that uses the product or service procured. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id109ef13c96a841e8b6f333a7eee4d0bb"><enum>(6)</enum><header>Head of contracting activity</header><text>The term <term>head of contracting activity</term> has the meaning given the term <quote>head of the contracting activity</quote> in section 2.101 of the Federal Acquisition Regulation. </text></paragraph><paragraph id="idecefb9fc9a1044b98c806b50e53562e3"><enum>(7)</enum><header>Military department</header><text>The term <term>military department</term> has the meaning given the term in section 101(a)(8) of title 10, United States Code.</text></paragraph><paragraph id="id06a3c1e3b4b24eaeb2818c740e5f8764"><enum>(8)</enum><header>Multiple award contract</header><text>The term <term>multiple award contract</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfb8495a8f22b4d6791c6e011ec77715a"><enum>(A)</enum><text display-inline="yes-display-inline">a contract that is entered into by the Administrator of General Services under the multiple award schedule program referred to in section 3012(3) of title 10, United States Code; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e65be9539174277a969eac5c8d6eef3"><enum>(B)</enum><text display-inline="yes-display-inline">a multiple award task order contract that is entered into under the authority of title 10 or title 41, United States Code.</text></subparagraph></paragraph><paragraph id="ida3a81d2689264f58b2b93581f526cf67"><enum>(9)</enum><header>Senior procurement executive</header><text>The term <term>senior procurement executive</term> has the meaning given the term in section 1702(c) of title 41, United States Code.</text></paragraph><paragraph id="id18cc8056fc8a4066b28cd3549b7a88d7"><enum>(10)</enum><header>Transactional data</header><text>The term <term>transactional data</term> refers to order details, including unit price, quantity, and line item descriptions. </text></paragraph></section><section id="id4d081ea84ebe4000935814c631f78442"><enum>3.</enum><header>Pilot program to improve contracting outcomes</header><subsection id="id7e9305f4d5024cf2bd5dc548bdbe417a"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Administrator for Federal Procurement Policy shall initiate a pilot program to improve contracting outcomes.</text></subsection><subsection id="id5a6cfce4d66b4c5d8dd782b23cd5ce02"><enum>(b)</enum><header>Purpose</header><text>The purpose of the pilot program is to identify and assess innovative approaches for establishing and using outcome-oriented contracting metrics, and the potential to establish and use outcome-oriented contracting metrics at each Chief Financial Officer Act Agency and military department.</text></subsection><subsection id="id498fa204c97b488d8141fdc489be62fc"><enum>(c)</enum><header>Key elements</header><text>The pilot program initiated pursuant to subsection (a) shall—</text><paragraph id="idc398fceb817a4dfca56b30966768127e"><enum>(1)</enum><text>comprise no less than three Chief Financial Officer Act Agencies, and at least one military department;</text></paragraph><paragraph id="id08214c53163e42f8a7fd4fcc76011826"><enum>(2)</enum><text>span a period of two years;</text></paragraph><paragraph id="id170bbdbdd10c482281eeb62ebecbe518"><enum>(3)</enum><text>demonstrate how senior procurement executives can establish quantitative outcome-oriented contracting metrics and corresponding goals—</text><subparagraph id="idde078fa0566d486a8f5722a9fc4e6419"><enum>(A)</enum><text>expressed on an annual basis;</text></subparagraph><subparagraph id="ida311a5fe8bf44df282739c65291e6698"><enum>(B)</enum><text>for each Head of Contracting Activity; and</text></subparagraph><subparagraph id="idb03ce49be43c4c0c9eedc5212deee76a"><enum>(C)</enum><text>representing, at a minimum—</text><clause id="idb47a1e842bab4f6e9a1accb826dbcfbe"><enum>(i)</enum><text>cost avoidance or cost savings;</text></clause><clause id="idfd57b75323d94f8e8e9492b70435b9a2"><enum>(ii)</enum><text>timeliness of deliveries in terms of end users’ receipt of a product or the start of a service;</text></clause><clause id="id446b0ed3fb7f4ab882230d911d117f07"><enum>(iii)</enum><text>quality of deliverables in terms of end users’ satisfaction with a delivered product or provided service; and</text></clause><clause id="ideac83d2239cf4b6f90312297d21a5f0c"><enum>(iv)</enum><text>end user satisfaction with the degree and nature of collaboration between the end user and the relevant procurement officials;</text></clause></subparagraph></paragraph><paragraph id="idd4444a2499914fca8b5e90673b4d6463"><enum>(4)</enum><text>illustrate how senior procurement executives can use the quantitative outcome-oriented contracting metrics and goals required under paragraph (3) to—</text><subparagraph id="idfc83fb180f584380862299b827798287"><enum>(A)</enum><text>assess the performance of procurement organizations on an ongoing basis;</text></subparagraph><subparagraph id="id1ccdd49cda5242e2b092aa32ec0ff502"><enum>(B)</enum><text>identify and share leading practices that Heads of Contracting Activity and other procurement officials can use to achieve desired contracting outcomes;</text></subparagraph><subparagraph id="id988927023a934369a361248ef15ebf88"><enum>(C)</enum><text>evaluate key factors affecting contracting outcomes, including—</text><clause id="idecab4bd7f82144baaab1662625e9d1d9"><enum>(i)</enum><text>collaboration with key stakeholders, particularly requirements generators, pre- and post-contract award; and</text></clause><clause id="id7a38d8607eb64a5399ff7bec0e389bf5"><enum>(ii)</enum><text>contractor performance; and</text></clause></subparagraph></paragraph><paragraph id="idf8945ee97c42412a9db7d801f05442c4"><enum>(5)</enum><text>assess the benefits and drawbacks of leveraging various data sources when establishing and using the outcome-oriented contracting metrics and goals required under paragraphs (3) and (4), respectively, including, at a minimum—</text><subparagraph id="id55a7dd517516476392f2e39ec1c8586e"><enum>(A)</enum><text>data stored in the Contractor Performance Assessment Reporting System; and</text></subparagraph><subparagraph id="idee675d1976b141fb908440b50cf4eb11"><enum>(B)</enum><text>transactional data for orders against multiple award contracts.</text></subparagraph></paragraph></subsection><subsection id="ida86856eae4c5440bb0906320d0ef0a6c"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed as precluding senior procurement executives from establishing or maintaining additional performance metrics and goals, in particular metrics and goals for small business utilization.</text></subsection></section><section id="id3928df9c03f4435299dbf1b5e751e984"><enum>4.</enum><header>Office of Federal Procurement Policy reporting</header><subsection id="idc264336159e4495fb4be9a928b3e3ae8"><enum>(a)</enum><header>Interim report</header><paragraph commented="no" display-inline="no-display-inline" id="id4136054285874471a4a828617e830657"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 2 years after the date of the enactment of this Act, the Administrator for Federal Procurement Policy shall submit to the appropriate congressional committees and the Comptroller General of the United States an interim report on the pilot program required under section 3.</text></paragraph><paragraph id="idb17a2d565ba64c8abe0a8aea9505bf79"><enum>(2)</enum><header>Purpose</header><text>The purpose of the interim report shall be to identify how each of the senior procurement executives participating in the pilot program are meeting the requirements under section 3(c).</text></paragraph><paragraph id="id3ef791bb3b244dd6b21c0ce94e1dba14"><enum>(3)</enum><header>Key elements</header><text>The interim report shall identify, at a minimum—</text><subparagraph id="id999faf02ee7f456cb3b46602fc5fb112"><enum>(A)</enum><text>each quantitative outcome-oriented contracting goal established pursuant to section 3(c)(3), including—</text><clause id="id67e5ce600926439eafae3aeb73f4f55b"><enum>(i)</enum><text>a precise definition that includes the methodology and data used to measure actual performance against the goal; and</text></clause><clause id="id254697a65405408fa3aab29b9387a1d7"><enum>(ii)</enum><text>the rationale for the goal;</text></clause></subparagraph><subparagraph id="id2f6b4f79a46947ff8c052919f5cb13fb"><enum>(B)</enum><text>illustrative examples of how each senior procurement executive has used quantitative outcome-oriented contracting metrics and goals to identify and share leading practices and key factors affecting contracting outcomes pursuant to section 3(c)(4); and</text></subparagraph><subparagraph id="id78a7929f182f4ced9709fed9644922fb"><enum>(C)</enum><text>data improvement initiatives, informed by the assessment required under section 3(c)(5), including a plan of action and milestones to improve the reliability of relevant data, including at a minimum—</text><clause id="idadd0428ed6f74259b85daeed04e22515"><enum>(i)</enum><text>data stored in the Contractor Performance Assessment Reporting System; and</text></clause><clause id="idb2817d1c631e4e6da9e9e3508477aaec"><enum>(ii)</enum><text>transactional data for orders against multiple award contracts.</text></clause></subparagraph></paragraph></subsection><subsection id="id671ad0803b92468faf1e9138a9dc3bf0"><enum>(b)</enum><header>Final report</header><paragraph commented="no" display-inline="no-display-inline" id="id1dc60aa6d0eb4a91afb10803c8f06794"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than three years after the date of the enactment of this Act, the Administrator for Federal Procurement Policy shall submit to the appropriate congressional committees and the Comptroller General of the United States a final report on the pilot program required under section 3.</text></paragraph><paragraph id="id4a70065169494c2aa1708e91599910f0"><enum>(2)</enum><header>Purpose</header><text>The purpose of the final report shall be to identify how each of the senior procurement executives participating in the pilot program met the requirements under section 3(c), and assess the potential to establish and use outcome-oriented contracting metrics and goals at each Chief Financial Officer Act Agency and military department in the future.</text></paragraph><paragraph id="id468897cbd64542009eeb3f58b60e940f"><enum>(3)</enum><header>Key elements</header><text>The final report shall identify, at a minimum—</text><subparagraph id="idc1d5dbcdb4314257ab762084cfb8fe19"><enum>(A)</enum><text>any modifications to the outcome-oriented metrics and goals established pursuant to section 3(c)(3) since the issuance of the interim report required under subsection (a), including—</text><clause id="id1abc1600e9a14578bd3ed06544a08181"><enum>(i)</enum><text>modifications to the definitions for the metrics and goals; and</text></clause><clause id="iddda35464d5704624b51e63aa6d85b337"><enum>(ii)</enum><text>the rationale for any modifications;</text></clause></subparagraph><subparagraph id="id0ee43c44a94b4cc9b708c7ce7136bed8"><enum>(B)</enum><text>examples of how each senior procurement executive has used outcome-oriented contracting metrics and goals to identify and share leading practices and key factors affecting contracting outcomes pursuant to section 3(c)(4) during the preceding year;</text></subparagraph><subparagraph id="idf2c8a81abfd14959a2d45a52d7642350"><enum>(C)</enum><text>a description of progress against the plan of action and milestones required under subsection (a)(3)(C), including qualitative descriptions of significant challenges and limitations hindering data improvement efforts; and</text></subparagraph><subparagraph id="id2c6b2f403b4a42abb4221d41175cb5ef"><enum>(D)</enum><text>observations from the Administrator for Federal Procurement Policy regarding the respective advantages and disadvantages of various approaches for establishing and using outcome-oriented contracting metrics and goals.</text></subparagraph></paragraph></subsection></section><section id="id720e996062ce431db985f2c45db43bc7"><enum>5.</enum><header>Government accountability office reporting</header><text display-inline="no-display-inline">Not later than 180 days after receiving the interim and final reports required under section 4, the Comptroller General of the United States shall provide the Comptroller General’s independent observations on the report to the appropriate congressional committees.</text></section></legis-body></bill>
