which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20241219" legis-day="20241216">December 19 (legislative day, December 16), 2024</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To amend title 5, United States Code, to make executive agency telework policies transparent, to track executive agency use of telework, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Telework Transparency Act of 2024</short-title></quote>.</text></section><section id="ida01abc02e59d4783b42e0f54835562eb" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Telework Policy Transparency and Tracking</header><subsection id="idc26a66f6f9674f34842dc4107bc43f94"><enum>(a)</enum><header>Monitoring executive agency telework policies and requiring transparency</header><paragraph id="id23081974b60f4ad3b9db2de476ff2991"><enum>(1)</enum><header>Telework eligibility policy</header><text>Section 6502(a)(1) of title 5, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7994e663247446c689c89712188a921a"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>Not later than 180 days after the date of enactment of this chapter, the</quote> and inserting <quote>The</quote>; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idccd7f4e6ffc74b95a8114c9c5590ff1d"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id15a98d7347a2451e8693f6b5ae87cb84"><enum>(C)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddb85ee32aeb84702bf94fa555a7baba1"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="idB7AAE192BD0B4CE8A85F030983E7DC92" style="OLC" act-name="" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subparagraph commented="no" display-inline="no-display-inline" id="id4305992d00cf4f8283a027ea986ff034"><enum>(D)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of enactment of this subparagraph, and as updates are made thereafter— </text><clause commented="no" display-inline="no-display-inline" id="id9f51d044e1614428a146330159adc5bd"><enum>(i)</enum><text display-inline="yes-display-inline">submit to the Director of the Office of Personnel Management a description of the policy established under subparagraph (A), or any successor policy; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id274cd56e79784fe79032df09adc1deb8"><enum>(ii)</enum><text display-inline="yes-display-inline">make publicly available on the website of the executive agency the most current version of the policy described in clause (i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id143b65f20af741958d340aa150f91e5e"><enum>(2)</enum><header>Training and monitoring</header><text>Section 6503 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6316413ebe1243f4b52c4048d2f36b05" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subsection id="id9669456d3d974130bb57ae7e1c4f5051"><enum>(c)</enum><header>Monitoring employee use of telework</header><paragraph id="idc70f38771740493db03e4b8d40d9f5e6"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>Shared Service Centers</term> has the meaning given the term in section 850.103 of title 5, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph id="ida68ae1617c7a4f86bdc7d3301e5a13d5"><enum>(2)</enum><header>Establishment of common data standards; data reporting requirements</header><text>Not later than 180 days after the date of enactment of this subsection, in part to aid in the collection of data for the purposes of satisfying the reporting requirements under section 6506, the Director of the Office of Personnel Management shall establish—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8a97ef627eee4e49a0c0ebedb9fe0caa"><enum>(A)</enum><text display-inline="yes-display-inline">executive agency telework data reporting requirements, including required timeframes for reporting;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida00ec2d22e804c83a0d6e4c7c6ef4d19"><enum>(B)</enum><text>data standards and protocols for tracking employee use of telework;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e04b84dfd0e4c9fab2e0cfbc5276507"><enum>(C)</enum><text>best practices and training for managers of employees who telework to review and verify the amount of a locality payment, as defined in section 531.602 of title 5, Code of Federal Regulations (or any successor regulation), paid to such an employee;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id13c0c5e573cd4add8329b67a115be93f"><enum>(D)</enum><text>internal controls for data quality with respect to the use of telework, including procedures to—</text><clause commented="no" display-inline="no-display-inline" id="idf2b2769a807f4b34857f4f9bed9d128e"><enum>(i)</enum><text display-inline="yes-display-inline">consistently monitor system-generated errors;</text></clause><clause commented="no" display-inline="no-display-inline" id="id17d85efc6e954c8b8e9b89abf8979e05"><enum>(ii)</enum><text>produce reports on adherence to data standards and edit rules; and</text></clause><clause id="ide9c949f0ebf84a7b9834c61ce72aa832"><enum>(iii)</enum><text>ensure prompt action to address issues identified in clauses (i) and (ii); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3519c982e6424d1597f94c44fd82a0c7"><enum>(E)</enum><text>mechanisms to provide regular feedback to executive agencies and Shared Service Centers on data quality with respect to telework, which shall include the provision of any human capital data needed to evaluate telework practices.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd2f829b2bac349ba9907672807422aaa"><enum>(3)</enum><header display-inline="yes-display-inline">Establishment of automated telework tracking systems within payroll systems</header><text>The head of each executive agency, in consultation (where applicable) with each Shared Service Center that provides payroll or human resources services to that executive agency, shall establish telework tracking within each payroll system that—</text><subparagraph id="id0a82688cd35343dabbff692280e62e2b"><enum>(A)</enum><text>is automated; and</text></subparagraph><subparagraph id="idde6704dfb6fb4450ab5756c446acbb6c"><enum>(B)</enum><text>conforms to— </text><clause commented="no" display-inline="no-display-inline" id="id3306d4bf03b2400b85b1a482813b024d"><enum>(i)</enum><text display-inline="yes-display-inline">the telework data standards and coding requirements issued by the Director of the Office of Personnel Management; and</text></clause><clause commented="no" display-inline="no-display-inline" id="iddce40094494d4a03a9259353a3ff23a1"><enum>(ii)</enum><text>the requirements established by the Director of the Office of Personnel Management under paragraph (2).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id114043e74ec04ce4a044312cc967a509"><enum>(4)</enum><header>Establishment of online tool</header><text>Not later than 2 years after the date of enactment of this subsection, the Director of the Office of Personnel Management shall establish and maintain a publicly available online tool that— </text><subparagraph commented="no" display-inline="no-display-inline" id="iddc5ad9d658204d8fafea3f160e5e5a6c"><enum>(A)</enum><text display-inline="yes-display-inline">makes available the data required to be reported under paragraph (2) in an appropriate and readable format;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id226bdaa1dab54289ab805c28b125bf96"><enum>(B)</enum><text display-inline="yes-display-inline">incorporates appropriate protections for personal and sensitive information; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e887ddf0d044afba9067c0a7949a271"><enum>(C)</enum><text display-inline="yes-display-inline">uses data visualization or other data presentation techniques to support strategic executive agency workforce planning and talent management objectives.</text></subparagraph></paragraph></subsection><subsection id="ided699595324848bb9e2d57d5e8ce1841"><enum>(d)</enum><header>Monitoring the effects of telework on office building space utilization and executive agency performance</header><text>The head of each executive agency shall—</text><paragraph id="id95437c76435641b9a91c1010c5ab6180"><enum>(1)</enum><text>establish a system to track office building space utilization rates that aligns with guidance and benchmarks issued by the Director of the Office of Management and Budget, in coordination with the Administrator of General Services and the Federal Real Property Council established by section 623(a) of title 40, under section 6504(b)(2)(A);</text></paragraph><paragraph id="id421bf135e4f1490085cff79028438375"><enum>(2)</enum><text>identify a set of indicators, and establish routines using the indicators, to assess and monitor the effects of telework policy on the performance of the executive agency, including, as applicable to the mission of the executive agency— </text><subparagraph commented="no" display-inline="no-display-inline" id="idd419445dcf334cf1ad375c574684e7cc"><enum>(A)</enum><text display-inline="yes-display-inline">indicators related to—</text><clause id="id954cd6715b3b495c981c239d01e1629c"><enum>(i)</enum><text>customer experience and service, including backlogs and wait times;</text></clause><clause id="idd2f6814db26d40668297357f594bff0f"><enum>(ii)</enum><text>security;</text></clause><clause id="id27395a19b0024a0180ce69a048e5d011"><enum>(iii)</enum><text>cost to operations;</text></clause><clause id="iddfd93f973d674d7395abc7c94f5ed318"><enum>(iv)</enum><text>the management of real property and personal property;</text></clause><clause id="id1bedf12294484174a3611ce7435d26a9"><enum>(v)</enum><text>investments in network capacity or communications infrastructure, including technology capabilities to improve efficiency and reduce the use of outdated technology; and</text></clause><clause id="id9f189a9b777741f69d332a2917edb8f4"><enum>(vi)</enum><text>the ability of the executive agency to recruit and retain top talent; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7422b917e99c4fd58951d7678580fac8"><enum>(B)</enum><text>any other indicator determined appropriate by the head of the executive agency, including as the result of policy and policy guidance provided under section 6504(b)(2)(B);</text></subparagraph></paragraph><paragraph id="idefd4a715a31946c19288f2d200cdcf34"><enum>(3)</enum><text>not later than 180 days after the date of enactment of this subsection, and as updates are made thereafter— </text><subparagraph commented="no" display-inline="no-display-inline" id="id043ad25225d94e54bd92613212ccac7b"><enum>(A)</enum><text display-inline="yes-display-inline">submit to the Director of the Office of Management and Budget and the Director of the Office of Personnel Management a description of the indicators and routines described in paragraph (2); and</text></subparagraph><subparagraph id="id4c65e8cb4ef041eba68203277366d9ce"><enum>(B)</enum><text>make publicly available on the website of the executive agency the most current version of the indicators and routines described in paragraph (2); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96416b1b264640088dfb1cd7ae4da12c"><enum>(4)</enum><text display-inline="yes-display-inline">with respect to the office building space utilization rates described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida068275b6ac343859277e169dcb55860"><enum>(A)</enum><text display-inline="yes-display-inline">include those rates in the budget justification materials (as defined in section 3(b)(2) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note)) of the executive agency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1e3a9dcb9490469caea7e6c8cdea5abe"><enum>(B)</enum><text display-inline="yes-display-inline">make those rates publicly available.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="ided2319f82f89421a88306de5e05a29f3"><enum>(3)</enum><header>Telework website</header><text>Section 6504(e)(2) of title 5, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id445c0149b7884dc1ae98ebed68d2a9c1"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>telework links</quote> and inserting the following: <quote>links to Government websites, including a compilation of links to executive agency websites with descriptions of telework policies and indicators and routines described in sections 6502(a)(1)(D) and 6503(d)(2), respectively</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idac8bfc3203ad473cba118bffe9cf6076"><enum>(B)</enum><text>in subparagraph (D)—</text><clause commented="no" display-inline="no-display-inline" id="idd8675f67018e4e6e82d73137fda328cf"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>, and the General Services Administration</quote> and inserting <quote>, the General Services Administration, and the Department of State</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id80f4870f41df494f87bae151cc9903bc"><enum>(ii)</enum><text>by striking <quote>10</quote> and inserting <quote>30</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="id476670d24be74da8a80c92e8012a6085"><enum>(b)</enum><header>Establishing benchmarks and providing guidance</header><text>Section 6504(b) of title 5, United States Code, is amended—</text><paragraph id="id85ec79adefc847689c22bc0218b86228"><enum>(1)</enum><text>in paragraph (3), by redesignating subparagraphs (A), (B), and (C) as clauses (i), (ii), and (iii), respectively, and adjusting the margins accordingly;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida9500b9a65eb4574abdd30f07eae4b5c"><enum>(2)</enum><text>by redesignating paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (C), and adjusting the margins accordingly;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id07f8ff192ced494b945496d97c3721ce"><enum>(3)</enum><text>by striking <quote>The Office of Personnel Management shall</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3784C27FC49245128C6AFFB0A80D0AAC" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="id484fbda5feee4fe3b87de642fd202f01"><enum>(1)</enum><header>Office of Personnel Management</header><text>The Office of Personnel Management shall</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id69ecd00238c34126b5fbd27b735145ac"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5c6ef7b1c0ee4398ba42904e9c7ef4e4" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="id6fc9763c9ee344acbd7b3dfe46ff7b74"><enum>(2)</enum><header>Office of Management and Budget</header><text>The Director of the Office of Management and Budget shall take the following actions:</text><subparagraph id="idb1f07599c9a248b7ae891365518ae30a"><enum>(A)</enum><text>In coordination with the Administrator of General Services and the Federal Real Property Council established by section 623(a) of title 40, the following actions:</text><clause id="idead0e8b8324d44aba0fb863ed930276d"><enum>(i)</enum><text>Develop benchmarks for measuring office building space utilization that account for the use of telework.</text></clause><clause id="id24944335550a493cbeec80fb885f05f1"><enum>(ii)</enum><text>Provide guidance to each executive agency for collecting office building space occupancy data regarding the average daily onsite attendance in the office building space owned or leased by the executive agency.</text></clause><clause commented="no" display-inline="no-display-inline" id="id5dbad7d8a3ab4f5e80186eb70b2c8df8"><enum>(iii)</enum><text>Establish office building space utilization rate goals for each executive agency of not less than 60 percent.</text></clause><clause commented="no" display-inline="no-display-inline" id="id76051cf361e241c68761930e6b64b74c"><enum>(iv)</enum><text>Until the benchmarks described in clause (i) are developed, and the guidance described in clause (ii) is provided, ensure that each executive agency, not less frequently than quarterly, uses the following formula to calculate office building space utilization with respect to the office building space that the executive agency leases or owns:</text><subclause commented="no" display-inline="no-display-inline" id="idcfc3df8a3639457d83db8d58e899c76b"><enum>(I)</enum><text>Calculate the usable square feet of the office building space so leased or owned, which shall be calculated— </text><item commented="no" display-inline="no-display-inline" id="id9aa4ee616c494e9eb41525cb797abc77"><enum>(aa)</enum><text display-inline="yes-display-inline">by using the portion of that office building space that is available for occupants, including offices, team rooms, and conference rooms; and</text></item><item commented="no" display-inline="no-display-inline" id="id6e242e95a8014a62a64b8a5b772de518"><enum>(bb)</enum><text>in accordance with the standard methods of measurement developed by the Building Owners and Managers Association International, as approved by the American National Standards Institute.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idf162fb418ff94fa8bc42a459cdcc64ab"><enum>(II)</enum><text>Divide the number of usable square feet calculated under subclause (I) by 180.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd8a83b26611d4eca85fb92d99706be79"><enum>(III)</enum><text>Divide the daily average of the number of individuals who are present working in the space that is the subject of the calculation under subclause (I) by the quotient obtained under subclause (II), which shall be expressed as a percentage.</text></subclause></clause></subparagraph><subparagraph id="id2d558e41345b4c49b6d9f2e070e9d746"><enum>(B)</enum><text>In coordination with the Director of the Office of Personnel Management and the Administrator of General Services, provide policy and policy guidance for the indicators and routines described in section 6503(d)(2), including with respect to the identification of additional indicators under section 6503(d)(2)(B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id2ea0b8747d214aadaf8cc1901a190487"><enum>(c)</enum><header>Continuity of operations</header><text>Section 6504(d) of title 5, United States Code, is amended—</text><paragraph id="id8e1d0cbb4acf47f8b87beba7bbc0850c"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">plans</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id57fbff4fd0b4486daccdab031c659a82"><enum>(2)</enum><text>by redesignating paragraphs (1) and (2) as paragraphs (2) and (3), respectively; and</text></paragraph><paragraph id="idacf991ad18964f3baf766375ed634f7b"><enum>(3)</enum><text>by inserting before paragraph (2), as so redesignated, the following:</text><quoted-block id="idB006AE4524FE4684881CFD87DFFB2DE7" style="OLC" act-name="" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="idEEAA81109256444AA82B7D53C72C998D"><enum>(1)</enum><header>Emergency incidents</header><subparagraph commented="no" display-inline="no-display-inline" id="id41f8e80ff8bf40dc9514e35fcce4100b"><enum>(A)</enum><header display-inline="yes-display-inline">Definition</header><text>In this paragraph, the term <term>emergency incident</term> means an event that, as determined by the head of an executive agency, would pose a threat to the life, health, or safety of an employee, or a group of employees, of the executive agency if the employee, or group of employees, were to report to the worksite of the employee or group of employees.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id45b2d39977d042e9a65eda7b1d3f4cda"><enum>(B)</enum><header>Telework during emergency incidents</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the head of an executive agency may require that an employee, or a group of employees, of the executive agency telework during an emergency incident under procedures established by the Director of the Office of Personnel Management.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id01fdacdee6ac42e280d09ce5276bcd4a"><enum>(d)</enum><header>Reports</header><text>Section 6506(b) of title 5, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id097acc0340264a989edb1ce7625fc76f"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2a2a445986a94f2b9fe1e5741a2ac059"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subparagraphs (D) and (E);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf199c9ea9d644c239009ce0a8359cb11"><enum>(B)</enum><text>by redesignating subparagraph (F) as subparagraph (D);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbd8904e3c58b401c9cc3df167a5e4e60"><enum>(C)</enum><text>in subparagraph (D), as so redesignated—</text><clause commented="no" display-inline="no-display-inline" id="id1ce323b40abb41ce8b926822356364b7"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>agency participation rate goals during the reporting period, and other</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idbaba5f64f0eb4fdd83133376e45d19b4"><enum>(viii)</enum><text display-inline="yes-display-inline">customer experience and service, including backlogs and wait times;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8eb6c6c3561a45d8b3ed717bd4d46157"><enum>(D)</enum><text>by inserting after subparagraph (D), as so redesignated, the following:</text><quoted-block id="idFD776FB6F9D74F009B7C96B864B85D27" style="OLC" act-name="" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subparagraph id="id6A9BB52D45DC434AB21EBEE823646E5C"><enum>(E)</enum><text>an explanation of whether or not each executive agency met the goals described in subparagraph (D) for the last reporting period and, if not, what actions are being taken to identify and eliminate barriers to meeting those goals for the next reporting period; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc2c24531a6c94b02a9cbdb6469ba6990"><enum>(F)</enum><text display-inline="yes-display-inline">what actions each executive agency has taken since the last reporting period, and any additional steps the executive agency is planning to take, to— </text><clause commented="no" display-inline="no-display-inline" id="id5568330abd4d4886be5a5b4fbbc42d32"><enum>(i)</enum><text display-inline="yes-display-inline">ensure oversight and quality control with respect to telework; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf04dade87d5840d498d914d2448ce271"><enum>(ii)</enum><text display-inline="yes-display-inline">increase the utilization rates of office building space owned or leased by the executive agency to not less than 60 percent (or any higher rate established by the Director of the Office of Management and Budget under section 6504(b)(2)(A)); executive agency; telework</header><text>The terms <term>employee</term>, <term>executive agency</term>, and <term>telework</term> have the meanings given those terms in section 6501 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id47e4842fa97b437ea3fc72e04bf4c04f"><enum>(4)</enum><header display-inline="yes-display-inline">Executive department</header><text>The term <term>Executive department</term> has the meaning given the term in section 101 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5413168888044af1872fb097b625bd2c"><enum>(5)</enum><header>Locality payment; official worksite</header><text>The terms <term>locality payment</term> and <term>official worksite</term> have the meanings given those terms in section 531.602 of title 5, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide52cd15d60c642339cf5030fddb50c13"><enum>(b)</enum><header>Office building space utilization</header><text>The Comptroller General shall conduct, and submit to Congress a report with respect to, the following audits:</text><paragraph commented="no" display-inline="no-display-inline" id="idea75c5d4931940e78f8ed9c0054fff80"><enum>(1)</enum><text>For each of the first 3 fiscal years that begins after the date of enactment of this Act, an audit of— </text><subparagraph commented="no" display-inline="no-display-inline" id="id110f72036e4b4d0182dfb9cc14afa357"><enum>(A)</enum><text display-inline="yes-display-inline">the measurements made under the benchmarks developed under section 6504(b)(2)(A)(i) of title 5, United States Code, as added by section 2 of this Act; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37ff37bc76f546e3aa22457cb33983ca"><enum>(B)</enum><text display-inline="yes-display-inline">if the Director of the Office of Management and Budget has not developed the benchmarks described in subparagraph (A) as of the first day of the fiscal year in which the audit is scheduled to be performed, the calculations made by executive agencies under section 6504(b)(2)(A)(iv) of title 5, United States Code, as added by section 2 of this Act. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4fe08f5d4cf7427e9c342f539f09e725"><enum>(2)</enum><text display-inline="yes-display-inline">An audit of the benchmarks developed by the Director of the Office of Management and Budget under section 6504(b)(2)(A)(i) of title 5, United States Code, as added by section 2 of this Act, including any changes to those benchmarks that are made after the benchmarks are first developed.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id805aa6accc5d44b7aadd8e60fbc9c51c"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id4282aee423514b1bbfaf7873de2b9489"><enum>(A)</enum><text>An audit of each system established to track office building space utilization rates, as required under section 6503(d)(1) of title 5, United States Code, as added by section 2 of this Act.</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="idc69962e81f144cf290e6a6434c5e9e2f"><enum>(B)</enum><text>The Comptroller General shall conduct the audit required under subparagraph (A) once for each of the first 3 fiscal years that begins after the fiscal year in which the Director of the Office of Management and Budget develops the benchmarks required under section 6504(b)(2)(A)(i) of title 5, United States Code, as added by section 2 of this Act, after which the Comptroller General shall conduct that audit—</text><clause commented="no" display-inline="no-display-inline" id="id741fa4dd262f40aeaff30f9488f7d281"><enum>(i)</enum><text>not more frequently than once each fiscal year; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf0bff7a4a6d84b058e527da757d3142d"><enum>(ii)</enum><text>upon request by any Member of Congress.</text></clause></subparagraph></paragraph></subsection><subsection id="id0c1f6ecc44f24139ac77fcd0a3064cf5"><enum>(c)</enum><header>Verifying official worksite and locality payment accuracy</header><paragraph commented="no" display-inline="no-display-inline" id="id2014bfa42dbc432b89a0f86aafa4cf4c"><enum>(1)</enum><header>In general</header><text>The Comptroller General shall— </text><subparagraph commented="no" display-inline="no-display-inline" id="id7fc25635f7794fa7a6066493dba10e24"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of enactment of this Act, brief the appropriate congressional committees on how Executive departments determine the official worksite for an employee who teleworks, especially for the purpose of determining the amount of a locality payment paid to such an employee; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3089ac604c324cfdacace252a4e11f5b"><enum>(B)</enum><text>not later than 1 year after the date on which the Comptroller General provides the briefing required under subparagraph (A), submit to the appropriate congressional committees a report regarding the matters described in that subparagraph.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb389685cef79494aa9f5cf9c59f31313"><enum>(2)</enum><header>Contents of report</header><text>The report required under paragraph (1)(B) shall include an assessment of—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddc7e8d3fc53a4128a0846194af7a8c81"><enum>(A)</enum><text>how Executive departments—</text><clause commented="no" display-inline="no-display-inline" id="id88811188d03840a3adc80a5a67cd77bb"><enum>(i)</enum><text display-inline="yes-display-inline">ensure that employees regularly report to the official worksite of those employees; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc2af7635856f4d279fc2dc34dddff0d9"><enum>(ii)</enum><text>use the authorities under section 531.605(d)(2) of title 5, Code of Federal Regulations, or any successor regulation, including an assessment of— </text><subclause commented="no" display-inline="no-display-inline" id="idbded71a3d3054335b8a2c751c1b27752"><enum>(I)</enum><text display-inline="yes-display-inline">the frequency with which Executive departments use those authorities; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id55d929e859b44e57abad8d394bbc39c5"><enum>(II)</enum><text display-inline="yes-display-inline">the average duration that employees telework under an exception granted under such section 531.605(d)(2); and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6d0c08cb9b7a40308f1b5a94e1495e98"><enum>(B)</enum><text>the oversight practices that Executive departments use to review and verify the amount of a locality payment paid to an employee who teleworks.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79a75289d5d2450bbc0d446289810d2c"><enum>(3)</enum><header>Recurring analysis</header><text>With respect to the practices described in subparagraphs (A) and (B) of paragraph (2), the Comptroller General shall take the following actions:</text><subparagraph commented="no" display-inline="no-display-inline" id="idc093b51b090f4be4b1b8cb17426c7309"><enum>(A)</enum><text>Assess those practices once for each of the 5 fiscal years that begins after the fiscal year in which the Comptroller General submits the report required under paragraph (1)(B) and submit to the appropriate congressional committees a report if the Comptroller General determines that there have been any changes to those practices since the last such assessment performed by the Comptroller General.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7c55fe85a7404bdba790b3e7151dc632"><enum>(B)</enum><text>After carrying out subparagraph (A) of this paragraph, conduct an assessment described in such subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="id6c693d6e30154df191f5b1f5f38b55f8"><enum>(i)</enum><text>not more frequently than once each fiscal year, which shall include the submission to the appropriate congressional committees of a report if the Comptroller General determines that there have been any changes to those practices since the last such assessment performed by the Comptroller General; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idba0ce58798fb47eb99e85b4848bf9152"><enum>(ii)</enum><text>upon request by any Member of Congress.</text></clause></subparagraph></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="idffc289ae-e8f1-4c6f-a958-0745df619493" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Telework Transparency Act of 2024</short-title></quote>.</text></section><section id="id0d41b3b5-02e5-4f1d-9fa2-5aa69af7343a" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Telework Policy Transparency and Tracking</header><subsection id="id64674287-2649-4f7a-bbc1-473e5b483d64"><enum>(a)</enum><header>Monitoring executive agency telework policies and requiring transparency</header><paragraph id="ideb1d49c0-94b1-4f18-ac6d-862a41b58ccb"><enum>(1)</enum><header>Telework eligibility policy</header><text>Section 6502(a)(1) of title 5, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc2dfe35a-528d-458a-a7f9-de27be98059b"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>Not later than 180 days after the date of enactment of this chapter, the</quote> and inserting <quote>The</quote>; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id706de781-c633-49e6-9cee-01ae43123345"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2bbe4a58-4962-437a-8766-00e9270f7a58"><enum>(C)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idae1112ac-6635-452c-b0aa-70a6a334cb49"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="id120eefba-0c0a-46d8-8150-e12ed78db95e" style="OLC" act-name="" changed="added" reported-display-style="italic" committee-id="SSGA00"><subparagraph commented="no" display-inline="no-display-inline" id="ida38ab6bf-f2a6-4e6c-a71a-9f50edf2b052"><enum>(D)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of enactment of this subparagraph, and as updates are made thereafter— </text><clause commented="no" display-inline="no-display-inline" id="id7755a06e-cb77-4963-8d2d-ac187f1b691a"><enum>(i)</enum><text display-inline="yes-display-inline">submit to the Director of the Office of Personnel Management a description of the policy established under subparagraph (A), or any successor policy; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idac84f6a8-d08d-40d4-8084-2da287877fd1"><enum>(ii)</enum><text display-inline="yes-display-inline">make publicly available on the website of the executive agency the most current version of the policy described in clause (i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idd0401ea3-5d31-433d-8725-1a906de3248a"><enum>(2)</enum><header>Training and monitoring</header><text>Section 6503 of title 5, United States Code, is amended— </text><subparagraph commented="no" display-inline="no-display-inline" id="id9e7457c89d0544c7a2756838d6bcf344"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><clause commented="no" display-inline="no-display-inline" id="id9421304508014f0b8e7c74db24f722d5"><enum>(i)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7385da73c0fa4c66b3f2732e7b620412"><enum>(ii)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block id="id2CBC8F6497AC419DAA5EC71AFE807CCC" style="OLC" act-name="" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="idEE427A8C4398468789E03013BFF8DCE4"><enum>(3)</enum><text>managers of teleworkers, using appropriate methods, track and evaluate the performance of teleworkers, including with respect to the completion of tasks associated with the duties, responsibilities, and authorized activities of teleworkers;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id33d833c1cdff4b2fbbcd7deff9f5ee34"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7a67ad0f-000a-4cb4-b747-f5fcddfc23a8" changed="added" reported-display-style="italic" committee-id="SSGA00"><subsection id="ida3ebfd68-212f-42bb-b0bd-52b359c406da"><enum>(c)</enum><header>Monitoring employee use of telework</header><paragraph id="id9868da5b-de13-4e33-862a-65d46311e1d3"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>Shared Service Centers</term> has the meaning given the term in section 850.103 of title 5, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph id="id58cab075-e87b-4829-85db-8ade2510fee3"><enum>(2)</enum><header>Establishment of common data standards; data reporting requirements</header><text>Not later than 180 days after the date of enactment of this subsection, in part to aid in the collection of data for the purposes of satisfying the reporting requirements under section 6506, the Director of the Office of Personnel Management shall establish—</text><subparagraph commented="no" display-inline="no-display-inline" id="id98aba982-7c34-4fa8-b4c6-22215c07633f"><enum>(A)</enum><text display-inline="yes-display-inline">executive agency telework data reporting requirements, including required timeframes for reporting;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7ee74dbb-a034-45d6-b152-190ecde3575d"><enum>(B)</enum><text>data standards and protocols for tracking employee use of telework;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id39596259-3b24-4896-a8ed-d1679e93b846"><enum>(C)</enum><text>best practices and training for managers of employees who telework to review and verify the amount of a locality payment, as defined in section 531.602 of title 5, Code of Federal Regulations (or any successor regulation), paid to such an employee;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8186df34-2ea2-47cb-8567-08f4a1eba6a8"><enum>(D)</enum><text>internal controls for data quality with respect to the use of telework, including procedures to—</text><clause commented="no" display-inline="no-display-inline" id="idcd2c1fd2-a6ad-4450-bb31-f31c0d86a541"><enum>(i)</enum><text display-inline="yes-display-inline">consistently monitor system-generated errors;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5dd03ecb-21e1-4f28-a30e-bb37827eecc8"><enum>(ii)</enum><text>produce reports on adherence to data standards and edit rules; and</text></clause><clause id="id4172a724-1180-4bee-a27d-4730587de46e"><enum>(iii)</enum><text>ensure prompt action to address issues identified in clauses (i) and (ii); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66016111-a509-4d36-adf6-2fec82bde3e0"><enum>(E)</enum><text>mechanisms to provide regular feedback to executive agencies and Shared Service Centers on data quality with respect to telework, which shall include the provision of any human capital data needed to evaluate telework practices.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idddd8d4f5-c9aa-4551-aa7e-3597e10e7d12"><enum>(3)</enum><header display-inline="yes-display-inline">Establishment of automated telework tracking systems within payroll systems</header><text>The head of each executive agency, in consultation (where applicable) with each Shared Service Center that provides payroll or human resources services to that executive agency, shall establish telework tracking within each payroll system that—</text><subparagraph id="id48a0e824-0b3b-4340-95b4-7b00a131f8d4"><enum>(A)</enum><text>is automated; and</text></subparagraph><subparagraph id="id83e44b9b-9b89-49b9-88b6-1a768efd0e2c"><enum>(B)</enum><text>conforms to— </text><clause commented="no" display-inline="no-display-inline" id="ide6492247-e892-47d0-b431-a23690cce73d"><enum>(i)</enum><text display-inline="yes-display-inline">the telework data standards and coding requirements issued by the Director of the Office of Personnel Management; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id47b3963d-89bc-4760-b244-bb1cdb2ced85"><enum>(ii)</enum><text>the requirements established by the Director of the Office of Personnel Management under paragraph (2).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id967962c5-c014-49ba-8b3a-42f6b3028a84"><enum>(4)</enum><header>Establishment of online tool</header><text>Not later than 2 years after the date of enactment of this subsection, the Director of the Office of Personnel Management shall establish and maintain a publicly available online tool that— </text><subparagraph commented="no" display-inline="no-display-inline" id="idc5510ed5-bdb7-48cb-98b4-3e81802d50ae"><enum>(A)</enum><text display-inline="yes-display-inline">makes the data required to be reported under paragraph (2), including the average number of days per period that eligible employees telework, available in an appropriate and readable format;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6b39c7cc-ce72-44e8-8706-447cbf0774fa"><enum>(B)</enum><text display-inline="yes-display-inline">incorporates appropriate protections for personal and sensitive information reported under paragraph (2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb685daa-77fb-4b49-9baa-6c0e01356ea7"><enum>(C)</enum><text display-inline="yes-display-inline">uses data visualization or other data presentation techniques to support strategic executive agency workforce planning and talent management objectives.</text></subparagraph></paragraph></subsection><subsection id="idec80da4b-7f19-4a9d-88e1-1dddf7e43722"><enum>(d)</enum><header>Monitoring the effects of telework on office space utilization and executive agency performance</header><text>The head of each executive agency shall—</text><paragraph id="id308ef176-ec39-4e8f-aa58-d25d77be6e37"><enum>(1)</enum><text>establish a system to track office space utilization rates that aligns with guidance and benchmarks issued by the Director of the Office of Management and Budget, in coordination with the Administrator of General Services and the Federal Real Property Council established by section 623(a) of title 40, under section 6504(b)(2)(A);</text></paragraph><paragraph id="id8c2010df-a489-4ffd-a379-cd0c4dcd3a8c"><enum>(2)</enum><text>identify a set of indicators, and establish routines using the indicators, to assess and monitor the effects of telework policy on the performance of the executive agency, including, as applicable to the mission of the executive agency— </text><subparagraph commented="no" display-inline="no-display-inline" id="idae5b2862-bdac-46f5-80ad-d96c3374e04d"><enum>(A)</enum><text display-inline="yes-display-inline">indicators related to—</text><clause id="idefe07b26-41b0-44be-acd5-f3ee4f922e07"><enum>(i)</enum><text>customer experience and service, including backlogs and wait times;</text></clause><clause id="iddabb69c6-e1a3-46a5-975a-00296f1e7b4f"><enum>(ii)</enum><text>security;</text></clause><clause id="idfaeddda0-57f4-4dca-9912-db93eb086159"><enum>(iii)</enum><text>cost to operations;</text></clause><clause id="id96847f71-5273-4a8f-b304-2219d9d8dec4"><enum>(iv)</enum><text>the management of real property and related personal property;</text></clause><clause id="id79e5057e-f0a6-4571-b211-45122c0acff7"><enum>(v)</enum><text>investments in network capacity or communications infrastructure, including technology capabilities to improve efficiency and reduce the use of outdated technology; and</text></clause><clause id="idb749afbf-15da-4189-84dc-f78618f75986"><enum>(vi)</enum><text>the ability of the executive agency to recruit and retain top talent; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43a1daf6-b025-4f14-9ec0-452b48978f08"><enum>(B)</enum><text>any other indicator determined appropriate by the head of the executive agency, including as the result of policy and policy guidance provided under section 6504(b)(2)(B);</text></subparagraph></paragraph><paragraph id="idd8523c0c-1278-4325-a590-8174b1e8f264"><enum>(3)</enum><text>not later than 180 days after the date of enactment of this subsection, and as updates are made thereafter— </text><subparagraph commented="no" display-inline="no-display-inline" id="ide60a6122-9fc4-4a54-a37c-f9951fa394b9"><enum>(A)</enum><text display-inline="yes-display-inline">submit to the Director of the Office of Management and Budget and the Director of the Office of Personnel Management a description of the indicators and routines described in paragraph (2); and</text></subparagraph><subparagraph id="id5608bcba-da87-4b96-a524-9b4982cb1b5d"><enum>(B)</enum><text>make publicly available on the website of the executive agency the most current version of the indicators and routines described in paragraph (2); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b900716-84f4-424d-8959-93896a425bb3"><enum>(4)</enum><text display-inline="yes-display-inline">with respect to the office space utilization rates described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id52419217-7fc6-49d2-b705-299bd975a7da"><enum>(A)</enum><text display-inline="yes-display-inline">include those rates in the budget justification materials (as defined in section 3(b)(2) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note)) of the executive agency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id819646e9-0503-48e5-b446-3f2a866ff122"><enum>(B)</enum><text display-inline="yes-display-inline">make those rates publicly available.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ide6244276-12bc-4400-915d-035ca7a419d9"><enum>(3)</enum><header>Telework website</header><text>Section 6504(e)(2) of title 5, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4125368d-4f10-4358-86d4-ebc0951ed5d2"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>telework links</quote> and inserting the following: <quote>links to Government websites, including a compilation of links to executive agency websites with descriptions of telework policies and indicators and routines described in sections 6502(a)(1)(D) and 6503(d)(2), respectively</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idee2bb4e2-d6b8-4788-9cee-83cae3293b72"><enum>(B)</enum><text>in subparagraph (D)—</text><clause commented="no" display-inline="no-display-inline" id="id6b78e959-a36f-48be-a624-6cfebe36ba54"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>, and the General Services Administration</quote> and inserting <quote>, the General Services Administration, and the Department of State</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id491551d4-294b-48c2-a85b-a313c3dc4187"><enum>(ii)</enum><text>by striking <quote>10</quote> and inserting <quote>30</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="id63768971-14f4-4ffa-a8ba-826ceb561f17"><enum>(b)</enum><header>Establishing benchmarks and providing guidance</header><text>Section 6504(b) of title 5, United States Code, is amended—</text><paragraph id="id778ddc1e-9b11-4f85-9c77-a0a8d7a7a954"><enum>(1)</enum><text>in paragraph (3), by redesignating subparagraphs (A), (B), and (C) as clauses (i), (ii), and (iii), respectively, and adjusting the margins accordingly;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc86ee4d-bf9f-4128-bfc8-0424f0e70d1a"><enum>(2)</enum><text>by redesignating paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (C), respectively, and adjusting the margins accordingly;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99bbcffb-8ac6-49f9-8649-690a5c7e7863"><enum>(3)</enum><text>by striking <quote>The Office of Personnel Management shall</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0268d1ac-3881-4255-b13d-af343a4cbf46" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="idbad0c031-0b94-48aa-8628-0a064836d8c0"><enum>(1)</enum><header>Office of Personnel Management</header><text>The Office of Personnel Management shall</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="ida89b8c45-3a63-47ca-9a99-acb2f5c413fd"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddb771db6-73bb-4858-8944-e7e039f70f41" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="id4b45d36b-7629-4936-8036-7453581651db"><enum>(2)</enum><header>Office of Management and Budget</header><text>The Director of the Office of Management and Budget shall take the following actions:</text><subparagraph id="ida71a250e-22c2-4718-be5a-e6bc78c37a64"><enum>(A)</enum><text>In coordination with the Administrator of General Services and the Federal Real Property Council established by section 623(a) of title 40, the following actions:</text><clause id="id0cca392f-88b2-4d09-8c12-0815ac43a490"><enum>(i)</enum><text>Develop benchmarks for measuring office space utilization that account for the use of telework.</text></clause><clause id="id3a01dc55-25b8-445d-a808-31f97fa3d358"><enum>(ii)</enum><text>Provide guidance to each executive agency for collecting office space occupancy data regarding the average daily onsite attendance in the office space owned or leased by the executive agency, which shall take into consideration—</text><subclause commented="no" display-inline="no-display-inline" id="id664bf960dc7b48ea824a487f9f528038"><enum>(I)</enum><text display-inline="yes-display-inline">duties of employees of the executive agency that involve official travel, mobile work, or other job functions requiring such an employee to temporarily report to an offsite location;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idfa66299ad0e546ceb741a0363c303b31"><enum>(II)</enum><text>variation within a year with respect to the number of employees of the executive agency taking scheduled or unscheduled leave and the duration of that leave; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4e3f2e74527747ba90a3b6ca914be360"><enum>(III)</enum><text>data collected from swipes of Personal Identity Verification Cards or Common Access Cards, as applicable, with appropriate protections for personally identifiable information.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf6e8c98c-0f4b-452f-a96a-a821259dc112"><enum>(iii)</enum><text>Establish office space utilization rate goals for each executive agency— </text><subclause commented="no" display-inline="no-display-inline" id="id848b4b0137754dd29d3eeea119d9a5bb"><enum>(I)</enum><text display-inline="yes-display-inline">of not less than 60 percent; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2fde42ab25d84993b1512746c4286ee7"><enum>(II)</enum><text>that takes into consideration the matters described in subclauses (I) and (II) of clause (ii).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idbfb8c6eb-c0f6-47e1-8f63-b98ceaeca239"><enum>(iv)</enum><text>Until the benchmarks described in clause (i) are developed, and the guidance described in clause (ii) is provided, ensure that each executive agency, not less frequently than quarterly, uses the following formula to calculate office space utilization with respect to the office space that the executive agency leases or owns:</text><subclause commented="no" display-inline="no-display-inline" id="id7e5e0aa1-9a1b-492a-a96c-fc950f565993"><enum>(I)</enum><text>Calculate the usable square feet of the office space so leased or owned— </text><item commented="no" display-inline="no-display-inline" id="id6d1b1884-e44d-4da5-9ab5-588c1c74bfb9"><enum>(aa)</enum><text display-inline="yes-display-inline">by using the portion of that office space that is available for occupants, including offices, team rooms, and conference rooms; and</text></item><item commented="no" display-inline="no-display-inline" id="id2f60a56d-0a95-4bcb-9382-78bdb29509da"><enum>(bb)</enum><text>in accordance with the standard methods of measurement developed by the Building Owners and Managers Association International, as approved by the American National Standards Institute.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idd85493ff-14ad-4555-a7f0-a4c87920fca3"><enum>(II)</enum><text>Divide the number of usable square feet calculated under subclause (I) by 180.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idff25d047-896f-4f88-a3f1-3fef403dff32"><enum>(III)</enum><text>Divide the daily average of the number of individuals, including contractors, who are present working in the space that is the subject of the calculation under subclause (I) by the quotient obtained under subclause (II), which shall be expressed as a percentage.</text></subclause></clause></subparagraph><subparagraph id="id3f297bf9-50d5-4341-9882-4d2f2bd2215f"><enum>(B)</enum><text>In coordination with the Director of the Office of Personnel Management and the Administrator of General Services, provide policy and policy guidance for the indicators and routines described in section 6503(d)(2), including with respect to the identification of additional indicators under section 6503(d)(2)(B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id49f78bc9-7908-4144-a6a4-3a46c05b780a"><enum>(c)</enum><header>Reports</header><text>Section 6506(b) of title 5, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idd6ec8fd6-33a1-434e-ad60-4eef788b02f6"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0392d221-0c62-4594-8fde-0f1bfc0804ea"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subparagraphs (D) and (E);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id447e6594-6eac-4d5c-8ac9-8d8ff619bb80"><enum>(B)</enum><text>by redesignating subparagraph (F) as subparagraph (D);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfeaaa259-aac6-479e-ad66-e20a18a36041"><enum>(C)</enum><text>in subparagraph (D), as so redesignated—</text><clause commented="no" display-inline="no-display-inline" id="id8b00f413-f366-43df-9cee-55c5758bc1c9"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>agency participation rate goals during the reporting period, and other</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id25171ecd-5732-4a91-b95c-183986c9dd80"><enum>(viii)</enum><text display-inline="yes-display-inline">customer experience and service, including backlogs and wait times;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb5027226-903b-4e73-b607-e65bbd17032a"><enum>(D)</enum><text>by inserting after subparagraph (D), as so redesignated, the following:</text><quoted-block id="id5b32d552-b689-4881-ae1c-d9ea91699a90" style="OLC" act-name="" changed="added" reported-display-style="italic" committee-id="SSGA00"><subparagraph id="id19c68f78-dc4c-4e0d-a665-90300cf04374"><enum>(E)</enum><text>an explanation of whether each executive agency met the goals described in subparagraph (D) for the last reporting period and, if not, what actions are being taken to identify and eliminate barriers to meeting those goals for the next reporting period; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51b29c15-ef1a-4077-a9fd-412dd5a3866c"><enum>(F)</enum><text display-inline="yes-display-inline">what actions each executive agency has taken since the last reporting period, and any additional steps the executive agency is planning to take, to— </text><clause commented="no" display-inline="no-display-inline" id="id3a9a1e30-35d9-4d6a-bf4f-efdd47f609bb"><enum>(i)</enum><text display-inline="yes-display-inline">ensure oversight and quality control with respect to telework; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida690b7d9-3e0f-4aff-88a1-c1eee1bd6cad"><enum>(ii)</enum><text display-inline="yes-display-inline">increase the utilization rates of office space owned or leased by the executive agency to not less than 60 percent (or any higher rate established by the Director of the Office of Management and Budget under section 6504(b)(2)(A)); Regulatory authority.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0b659c90aa4542f6bb5bb71c9fcf6d38"><enum>(e)</enum><header>Report from executive agencies</header><paragraph commented="no" display-inline="no-display-inline" id="id1a553b2977a54f0d9ace5ca9a317ddc8"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection, the terms <term>employee</term>, <term>executive agency</term>, and <term>telework</term> have the meanings given those terms in section 6501 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbe28e389ff37484aac2325509ea4d852"><enum>(2)</enum><header>Requirement</header><text>Not later than 1 year after the date of enactment of this Act, the head of each executive agency, in coordination with the Director of the Office of Personnel Management, the Chief Human Capital Officer of the executive agency, the Chief Information Officer of the executive agency, the Director of the Office of Management and Budget, and the Administrator of General Services, shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives a report that identifies—</text><subparagraph commented="no" display-inline="no-display-inline" id="idba89bda23074486c8d8e5285def24021"><enum>(A)</enum><text display-inline="yes-display-inline">what metrics and methods the executive agency has used to determine the productivity of employees who telework;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd6f43530b6c04a0d8c3a3d3ef9010b6e"><enum>(B)</enum><text>any effects of telework, including the effects of telework on—</text><clause commented="no" display-inline="no-display-inline" id="id030f1807f9da4c589cb70a1dfa3a80a4"><enum>(i)</enum><text display-inline="yes-display-inline">costs;</text></clause><clause commented="no" display-inline="no-display-inline" id="idebb996ecf30945059228b1b0e75daa4f"><enum>(ii)</enum><text>security;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2e8450e70a2f43ea8d1d649f37a0862e"><enum>(iii)</enum><text>employee morale;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6b3c7a57a1694654b4d642ce31364de3"><enum>(iv)</enum><text>employee productivity; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0a01be79e06843009b3edda374a6ee28"><enum>(v)</enum><text>waste, fraud, or abuse;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id229d20d9d63c4d7e83154dd45b43603e"><enum>(C)</enum><text>barriers that prevent the executive agency from meeting in-person work targets, if applicable; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id60a0a4fa1e214a3cbc5b77504938ba7a"><enum>(D)</enum><text>any initiatives of the executive agency to address the barriers described in subparagraph (C).</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id14d6c01e-0429-4a5e-ad12-048ecc7af5ef" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>3.</enum><header>GAO audits and reports</header><subsection commented="no" display-inline="no-display-inline" id="id9454c837-5a17-43c0-af49-b0aa98a05fdf"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idb1198cef-5005-4d81-9301-f0bf3ad4e7cc"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means an agency described in section 901(b) of title 31, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id86d5b56cc8b34d02a9f897dfc36f3f86"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id131e30fe-4549-4753-baad-eeb8b5f6a85b"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf3ec4a4c-3d7b-41ed-9489-0d1f5573821e"><enum>(B)</enum><text>the Committee on Oversight and Accountability of the House of Representatives; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id003568a9-2ae9-46c4-a98d-66fcd0bdc707"><enum>(C)</enum><text>any other congressional committee determined appropriate by the Comptroller General.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a2e30fa-6cd8-4291-970a-96862a85300f"><enum>(3)</enum><header display-inline="yes-display-inline">Comptroller General</header><text>The term <term>Comptroller General</term> means the Comptroller General of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id72b20031-e11d-4bc0-8dfd-e898086e5590"><enum>(4)</enum><header display-inline="yes-display-inline">Employee; executive agency; telework</header><text>The terms <term>employee</term>, <term>executive agency</term>, and <term>telework</term> have the meanings given those terms in section 6501 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaebe3926-ac6b-4c3b-8d71-1940fbd6eb30"><enum>(5)</enum><header>Locality payment; official worksite</header><text>The terms <term>locality payment</term> and <term>official worksite</term> have the meanings given those terms in section 531.602 of title 5, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id86178172-6d1b-4525-b5c3-cb056c726e3b"><enum>(b)</enum><header>Office space utilization</header><text>The Comptroller General shall conduct, and submit to Congress a report with respect to, the following audits:</text><paragraph commented="no" display-inline="no-display-inline" id="idd979c403-84fc-42f1-aead-68e4639cac80"><enum>(1)</enum><text>For each of the first 3 fiscal years that begins after the date of enactment of this Act, an audit of— </text><subparagraph commented="no" display-inline="no-display-inline" id="id02200b45-9ae7-4817-b4e5-b63764ab4d27"><enum>(A)</enum><text display-inline="yes-display-inline">the measurements made under the benchmarks developed under paragraph (2)(A)(i) of section 6504(b) of title 5, United States Code, as added by section 2 of this Act; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18e2556b-3f41-419d-b2e5-c99186d0d0aa"><enum>(B)</enum><text display-inline="yes-display-inline">if the Director of the Office of Management and Budget has not developed the benchmarks described in subparagraph (A) as of the first day of the fiscal year in which the audit is scheduled to be performed, the calculations made by executive agencies under paragraph (2)(A)(iv) of section 6504 of title 5, United States Code, as added by section 2 of this Act. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b09774b-e51c-4baf-94e2-3f1fca59b97d"><enum>(2)</enum><text display-inline="yes-display-inline">An audit of the benchmarks developed by the Director of the Office of Management and Budget under paragraph (2)(A)(i) of section 6504(b) of title 5, United States Code, as added by section 2 of this Act, including any changes to those benchmarks that are made after the benchmarks are first developed.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8ebf9a3c-0465-4823-9c2e-4ca1ffe43c4b"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ide63bee48-8fea-49ff-85a6-a33cf210075a"><enum>(A)</enum><text>An audit of each system established to track office space utilization rates, as required under subsection (d)(1) of section 6503 of title 5, United States Code, as added by section 2 of this Act.</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id0c1d0ff9-94e6-4da0-8d55-2798fbee73d3"><enum>(B)</enum><text>The Comptroller General shall conduct the audit required under subparagraph (A) once for each of the first 3 fiscal years that begins after the fiscal year in which the Director of the Office of Management and Budget develops the benchmarks required under paragraph (2)(A)(i) of section 6504(b) of title 5, United States Code, as added by section 2 of this Act, after which the Comptroller General shall conduct that audit—</text><clause commented="no" display-inline="no-display-inline" id="ida9b457b6-3888-45e9-94c7-9bd1a341b6b7"><enum>(i)</enum><text>not more frequently than once each fiscal year; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3fa1b415-3b31-49f4-b92e-d1c86c819861"><enum>(ii)</enum><text>upon request by any Member of Congress.</text></clause></subparagraph></paragraph></subsection><subsection id="id1b84ab0d-95cd-4349-82ec-94e8e9ebba2a"><enum>(c)</enum><header>Verifying official worksite and locality payment accuracy</header><paragraph commented="no" display-inline="no-display-inline" id="idda0b3a5e-6a37-4b22-8ea1-58312b52de96"><enum>(1)</enum><header>In general</header><text>The Comptroller General shall— </text><subparagraph commented="no" display-inline="no-display-inline" id="id813d1d25-16d9-4315-8575-4646d4cea2f2"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of enactment of this Act, brief the appropriate congressional committees on how agencies determine the official worksite for an employee who teleworks, especially for the purpose of determining the amount of a locality payment paid to such an employee; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25b4b3ac-732b-4479-9a28-381c59671b70"><enum>(B)</enum><text>not later than 1 year after the date on which the Comptroller General provides the briefing required under subparagraph (A), submit to the appropriate congressional committees a report regarding the matters described in that subparagraph.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e6bf583-0828-4f8b-aa37-418d88f2332d"><enum>(2)</enum><header>Contents of report</header><text>The report required under paragraph (1)(B) shall include an assessment of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf538e2a2-12e5-4905-93bf-a4babb3475fc"><enum>(A)</enum><text>how agencies—</text><clause commented="no" display-inline="no-display-inline" id="id66d1210f-d2be-4966-8f66-46541da62b89"><enum>(i)</enum><text display-inline="yes-display-inline">ensure that employees regularly report to the official worksite of those employees; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2dbc2ec2-7820-4fd6-9909-63c225eb80c0"><enum>(ii)</enum><text>use the authorities under section 531.605(d)(2) of title 5, Code of Federal Regulations, or any successor regulation, including an assessment of— </text><subclause commented="no" display-inline="no-display-inline" id="iddc4f13e4-370e-4cb1-85df-bb7a328b7d53"><enum>(I)</enum><text display-inline="yes-display-inline">the frequency with which agencies use those authorities; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc08109b0-80b8-4046-84e2-cff9d30bfa2d"><enum>(II)</enum><text display-inline="yes-display-inline">the average duration that employees telework under an exception granted under such section 531.605(d)(2); and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0461703e-1452-4f5e-9d80-c7adb135f6c2"><enum>(B)</enum><text>the oversight practices that agencies use to review and verify the amount of a locality payment paid to an employee who teleworks.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7b7c1246-247f-4246-8a17-14c01b854538"><enum>(3)</enum><header>Additional reports</header><text>With respect to the practices described in subparagraphs (A) and (B) of paragraph (2), the Comptroller General shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id04d7fe7d9f694b4a8d59a0c7058db4e9"><enum>(A)</enum><text display-inline="yes-display-inline">assess those practices as of the date that is 2 years, and as of the date that is 4 years, after the date on which the Comptroller General submits the report required under paragraph (1)(B); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6b7b09b3705e48e984f48c6f44202a82"><enum>(B)</enum><text>submit to the appropriate congressional committees a report regarding each assessment conducted under subparagraph (A) of this paragraph, which shall include a description of any changes to those practices since the last such assessment conducted by the Comptroller General.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id03f9043038d94c548c23b9afb52bcde1" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>4.</enum><header>No additional funds</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated for the purpose of carrying out this Act or the amendments made by this Act.</text></section></legis-body><endorsement><action-date date="20241219" legis-day="20241216">December 19 (legislative day, December 16), 2024</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
