Application of Occupational Safety and Health Act amendments.</toc-entry></toc></section><section id="id25181e4399f64b61a5ea199657e4891d"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="ida2aab04b5eb64ee0989afb7f650a2c92"><enum>(1)</enum><text>Across the United States, there are hundreds of thousands of children who are working in the agricultural industry and performing the grueling work that is required to plant, pick, process, and pack the food that people eat every day.</text></paragraph><paragraph id="id939a6e5856934135bc3357d2bfc2bee2"><enum>(2)</enum><text>Congress included exemptions to the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) child labor provisions that create separate minimum age thresholds and hazardous occupations rules for children employed in agriculture. Such Act does not limit the number of hours per day or week that children can work in agriculture, nor does it place limits on when that work occurs outside of school hours (i.e., children may work in agriculture for any number of hours per day or week, and at any time during the day or night).</text></paragraph><paragraph id="id50c17409151e4a34abed9bda5ed8871f"><enum>(3)</enum><text>Historically, children have been permitted to work in agriculture at younger ages, for longer hours, and under more hazardous conditions than other working children. Like most other agricultural workers, children remain excluded from basic protections provided to workers in other industries under Federal employment laws. Even where protections exist under Federal law, Federal agencies lack sufficient resources to conduct investigations and hold employers accountable for violations.</text></paragraph><paragraph id="idf887ba730caa43cc9e427771d6619e9b"><enum>(4)</enum><text>Allowing children to engage in agricultural work from a young age can result in long-term negative consequences, especially when the child worker is not employed on a family farm where family members take precautions for their children and family members. Working in agriculture as a child can result in an early end to childhood, and long hours worked at unfair and unlawful wages can pose risks to their overall health, education, and lives.</text></paragraph><paragraph id="idb1c940d0400443d38677b2424cabe869"><enum>(5)</enum><text>Child farmworkers suffer work-related fatalities at more than 4 times the rate of other young workers and, according to a 2018 report by the Government Accountability Office, more than half of all work-related child fatalities are in the agriculture industry, often because exceptions are made that allow farmworker children to operate heavy, dangerous equipment and to be exposed to other hazards. Yet, great efforts have been taken to strictly limit the possibility of children in other industries from engaging in dangerous work activities or jobs. The demands imposed by doing agricultural work, coupled with the low pay and poor working conditions, result in shocking drop-out rates from school for child farmworkers. Aside from these risks, farmworker children are exceptionally vulnerable to sexual abuse and harassment by supervisors, company owners, crew leaders, co-workers, and others.</text></paragraph></section><title id="id7d36288b53df483ba56760c9b60acc68" style="OLC"><enum>I</enum><header>Amendments to the Fair Labor Standards Act of 1938</header><section commented="no" display-inline="no-display-inline" id="ida9faaf1799c24f26b5ecb206fd7bfdcd"><enum>101.</enum><header>Application of child labor laws to independent contractors</header><text display-inline="no-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida046ef03ccf346c680ea166eabdea903"><enum>(1)</enum><text display-inline="yes-display-inline">in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id873a296e365f43cd9d470d740852006e"><enum>(A)</enum><text>in subsection (d)—</text><clause id="HB11C783349574BD787FCF5032E9A5FF6"><enum>(i)</enum><text>by striking <quote><quote>Employer</quote> includes</quote> and inserting <quote>(1) <quote>Employer</quote> includes</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id05d71b01f6674276b2101318646c4e89"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>(or, for purposes of any child labor provision of this Act, including paragraph (2), subsection (aa), section 12, and any provision of this Act administering or enforcing such a child labor provision, a worker)</quote> after <quote>employee</quote>; and</text></clause><clause id="HA22AB2DCF0574C94A3913919709F375A"><enum>(iii)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id7B0EFABAA039447DB372FFB7EE2455D6"><paragraph commented="no" display-inline="no-display-inline" id="id6cef7ed0a31e41f495fa8874e46db349" indent="up1"><enum>(2)</enum><text>Notwithstanding any other provision in this section, for purposes of any child labor provision of this Act, including subsections (l) and (aa), section 12, and any provision of this Act administering or enforcing such a child labor provision, the term <term>employer</term> includes any person engaging an individual (including an independent contractor) for the performance of work.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id35a140db2d0f4c2a80937363ad4c3a48"><enum>(B)</enum><text>in subsection (j)—</text><clause commented="no" display-inline="no-display-inline" id="id80591d3a3c104c15892bcc0deac82984"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>(or, for purposes of any child labor provision of this Act, including section 12 and any provision of this Act administering or enforcing such a child labor provision, worker)</quote> after <quote>employee</quote> each place it appears; and</text></subparagraph><subparagraph id="id04934a733d924bca978d71b811b8b515"><enum>(E)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id778612BBE4E840CA8F7BAEA32CFF208F"><subsection commented="no" display-inline="no-display-inline" id="id74ae6d4131514135952b0c1ffc725d23"><enum>(z)</enum><text><term>Work</term>, for purposes of any child labor provision of this Act, including subsections (d)(2), (l), and (aa), section 12, and any provision of this Act administering or enforcing such a child labor provision, means the performance of services for remuneration, including employment.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id608afaa66d5547a1a8f95201238e9c2d"><enum>(aa)</enum><text display-inline="yes-display-inline"><term>Worker</term>, for purposes of any child labor provision of this Act, including subsection (l), section 12, and any provision of this Act administering or enforcing such a child labor provision, means any individual (including an independent contractor or an employee) engaged for work by an employer.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2178d34239734016a66ce692f4634805"><enum>(2)</enum><text display-inline="yes-display-inline">in section 11 (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0280077766dd4115a6fd04f38ac4cee8"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><clause commented="no" display-inline="no-display-inline" id="iddaf8d2ef57344bda8b0155a08ee04476"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>(or, for purposes of any child labor provision of this Act, including section 12 and any provision of this Act administering or enforcing such a child labor provision, work)</quote> after <quote>employment</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6a019556e8f6481c809234a9ba88d859"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>(or, for purposes of any child labor provision of this Act, including section 12 and any provision of this Act administering or enforcing such a child labor provision, of work)</quote> after <quote>employment</quote> each place it appears.</text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idb2b1133fd4f447f8a6e62c9b892362ca"><enum>102.</enum><header>Revised age requirement for child agricultural employment and exemptions for hazardous and non-hazardous work</header><subsection commented="no" display-inline="no-display-inline" id="id9215dfa5796a4d2b83b52c69116dd7b3"><enum>(a)</enum><header>Revised age requirement for child agricultural employment and exemptions for non-Hazardous work</header><text>Section 13(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(c)</external-xref>) is amended by striking paragraph (1) and inserting the following: “(1) Except as provided in paragraph (2), the provisions of section 12 relating to child labor shall not apply to any worker—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id323C2AAAC56443988D8216D234B04C70"><subparagraph commented="no" display-inline="no-display-inline" id="idfb12abf5601d44fe96f1e7c237cacb44" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">who is younger than 16 years of age and engaged for work, outside of the school hours for the school district where such worker is living while so engaged, in agriculture by his or her parent, grandparent, aunt, uncle, first cousin, or legal guardian, on a farm that is owned or operated by such parent, grandparent, aunt, uncle, first cousin, or legal guardian, while such worker is so engaged;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2C37AE436D034E80A2F8F718F4424E49" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">who—</text><clause commented="no" display-inline="no-display-inline" id="id88F058E07E7E4E26AF05A97B38CE420F"><enum>(i)</enum><text display-inline="yes-display-inline">is 16 or 17 years of age; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id050F4DF6470C4C47BA160047AA5BCD84"><enum>(ii)</enum><text display-inline="yes-display-inline">is engaged for work in agriculture; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAFB10BF7F941407AB1A8D42B5DFB64F9" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">who—</text><clause commented="no" display-inline="no-display-inline" id="idA4AC85A5090443E0AFD79332C086F08D"><enum>(i)</enum><text display-inline="yes-display-inline">is 14 or 15 years of age; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id28E6282ADA8F4200B4FD78C5D582C628"><enum>(ii)</enum><text display-inline="yes-display-inline">is engaged for work in agriculture—</text><subclause commented="no" display-inline="no-display-inline" id="id8A44650AFE3247F8B9D8DF4A5E5C9E82"><enum>(I)</enum><text display-inline="yes-display-inline">in an occupation that the Secretary finds and declares appropriate for the engagement for work of a child who is 14 or 15 years of age and does not interfere with the schooling, health, and well-being of such a child; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2db8ab1ef2844315bfca0514f68d77d2"><enum>(II)</enum><text display-inline="yes-display-inline">for periods, and under conditions, that the Secretary finds and declares appropriate for the engagement for work of a child who is 14 or 15 years of age in non-agricultural work and does not interfere with the schooling, health, and well-being of such a child.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id8eff35cce395473ab054b7608c0a9c9e"><enum>(b)</enum><header>Exemptions for hazardous work</header><text display-inline="yes-display-inline">Section 13(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(c)</external-xref>) is further amended by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF437635A88B3478ABFE7D0415B7319C7"><paragraph id="id4CC9696064024DA6980057C4E3B6DDB9" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The provisions of section 12 relating to child labor shall apply to any worker younger than 18 years of age engaged for work in agriculture in an occupation the Secretary finds and declares to be particularly hazardous for the engagement for work of a child younger than 18 years of age or detrimental to the health or well-being of such a child, except—</text><subparagraph commented="no" display-inline="no-display-inline" id="id25428082AB7D4063BD3025802A45AB8C"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to engagement for work, outside of the school hours for the school district where such worker is living while so engaged, in agriculture by his or her parent, grandparent, aunt, uncle, first cousin, or legal guardian, on a farm that is owned or operated by such parent, grandparent, aunt, uncle, first cousin, or legal guardian; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9B5C5D21D6DA450F9A92E8637251B1D7"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to engagement for work in agriculture of a worker who—</text><clause commented="no" display-inline="no-display-inline" id="idbdcbc5ef8b0144bebde38008c95ef7ff"><enum>(i)</enum><text display-inline="yes-display-inline">is a student learner exempted under section 570.72(a) of title 29, Code of Federal Regulations (or any successor regulations); </text></clause><clause commented="no" display-inline="no-display-inline" id="id55204cea7e78437286ac8e07018a6b3d"><enum>(ii)</enum><text display-inline="yes-display-inline">is exempted under section 570.72(b) of title 29, Code of Federal Regulations (or any successor regulations), because the worker has completed a training program of the cooperative extension service of a land-grant college or university; or </text></clause><clause commented="no" display-inline="no-display-inline" id="idb6b831684b4d4bfaa6798cbd7c7422da"><enum>(iii)</enum><text display-inline="yes-display-inline">is exempted under section 570.72(c) of title 29, Code of Federal Regulations (or any successor regulations), because the worker is engaged in a vocational agricultural training program.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H46E96F4ABC00421DB5FD4EB4982D40F8"><enum>103.</enum><header>Repeal of waiver provision for hand harvest laborers</header><text display-inline="no-display-inline">Section 13(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(c)</external-xref>) is amended by repealing paragraph (4).</text></section><section id="idA7B1E3725AD94EB6AC14197C3EA0BFB5"><enum>104.</enum><header>Pesticide-related worker protection standard</header><subsection id="idDB62A7A063F1431FB30E9F2BD6668863"><enum>(a)</enum><header>Congressional finding</header><text>Congress finds and declares that the engagement for work of children younger than the age of 18 in the occupation of a pesticide handler is particularly hazardous for, and detrimental to the health and well-being of, such children.</text></subsection><subsection id="idA0FFD460BDB74EF4A5C7F9A684E4A07F"><enum>(b)</enum><header>Requirement for Secretary of Labor</header><text>Not later than the date that is 1 year after the date of enactment of this Act, the Secretary of Labor shall revise part 570 of title 29, Code of Federal Regulations (as in effect on the date of enactment of this Act), to prohibit the engagement for work of a child under the age of 18 as a pesticide handler.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idD139ED79FC844A0C88914EB52DB3508E"><enum>(c)</enum><header>Definition of pesticide handler</header><paragraph commented="no" display-inline="no-display-inline" id="id34CB26A148AD41968EB01CCED5B8CC88"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>pesticide handler</term> means, except as provided in subparagraph (B), an individual who—</text><subparagraph commented="no" display-inline="no-display-inline" id="id704707E263A94B7F9F76ACCF53599DEA"><enum>(A)</enum><text display-inline="yes-display-inline">is a child worker performing work at an agricultural establishment or commercial pesticide handling establishment; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id00D07AEE90AD47EF8949B28FA7BE65C2"><enum>(B)</enum><text display-inline="yes-display-inline">is—</text><clause commented="no" display-inline="no-display-inline" id="idB3C0D457BC6649B69A090A5FAC58C77E"><enum>(i)</enum><text display-inline="yes-display-inline">mixing, loading, transferring, or applying pesticides;</text></clause><clause commented="no" display-inline="no-display-inline" id="id96779A33AC104854A5D1B66996E69571"><enum>(ii)</enum><text display-inline="yes-display-inline">disposing of pesticides or pesticide containers; </text></clause><clause commented="no" display-inline="no-display-inline" id="id266A519DE0EB43E6A15B3775C8874E7E"><enum>(iii)</enum><text display-inline="yes-display-inline">handling opened containers of pesticides; </text></clause><clause commented="no" display-inline="no-display-inline" id="idDB271A4EACF142C39B1D7F3A7F0656B1"><enum>(iv)</enum><text display-inline="yes-display-inline">acting as a flagger;</text></clause><clause commented="no" display-inline="no-display-inline" id="idB43265D494B842E3AB13234579A2B716"><enum>(v)</enum><text display-inline="yes-display-inline">cleaning, adjusting, handling, or repairing the parts of mixing, loading, or application equipment that may contain pesticide residues; </text></clause><clause commented="no" display-inline="no-display-inline" id="id5527BF25CFCE4CC5A637A1BF47362101"><enum>(vi)</enum><text display-inline="yes-display-inline">assisting with the application of pesticides; </text></clause><clause commented="no" display-inline="no-display-inline" id="id8A6FD996A64647BBA5A0C0252B20C596"><enum>(vii)</enum><text display-inline="yes-display-inline">entering a greenhouse or other enclosed area—</text><subclause commented="no" display-inline="no-display-inline" id="id09DD38CFEA434534BD93275BC0B32219"><enum>(I)</enum><text display-inline="yes-display-inline">after the application of a pesticide and before—</text><item commented="no" display-inline="no-display-inline" id="id11461CDC2CAA4D4C944F5345CF161B19"><enum>(aa)</enum><text display-inline="yes-display-inline">the inhalation exposure level listed in the labeling has been reached; or </text></item><item commented="no" display-inline="no-display-inline" id="id164FA090492149778DFA9948FFBFC7BE"><enum>(bb)</enum><text display-inline="yes-display-inline">one of the ventilation criteria described in paragraph (3), or in the labeling of the pesticide, has been met; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idD352C909E5404C9ABD81104C9F325EFD"><enum>(II)</enum><text display-inline="yes-display-inline">to—</text><item commented="no" display-inline="no-display-inline" id="id427DE58A956645FEAD56CF414B74145C"><enum>(aa)</enum><text display-inline="yes-display-inline">operate ventilation equipment; </text></item><item commented="no" display-inline="no-display-inline" id="idC13FB7D6B96D4CF5BD976FA9227DA30B"><enum>(bb)</enum><text display-inline="yes-display-inline">adjust or remove coverings used in fumigation; or</text></item><item commented="no" display-inline="no-display-inline" id="id30691884C6184A37850864314C403181"><enum>(cc)</enum><text display-inline="yes-display-inline">monitor air levels;</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id327414E6E0494239B2A05F03545285A3"><enum>(viii)</enum><text display-inline="yes-display-inline">entering a treated area outdoors after application of any soil fumigant to adjust or remove soil coverings such as tarpaulins; </text></clause><clause commented="no" display-inline="no-display-inline" id="idB15D921B8BA54700BC1837677DE6CF2C"><enum>(ix)</enum><text display-inline="yes-display-inline">performing tasks as a crop advisor—</text><subclause commented="no" display-inline="no-display-inline" id="idC5337CACD97D4BF79D6FAE2FCA046B7A"><enum>(I)</enum><text display-inline="yes-display-inline">during any pesticide application; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id65C66EB9598E43C59EF55D6360F20B00"><enum>(II)</enum><text display-inline="yes-display-inline">before—</text><item commented="no" display-inline="no-display-inline" id="idc473a38788cb42e8bc5b078eb0b48597"><enum>(aa)</enum><text display-inline="yes-display-inline">the inhalation exposure level listed in the labeling has been reached; or </text></item><item commented="no" display-inline="no-display-inline" id="id5f4bde6b9de24489bfeb203b94f609a3"><enum>(bb)</enum><text display-inline="yes-display-inline">one of the ventilation criteria described in paragraph (3), or in the labeling of the pesticide, has been met; or</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id235600D0EE7E4BA9B5CFF6CF2E3CF198"><enum>(III)</enum><text display-inline="yes-display-inline">during any restricted-entry interval; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id837503718E984C299EE19D5692F6744E"><enum>(x)</enum><text>performing any task or duty—</text><subclause commented="no" display-inline="no-display-inline" id="id3DA101E73152417FBA2F413BD522ECD4"><enum>(I)</enum><text display-inline="yes-display-inline">described in the definition of the term <term>handler</term> in section 170.3 of title 40, Code of Federal Regulations (or any successor regulations); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idD94D58FCF4124B3D93F3E576D087E4C8"><enum>(II)</enum><text>not otherwise described in clauses (i) through (ix).</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA75E3B56DEA64048B41F7EF5576AB863"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The term <term>pesticide handler</term> described under paragraph (1) does not include any individual who is only handling pesticide containers that have been emptied or cleaned according to pesticide product labeling instructions or, in the absence of such instructions, have been subjected to triple-rinsing or its equivalent.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id278198b978a44b79b1ebb0d02c892ddb"><enum>(3)</enum><header>Ventilation criteria</header><text display-inline="yes-display-inline">The ventilation criteria described in this paragraph are the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="idaf3fa36bab0f4d2cb54e77512d6ea26e"><enum>(A)</enum><header>Fumigant</header><text>In the case of a pesticide applied as a fumigant, an individual may not be in the entire greenhouse (and any adjacent structure that cannot be sealed off from the treated area)—</text><clause commented="no" display-inline="no-display-inline" id="id53daf6d4144d42caaa8ebeb52669abd3"><enum>(i)</enum><text display-inline="yes-display-inline">until the air concentration is measured to be equal to or less than the inhalation exposure level the labeling of the pesticide requires to be achieved; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id4af61b6fa0644249ac7ebaeec1bdbb47"><enum>(ii)</enum><text>in the case of a pesticide with no inhalation exposure level listed on the labeling, until after—</text><subclause id="id9b0657f8b0054861bad41966aab8e570"><enum>(I)</enum><text>ten air exchanges are completed; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id19b8d37c231240749496dc8af3c550b3"><enum>(II)</enum><text display-inline="yes-display-inline">two hours of ventilation using fans or other mechanical ventilating systems; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id32a3ff500741491c95ae0af99baee1dc"><enum>(III)</enum><text display-inline="yes-display-inline">four hours of ventilation using vents, windows or other passive ventilation; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id741991eafc104a998727a9bddaf1e46e"><enum>(IV)</enum><text display-inline="yes-display-inline">eleven hours with no ventilation followed by 1 hour of mechanical ventilation;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0929a5f9a3914551b5e491f89b332fe2"><enum>(V)</enum><text display-inline="yes-display-inline">eleven hours with no ventilation followed by 2 hours of passive ventilation; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id189552039622419eb332a49b118ba0d8"><enum>(VI)</enum><text display-inline="yes-display-inline">twenty-four hours with no ventilation. </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48828a4fd2ae4fc690805ace84c74dc5"><enum>(B)</enum><header display-inline="yes-display-inline">Smoke, mist, fog, or aerosol</header><text>In the case of a pesticide applied as a smoke, mist, fog, or aerosol, an individual may not be in the entire enclosed area until the requirements in clause (i) or (ii) of subparagraph (A) are met.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfcd1d9ce230647318186b79332defd71"><enum>(C)</enum><header display-inline="yes-display-inline">Respiratory protection device required for application by the product labeling</header><text>In the case of a pesticide not otherwise covered by subparagraph (A) or (B) and for which a respiratory protection device is required by the product labeling for application, an individual may not be in the treated area until the requirements in clause (i) or (ii) of subparagraph (A) are met.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idca76f4e34f184745a7319f9992e18b76"><enum>(D)</enum><header display-inline="yes-display-inline">Applied from 12-inches above, as a fine spray, or using pressure greater than 40 psi</header><text>In the case of a pesticide that is not otherwise covered by subparagraph (A), (B), or (C) and is applied from a height of not less than 12 inches from the planting medium, as a fine spray, or using spray pressure greater than 40 pounds per square inch, an individual may not be in the treated area (or any area that is 25 feet or less from the enclosed area) until the application of the pesticide is complete and all required re-entry intervals have been maintained.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida39325d4fc10439181f7400d144b509c"><enum>(E)</enum><header display-inline="yes-display-inline">Other</header><text>In the case of a pesticide that is not otherwise covered by subparagraph (A), (B), (C), or (D), an individual may not be in the treated area until the application of the pesticide is complete and all required re-entry intervals have been maintained.</text></subparagraph></paragraph><paragraph id="id43C1DB3B344748AF9621F21BDFCC18DB"><enum>(4)</enum><header>Definitions</header><text>For purposes of paragraph (1): </text><subparagraph commented="no" display-inline="no-display-inline" id="id8A382805A6B44E8FB07ACA271003DF91"><enum>(A)</enum><header>Agricultural establishment</header><text>The term <term>agricultural establishment</term> means an establishment—</text><clause commented="no" display-inline="no-display-inline" id="id0D8634B4D9C34EB6BA8A6215CA7F4858"><enum>(i)</enum><text display-inline="yes-display-inline">that is an establishment described in the definition of the term <term>agricultural establishment</term> in section 170.3 of title 40, Code of Federal Regulations (or any successor regulations); and</text></clause><clause id="id9CB39921FF644AA3A947F5622E2BF4CD"><enum>(ii)</enum><text>to which subpart C of part 170 of title 40, Code of Federal Regulations (or any successor regulations) applies.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7823a075c30f4947ab3953f5463bf96b"><enum>(B)</enum><header>Child worker</header><text>The term <term>child worker</term> has the meaning given the term <term>worker</term> in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text></subparagraph><subparagraph id="iddd03fbc871c74252af4ac6250062cf06"><enum>(C)</enum><header>Pesticide</header><text>The term <term>pesticide</term> has the meaning given that term in section 2 of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136</external-xref>). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEFB87AB8154F47479E7006E0644004FE"><enum>(D)</enum><header display-inline="yes-display-inline">Other terms</header><text display-inline="yes-display-inline">The terms <term>commercial pesticide handling establishment</term>, <term>crop advisor</term>, <term>farm</term>, <term>forest</term>, <term>fumigant</term>, <term>greenhouse</term>, <term>nursery</term>, <term>restricted-entry interval</term>, and <term>treated area</term> have the meanings given such terms in section 170.3 of title 40, Code of Federal Regulations (or any successor regulations).</text></subparagraph></paragraph></subsection></section></title><title id="id1c579b171f1b4238a65e61fa3b15f75b" style="OLC"><enum>II</enum><header>Penalties and enforcement</header><section id="id7CAE87CE6CCA4B64AEAAF628493A457D" commented="no"><enum>201.</enum><header>Increased civil penalties for child labor violations</header><subsection commented="no" display-inline="no-display-inline" id="id9a3b69fa02da4cb38a1952278afe8d34"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 16(e)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216(e)(1)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id3DA6245038274BD8A0B89A12649F7999"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2a8d284d2d594806b0aa240c20c12d0b"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>not to exceed</quote> and inserting <quote>of an amount (subject to subparagraph (D)) that is</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79b51a0e3ded4f20bd11e2aa7c0b8a5c"><enum>(B)</enum><text display-inline="yes-display-inline">by striking clauses (i) and (ii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id17BB701F04FC4835A53F8E35E760D9B3"><clause commented="no" display-inline="no-display-inline" id="id7942D7FB0BA34A58BA462E7131A4886A" indent="up2"><enum>(i)</enum><text>not less than $1,000 and not more than $156,290 for each worker who was the subject of such a violation, which penalty may be doubled in the case of a violation described in subparagraph (C); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idE946E4578442492DAD552C5BF46F2192" indent="up2"><enum>(ii)</enum><text>not less than $1,000 and not more than $710,310 with regard to each violation of section 12 or 13(c), relating to child labor, or any regulation issued pursuant to such a section, that causes the death or serious injury of any worker younger than the age of 18 years, which penalty may be doubled in the case of a violation described in subparagraph (C).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87A0E6F1B87C4CE0905E75B592DD6197"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="id846F9CCB04374213AD4C351C03D53091" display-inline="no-display-inline" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="id188F4A31B4BE496DAA64567B142B9CE0" indent="up2"><enum>(C)</enum><text>For purposes of penalties that may be doubled under clause (i) or (ii) of subparagraph (A), a violation described in this subparagraph is a violation—</text><clause commented="no" display-inline="no-display-inline" id="id67B8CE010BB34D85AA97C6F257A16456"><enum>(i)</enum><text>that is a repeated or willful violation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2D73B1337A0D48D398835072DB33466D"><enum>(ii)</enum><text>that has occurred within 10 years of the final disposition of another violation of section 12 or 13(c), relating to child labor, or any regulation issued pursuant to such a section; or</text></clause><clause id="idC46CCB75A0144B0C93D14ACBD04248F6" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>for which the employer that committed the violation is found, during the period in which the person was investigated for such violation, to have engaged for work more than 10 children in such a violation. </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf47110d98c054a309a9448cba4e239a0"><enum>(b)</enum><header>Adjustment of amounts for inflation</header><text>Section 16(e)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216(e)(1)</external-xref>), as amended by subsection (a), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDAADD4A83BB2427592FA0A91BC526153"><subparagraph commented="no" display-inline="no-display-inline" id="id988ea26272854ed88061ae595fa438a6" indent="up1"><enum>(D)</enum><text>The dollar amounts referred to in clauses (i) and (ii) of subparagraph (A) shall be increased annually, for fiscal year 2025 and every fiscal year thereafter, by the percent increase, if any, in the consumer price index for all urban consumers (all items; United States city average) for the most recent 12-month period for which applicable data is available.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="ide37a8cdf629e4fdf9e81d9c8c8ac0bbc" commented="no"><enum>202.</enum><header>Special criminal penalties for certain aggravated child labor violations</header><text display-inline="no-display-inline">Section 16(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216(a)</external-xref>) is amended—</text><paragraph id="id6ac521b95da545808adf8da1d87a3ee7" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Any</quote> and inserting <quote>(1) Any</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc00ab7b1f311482e8682f5ce80cedbf4"><enum>(2)</enum><text>by inserting <quote>(other than subsection (a)(4) of such section)</quote> after <quote>section 15</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0615d2daad7d49d88feae3e5bdc0c026"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>subsection</quote> each place it appears and inserting <quote>paragraph</quote>; and</text></paragraph><paragraph id="id18cf3c270d604217b73f21aec1a7a52e" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idD9FE80382B8A4F4EA813EB9F069201EC"><paragraph id="id470f48ba864349e8aeb48582e440d717" indent="up1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id233338695ec64d73911f944f32bcf747"><enum>(A)</enum><text display-inline="yes-display-inline">Any person who violates section 15(a)(4) shall upon conviction thereof be subject to a fine of (subject to subparagraph (B)) not more than $750,000, or to imprisonment for not more than 5 years, or both.</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id53187936d020451b904d6bc6e336cbe0"><enum>(B)</enum><text>The dollar amounts referred to in subparagraph (A) shall be increased annually, for fiscal year 2025 and every fiscal year thereafter, by the percent increase, if any, in the consumer price index for all urban consumers (all items; United States city average) for the most recent 12-month period for which applicable data is available.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="id3aa2efcdd15c4b5594f1de9089e9753b" style="OLC"><enum>III</enum><header>Reports and memorandum of understanding</header><section id="id7bcb3214e26d4a46a86ec03bcd1df2ad" commented="no"><enum>301.</enum><header>Report to Congress on child labor and work-related injuries to children and related matters</header><text display-inline="no-display-inline">The Fair Labor Standards Act of 1938 is amended by inserting after section 12 (<external-xref legal-doc="usc" parsable-cite="usc/29/212">29 U.S.C. 212</external-xref>) the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id391c83708ca641ed8a894ed64cefbce5"><section id="idf5a0e5f6ab564a40aac5d52f360d5fe2" commented="no"><enum>12A.</enum><header>Data on child labor and work-related injuries to children and related matters</header><subsection id="id9e0950f225a14f85aff5e453630a0e8a" commented="no"><enum>(a)</enum><header>Data analysis</header><text>Using the sources specified in subsection (b), the Secretary shall analyze data concerning—</text><paragraph commented="no" display-inline="no-display-inline" id="id8c5d7a0f34844cc6a46a7ca810c2da32"><enum>(1)</enum><text display-inline="yes-display-inline">the number of children younger than 18 years of age who are engaged for work in agriculture and non-agricultural sectors; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f1167906c4c4fa49d02d0c19e42bb90"><enum>(2)</enum><text display-inline="yes-display-inline">any work-related serious injury (as such term is defined in section 16(e)(1)(B) or death of any such child.</text></paragraph></subsection><subsection id="idcad509e4751d41ea88fe5ccc52d9b48f" commented="no"><enum>(b)</enum><header>Sources specified</header><text>The sources referred to in subsection (a) are the following:</text><paragraph id="idb865bb865a0344b393f4241899826ed9" commented="no"><enum>(1)</enum><text>Sources within the Department of Labor, including the Wage and Hour Division, the Bureau of Labor Statistics, and the Occupational Safety and Health Administration.</text></paragraph><paragraph id="ide9e457819174486d87c0d28b65d87a72" commented="no"><enum>(2)</enum><text>State employment security agencies and other relevant State agencies.</text></paragraph><paragraph id="id88670c625b60420ea835f3686eb3ac70" commented="no"><enum>(3)</enum><text>The National Institute for Occupational Safety and Health.</text></paragraph></subsection><subsection id="id1d67b7948c8d44c6b28d7eb2a5e61c9a" commented="no"><enum>(c)</enum><header>Report</header><paragraph id="id4aea284b9f2643e19f0a7e882d3c820f" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>CARE Act of 2024</short-title>, and annually thereafter, the Secretary shall submit a report to Congress which shall include—</text><subparagraph id="iddcf15f4cfd284074b75a25d8d87665d0" commented="no"><enum>(A)</enum><text>a summary of the data collected by the Secretary under—</text><clause commented="no" display-inline="no-display-inline" id="id320e4113ba00478c8ddb4a663b833234"><enum>(i)</enum><text display-inline="yes-display-inline">this section; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id75ed3e29efde4625a83a697bb37955b9"><enum>(ii)</enum><text display-inline="yes-display-inline">section 8(c)(2) of the Occupation Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657(c)(2)</external-xref>) with respect to the death, serious injury or illness of a child younger than 18 years of age;</text></clause></subparagraph><subparagraph id="idb294c234e18a404197c3226ce90299d0" commented="no"><enum>(B)</enum><text>an evaluation, based on such data, that reflects the status of child labor in agricultural and non-agricultural sectors and related industry safety and health hazards; and</text></subparagraph><subparagraph id="ide56b9535915e4c03914564b1a1311641" commented="no"><enum>(C)</enum><text>any information, based on such data, that leads the Secretary to believe that children younger than 18 years of age may have been engaged for work in violation of section 12.</text></subparagraph></paragraph><paragraph id="ida3ecf02239604a618db2564ce803a5cb" commented="no"><enum>(2)</enum><header>Publication</header><text>The Secretary shall, on the date that the Secretary submits each report under paragraph (1) to Congress, publish each such report in the Federal Register and on the website of the Department of Labor.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id2be851a2ca1742e99329351b53b14836" commented="no"><enum>302.</enum><header>Employer reporting requirements</header><text display-inline="no-display-inline">Section 8(c)(2) of the Occupation Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657(c)(2)</external-xref>) is amended by inserting <quote>, including the age of the individual involved</quote> before the period at the end.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idbc0a620157b24db6b99ec319f9d9dc32"><enum>303.</enum><header>Memorandum of understanding</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Assistant Secretary of Labor for Occupational Safety and Health and the Administrator of the Wage and Hour Division of the Department of Labor shall enter into a memorandum of understanding—</text><paragraph commented="no" display-inline="no-display-inline" id="id0a5f6f4b69754376a11cfe5e175a96bb"><enum>(1)</enum><text display-inline="yes-display-inline">to coordinate information sharing and facilitate enforcement activities between the Occupational Safety and Health Administration and the Wage and Hour Division, including with respect to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc15fd54c29224c2681725dd8cb7935e0"><enum>(A)</enum><text display-inline="yes-display-inline">records and reports provided to the Secretary of Labor pursuant to section 8(c) of the Occupational Health and Safety Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657(c)</external-xref>) or in accordance with a State plan that has been approved by the Secretary under section 18 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/667">29 U.S.C. 667</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3369e61cf1574994bc8ca51c2e571238"><enum>(B)</enum><text>any other information available to the Assistant Secretary of Labor for Occupational Safety and Health regarding any injury, illness, or fatality involving a worker who is a child younger than 18 years of age;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ebb97534527408b84dbf7e794bc6596"><enum>(2)</enum><text display-inline="yes-display-inline">that provides that the Assistant Secretary of Labor for Occupational Safety and Health shall encourage each State agency that administers such a State plan in a State to participate in information sharing activities under the memorandum of understanding; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4a58ff702d434fce9c58d122d77a98e4"><enum>(3)</enum><text display-inline="yes-display-inline">that is based on the agreement entitled <quote>Memorandum of Understanding Between the U.S. Department of Labor, Occupational Safety and Health Administration and the U.S. Department of Labor, Wage and Hour Division</quote> and made effective on May 4, 2023.</text></paragraph></section></title><title id="id77913e58ea1b4506afbcc798015a0e0f" style="OLC"><enum>IV</enum><header>Effective dates</header><section commented="no" display-inline="no-display-inline" id="ide230c4a29f574627b214717fc0a86e58"><enum>401.</enum><header display-inline="yes-display-inline">Effective date for application of child labor laws to independent contractors</header><text display-inline="no-display-inline">The amendments made by section 101 shall take effect on the date that is 1 year after the date of enactment of this Act. </text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id61b70ff19dc34209b0cddbc445e9f02c"><enum>402.</enum><header display-inline="yes-display-inline">Application of other fair labor standards amendments</header><subsection id="id6233587be6f6456995c5b2145e3a66d2"><enum>(a)</enum><header>Rulemaking</header><text>Not later than the date that is 12 months after the date of enactment of this Act, the Secretary of Labor shall prescribe rules as necessary to implement the amendments made by sections 102 and 103 and by title II and the revision required by section 104(b). Any such rules issued shall take effect not later than 30 days after the date on which the rules are published in the Federal Register.</text></subsection><subsection id="id0cd43993b70d48349aee1133ef1cc35a"><enum>(b)</enum><header>Violations</header><text>The amendments made by sections 102 and 103 and by title II and the revision required by section 104(b) shall apply to violations of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) that occur after the date on which the rules issued under subsection (a) take effect.</text></subsection><subsection id="id4704644e331e457c97c8f7412118456c"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in the amendments made by sections 102 and 103 and by title II and the revision required by section 104(b) shall be construed to preempt any State law that provides protections or remedies for employees that are greater than the protections or remedies provided under such amendments or such revision. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="idf4279b956ce24ccea92d44e757ba1a0b"><enum>403.</enum><header>Application of Occupational Safety and Health Act amendments</header><subsection commented="no" display-inline="no-display-inline" id="id5806079fb8104609a2c7ef5b88df3e08"><enum>(a)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than the date that is 12 months after the date of enactment of this Act, the Secretary of Labor shall prescribe rules as necessary to implement the amendment made by section 302. Any such rules issued shall take effect not later than 30 days after the date on which the rules are published in the Federal Register.</text></subsection><subsection id="id4682B66293FF42B784833EAEC40F49F3" commented="no"><enum>(b)</enum><header>Violations</header><text>The amendment made by section 302 shall apply to work-related deaths, injuries, and illnesses that occur after the date on which the rules issued under paragraph (1) take effect.</text></subsection></section></title></legis-body></bill>
