Budgetary effects.</toc-entry></toc></subsection></section><section id="H2EEE483C01D14856B35C34BC60CBFEA9"><enum>2.</enum><header>Firefighter PFAS Injury Compensation Program</header><text display-inline="no-display-inline">The Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/201">42 U.S.C. 201 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H3808642537244592BE567B2639F2916C"><title id="HAE4441C1F1014775A021A4DE58D858AD"><enum>XXXIV</enum><header>Firefighter PFAS Injury Compensation Program</header><section id="HE231769CC1204111B7DC09F4DA7C13AB"><enum>3401.</enum><header>Firefighter PFAS Injury Compensation Program</header><subsection id="H69183FB49DC54C20B2D2CC09A73ACB59"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a program, to be known as the Firefighter PFAS Injury Compensation Program (in this title referred to as the <quote>Program</quote>), for the purpose of providing compensation for physical injury or death suffered by firefighters in connection with PFAS-related health conditions.</text></subsection><subsection id="H0A065A87A9D24D46953C5C855631B6D0"><enum>(b)</enum><header>Submission of claims</header><paragraph id="H2FFA83F49B7C43BB8DCE11B21C6D1617"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (3), to seek compensation under the Program, an eligible claimant shall submit to the Secretary a claim—</text><subparagraph id="HE6DB52A1FF70433CAA3D21872F7290E1"><enum>(A)</enum><text>using the claim form developed by the Secretary under paragraph (2); and</text></subparagraph><subparagraph id="HF85B9D408491424F99CA57F5649A05BA"><enum>(B)</enum><text>by presenting any additional evidence, including witness testimony and supporting documents, alongside such claim form.</text></subparagraph></paragraph><paragraph id="H3A3DF439DC594AA491C934D546FBB271"><enum>(2)</enum><header>Claim form</header><text>The Secretary shall develop a claim form that requests the following information:</text><subparagraph id="H797485A11C6C48EF8C03EA9779803BF1"><enum>(A)</enum><text display-inline="yes-display-inline">Information concerning any PFAS-related health condition of the firefighter in relation to whom the eligible claimant seeks compensation, including—</text><clause id="H34F85669FA274CF29DDE0E74421504CE"><enum>(i)</enum><text>proof of the diagnosis of such condition by a physician; and</text></clause><clause id="HE0EAA60FB0564716A6FA2539A19F6528"><enum>(ii)</enum><text>the date of such diagnosis.</text></clause></subparagraph><subparagraph id="H29848922CD9045DE8BF5D6EC1CD0E860"><enum>(B)</enum><text>The years of service of such firefighter.</text></subparagraph><subparagraph id="H34678B5CEE3B4B779C52F53AB5A71B33"><enum>(C)</enum><text>A description of any special circumstances that may support a more substantial award.</text></subparagraph></paragraph><paragraph id="HCF3047F8B63545D59E8CB65CE7C71EA9"><enum>(3)</enum><header>Time limitation</header><text>An eligible claimant may submit a claim under paragraph (1) during the period beginning on the date on which the regulations are promulgated as final under section 3403 and ending on the later of—</text><subparagraph id="HA49FD4F6551B48198A60A0A1B20DCF01"><enum>(A)</enum><text>the date that is 2 years after the date on which such regulations are promulgated as final; and</text></subparagraph><subparagraph id="H37215B6724B545DEB9E293A13F66BD56"><enum>(B)</enum><text>the date that is 2 years after the date of death of the firefighter in relation to whom the eligible claimant seeks compensation.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H4056FD4BB7B2451A86180DC1CD25DAB0"><enum>(c)</enum><header>Eligible claimant</header><paragraph id="H1BCC462C47EA473A8FE834EB4E4D2DFC"><enum>(1)</enum><header>In general</header><text>A person is eligible to submit a claim under the Program only if such person—</text><subparagraph commented="no" id="H0D70C4AE31F346CF8ED7184A7E89BBE7"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H4E389A22A93449E084C0A5C5957473C8"><enum>(i)</enum><text>served as a firefighter for 2 or more years; and</text></clause><clause id="H4446C6C6B45F48F29A2B2706A2EF4744" indent="up1"><enum>(ii)</enum><text>during or after such service, suffered a PFAS-related health condition; or</text></clause></subparagraph><subparagraph id="H0614575D2ADF49E4B78C2D60F9D4957A"><enum>(B)</enum><text>in the case of a deceased firefighter who meets the requirements of subparagraph (A)—</text><clause commented="no" id="H8F70B60917F6460AB3440127254D165F"><enum>(i)</enum><text display-inline="yes-display-inline">is the administrator of the estate of such firefighter; or</text></clause><clause commented="no" id="H18DB6657FAB94F4CA62F27359B017847"><enum>(ii)</enum><text>in the case that the claim is submitted before the date on which the estate of such firefighter is opened—</text><subclause id="HFEDC769E146F40759FA053BC88F52AC5"><enum>(I)</enum><text>is an adult heir of such firefighter; and</text></subclause><subclause id="H0C97D37710E14958B016E0BBF5AED63E"><enum>(II)</enum><text>is represented by counsel.</text></subclause></clause></subparagraph></paragraph><paragraph id="H6DFC8F9AC141418081874B3B622AFB20"><enum>(2)</enum><header>Claims from multiple adult heirs prohibited</header><text display-inline="yes-display-inline">If more than 1 adult heir described in paragraph (1)(B)(ii) submits a claim for the same firefighter before the date on which the estate of such firefighter is opened, all such adult heirs shall cease to be eligible claimants. In such case, the eligible claimant shall be the administrator of the firefighter’s estate under paragraph (1)(B)(i).</text></paragraph></subsection><subsection id="HED2DD0F80F7043B2A6E24243EE3D9C5A"><enum>(d)</enum><header>Review of claims</header><paragraph commented="no" id="H9528CA6D737C4864A9098C91E3707A81"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For each claim submitted under subsection (b)(1), the Secretary shall—</text><subparagraph commented="no" id="H5EFA271D87EE4D7CA0953E70538B784E"><enum>(A)</enum><text>determine whether the firefighter suffered a PFAS-related health condition; and</text></subparagraph><subparagraph commented="no" id="H82A9E03B41E44189B8FCDC620EF6DD15"><enum>(B)</enum><text>not later than 120 days after the date on which the claim is submitted—</text><clause commented="no" id="H3D21AB2BBA6F4BAB940B8253B0C93D5E"><enum>(i)</enum><text>determine the amount of compensation (if any) to award to the eligible claimant, as described in subsection (e); and</text></clause><clause commented="no" id="HAD0053341FE94C99B071DDEFDEA1BFDE"><enum>(ii)</enum><text display-inline="yes-display-inline">provide to the eligible claimant written notice of such determination.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HF4EF4F5A08EB446096BAADCF9C36B046"><enum>(2)</enum><header>No-fault program</header><text>In reviewing claims under paragraph (1), the Secretary—</text><subparagraph commented="no" id="H68CB787555B247E596C3BECDA8A1E5E2"><enum>(A)</enum><text display-inline="yes-display-inline">shall conclude that any PFAS-related health condition of a firefighter was caused by exposure to PFAS during the firefighting activities of such firefighter; and</text></subparagraph><subparagraph commented="no" id="H0958E16188C54128ACBBD54121A49671"><enum>(B)</enum><text>may not consider negligence or any other theory of liability or defense thereto.</text></subparagraph></paragraph><paragraph commented="no" id="HE49A1AA2C8E74BE385EEB4D3A9878543"><enum>(3)</enum><header>Rights of eligible claimant</header><text display-inline="yes-display-inline">An eligible claimant in a review under paragraph (1) shall have the right to be represented by an attorney.</text></paragraph></subsection><subsection id="H6CE7E5042FE5455DA20A53D4FE20AAE6"><enum>(e)</enum><header>Amount of compensation</header><paragraph id="H3837B5E0683F4A82895DDCF2A42E1C0E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The amount of compensation described in subsection (d)(1)(B)(i) is the base award described in paragraph (2), as multiplied by the service modifier described in paragraph (3), and as modified by any special circumstances (as the Secretary determines appropriate).</text></paragraph><paragraph id="H93BBFEC1B93340858E9C1052660EC519"><enum>(2)</enum><header>Base award</header><text>Subject to paragraph (4), the base award described in this paragraph is—</text><subparagraph id="H3FD3A5CAC8B4472DA33E28DFCD19CE2E"><enum>(A)</enum><text display-inline="yes-display-inline">$250,000 for a PFAS-related health condition that is a cancer; and</text></subparagraph><subparagraph id="HAE1504C72A1A424FA7655A4BDF2B6269"><enum>(B)</enum><text display-inline="yes-display-inline">$50,000 for a PFAS-related health condition that is not a cancer.</text></subparagraph></paragraph><paragraph id="HBABC35EA316E42F7B7F2F3B8C6661422"><enum>(3)</enum><header>Service modifier</header><text>The service modifier described in this paragraph is—</text><subparagraph id="H7F61BED34A2A45FA855FC7910B96EC48"><enum>(A)</enum><text>1 for a firefighter with at least 2 and fewer than 5 years of service;</text></subparagraph><subparagraph id="H52467B33A656456CA956B132DA75F9DB"><enum>(B)</enum><text>2 for a firefighter with at least 5 and fewer than 7 years of service;</text></subparagraph><subparagraph id="H27930EAF65AF454C99A1E2DA6D0EA195"><enum>(C)</enum><text display-inline="yes-display-inline">3 for a firefighter with at least 7 and fewer than 10 years of service; and</text></subparagraph><subparagraph id="H5D740E8BA3B7452DA0CF68621BEDE5A0"><enum>(D)</enum><text>4 for a firefighter with at least 10 years of service.</text></subparagraph></paragraph><paragraph id="HEF85F739D9ED4A17B79082792FDB795D"><enum>(4)</enum><header>Inflation adjustments</header><text>The Secretary may adjust the base award described in paragraph (2) to account for any inflation or deflation occurring after the date of enactment of the <short-title>Firefighter PFAS Injury Compensation Act of 2024</short-title>.</text></paragraph><paragraph id="H07810A8A0EE14CDA9DB07A3B29C8839F"><enum>(5)</enum><header>No punitive damages; no consideration of funding availability</header><text display-inline="yes-display-inline">In determining the amount of compensation described in subsection (d)(1)(B)(i), the Secretary—</text><subparagraph id="HC7B664408FFD44CAAD9C57F1187B6070"><enum>(A)</enum><text>may not include any punitive damages; and</text></subparagraph><subparagraph id="HC1AF544F30B9434184249BC3054075B7"><enum>(B)</enum><text display-inline="yes-display-inline">may not consider the amounts available in the PFAS Trust Fund under <external-xref legal-doc="usc" parsable-cite="usc/26/9512">section 9512</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H0D40A47BA9DF4B66AD1C8758FB9FD3C9"><enum>(f)</enum><header>Limitations on claims</header><paragraph commented="no" id="H4B602FD1C00144529A4E2B1C390D024A"><enum>(1)</enum><header>Only 1 cancer and 1 noncancer condition</header><text>An eligible claimant may receive compensation under the Program only with respect to 1 PFAS-related health condition that is a cancer and 1 PFAS-related health condition that is not a cancer.</text></paragraph><paragraph commented="no" id="H41988D2B1D4A4E8EAF24380308122084"><enum>(2)</enum><header>Single claim rule</header><text>Only 1 claim may be submitted under the Program with respect to any firefighter, but a single claim may include multiple PFAS-related health conditions, and claims may be amended and supplemented.</text></paragraph></subsection><subsection id="H1DA7639832CC4DD7976F98EC0F878B1E"><enum>(g)</enum><header>Appeals to Court of Federal Claims</header><paragraph id="H2704B04A362D496B9D980E740CBC242B"><enum>(1)</enum><header>In general</header><text>An eligible claimant aggrieved by a determination of the Secretary with respect to a claim of such eligible claimant under the Program may appeal such determination to the United States Court of Federal Claims.</text></paragraph><paragraph id="H799BD14A7355423FA6BC00FD1F50AAC7"><enum>(2)</enum><header>De novo review</header><text>The United States Court of Federal Claims shall review any determination appealed under paragraph (1) using a de novo standard of review.</text></paragraph><paragraph id="H80FC4F3D94B2490C8E14D16168DF3AFF"><enum>(3)</enum><header>Additional evidence</header><text>As part of an appeal referred to in paragraph (1), an eligible claimant may provide additional evidence, including witness testimony and supporting documents, irrespective of whether such evidence was provided in the claim submitted under subsection (b)(1).</text></paragraph></subsection></section><section commented="no" id="H3940D6AB61DD440EAEE5251D952F58DD"><enum>3402.</enum><header>Payments to eligible individuals</header><subsection commented="no" id="H110120F9A9324068AA8726F024B7B09B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subsection (b), not later than 20 days after the date on which a determination is made by the Secretary regarding the amount of compensation to award an eligible claimant under the Program, the Secretary shall pay to such eligible claimant such amount from the PFAS Trust Fund under <external-xref legal-doc="usc" parsable-cite="usc/26/9512">section 9512</external-xref> of the Internal Revenue Code of 1986.</text></subsection><subsection commented="no" id="H07DB34F4A43B402D92E1E88F9D57CD77"><enum>(b)</enum><header>Limitations</header><paragraph commented="no" id="H6973D959CF8E48B58605B24BC1768C53"><enum>(1)</enum><header>Payment system</header><text>The Secretary shall establish a system for providing compensation for claims in accordance with this subsection and section 3401.</text></paragraph><paragraph commented="no" id="HED8CADFBED664C73B62CF41132AB00C1"><enum>(2)</enum><header>Agency policies and procedures</header><subparagraph commented="no" id="H6260A9C9CB9944EAB59FCBE138B1BBE3"><enum>(A)</enum><header>Development</header><clause commented="no" id="HE8FBC0C6A4A14003825F6B28CC9F7C09"><enum>(i)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of the <short-title>Firefighter PFAS Injury Compensation Act of 2024</short-title>, the Secretary shall develop agency policies and procedures that meet the requirements described in clauses (ii) and (iii) for providing compensation for claims.</text></clause><clause id="H439BE2D710F34CAEA6ECA59CB7EA5BD5"><enum>(ii)</enum><header>No exceeding amounts in Fund</header><text display-inline="yes-display-inline">The policies and procedures developed under clause (i) shall ensure that total obligations and expenditures in providing compensation for claims do not exceed the amounts appropriated to the PFAS Trust Fund under <external-xref legal-doc="usc" parsable-cite="usc/26/9512">section 9512</external-xref> of the Internal Revenue Code of 1986.</text></clause><clause commented="no" id="HAA7BB2AABED74C0E87FA0E1F9FCB54BF"><enum>(iii)</enum><header>Proration</header><text>The policies and procedures developed under clause (i) shall include a process for prorating payments when funding is deficient and for supplementing the prorated payments as funding becomes available consistent with paragraph (3).</text></clause></subparagraph><subparagraph commented="no" id="HA8F966BB96D34E5F922F9298458526F2"><enum>(B)</enum><header>Reassessment</header><text>Not later than 1 year after the date of enactment of the <short-title>Firefighter PFAS Injury Compensation Act of 2024</short-title>, and annually thereafter, the Secretary shall conduct a reassessment of the agency policies and procedures developed under subparagraph (A) to ensure that such policies and procedures continue to satisfy the requirements described in clauses (ii) and (iii) of such subparagraph. If the Secretary determines, upon reassessment, that such agency policies or procedures do not achieve the requirements of such clauses, the Secretary shall take additional actions or make such modifications as necessary to achieve such requirements.</text></subparagraph></paragraph><paragraph commented="no" id="H7AE88D2D83374975B716076D16320142"><enum>(3)</enum><header>Adjustment for delayed payment due to insufficient funding</header><subparagraph commented="no" id="HB21658A2F2C84EF781812AEA7858E3F8"><enum>(A)</enum><header>In general</header><text>For any claim for which the Secretary advises the eligible claimant that the amount of compensation to be paid has been reduced on the basis of insufficient funding, the Secretary shall, in the first fiscal year beginning after sufficient funding becomes available, pay to the eligible claimant the unpaid amount plus 6 percent interest per annum on such unpaid amount.</text></subparagraph><subparagraph commented="no" id="H142387925EDA4B12B6F4DD0B787D9FFD"><enum>(B)</enum><header>Definitions</header><text>In this paragraph:</text><clause commented="no" id="H47BF52C007264782B63D0C24AD8F23A4"><enum>(i)</enum><header>Insufficient funding</header><text>The term <term>insufficient funding</term> means funding that the Secretary determines is insufficient for purposes of compensating all claims under the Program.</text></clause><clause commented="no" id="HEDCCB98719D94938874238147DED4762"><enum>(ii)</enum><header>Sufficient funding</header><text display-inline="yes-display-inline">The term <term>sufficient funding</term> means funding that the Secretary determines is sufficient for purposes of compensating all claims under the Program.</text></clause><clause id="HE78F1A879302469EAFDE99E8E11B9E80"><enum>(iii)</enum><header>Unpaid amount</header><text display-inline="yes-display-inline">The term <term>unpaid amount</term> means the amount of additional compensation the eligible claimant would have been paid under the Program if sufficient funding had been available.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H853BE224063E4844AABE3F294C79458A"><enum>(4)</enum><header>Decedents’ creditors</header><text>Compensation paid under the Program is not subject to a claim of a creditor of any deceased firefighter with respect to whom such compensation was paid.</text></paragraph></subsection><subsection commented="no" id="HBC6DE4EF61BC4FD8AA34E00D31C8CA68"><enum>(c)</enum><header>Attorneys’ fees</header><paragraph id="HF2331C3CB74847438AC63F365C85E17D"><enum>(1)</enum><header>Maximum percentage</header><text>Notwithstanding any contract, attorneys’ fees for services rendered in obtaining compensation under the Program (including an appeal under section 3401(g)) may not exceed the highest percentage permitted under section 2678 of title 28, United States Code.</text></paragraph><paragraph id="H9918FCC878924E638BF64EB02AFC39A3"><enum>(2)</enum><header>Penalties</header><text>Any attorney who charges, demands, receives, or collects for services rendered in connection with obtaining compensation under the Program any amount in excess of that allowed under this subsection, if recovery be had, shall be subject to the penalties provided in such section 2678.</text></paragraph></subsection></section><section id="HFB92AE4D431E482D9B639D95847E0959"><enum>3403.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this title, the Secretary shall promulgate regulations to carry out this title, including regulations with respect to—</text><paragraph id="HCCE6BD9E30224F32ADAEDF3D92B08798"><enum>(1)</enum><text>the claim form developed by the Secretary under section 3401(b)(2);</text></paragraph><paragraph id="HEAB07C2E23DF43B88188DB77B0C368D8"><enum>(2)</enum><text>procedures for hearing and the presentation of evidence;</text></paragraph><paragraph id="H0A9497F1F2F1428DABEEE4E6D1AFBE5E"><enum>(3)</enum><text>procedures to assist a person in submitting and pursuing a claim under this title; and</text></paragraph><paragraph id="H55051C8E82D5426DBA36EBD17E2DDDB8"><enum>(4)</enum><text>other matters determined appropriate by the Secretary.</text></paragraph></section><section id="H0CC4C7854FC14D178C613952F1CDA467"><enum>3404.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="HD4C035E521E947E88197004280F9252D"><enum>(1)</enum><header>Firefighter</header><text display-inline="yes-display-inline">The term <term>firefighter</term> means a member of a civilian or military fire department or volunteer fire organization who is qualified to respond to and extinguish fires.</text></paragraph><paragraph id="HAF635E78BA474238805DBB2D5C5120F8"><enum>(2)</enum><header>Heir</header><text display-inline="yes-display-inline">The term <term>heir</term> means, in relation to a deceased individual, an individual who, at the time of death of the deceased individual, was a spouse, parent, child, grandchild, or sibling of the deceased individual.</text></paragraph><paragraph id="HCFABC800A47C4C079F2FD09F60C20236"><enum>(3)</enum><header>PFAS</header><text>The term <term>PFAS</term> means per- and polyfluoroalkyl substances.</text></paragraph><paragraph id="H328638A3CA50475486F19FF5090060D6"><enum>(4)</enum><header>PFAS-related health condition</header><subparagraph id="H82B06E4343DA4BF7906910488A751F9E"><enum>(A)</enum><header>In general</header><text>The term <term>PFAS-related health condition</term> means an illness or health condition for which exposure to PFAS is likely to be a significant factor in aggravating, contributing to, or causing the illness or health condition, including—</text><clause id="HDAD5966EEE7148E6BF97B51E97CF4CF1"><enum>(i)</enum><text>cancers of the kidney, testicle, liver, prostate, bladder, pancreas, breast, colon, and ovary;</text></clause><clause id="H1A9643B089FD4E98B80304BE94E46567"><enum>(ii)</enum><text>thyroid diseases; </text></clause><clause id="H7D474549AA234636967E9F59F0237DB8"><enum>(iii)</enum><text>ulcerative colitis; and</text></clause><clause id="H79BADB65155B439599A37D45880097A4"><enum>(iv)</enum><text>any other illness or health condition, as the Secretary determines appropriate.</text></clause></subparagraph><subparagraph id="HEEE1B663A9304E918DCD1983ED259BDF"><enum>(B)</enum><header>Advisory panel</header><clause id="HB70E7A33BA2A456BAE9D58AC0C875D84"><enum>(i)</enum><header>Establishment</header><text>The Secretary shall establish an advisory panel of individuals with appropriate expertise to advise the Secretary on which other illnesses or health conditions should be considered PFAS-related health conditions under subparagraph (A)(iv).</text></clause><clause id="HD6651A28FDA84EB2A2B589620DFE71C4"><enum>(ii)</enum><header>Recommendations regarding specific claims</header><text>For each claim submitted under subsection (b)(1) with respect to an illness or health condition not listed in clauses (i) through (iii) of subparagraph (A), or previously determined by the Secretary to be a PFAS-related health condition under clause (iv) of such subparagraph, the advisory panel established under clause (i) shall, not later than 90 days after the submission of such claim, submit to the Secretary a recommendation on whether the illness or health condition should be considered a PFAS-related health condition.</text></clause><clause id="H119916595B684296B8B22D13D3FD3F89"><enum>(iii)</enum><header>Termination</header><text>Section 1013(a)(2) of title 5, United States Code, (relating to the termination of advisory committees) shall not apply to the advisory panel established under clause (i).</text></clause></subparagraph></paragraph></section><section id="H41D9F017C72C47969602F51F8A2F6AC4"><enum>3405.</enum><header>Funding</header><subsection id="H172E37E3D0E24A98B74019361B0F0740"><enum>(a)</enum><header>Compensation paid only from PFAS Trust Fund</header><text>Compensation under this title may be awarded only from amounts in the PFAS Trust Fund established under <external-xref legal-doc="usc" parsable-cite="usc/26/9512">section 9512</external-xref> of the Internal Revenue Code of 1986.</text></subsection><subsection id="H2565631CEF534C129F03391A15A9A0A9"><enum>(b)</enum><header>Authorization of appropriations for administrative costs</header><text>There is authorized to be appropriated for the costs of administering and carrying out this title such sums as may be necessary for each of fiscal years 2025 through 2029.</text></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block></section><section section-type="subsequent-section" id="HEC802E3A60734E8286BBAC8D1CB9C6A7"><enum>3.</enum><header>PFAS Trust Fund</header><subsection id="H02F5C0C8F5BC47F8A9E9C154751C2A1A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/98">chapter 98</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD88F630C9EA945419D1BFABA17BB5E2B"><section id="H56F4586D40934D92A4EFE310C734062E"><enum>9512.</enum><header>PFAS Trust Fund</header><subsection id="HCA6A0667D592474E8EA8698211F9508B"><enum>(a)</enum><header>Creation of Trust Fund</header><text display-inline="yes-display-inline">There is hereby established in the Treasury of the United States a trust fund to be known as the <quote>PFAS Trust Fund</quote>, consisting of such amounts as may be appropriated or credited to such Trust Fund as provided in this section or section 9602(b).</text></subsection><subsection id="H3B927CAD94F5483B9C414C45E8E90BD7"><enum>(b)</enum><header>Transfer to Trust Fund of amounts equivalent to certain taxes and contributions</header><text display-inline="yes-display-inline">There are hereby appropriated to the PFAS Trust Fund amounts equivalent to—</text><paragraph id="H53208A60FD704E768B26328DCA5FCD0F"><enum>(1)</enum><text>the taxes received in the Treasury under sections 4191 and 5000E, and</text></paragraph><paragraph commented="no" id="HE01D581C30554397A10718C3EB3740B4"><enum>(2)</enum><text>the contributions accepted by the Secretary of Health and Human Services under subsection (c).</text></paragraph></subsection><subsection commented="no" id="H1ED174A9BEE0430F8FEAEB29A5EA21AE"><enum>(c)</enum><header>Contributions</header><text>The Secretary of Health and Human Services may accept contributions to the PFAS Trust Fund under such terms and conditions as the Secretary determines appropriate.</text></subsection><subsection id="HF6C15BAA35EC4B25B191F102791419C9"><enum>(d)</enum><header>Expenditures from Trust Fund</header><text display-inline="yes-display-inline">Amounts in the PFAS Trust Fund shall be available, without further appropriation, to the Secretary of Health and Human Services to provide compensation through the Firefighter PFAS Injury Compensation Program under title XXXIV of the Public Health Service Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H42A45ED2A8EB47429CBF0BA25E5CB902"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subchapter A of chapter 98 of such Code is amended by adding at the end the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8AC099A7E7C24C2E87C26B5187C31509"><toc regeneration="yes-regeneration"><toc-entry idref="H56F4586D40934D92A4EFE310C734062E" level="section">Sec. 9512. PFAS Trust Fund.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6605ECA0FB17455FBA6FA8C149F42229"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to amounts received after the date of the enactment of this Act.</text></subsection></section><section id="H0D1725CA16AD4937804EA8F3C0B03095"><enum>4.</enum><header>Excise tax on PFAS manufacturers</header><subsection id="H31C65881A7E947D586E4749E3989C560"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 32 of subtitle D of the Internal Revenue Code of 1986 is amended by inserting after subchapter D the following new subchapter:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H541C893FC8674F05B9B1021A6B0AD59A"><subchapter id="H23BE3903B02A4E06B23C780C1BC332D0"><enum>E</enum><header>PFAS</header><toc container-level="subchapter-container" quoted-block="no-quoted-block" lowest-level="section" idref="H23BE3903B02A4E06B23C780C1BC332D0" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry idref="H26536B453986446E83AC3EB24FB84923" level="section">Sec. 4191. PFAS excise tax.</toc-entry></toc><section id="H26536B453986446E83AC3EB24FB84923"><enum>4191.</enum><header>PFAS excise tax</header><subsection id="H35F92180842A4C8885816BDB98BE11AE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is hereby imposed on PFAS products sold by the manufacturer, producer, or importer thereof a tax equal to 10 percent of the price for which so sold.</text></subsection><subsection id="HB80E413C44004FFD8A1668B6960AB8F6"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text><paragraph id="H23AC190197BC44BAA049A81A20D17DE6"><enum>(1)</enum><header>PFAS</header><text>The term <term>PFAS</term> means per- and polyflouroalkyl substances.</text></paragraph><paragraph id="HEA8E804804A04FDC924592BF1C49A1FF"><enum>(2)</enum><header>PFAS products</header><text>The term <term>PFAS products</term> means any product containing PFAS, including firefighter gear containing PFAS.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H71708E87973B4EE08218931E9EC0C3F8"><enum>(b)</enum><header>Clerical amendment</header><text>The table of subchapters for chapter 32 of subtitle D of such Code is amended by inserting after the item relating to subchapter D the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H51277770C9D840248E8EA36D52E9D8FF"><toc regeneration="no-regeneration"><toc-entry level="section">Subchapter E. PFAS litigation excise tax.</toc-entry></toc><section id="HB1745F94A0534E67BE02682E140EAA3D"><enum>5000E.<?LEXA-Enum 5000E.?></enum><header>PFAS litigation excise tax</header><subsection id="H400AB7EFDBEA426A8A0A24ADF830889D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is hereby imposed a tax on any taxpayer that pays a qualifying PFAS litigation award during the taxable year in an amount equal to 10 percent of the present value of such award.</text></subsection><subsection id="HE021FEB0884F46B5BE12839B991C0028"><enum>(b)</enum><header>Qualifying PFAS litigation award</header><text>For purposes of this section, the term <term>qualifying PFAS litigation award</term> means a payment made pursuant to any final court order or settlement to compensate any person for harm suffered as a result of exposure to PFAS (as defined in section 4191) other than a claim for personal injury.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF674717ABCE04AD2AA8D1EF65E31F471"><enum>(b)</enum><header>Clerical amendment</header><text>The table of chapters for subtitle D of the Internal Revenue Code of 1986 is amended by adding at the end the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBFD81909D9094CB3BFC81E4BAC1CE8B7"><toc><toc-entry level="chapter" bold="off">CHAPTER 50B—PFAS LITIGATION</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id226675e3ce1d4157a9f9f5af608b0ae3"><enum>(c)</enum><header display-inline="yes-display-inline">Effective date</header><text>The amendments made by this section shall apply to payments paid or incurred after the date of the enactment of this section.</text></subsection></section><section id="H24E8EB8EAAD147F1962AE96C5207B387"><enum>6.</enum><header>Budgetary effects</header><subsection commented="no" id="HCD79386D96C54D47AD8FE5B8122D5886"><enum>(a)</enum><header>Statutory PAYGO scorecards</header><text display-inline="yes-display-inline">The budgetary effects of this Act and the amendments made by this Act shall not be entered on either PAYGO scorecard maintained pursuant to section 4(d) of the Statutory Pay As-You-Go Act of 2010.</text></subsection><subsection commented="no" id="HD916C3EB901C4ADAB105D87E9332F18F"><enum>(b)</enum><header>Senate PAYGO scorecards</header><text display-inline="yes-display-inline">The budgetary effects of this Act and the amendments made by this Act shall not be entered on any PAYGO scorecard maintained for purposes of section 4106 of H.
