Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to direct the Secretary of Veterans Affairs to offer annual preventative health evaluations to veterans with a spinal cord injury or disorder and increase access to assistive technologies, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA918EFDC92AD4FE783331728464DD7A3"><section section-type="section-one" id="H10FEC139FFC14C9AAA0E3505AB39AF1E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Spinal Trauma Access to New Devices Act</short-title></quote> or the <quote><short-title>Veterans STAND Act</short-title></quote>.</text></section><section id="H0B301197EBF84E46B991A40AA0237DD5"><enum>2.</enum><header>Provision of preventative health evaluations for veterans with a spinal cord injury or disorder</header><subsection commented="no" display-inline="no-display-inline" id="id9e44d2c905b1471ca2f99d0435980594"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/1712C">section 1712C</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id332DFBD2E74F4154B8259144186AC670"><section id="id647127961a7043c5be30dad6d8ae6a18"><enum>1713.</enum><header>Preventative health evaluations for veterans with a spinal cord injury or disorder</header><subsection id="HBAFC78F815BF48FAA01CF1F55AA5A320"><enum>(a)</enum><header>Health evaluations</header><text>The Secretary shall furnish (through direct provision of service, referral, or a telehealth program operated by the Department) a preventative health evaluation annually to any veteran with a spinal cord injury or disorder who elects to undergo the evaluation.</text></subsection><subsection id="H6C18511D5EC749C0A3E77A18ED73960A"><enum>(b)</enum><header>Assessments</header><text>The evaluation described in subsection (a) shall include the following:</text><paragraph id="H50D24E2A5AE34FAEAFC0C571A1E7A63C"><enum>(1)</enum><text>An assessment of any circumstance or condition the veteran is experiencing that indicates a risk for any health complication related to a spinal cord injury or disorder, including a risk of comorbidities.</text></paragraph><paragraph id="H8C2C7D3E119D4077B180D405CDF978DD"><enum>(2)</enum><text>An assessment regarding chronic pain and, if applicable, the management of chronic pain.</text></paragraph><paragraph id="H8897B6EB47C74AB6820BD0F0982646BB"><enum>(3)</enum><text>An assessment regarding dietary management and weight management.</text></paragraph><paragraph id="H35142098A2234347969966B37D7E36C0"><enum>(4)</enum><text>An assessment regarding prosthetic equipment, including which prosthetic equipment the veteran needs, how well any existing prosthetic equipment is functioning considering the needs of the veteran, and any safety concerns regarding the prosthetic equipment in use by or recommended to the veteran.</text></paragraph><paragraph id="HF94854CBB3314E949A4AD915E0A9DA27"><enum>(5)</enum><text>An assessment for the provision of any assistive technology that could help maximize the independence and mobility of the veteran.</text></paragraph></subsection><subsection id="H3EF40D1FC7954653BC3CE3C2DBF2450F"><enum>(c)</enum><header>Consultation</header><paragraph commented="no" display-inline="no-display-inline" id="idb74e8df7804f469b8e4712f168078127"><enum>(1)</enum><header>Spinal cord injury and disorder program managers</header><text display-inline="yes-display-inline">In maintaining, prescribing, or amending any guidance, rules, or regulations issued by the Department regarding the requirements set out in this section, the Secretary shall consult with the spinal cord injury and disorder program managers of the Department, clinicians employed by the Department as specialists in spinal cord injuries and disorders, and the organizations named in or approved under section 5902 of this title.</text></paragraph><paragraph id="H81DB3A7356B74FE6A34768DEEF047B15"><enum>(2)</enum><header>Manufacturers and other entities</header><text display-inline="yes-display-inline">In issuing any guidance, rules, or regulations regarding the requirements set out in this section, the Secretary may consult with manufacturers of assistive technologies and other entities relevant to the provision of assistive technologies if the guidance, rules, or regulations would directly affect such manufacturers or entities.</text></paragraph></subsection><subsection commented="no" id="H1A0C8FEB2F0446BA8694D26126E39693"><enum>(d)</enum><header>Information on evaluation</header><text display-inline="yes-display-inline">The Secretary shall ensure, to the extent possible, that any veteran known by the Secretary to have a spinal cord injury or disorder receives information annually about the evaluation available under this section and the benefits to the veteran of choosing to undergo the evaluation.</text></subsection><subsection id="HC7CAB8AA91214AEE9D1D9957B09097D7"><enum>(e)</enum><header>Use of evaluation in performance reviews</header><text>In reviewing the performance metrics of a Veterans Integrated Service Network for any year beginning after the date that is one year after the date of the enactment of the <short-title>Veterans Spinal Trauma Access to New Devices Act</short-title>, the Secretary shall consider the provision of evaluations under this section. </text></subsection><subsection id="H63AB0FBF0FC84D858019639BF4A5C2A1"><enum>(f)</enum><header>Report</header><text>Not later than one year after the date of the enactment of the <short-title>Veterans Spinal Trauma Access to New Devices Act</short-title>, and every two years thereafter, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report that includes the following:</text><paragraph id="HB17BAA4E17364C4B8F3E5EC675382A51"><enum>(1)</enum><text>For the period covered by the report—</text><subparagraph id="H0B8A6BE48D89444D9C56EEC5E730AF4F"><enum>(A)</enum><text>the number of veterans who received hospital care or medical services from the Department and used an assistive technology;</text></subparagraph><subparagraph id="HDA2930A4AC6D491389AC928BA23C9914"><enum>(B)</enum><text display-inline="yes-display-inline">the number of veterans who received hospital care or medical services from the Department and were assessed for the provision of an assistive technology; and</text></subparagraph><subparagraph id="H0BCF80ECD2EF491CB30D1EB7CAF9E1A3"><enum>(C)</enum><text display-inline="yes-display-inline">the number of veterans who received hospital care or medical services from the Department and were prescribed an assistive technology.</text></subparagraph></paragraph><paragraph id="H51A28C15B3004B0481A39402B813EBE7"><enum>(2)</enum><text>For the two-year period immediately prior to year the report is submitted, the year-to-year change in the percentage of veterans with a spinal cord injury or disorder who received an evaluation under this section.</text></paragraph></subsection><subsection commented="no" id="HDE04FDA1345E4FB78867503E2EED2AB2"><enum>(g)</enum><header>Assistive technology defined</header><text display-inline="yes-display-inline">In this section, the term <term>assistive technology</term> means a powered medical device or electronic tool used to treat or alleviate symptoms or conditions caused by a spinal cord injury or disorder, including the following:</text><paragraph commented="no" id="H4F2BDC6ABE304BB087B8E1339F75AE22"><enum>(1)</enum><text>A personal mobility device, including a powered exoskeleton device.</text></paragraph><paragraph commented="no" id="H3FCBE5CAC66743D9903B576A8408C937"><enum>(2)</enum><text>A speech generating device.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id599a5a7cf37a4ff08a9bd6636e4cb8e0"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 17 of such title is amended by inserting after the
