which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To place limitations on excepting positions from the competitive service, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HDE06E74B29B4449CA6027F3D28E90A4A"><section id="id949910B4BA524AED909B68AE72733272" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Saving the Civil Service Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HC8808302347C"><enum>2.</enum><header>Limitations on excepting positions from competitive service and transferring positions</header><subsection id="H70D4A6B0009C48E9B00E794E5BDB6ACA"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HA3886580F6E540719DBEF25D614759A4"><enum>(1)</enum><text>the term <term>agency</term> means any department, agency, or instrumentality of the Federal Government; </text></paragraph><paragraph id="H6EEDD611115C453283EC2D760A75BA60"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>competitive service</term> has the meaning given the term in section 2102 of title 5, United States Code;</text></paragraph><paragraph id="H81C565C0B5EB4F64A04396247D322CE8"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>Director</term> means the Director of the Office of Personnel Management; and</text></paragraph><paragraph id="H8AC383370790459E9B7155B7808CBCEF" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>excepted service</term> has the meaning given the term in section 2103 of title 5, United States Code.</text></paragraph></subsection><subsection id="H986D7E04E9154A3DA3A954BAD1107994"><enum>(b)</enum><header>Limitations</header><text display-inline="yes-display-inline">A position in the competitive service may not be excepted from the competitive service unless that position is placed—</text><paragraph id="H9F24F10D86F845C0B6FF55FECA7ECAB5"><enum>(1)</enum><text display-inline="yes-display-inline">in any of schedules A through E, as described in section 6.2 of title 5, Code of Federal Regulations, as in effect on September 30, 2020; and</text></paragraph><paragraph id="H2D780E6475B04695B8C4091ECEB96227"><enum>(2)</enum><text display-inline="yes-display-inline">under the terms and conditions under part 6 of title 5, Code of Federal Regulations, as in effect on September 30, 2020.</text></paragraph></subsection><subsection id="HD1F45449FEC54C759E4CCD2B58B48AAA"><enum>(c)</enum><header>Transfers</header><paragraph id="HDF01520D232948759CD34A06956609B1"><enum>(1)</enum><header>Within excepted service</header><text display-inline="yes-display-inline">A position in the excepted service may not be transferred to any schedule other than a schedule described in subsection (b)(1).</text></paragraph><paragraph commented="no" id="HD7848C905CBB4125BDE2470DAFED4015"><enum>(2)</enum><header>OPM consent required</header><text display-inline="yes-display-inline">An agency may not transfer any occupied position from the competitive service or the excepted service into schedule C of subpart C of part 213 of title 5, Code of Federal Regulations, or any successor regulations, without the prior consent of the Director.</text></paragraph><paragraph commented="no" id="HDB3DB626AB854DCB944BF5AAC61030AF"><enum>(3)</enum><header>Limit during presidential term</header><text>During any 4-year presidential term, an agency may not transfer from a position in the competitive service to a position in the excepted service the greater of the following: </text><subparagraph commented="no" id="id4ED2FD3C8185469AA2EF4482D584BAC1"><enum>(A)</enum><text>A total number of employees that is more than 1 percent of the total number of employees employed by that agency, as of the first day of that presidential term. </text></subparagraph><subparagraph commented="no" id="idE36118A4053B4849B433F6AC094B5BF3"><enum>(B)</enum><text>5 employees.</text></subparagraph></paragraph><paragraph id="H749B4AAF92AF49399A16030EECA7E0EB"><enum>(4)</enum><header>Employee consent required</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section—</text><subparagraph id="H0D0930D2CCBB486CA548D335FC4BB71D"><enum>(A)</enum><text>an employee who occupies a position in the excepted service may not be transferred to an excepted service schedule other than the schedule in which that position is located without the prior written consent of the employee; and</text></subparagraph><subparagraph id="HDBDE9AEDAC6E48C1B64490C703357F73"><enum>(B)</enum><text>an employee who occupies a position in the competitive service may not be transferred to the excepted service without the prior written consent of the employee.</text></subparagraph></paragraph></subsection><subsection id="H6C654605F0574B0286D18B56660387F4"><enum>(d)</enum><header>Other matters</header><paragraph id="HFFCC94A5D43E444198E83595B310D5E6"><enum>(1)</enum><header>Application</header><text>Notwithstanding section 7425(b) of title 38, United States Code, this section shall apply to a position under chapter 73 or 74 of that title.</text></paragraph><paragraph commented="no" id="HE2C9EA6873294F35B83E4E68AA44CC09"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than March 15 of each calendar year, the Director shall submit to Congress a report on the immediately preceding calendar year that lists—</text><subparagraph commented="no" id="HD4FEAF3A94BB4DA495BC213B47506722"><enum>(A)</enum><text>each position that, during the year covered by the report, was transferred from the competitive service to the excepted service and a justification as to why each such position was so transferred; and</text></subparagraph><subparagraph commented="no" id="H231E42A0D39C492DA921842FCAAF8DFF"><enum>(B)</enum><text>any violation of this section that occurred during the year covered by the report.</text></subparagraph></paragraph></subsection><subsection id="HCF5015DB3AA3428198FE183050D1F08D"><enum>(e)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Director shall issue regulations to implement this section.</text></subsection></section></legis-body></bill>
