which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize and encourage the United States Agency for International Development to pursue a model of locally led development and humanitarian response and expanded engagement with local partners and to increase its local partner base.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Locally Led Development and Humanitarian Response Act</short-title></quote>.</text></section><section id="idb7f11464bc0a4aeaad44e584b4140141"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to encourage USAID to pursue a model of locally led development and humanitarian response and expanded engagement and partnership with local entities.</text></section><section id="idadf5d75a91a2466e9b979f000414f1c2"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id6043d1fbb96e455ca678749d34a5af45"><enum>(1)</enum><text>locally led development and humanitarian response—</text><subparagraph commented="no" display-inline="no-display-inline" id="id39f688cb375745d88f89c4dab15b3477"><enum>(A)</enum><text display-inline="yes-display-inline">is more equitable and inclusive;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0b78239456e44d5f9d7066afb464b8f5"><enum>(B)</enum><text display-inline="yes-display-inline">is linked to more efficient and sustainable development and humanitarian outcomes; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd28596a4bc094d2ab4ab61957becd62f"><enum>(C)</enum><text display-inline="yes-display-inline">is vital to building long-term self-reliance;</text></subparagraph></paragraph><paragraph id="id90d3754f96d74865b3a21ca9ff53b8d9"><enum>(2)</enum><text>over multiple presidential administrations, USAID has sought to achieve greater development outcomes through stronger local partnerships, including through <quote>Country Ownership</quote>, <quote>The Journey to Self-Reliance</quote>, and <quote>Locally Led Development</quote>;</text></paragraph><paragraph id="id3f29f0a56ab14ec09ed27a19bc7f05ba"><enum>(3)</enum><text>USAID should increase direct funding to local entities, including by increasing the amount of development and humanitarian assistance to such entities;</text></paragraph><paragraph id="id419f3981a1834114b58c7e00edfb537a"><enum>(4)</enum><text>USAID should ensure its programming enables local communities to exercise leadership over priorities, project design, implementation, and measuring and evaluating results of such programs;</text></paragraph><paragraph id="id27a7b30ef74d4965896de915535f0b85"><enum>(5)</enum><text>working with local partners often requires more time and resources than traditional partners, including extended availability of funds and additional staff resources; and</text></paragraph><paragraph id="idc8df07cd5c4b4c51b7a1610fd77be220"><enum>(6)</enum><text>increased flexibility is critical to enable USAID to respond to local priorities and leverage local capacities, including with respect to staffing, availability of funds, program design, and acquisition and assistance processes.</text></paragraph></section><section id="id4cd9e52a005b4970a5abafd2b8d1418d"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id8e18d33022144c7296c8451fd1445231"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="ida58f407bd8eb40889344a6a91f867ad0"><enum>(A)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idba549c31a05a4e0a956578462d08690a"><enum>(B)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text></subparagraph><subparagraph id="idc1379b40ef854855afe4f53536e0da0f"><enum>(C)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4fbc6aba6fed4cd4a4050f1f11774444"><enum>(D)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="ida56ff26b125e4b26a4c8495c4fdde986" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>NICRA</header><text>The term <term>NICRA</term> means Negotiated Indirect Cost Rate.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1e8723d207124c87bf1f0c488ec830f6"><enum>(3)</enum><header display-inline="yes-display-inline">USAID</header><text>The term <term>USAID</term> means the United States Agency for International Development. </text></paragraph></section><section id="idbd3dc028cfc34fa698995948621577d7"><enum>5.</enum><header>Working with local partners</header><text display-inline="no-display-inline">The Administrator of USAID should, to the extent feasible and appropriate, localize the USAID partner base by—</text><paragraph id="idb88bc1953bc0433fbd7d00d4c6b12337"><enum>(1)</enum><text>simplifying and increasing access to USAID resources for local partners in humanitarian and development sectors, including local partners who have relations, agency, or power structures in place that produced, or can produce, strong trust, accountability, and legitimacy in the communities or networks in which such partners work;</text></paragraph><paragraph id="idbdd75403d8174e50a8be3a0055a452e5"><enum>(2)</enum><text>diversifying award types to streamline performance requirements and working with the Office of Management and Budget to address threshold constraints, such as fixed amount subaward thresholds, category management award targets, and other thresholds, policies, and contracting incentives that pose a barrier to effectively supporting local partners;</text></paragraph><paragraph id="idba7e3f7f5360441c989e9fb6a3cc2642"><enum>(3)</enum><text>streamlining monitoring and evaluation, periodic reporting, and other USAID reporting requirements;</text></paragraph><paragraph id="id814b39048d2d45dab195df6e088f516d"><enum>(4)</enum><text>ensuring USAID staff are able and encouraged to conduct regular consultation with local partners in local languages of the host countries, making available solicitations for acquisitions and assistance and accepting submissions in local languages, video format, or verbal presentations, including by—</text><subparagraph id="id94e48b167c6c48b59e70cbd221bf0baa"><enum>(A)</enum><text>investing in translation services;</text></subparagraph><subparagraph id="id08c4db9b654947c5ad750cef592d54ff"><enum>(B)</enum><text>hosting workshop-based engagements; and</text></subparagraph><subparagraph id="idea4c9a1953a94258be65f8b96d730299"><enum>(C)</enum><text>advertising solicitations in local trade publications, local media including newspapers and radio, local community centers, and local online forums;</text></subparagraph></paragraph><paragraph id="ideaa427b088d54a4a95da0221c75a58c6"><enum>(5)</enum><text>allowing and promoting multi-year, flexible, tiered, and milestone-based funding for new programs and to bring successful programs to scale;</text></paragraph><paragraph id="idb30d189361734311be0dec2ae2c9d51c"><enum>(6)</enum><text>strengthening the capacity of USAID staff and local partners to undertake risk management and mitigation;</text></paragraph><paragraph id="idb360b95419db451cbae4eec054f8fcd0"><enum>(7)</enum><text>supporting consistent and unimpeded access to full cost recovery for local partners implementing activities funded by USAID;</text></paragraph><paragraph id="id300e8860da01427289d1ff81a7a72850"><enum>(8)</enum><text>assessing current definitions of <quote>local partner</quote>, <quote>local ownership</quote>, and <quote>localization</quote> used by USAID for programming and reporting metrics, and updating such definitions, as necessary;</text></paragraph><paragraph id="id177a0420ca4e4bb5a0c1aa3d93593a57"><enum>(9)</enum><text>undertaking outreach campaigns and engaging with local partners (formally and informally) to raise awareness about opportunities and the process for applying for and managing awards in compliance with applicable Federal regulations and USAID policies, and ensuring such engagement is accessible to all entities, including unregistered and informal organizations;</text></paragraph><paragraph id="id93c738e7dd3d46c8a514d3d1b0583dcf"><enum>(10)</enum><text>strengthening oversight of capacity strengthening components of awards to ensure United States and international awardees are making good-faith efforts to strengthen local organizations’ capacities, including independent and external evaluations to evaluate the mentorship process and regular feedback loops;</text></paragraph><paragraph id="id55da32c635a44887bc2cd9e4afa97cb4"><enum>(11)</enum><text>expeditiously solving the shortage of contracting officers within USAID, including granting warrants to qualified staff and providing appropriate training;</text></paragraph><paragraph id="id56d09a4515b84a09b18a41905d3767a0"><enum>(12)</enum><text>addressing performance evaluation criteria to create greater workforce incentives for USAID personnel to champion locally led development;</text></paragraph><paragraph id="idcfb87c71bc2445bf88a72cb47951ecdd"><enum>(13)</enum><text>addressing internal delays and recipient organization issues that result in the required extension of provisional NICRAs, in accordance with section 200.414(g) of title 2, Code of Federal Regulations;</text></paragraph><paragraph id="id9515ae3de0eb4568ab8976d98603b215"><enum>(14)</enum><text>conducting NICRA seminars in local languages and providing NICRA documentation in local languages; and</text></paragraph><paragraph id="idb496a2955ad04b56966c4f9fa06d270b"><enum>(15)</enum><text>ensuring that contracting officers and agreement officers communicate to awardees who do not submit for a NICRA that they are eligible for the de minimis indirect cost rate.</text></paragraph></section><section id="idd2e38f5164ca4b34bdb55a1569a77571"><enum>6.</enum><header>Institutionalization of local partnerships</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Administrator of USAID shall initiate policy actions, including rulemaking, if necessary, to institutionalize the actions taken pursuant to section 5, to the extent appropriate and feasible, within all relevant USAID internal rules and regulations, including—</text><paragraph commented="no" display-inline="no-display-inline" id="ide0cc00fbd5e944908cd72f45fbdb65d9"><enum>(1)</enum><text display-inline="yes-display-inline">the Automated Directive System;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida60654344d0140d38039496ab3e8630d"><enum>(2)</enum><text display-inline="yes-display-inline">the Acquisition and Assistance Strategy;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c8c8149a61147129c0576216941b286"><enum>(3)</enum><text display-inline="yes-display-inline">the Local Capacity Strengthening Policy;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida79f336dd5854901b8aedd6451486e4d"><enum>(4)</enum><text display-inline="yes-display-inline">the Localization of Humanitarian Assistance Strategy;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62d3f5da413a4ee7be89f17c7eede641"><enum>(5)</enum><text display-inline="yes-display-inline">the USAID Acquisition Regulation;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida2973bd2c3de4352a4de36862e809831"><enum>(6)</enum><text display-inline="yes-display-inline">the Local Systems Framework; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id048aed90fc98440ebbb09a5662d54efa"><enum>(7)</enum><text display-inline="yes-display-inline">the Private Sector Engagement Policy.</text></paragraph></section><section id="id66546d3eaa3344649652f1338587c9b5"><enum>7.</enum><header>Authority to accept applications, proposals, and contracting agreements in local languages and local language support</header><subsection id="id485942d8d8364eed9383bd6e243b3cce"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, USAID is authorized to accept applications or proposals in languages other than English if—</text><paragraph commented="no" display-inline="no-display-inline" id="ided19a1c53f154b80a6b95b2a5ec57200"><enum>(1)</enum><text display-inline="yes-display-inline">such acceptance eases the burden of a local entity working with USAID; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id397e0c298d6648b5a9b705175740ae31"><enum>(2)</enum><text display-inline="yes-display-inline">USAID staff are able to effectively evaluate such applications or proposals.</text></paragraph></subsection><subsection id="id15f85712735f49509ecc4e9cb2646b89"><enum>(b)</enum><header>Local language support</header><paragraph id="id0cd6822ce56c420695d516b1c27ac1db"><enum>(1)</enum><header>In general</header><text>The Administrator of USAID shall conduct an assessment of options to enable USAID to utilize local languages to support local partners with award solicitations, proposals and applications, evaluations, management, and close out, including advising local partners on applicable United States regulations and USAID policies and local country rules and regulations common in such activities.</text></paragraph><paragraph id="id10e8e6e97cb74fc9b6c46f618a4529b0"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Administrator of USAID shall submit a report to Congress containing the results of the assessment conducted pursuant to paragraph (1).</text></paragraph></subsection></section><section id="id9a3a714d7e894e95b319e8190dc898d9"><enum>8.</enum><header>Modifications relating to the Code of Federal Regulations and other requirements</header><subsection id="idea6d5c226e20493eb0edf6fb932bde7f"><enum>(a)</enum><header>Increase in the de minimis indirect cost</header><text>The Administrator of USAID is authorized—</text><paragraph commented="no" display-inline="no-display-inline" id="id51875cc33b92456cb8c71bf236c93fe5"><enum>(1)</enum><text display-inline="yes-display-inline">to increase the de minimis indirect cost rate provided for in section 200.414 of title 2, Code of Federal Regulations, or in any successor regulations, to 15 percent for local entities receiving USAID assistance awards;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42db08c6b8f54e638ad2057545f6b9f9"><enum>(2)</enum><text display-inline="yes-display-inline">to establish a similar de minimis indirect cost rate of 15 percent for acquisitions awarded to local entities pursuant to title 48, Code of Federal Regulations; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id900c546b2c3b4e108fc3f654be735b24"><enum>(3)</enum><text display-inline="yes-display-inline">to further increase such threshold if such action is recommended by regulations promulgated by the Office of Management and Budget.</text></paragraph></subsection><subsection id="idfa85da7abab04644a848e0f8ce6a419e"><enum>(b)</enum><header>Exemption for local entities</header><text>The Administrator of USAID is authorized to exempt local entities, as needed, from the reporting requirements under the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6106">31 U.S.C. 6106</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/282">Public Law 109–282</external-xref>) to allow for a 180-day delay in obtaining a unique entity identifier and registration in the System for Award Management if such exemption is not granted later than 30 days before the end of the award’s period of performance.</text></subsection><subsection id="id347fb32a43004e95890a30f8f9e2bb69"><enum>(c)</enum><header>Local competition authority</header><paragraph commented="no" display-inline="no-display-inline" id="id6faf6a1b8ffe4701bc3762cb8de35bce"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Administrator of USAID, or a designee of the Administrator, may award contracts and other acquisition instruments in which competition is limited to local entities if such process would—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf49ed7a0ca4c40d383463e7e50d059fd"><enum>(A)</enum><text display-inline="yes-display-inline">result in cost savings;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb94db162276c477581440f2ac3d3a089"><enum>(B)</enum><text display-inline="yes-display-inline">strengthen local capacity; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida6c2a499c09c42bd851e7496673ce3ce"><enum>(C)</enum><text display-inline="yes-display-inline">enable USAID to deliver a program or activities more sustainably or quickly than if competition were not so limited. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id86a625254776450bb93b82ce4a222823"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">The authority granted under paragraph (1) may not be used—</text><subparagraph commented="no" display-inline="no-display-inline" id="id057b3c38436c4781b399ebcaf2865bc3"><enum>(A)</enum><text display-inline="yes-display-inline">to make acquisition awards in excess of $25,000,000; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc51b2d190b234adabc1b48af27ee9cec"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to more than 10 percent of the amounts appropriated to USAID in any fiscal year.</text></subparagraph></paragraph></subsection><subsection id="id6e4755e1f2a04e1b8a8f1e42cc097267"><enum>(d)</enum><header>Use of national or international generally accepted accounting principles</header><text>The Administrator of USAID, in consultation with the Administrator of the General Services Administration, the Secretary of Defense, and the Administrator of the National Aeronautics and Space Administration, may permit foreign entities to use national or international generally accepted accounting principles instead of United States Generally Accepted Accounting Principles (GAAP) for contracts or grants awarded under chapter 7 of title 2, Code of Federal Regulations, or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/4/7">chapter 7</external-xref> of title 48, Code of Federal Regulations.</text></subsection></section><section id="id7e80210a39dd44aa8dc51a039f43e0a6"><enum>9.</enum><header>Annual report</header><text display-inline="no-display-inline">Not later than 180 days after the last day of each fiscal year, and annually thereafter, the Administrator of USAID shall submit to the appropriate congressional committees and publish on the USAID website a report on the progress made by USAID during the most recently completed fiscal year to advance locally led development and humanitarian response, which shall include, with respect to the reporting period—</text><paragraph id="id7d7387b54e114488bba48088876447c8"><enum>(1)</enum><text>the amount of funding expended directly or indirectly by local entities, including through all development and humanitarian assistance programs;</text></paragraph><paragraph id="id17e8b4420f4d4e879705523e295f8b95"><enum>(2)</enum><text>an assessment of how USAID is enabling more local leadership of programs funded by USAID, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id92651ab85b4f445ab921abfe172d2a48"><enum>(A)</enum><text display-inline="yes-display-inline">recipients of direct funding;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddc574f7bb3614dfbb8b76c4ec46d8ce6"><enum>(B)</enum><text display-inline="yes-display-inline">subrecipients and subcontractors to an international implementing partner;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf8ab20d7eab0491b9c67dbea6d6f68c6"><enum>(C)</enum><text display-inline="yes-display-inline">participants in a USAID-funded program; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id771141be337f4b48a60720cace7103bd"><enum>(D)</enum><text display-inline="yes-display-inline">members of a community affected by a USAID program;</text></subparagraph></paragraph><paragraph id="id262b273e5e2143dcb0dd2d75550fe698"><enum>(3)</enum><text>an assessment of progress made by USAID towards implementing—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1fd1c0edc27a4f2eaa40ddc1485f0242"><enum>(A)</enum><text display-inline="yes-display-inline">the Acquisitions and Assistance Strategy;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06615cf8ad2d4e7792f8c60391b5911e"><enum>(B)</enum><text display-inline="yes-display-inline">the Local Capacity Strengthening Policy;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9abf57ef7a0b4b30aac76644d4760689"><enum>(C)</enum><text display-inline="yes-display-inline">the Policy on Locally Led Humanitarian Assistance; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5344fa20bce348eaa74e0a1ae942fd08"><enum>(D)</enum><text display-inline="yes-display-inline">any other relevant strategies and policies;</text></subparagraph></paragraph><paragraph id="id339a9c36847140ca99546837bbb18e8c"><enum>(4)</enum><text>an assessment of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4c27f4f364194548bbfa804bc9a5f392"><enum>(A)</enum><text display-inline="yes-display-inline">how USAID is using the new authorities granted under sections 7 and 8; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8c71c205a6c6400d8bd12a075386e8c7"><enum>(B)</enum><text display-inline="yes-display-inline">the impact of such authorities on the ability of USAID to work with local partners; and</text></subparagraph></paragraph><paragraph id="id59c5365136ec4c90b09f8de0e2487f23"><enum>(5)</enum><text>an assessment of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf14c80b72fef4418a0c026123bb77d87"><enum>(A)</enum><text display-inline="yes-display-inline">the number of organizations with a NICRA known to USAID that are utilizing provisional NICRAs for longer than 4 years without a final NICRA; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide769300c692a4a7cbfc72bb4efd3a905"><enum>(B)</enum><text display-inline="yes-display-inline">the steps that USAID recommends be taken to reduce the extension of provisional NICRAs beyond 1 year.</text></subparagraph></paragraph></section></legis-body></bill>
