which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Marketing Act of 1946 to establish the Expanding Access to Local Foods Program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Access To Local Foods Act of 2024</short-title></quote> or the <quote><short-title>EAT Local Foods Act of 2024</short-title></quote>.</text></section><section id="idC5431B867F724F80868F8CBEC261DDF6"><enum>2.</enum><header>Expanding Access To Local Foods Program</header><text display-inline="no-display-inline">Subtitle A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB64209BFA67F400F8A18FB5148176637"><section id="id4CFE0C9FE0CC439CB7343A4EE6C9433D"><enum>210B.</enum><header>Expanding Access To Local Foods Program</header><subsection id="id186D9B7E91E14E99B622C8EF160A3BD3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id08c2336e67184c50b0e803c4445d6579"><enum>(1)</enum><header>Collaborator</header><text>The term <term>collaborator</term>, with respect to a project carried out using funding provided under this section, means an individual or entity (including private, for-profit, and nonprofit entities) that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6618eb1cf3354821a5a3795d0c6bbac0"><enum>(A)</enum><text display-inline="yes-display-inline">is unaffiliated with the eligible unit of government carrying out the project;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id58f25a069a1f46c9b1928032ba13c469"><enum>(B)</enum><text display-inline="yes-display-inline">cooperates with respect to—</text><clause commented="no" display-inline="no-display-inline" id="id4179adf62505434c9bbb456765d30995"><enum>(i)</enum><text display-inline="yes-display-inline">the application relating to the project under subsection (d); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idcca3e7a89fc64d6da3bcd2d99c38305e"><enum>(ii)</enum><text display-inline="yes-display-inline">the conduct of the project; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id916f7509e5204b2793ab8ee9a088532a"><enum>(C)</enum><text display-inline="yes-display-inline">is not immediately connected to the management of the project.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id632a40f46834488796dfe647c82b1f83"><enum>(2)</enum><header>Eligible unit of government</header><text>The term <term>eligible unit of government</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddd8129f1eb5c42c0bd1ff846888e7e1a"><enum>(A)</enum><text display-inline="yes-display-inline">a State agency, commission, or department that is responsible for agriculture, procurement, food distribution, emergency response, or other similar activities within the State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id368577eb86c84ddda84d652321bcc5aa"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd9cf697e7dcd4adea001f3acbe6fd585"><enum>(C)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e9403f824334b6080ca352f56065a2e"><enum>(D)</enum><text>the United States Virgin Islands;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id42358da51f164cf0a378e590043454f5"><enum>(E)</enum><text>Guam; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4C3E77CCC0C24E539B397E0FB3E6127B"><enum>(F)</enum><text>a Tribal government.</text></subparagraph></paragraph><paragraph id="id7aca5cdcd7cd42fe8bf5803fadfc3619"><enum>(3)</enum><header>Partnership</header><text>The term <term>partnership</term> means a relationship involving close cooperation between or among individuals and entities (including private, for-profit, and nonprofit entities) with specified, joint rights and responsibilities in the management of a project carried out using funding provided under this section.</text></paragraph><paragraph id="idBB7171A4CA5C409A9ACD577E5456378D"><enum>(4)</enum><header>Program</header><text>The term <term>Program</term> means the Expanding Access To Local Foods Program established under subsection (b).</text></paragraph><paragraph id="id73519404D3A94895ADC99BDB1368B199"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="id8C1F1540C51C432AAB107B9C48C4A02C"><enum>(b)</enum><header>Establishment</header><text>To maintain and improve food and agricultural supply chain resiliency and expand economic opportunities for small and underserved producers while promoting food security, the Secretary shall establish a program, to be known as the <quote>Expanding Access To Local Foods Program</quote>, under which the Secretary shall enter into cooperative agreements with eligible units of government for the purposes of— </text><paragraph id="id87E5F4C601E14936A34F42F1F84EA407"><enum>(1)</enum><text>purchasing food, including seafood, meat, and poultry, from local, regional, and underserved producers; and </text></paragraph><paragraph id="idD612C5F9B4C347A19FBD4AD813CBFEEA"><enum>(2)</enum><text>distributing that food within the geographic boundaries of the eligible unit of government. </text></paragraph></subsection><subsection id="idF8571B4B5C4D419EB68104CCB89D8E47"><enum>(c)</enum><header>Noncompetitive allocation</header><text>The Secretary shall—</text><paragraph id="id8CA19FA39C514E9880C319576302C48E"><enum>(1)</enum><text>enter into cooperative agreements with, and provide funding to, eligible units of government under the Program on a noncompetitive basis; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc8b8d9bec22143848e253b21d5731f76"><enum>(2)</enum><text>of the amounts appropriated to carry out the Program for each fiscal year—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5805F12D7A7B47D0AE5CAD080AA157AF"><enum>(A)</enum><text>allocate 10 percent to Tribal governments, to be allocated using a funding formula determined by the Secretary; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0de240e7386444aa8a2c22d8cc98adc0"><enum>(B)</enum><text display-inline="yes-display-inline">of the amounts remaining after making the allocation under subparagraph (A), allocate 1 percent to each State; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd7cea236257244d9be5c17ed31c44e93"><enum>(C)</enum><text>after making the allocations under subparagraphs (A) and (B), allocate the remaining amounts to each eligible unit of government (excluding Tribal governments) by applying the formula described in section 214 of <external-xref legal-doc="public-law" parsable-cite="pl/98/8">Public Law 98–8</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/7/7515">7 U.S.C. 7515</external-xref>); and</text></subparagraph></paragraph><paragraph id="idCDEF2A497DBB4635AA6DE990E853FBD6"><enum>(3)</enum><text>in the case of an eligible unit of government that has not submitted to the Secretary, by the date that is 1 year after the date on which amounts are allocated to the eligible unit of government under paragraph (2), an application under subsection (d) for spending those amounts, redistribute those amounts to 1 or more other eligible units of government with the capacity to spend those amounts.</text></paragraph></subsection><subsection id="idc97cd6852b51413b8630c4f7e3a5d1f9"><enum>(d)</enum><header>Applications</header><paragraph commented="no" display-inline="no-display-inline" id="idec0f54d962fc44dcaa18187bdbb234cc"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>To be eligible to receive funding under this section, an eligible unit of government shall submit to the Secretary an application, at such time, in such manner, and containing such information as the Secretary shall require, by regulation, including—</text><subparagraph id="id54c844a703344c478058dc1ca89f3abe"><enum>(A)</enum><text>a plan that—</text><clause commented="no" display-inline="no-display-inline" id="id0a31b5ea52194cb2b98a13ab18f57986"><enum>(i)</enum><text display-inline="yes-display-inline">identifies—</text><subclause commented="no" display-inline="no-display-inline" id="id05d7c7fcbecb4e3b959031fd16b1e00e"><enum>(I)</enum><text display-inline="yes-display-inline">the lead agency responsible for carrying out the plan; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7800109cb3e64e7fbbebf8c66af86ed2"><enum>(II)</enum><text display-inline="yes-display-inline">community partners that will contribute to the implementation of the plan;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id5f340f5a3e674086b51756bc6370d526"><enum>(ii)</enum><text display-inline="yes-display-inline">describes the means by which the funds will be used—</text><subclause commented="no" display-inline="no-display-inline" id="idfa6068a8d49248f0a284d25bd80a37f1"><enum>(I)</enum><text display-inline="yes-display-inline">to grow a local food system; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id13dade1f394d4a50b4ac74c680f28fa9"><enum>(II)</enum><text display-inline="yes-display-inline">to promote food security; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idb974f2c4afc9452d8bb8b1d89bd0a435"><enum>(iii)</enum><text>meets the requirements of subsection (e); and</text></clause></subparagraph><subparagraph id="idd5edb1a6b1a34d05aab390dce0487ebb"><enum>(B)</enum><text>an assurance that—</text><clause commented="no" display-inline="no-display-inline" id="idd09bf03bba05417bb478976943e97d09"><enum>(i)</enum><text display-inline="yes-display-inline">the eligible unit of government will comply with the requirements of the plan; and</text></clause><clause id="iddbf646b853df4528b2f3a52a1dc86113"><enum>(ii)</enum><text>the funds will supplement, not supplant, funds provided by the eligible unit of government in support of local food or hunger relief systems.</text></clause></subparagraph></paragraph><paragraph id="id4d1a1833c43742a0979e1a8d7e4165bc"><enum>(2)</enum><header>Review</header><text>The Secretary—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide60f02b2a42d4847b4db90ca0120d2ad"><enum>(A)</enum><text display-inline="yes-display-inline">shall review each application submitted under paragraph (1) to ensure that the plan included in the application will carry out the purposes of the Program described in subsection (b); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id104c5a780def490683c6d7fe632b3d06"><enum>(B)</enum><text display-inline="yes-display-inline">may accept or reject each application, as the Secretary determines to be appropriate. </text></subparagraph></paragraph></subsection><subsection id="id6EA080C95CBD48198ED661033E28B611"><enum>(e)</enum><header>Requirements</header><paragraph commented="no" display-inline="no-display-inline" id="id582ad6882ed14150a7e75e4a7e4bacff"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Under a cooperative agreement entered into under the Program, an eligible unit of government shall—</text><subparagraph id="id2C9FEB270CEB4857B997447A0D97C914"><enum>(A)</enum><text>only purchase food—</text><clause commented="no" display-inline="no-display-inline" id="idf6e7a918aa9145039148c51e02e48c0d"><enum>(i)</enum><text display-inline="yes-display-inline">from fishermen, farmers, producers, and processors that are—</text><subclause id="idB821008F5BD448DE81C8C709462488D1"><enum>(I)</enum><text>within the geographic boundaries of the eligible unit of government in which the food will be delivered; or </text></subclause><subclause id="id3F2D66BCA88647C8969813808CC116EF"><enum>(II)</enum><text>not more than 400 miles from the delivery destination of the food; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf91f18b98f0d4c3089ff2b08e5ee2bc9"><enum>(ii)</enum><text>through a subawardee described in subsection (f)(1) that purchases food to fulfill the subaward only from fishermen, farmers, producers, and processors that are—</text><subclause id="id69D27051B38F46DC9CC2120F94E79036"><enum>(I)</enum><text>within the geographic boundaries of the eligible unit of government in which the food will be delivered; or </text></subclause><subclause id="idCC5CDC70484A4EA3BF2C7CF8FECD3A3B"><enum>(II)</enum><text>not more than 400 miles from the delivery destination of the food;</text></subclause></clause></subparagraph><subparagraph id="id91628DB0FAA2499AA2DDD149E0372E05"><enum>(B)</enum><text>ensure that not less than 51 percent of the total annual value of products purchased by the eligible unit of government and any subawardees comprises purchases from small, beginning, or underserved farmers, ranchers, and fishers, as defined by the Secretary; </text></subparagraph><subparagraph id="idB4DE32120820455098F79498AAC43004"><enum>(C)</enum><text>give priority to distributing food to underserved communities, as determined by the Secretary; </text></subparagraph><subparagraph id="idEBEBE77E1BDA485799715F6DBAA45D8C"><enum>(D)</enum><text>expend funding not later than 3 years after the date on which the funding is provided to the eligible unit of government; and</text></subparagraph><subparagraph id="idb4f3afbe0f8848a685858187ef015b13"><enum>(E)</enum><text>subject to paragraph (2), use not more than 25 percent of the amount allocated to the eligible unit of government for Program administration and technical assistance, which may include support for—</text><clause commented="no" display-inline="no-display-inline" id="idd609128e03334e0cafff9bb27b874f10"><enum>(i)</enum><text display-inline="yes-display-inline">participating producers;</text></clause><clause commented="no" display-inline="no-display-inline" id="id8640d14f8c494fbca07a8287f4985080"><enum>(ii)</enum><text display-inline="yes-display-inline">efforts to grow the local agricultural value chain; and</text></clause><clause id="idd999fbb6a836492883723f94c956410e"><enum>(iii)</enum><text>small, beginning, veteran, and underserved farmers, as determined by the Secretary, in obtaining food safety training and certifications.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69166bad8eb84c60bfe69980a9cc5af7"><enum>(2)</enum><header>Administration and technical assistance</header><text display-inline="yes-display-inline">Of the amount used for Program administration and technical assistance under paragraph (1)(E), an eligible unit of government shall allocate not less than 50 percent for technical assistance.</text></paragraph></subsection><subsection id="id170d6debc55d4f61a1b47013b90b1bfb"><enum>(f)</enum><header>Subcontracts and subawards</header><text>To effectuate the purposes of the Program, as described in subsection (b), an eligible unit of government—</text><paragraph id="id367f166b638547929f16813cb7534cde"><enum>(1)</enum><text>may enter into subcontracts and provide subawards to support partnerships and collaborators, subject to subsection (e)(1)(E); and</text></paragraph><paragraph id="idfb056b277f284f30a6cbe4c11547f73a"><enum>(2)</enum><text>on entering into a subcontract or subaward pursuant to paragraph (1), shall—</text><subparagraph id="id46369603179c447a9d724b063283bc4f"><enum>(A)</enum><text>structure the subcontract or subaward to be inclusive of all costs associated with implementing the Program purposes, including the costs of—</text><clause id="idf81943c99fcf4ce0b23a17c9c52eb200"><enum>(i)</enum><text>food products;</text></clause><clause commented="no" display-inline="no-display-inline" id="idce832dfea46b4ba89b22ccf141cc13b8"><enum>(ii)</enum><text display-inline="yes-display-inline">aggregation and distribution;</text></clause><clause id="idf3475d745fa449f4bd7e2bd45d94736e"><enum>(iii)</enum><text>equipment or infrastructure upgrades to support food safety compliance; and</text></clause><clause id="id0132158f5eb24086a9b6064a583b05ae"><enum>(iv)</enum><text>personnel; and</text></clause></subparagraph><subparagraph id="idca14c081f57942fe8f4e4ad67721a750"><enum>(B)</enum><text>require members of a partnership and collaborators to demonstrate evidence of existing community or industry engagement.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idaef267977b984d679cfeccf058820429"><enum>(g)</enum><header display-inline="yes-display-inline">Availability of funds</header><text>To effectuate the purposes of the Program and ensure that the producers described in subsection (e)(1)(B) can meaningfully participate in the Program, the Secretary shall provide—</text><paragraph id="id8a03eb477cb740fa96a95707b1ca02f8"><enum>(1)</enum><text>not less than 50 percent of the funding awarded to an eligible unit of government in advance of the distribution of food under the agreement entered into under the Program; and</text></paragraph><paragraph id="idbf7c91f549d245b19902430555edfe70"><enum>(2)</enum><text>the remaining funding awarded to the eligible unit of government not later than the midpoint of the period of performance established in that agreement.</text></paragraph></subsection><subsection id="id78624685956E4E3EB46B6B94956C574D"><enum>(h)</enum><header>Food safety training and certification</header><paragraph id="idBA5F4836457640F58D82CE39F95FA5B8"><enum>(1)</enum><header>In general</header><text>The Secretary may require food purchased under a cooperative agreement entered into under the Program to be purchased from a farm that has undergone food safety training, or received a relevant food safety certification, with respect to production, packaging, handling, and storage to minimize risks of food safety hazards.</text></paragraph><paragraph id="id6F20F53CCF474D6F964CA9212245A258"><enum>(2)</enum><header>Training, plans, and certifications</header><text>If the Secretary imposes the requirement described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1ebe46be9dac4e6f845d087694ebc8ca"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id7fdffb83a3a34715863b5c163bc5d725"><enum>(i)</enum><text display-inline="yes-display-inline">compliance with the requirement may be demonstrated by—</text><subclause id="id6fbbc02b01d148c099efaca419d90084" indent="up1"><enum>(I)</enum><text>a receipt of food safety training, including Good Agricultural Practices training, or an equivalent food safety curriculum; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3f8349e9a3674acb8656a8761a309404" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">a relevant food safety certification; but</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idee5dfc8a1d91437fbef23f2f0d80e0d3" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary shall not require such compliance to be demonstrated by a Federal certification; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8794d9f672d1417b8926d2cdec29c42d"><enum>(B)</enum><text>each eligible unit of government shall provide technical assistance in obtaining the required food safety training or certification, in accordance with subsection (e)(1)(E).</text></subparagraph></paragraph></subsection><subsection id="idD4C6D532901448FE859DA34826AC7A80"><enum>(i)</enum><header>Reports</header><text>An eligible unit of government that enters into a cooperative agreement under the Program shall submit to the Secretary, at such times as the Secretary determines to be appropriate, reports that shall include data relating to the procurement and distribution of food under the cooperative agreement.</text></subsection><subsection id="id0211BAFEFDB149E5811BF9F037D3E319"><enum>(j)</enum><header>Funding</header><paragraph id="id23672037114c4a59bc98a961b3fd810c"><enum>(1)</enum><header>Mandatory funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $200,000,000 for fiscal year 2024 and each fiscal year thereafter. </text></paragraph><paragraph id="id1B49B79EF6F34841ABAEDB34E7D90507"><enum>(2)</enum><header>Authorization of appropriations</header><text>In addition to other funds and authorities available to the Secretary, in order to carry out activities under this section, there is authorized to be appropriated $200,000,000 for each of fiscal years 2024 through 2028, to remain available until expended by the Secretary.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
