which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to protect beneficiaries with limb loss and other orthopedic conditions by providing access to appropriate, safe, effective, patient-centered orthotic and prosthetic care; to reduce fraud, waste, and abuse with respect to orthotics and prosthetics, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H190A0314BB0D403EA6ECDBBC3F241AC5"><section id="id4475f4acb1d04e00a9a2c2b65b0919e9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Orthotics and Prosthetics Patient-Centered Care Act</short-title></quote>.</text></section><section id="HD3A6A0DB682547D2B7A0F3B223AC8B67"><enum>2.</enum><header>Increasing protections for Medicare beneficiaries receiving orthotic and prosthetic care</header><subsection id="H39E27D882EF546388631698195DB353E"><enum>(a)</enum><header>Prohibition on payment for items delivered by drop shipment</header><paragraph id="HD6000CB0EE4748AEA83DA39FCD6F41E1"><enum>(1)</enum><header>In general</header><text>Section 1834(h)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(h)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9DA82B8BA9AA4E44B5FED9DCB5442285"><subparagraph id="H7BBF32D75CA041A089BA98109A6BAA4C"><enum>(I)</enum><header>Prohibition on payment for certain items furnished using a drop shipment</header><clause id="H918477ABE885412EA5374B5ABBDC66AB"><enum>(i)</enum><header>In general</header><text>No payment shall be made under this subsection for an item described in clause (ii) furnished to an individual via a drop shipment.</text></clause><clause id="H00A66ACB22D4457FBCBDBE987B112253"><enum>(ii)</enum><header>Items described</header><text>This items described in this clause are the following:</text><subclause id="H43D6951D9FB64B0F8A2C35BD0ADD1713"><enum>(I)</enum><text>A prosthesis (as defined in paragraph (4)(C)), except that such term does not include supplies for such prosthesis.</text></subclause><subclause id="HA25A85527C9146DB87DFFD4C399E4C0F"><enum>(II)</enum><text display-inline="yes-display-inline">A custom-fabricated orthosis (as described in subparagraph (F)(ii)), or a custom-fitted orthosis, except that such term does not include supplies for such orthosis.</text></subclause><subclause id="H86FDED4476D043AF9E2EDB97314525B6"><enum>(III)</enum><text>Off-the-shelf orthotics (as defined in section 1847(a)(2)(C)) that are not otherwise subject to competitive bidding and are delivered by drop shipment.</text></subclause></clause><clause id="HE95882078E6F4F3F89EE72F9873C6ABE"><enum>(iii)</enum><header>Drop shipment defined</header><text>In this subparagraph, the term <term>drop shipment</term> means the direct shipment of a prosthesis or an orthosis to an individual that has not received training or education with respect to fitting and adjustment or training in the care and use of such prosthesis or orthosis from a qualified practitioner (as described in subparagraph (F)(iii)).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H2E7CEE6A096943D1A57C9A2F9672EA1B"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply to items furnished on or after the first day of the first full calendar year following the date of enactment of this Act.</text></paragraph></subsection><subsection commented="no" id="HAE8E9B4AD7014D58BBADE53C13DF3C51"><enum>(b)</enum><header>Additional practitioners exempt from competitive acquisition</header><text>Section 1847(a)(7)(A)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3">42 U.S.C. 1395w–3(a)(7)(A)(i)</external-xref>) is amended—</text><paragraph commented="no" id="H5568FF0A5C754EDDB9DA532CEDD93C3F"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>, physical therapist, occupational therapist, orthotist, prosthetist</quote> after <quote>by a physician</quote>; and</text></paragraph><paragraph commented="no" id="HFBBC02A01C5D4F2FB392CE800D8A54EC"><enum>(2)</enum><text>by inserting <quote>, physical therapist, occupational therapist, orthotist, prosthetist</quote> after <quote>the physician’s</quote> in each place such term occurs. </text></paragraph></subsection><subsection commented="no" id="HDBBE89C724A641E9AFDA02F0DA712083"><enum>(c)</enum><header>Ensuring beneficiary access to replacement custom-Fitted orthotic devices and custom-Fabricated orthotic devices</header><text>Section 1834(h)(1)(G) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(h)(1)(G)</external-xref>) is amended—</text><paragraph commented="no" id="HC04127A0A90746DFBE7446BBE5D1D38C"><enum>(1)</enum><text>in the heading, by inserting <quote>,<header-in-text level="subparagraph" style="OLC"> custom-fitted orthotic devices, custom-fabricated orthotic devices</header-in-text>,</quote> after <quote><header-in-text level="subparagraph" style="OLC">Replacement of prosthetic devices</header-in-text></quote>; and</text></paragraph><paragraph commented="no" id="H16AB9DB2D77048018AA056FB9D9B4F57"><enum>(2)</enum><text>in clause (i), by inserting <quote>, replacement of custom-fitted orthotic devices, replacement of custom-fabricated orthotic devices,</quote> after <quote>which are artificial limbs,</quote>.</text></paragraph></subsection><subsection commented="no" id="HA14797F8EFCE4BE2939158BBBD342B9D"><enum>(d)</enum><header>Updating definitions of orthotics and prosthetics</header><text display-inline="yes-display-inline">Section 1834(h)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(h)(4)(C)</external-xref>) is amended by striking <quote>the term <term>orthotics and prosthetics</term> has the meaning given such term</quote>, and inserting <quote>the terms <term>orthotics and prosthetics</term> and <term>orthoses and prostheses</term> have the meaning given such terms</quote>.</text></subsection><subsection id="H8E3E1E726B7442859A15019536F95D24"><enum>(e)</enum><header>Regulations</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of Health and Human Services shall promulgate final regulations to implement the amendments made by this Act.</text></subsection></section></legis-body></bill>
