which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for greater accountability in enhanced end-use monitoring, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhanced End-Use Monitoring Accountability Act of 2024</short-title></quote>.</text></section><section id="ide7ab5ef38cd84fd0a7a7d9304690b968"><enum>2.</enum><header>Restriction on security assistance to Ukraine</header><text display-inline="no-display-inline">No Federal funds may be obligated or expended to provide Ukraine defense articles or services that require Enhanced End-Use Monitoring (EEUM) until all of the following conditions are met:</text><paragraph id="id378B25FDF7434DA7A8E99528CE4E44CD"><enum>(1)</enum><text>The Inspector General of the Department of Defense certifies to the appropriate congressional committees that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idEBA5CCF4BD9D4CAA801757B0B6EC6822"><enum>(A)</enum><text display-inline="yes-display-inline">all durable defense articles requiring EEUM that are currently in Ukraine are inventoried by serial number; and</text></subparagraph><subparagraph id="id1DE5755E232F4E299224F66D2237FAE2"><enum>(B)</enum><text>the overall delinquency rate of EEUM-designated defense articles sent to Ukraine has dropped below 10 percentage points.</text></subparagraph></paragraph><paragraph id="id60D53B5D812B4A8DBC00D77E8DBC6DDE" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>The Department of Defense fully implements the recommendations outlined in the Department of Defense Inspector General’s January 10, 2024, report entitled, <quote>Evaluation of the DoD’s Enhanced End-Use Monitoring of Defense Articles Provided to Ukraine</quote>. </text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id9985df51c3c64cde82b94488a43b886a"><enum>3.</enum><header>Reporting on enhanced end-use monitoring of defense articles and services provided to Ukraine</header><subsection commented="no" display-inline="no-display-inline" id="id83afcad17c434c6db1201e0238fe4c41"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, and every 30 days thereafter until the Inspector General of the Department of Defense certifies that the overall delinquency rate of defense articles that require EEUM and were provided by the United States to Ukraine is less than one percent, the Secretary of Defense, in coordination with the Secretary of State, shall submit to the appropriate congressional committees a report on measures being taken to account for United States defense articles designated for Ukraine since the February 24, 2022, Russian invasion of Ukraine, including descriptions of—</text><paragraph commented="no" display-inline="no-display-inline" id="id19ac705a00cc45ba877860a7aee2dfbe"><enum>(1)</enum><text display-inline="yes-display-inline"> measures with regard to such articles that require EEUM; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3214d820ef0b44da87bfeb6532201037"><enum>(2)</enum><text display-inline="yes-display-inline">measures to ensure that such articles reach their intended recipients and are used for their intended purposes; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id094f45a321aa4b8cad29ce0940c98f4e"><enum>(3)</enum><text display-inline="yes-display-inline">any other measures to promote accountability for the use of such articles; and</text></paragraph><paragraph id="idace86744462f4c02994a2aa3b80fd60b"><enum>(4)</enum><text>any occurrences of articles not reaching their intended recipients or used for their intended purposes and a description of any remedies taken.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1f3d1b2612e443b9a870d1da241dbe44"><enum>(b)</enum><header>Form</header><text display-inline="yes-display-inline">The report required under subsection (a) shall be submitted in unclassified form, but may be accompanied by a classified annex.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id84449bdba72944a199db6079429e657c"><enum>4.</enum><header>Appropriate congressional committees defined</header><text display-inline="no-display-inline">In this Act, the term <term>appropriate congressional committees</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id91fbade2394246b7a119341d068c2d21"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Armed Services, the Committee on Foreign Relations, and the Committee on Appropriations of the Senate; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcd570e5615e240e18029319d9c5b7502"><enum>(2)</enum><text>the Committee on Armed Services, the Committee on Foreign Affairs, the Committee on Oversight and Accountability, and the Committee on Appropriations of the House of Representatives.</text></paragraph></section></legis-body></bill>
