<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3957</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240314">March 14, 2024</action-date><action-desc><sponsor name-id="S327">Mr. Warner</sponsor> (for himself, <cosponsor name-id="S350">Mr. Rubio</cosponsor>, <cosponsor name-id="S408">Mr. Hickenlooper</cosponsor>, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, <cosponsor name-id="S414">Mr. Ossoff</cosponsor>, <cosponsor name-id="S373">Mr. Cassidy</cosponsor>, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, and <cosponsor name-id="S287">Mr. Cornyn</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SLIN00">Select Committee on Intelligence</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Director of National Intelligence to develop a strategy to improve the sharing of information and intelligence on foreign adversary tactics and illicit activities affecting the ability of United States persons to compete in foreign jurisdictions on projects relating to energy generation and storage, and for other purposes.</official-title></form><legis-body><section id="idab96822f8785464ab947555e5ebd7dd9" section-type="section-one"><enum>1.</enum><header>Enhancing public-private sharing on manipulative adversary practices in critical mineral projects</header><subsection id="id59bae206ea554d059b673bacb1169c38"><enum>(a)</enum><header>Strategy required</header><text>Not later than 90 days after the date of the enactment of this Act, the Director of National Intelligence shall, in consultation with the heads of such Federal agencies as the Director considers appropriate, develop a strategy to improve the sharing between the Federal Government and private entities of information and intelligence to mitigate the threat that foreign adversary illicit activities and tactics pose to United States persons in foreign jurisdictions on projects relating to energy generation and storage, including with respect to critical minerals inputs.</text></subsection><subsection id="ide650eb8c4a1c4f0a9055341a3054911a"><enum>(b)</enum><header>Elements</header><text>The strategy required by subsection (a) shall cover—</text><paragraph id="id8c37001ee9be4aea87e4ecf613edf7d7"><enum>(1)</enum><text>how best to assemble and transmit information to United States persons—</text><subparagraph id="id05a419fff9ad4a1f97def62be54d1657"><enum>(A)</enum><text>to protect against foreign adversary illicit tactics and activities relating to critical mineral projects abroad, including foreign adversary efforts to undermine such United States projects abroad;</text></subparagraph><subparagraph id="id3ded95d268e74bb89e8dad8278eb0840"><enum>(B)</enum><text>to mitigate the risk that foreign adversary government involvement in the ownership and control of entities engaging in deceptive or illicit activities pose to the interests of the United States; and</text></subparagraph><subparagraph id="id8fba8a7b4eaa4b23a7e4a84d128cc4de"><enum>(C)</enum><text>to inform on economic espionage and other threats from foreign adversaries to the rights of owners of intellectual property, including owners of patents, trademarks, copyrights, and trade secrets, and other sensitive information, with respect to such property; and</text></subparagraph></paragraph><paragraph id="id590ce65d546a45018fbbdcc35c367224"><enum>(2)</enum><text>how best to receive information from United States persons on threats to United States interests in the critical mineral space, including disinformation campaigns abroad or other suspicious malicious activity.</text></paragraph></subsection><subsection id="id2e252c9afe764e4c97a3c68268195dc4" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Implementation plan required</header><text>Not later than 30 days after the date on which the Director completes developing the strategy pursuant to subsection (a), the Director shall submit to the congressional intelligence committees (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)), or provide such committees a briefing on, a plan for implementing the strategy.</text></subsection></section></legis-body></bill>
