which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Geothermal Steam Act of 1970 to promote timely exploration for geothermal resources under geothermal leases, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HFB9AEEF67DBE4A5EB128C6385E140862"><section section-type="section-one" id="H31898A0952204130A24B8B9F9DF4C9C8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Geothermal Energy Optimization Act</short-title></quote>.</text></section><section id="HD413C6B29D84457384993FEF411108D2"><enum>2.</enum><header>Geothermal production on Federal land</header><text display-inline="no-display-inline">The Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCE7BF37B072F491695CF54C6A9F28A52"><section id="HB0C8FD02AD4047DCB5876F1EF2614910"><enum>30.</enum><header>Geothermal observation test projects</header><subsection display-inline="no-display-inline" id="HA85CFC5E82DE4CB38506E9BE1E1660F3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph display-inline="no-display-inline" commented="no" id="idecdf8802251544f1926d4ea9225b5382"><enum>(1)</enum><header display-inline="yes-display-inline">Categorical exclusion</header><text>The term <term>categorical exclusion</term> has the meaning given the term in section 111 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336e">42 U.S.C. 4336e</external-xref>).</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idd7833249e73f435fb6d044a864b2aa07"><enum>(2)</enum><header display-inline="yes-display-inline">Downhole</header><text>The term <term>downhole</term> means a well or borehole dug or drilled into the subsurface of the earth for the purposes of resource confirmation or potential use.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id78cae56075994a03a17d93504d20b5e5"><enum>(3)</enum><header display-inline="yes-display-inline">Geothermal observation test project</header><text display-inline="yes-display-inline">The term <term>geothermal observation test project</term> means using geothermal technologies to drill a test, monitor, calibration, or other similar type of exploratory drilling process well for geothermal resources on land for which the Secretary concerned has issued a lease under this Act, that—<italic></italic></text><subparagraph id="H96248556DF5C40529D307122363DC9D9"><enum>(A)</enum><text>is carried out by the leaseholder;</text></subparagraph><subparagraph id="HEB75A3ADFE2244A98E1F6764BD9AF52D"><enum>(B)</enum><text>causes an allowable amount of total disturbance;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53251ed5ae344a4e8a21d9781643fb53"><enum>(C)</enum><text>does not include any permanent roads;</text></subparagraph><subparagraph id="H1479C7511CB74ACE9F59A501A97CEE5B"><enum>(D)</enum><text display-inline="yes-display-inline">is developed—</text><clause id="H238AF25287B84D3DBC311818528BEA10"><enum>(i)</enum><text>with the deepest cemented casing string less than 12 inches of downhole size in diameter;</text></clause><clause id="H8AE34DDE58124711A7B73DE47BE3EB68"><enum>(ii)</enum><text>in a manner that does not require off-road motorized access other than to and from the well site along an identified off-road route;</text></clause><clause id="H3C01AA43D0B8465EBEBDF423EE051395"><enum>(iii)</enum><text>with temporary road access, if needed to enable access to the geothermal observation test project location, subject to the requirement that—</text><subclause commented="no" display-inline="no-display-inline" id="idaa612bba1fea441d841eb74e6de69dc6"><enum>(I)</enum><text display-inline="yes-display-inline">construction of the temporary road access is remediated as close as reasonably practicable to original condition following completion of the geothermal observation test project work; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5e8a972e04ed4bc4b579468079787495"><enum>(II)</enum><text>the temporary road access, with any additional permanent improvements, is included as part of the full review required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) if the leaseholder intends to proceed with geothermal energy use for—</text><item commented="no" display-inline="no-display-inline" id="idb978b97de3264f2b8cd5074dffb7de74"><enum>(aa)</enum><text display-inline="yes-display-inline">the production of electricity;</text></item><item commented="no" display-inline="no-display-inline" id="id359b7d9841684243ad41d062e05a05b0"><enum>(bb)</enum><text>industrial processes;</text></item><item commented="no" display-inline="no-display-inline" id="id5d9897113070417b96cc21459ad31e5d"><enum>(cc)</enum><text>agricultural processes;</text></item><item commented="no" display-inline="no-display-inline" id="id3029d1cf3894489caa9badad2626c67e"><enum>(dd)</enum><text>brine mineral extraction;</text></item><item commented="no" display-inline="no-display-inline" id="id38054b8dd350485498fb5afb59bae948"><enum>(ee)</enum><text>direct heating and cooling uses; or</text></item><item commented="no" display-inline="no-display-inline" id="id1f88352e849c4363b17d6851abbfb75a"><enum>(ff)</enum><text>any combination of items (aa) through (ee); and</text></item></subclause></clause><clause id="HCCA71CA828324692B21D69F068A2DD36"><enum>(iv)</enum><text>with the use of rubber-tired digging or drilling equipment vehicles;</text></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H2F5E1DC8238740ABABB44E01C882E21B"><enum>(E)</enum><text>is completed in less than 120 days—</text><clause display-inline="no-display-inline" commented="no" id="id2379ee87d3d54487b751e3537d8cbae5"><enum>(i)</enum><text display-inline="yes-display-inline">including the removal of any surface infrastructure from the site, unless—</text><subclause display-inline="no-display-inline" commented="no" id="id97ccb717c7b44ba5843a86773e443cdc"><enum>(I)</enum><text display-inline="yes-display-inline">the leaseholder conducting the geothermal observation test project submits to the Secretary concerned by not later than 60 days after the date of first exploration drilling an extension request for additional time to complete the observation project, in which the request provides justification indicating why granting an extension is necessary; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4c22979230424f749b15b7243a229c10"><enum>(II)</enum><text>the Secretary concerned grants an extension under subclause (I), if requested; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf69dc4ce5886432896d0ed8198360c4c"><enum>(ii)</enum><text>not including removal of any surface infrastructure from the site so long as the geothermal developer intends to proceed with resource development directly following the test phase of the project and into processes required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text></clause></subparagraph><subparagraph id="HAD9F8DFB07A64E139A78D437224BD99A"><enum>(F)</enum><text display-inline="yes-display-inline">requires the restoration of the project site as part of any new review required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) within 3 years of the date of first exploration drilling to approximately the condition that existed at the time the project began, unless the site is subsequently used as part of energy development under the lease.</text></subparagraph></paragraph><paragraph id="id4bde893279154a3e8c6dd10b77bd9e22"><enum>(4)</enum><header>Geothermal technology</header><text display-inline="yes-display-inline">The term <term>geothermal technology</term> means technology designed to extract heat from the subsurface of the earth and that is used to drill—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbf3319f0279c4b738649f306199583e9"><enum>(A)</enum><text display-inline="yes-display-inline">hydrothermal project test wells;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideadf8dd9ff6c411e847b0ccbb83a7103"><enum>(B)</enum><text display-inline="yes-display-inline">enhanced geothermal system monitoring wells; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5372a63a135443759c237fe556c38ec9"><enum>(C)</enum><text display-inline="yes-display-inline">closed loop geothermal system calibration wells; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f441294ea42489dadd56ec8709d211b"><enum>(D)</enum><text>similar types of subsurface disturbances through non-production wells to assess the viability of the heat resources of the earth.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbf8cdb286105464d8734f815fcaf3778"><enum>(5)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2cd2174b930449aca612e23db44c7d01"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture, with respect to National Forest System land; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7b7e6f3e49014e24bbbb39ac8a4bd954"><enum>(B)</enum><text>the Secretary, with respect to public lands.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04a8b65221c946a3ba9a3bf53081a24e"><enum>(6)</enum><header display-inline="yes-display-inline">Surface infrastructure</header><text display-inline="yes-display-inline">The term <term>surface infrastructure</term> means all equipment, materials, facilities, and other items used in the drilling of a geothermal observation test project.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idae3efc2e29374cb0ac2799ebb85a419c"><enum>(7)</enum><header>Total disturbance</header><subparagraph commented="no" display-inline="no-display-inline" id="id612660b954e94fe4a8e2e80fe12c2704"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>total disturbance</term> means a geothermal observation test project that causes not more than 10 acres of disturbance from—</text><clause commented="no" display-inline="no-display-inline" id="id9b551b0fa3f2494ba7cafb74a0b08158"><enum>(i)</enum><text display-inline="yes-display-inline">soil or vegetation disruption at the location of each geothermal observation test project; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id13d00f7603bf4a7eba6c0db0f04f294f"><enum>(ii)</enum><text>soil or vegetation disruption during access or egress to the geothermal observation test project site.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb5692fb455884383b744082d8f7d0f6b"><enum>(B)</enum><header>Allowance</header><clause commented="no" display-inline="no-display-inline" id="idf42d6ff936ed4bae9f1ed6b8cbd52781"><enum>(i)</enum><header>Multiple projects</header><text display-inline="yes-display-inline">For instances of multiple geothermal observation test projects, the acres of total disturbance allowed shall—</text><subclause commented="no" display-inline="no-display-inline" id="id31ead90589924342afd39f8d14c5bccc"><enum>(I)</enum><text display-inline="yes-display-inline">be equal to the total number of geothermal observation test projects multiplied by 10 acres; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb00504ea1eca42a2814e68f6684598fd"><enum>(II)</enum><text display-inline="yes-display-inline">not exceed 100 total acres.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id0f68a95350834884ba3db21058e22e38"><enum>(ii)</enum><header>Access or egress</header><text>For soil or vegetation disruption during access or egress to a geothermal observation test project site, the acres of total soil or vegetation disruption allowed shall be equal to the acres of total disturbance allowed minus the acres of soil or vegetation disruption caused by the geothermal observation test project.</text></clause></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="idc1deb07e971540c5b23a503e024e3936"><enum>(b)</enum><header display-inline="yes-display-inline">Categorical exclusion</header><paragraph id="H59655E75DA774561B0C53C68B64AFE1B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary concerned shall develop a categorical exclusion for geothermal observation test projects. </text></paragraph><paragraph id="H0C041D2D41F549C0829F0E8B1C0D9145"><enum>(2)</enum><header>Administration</header><text>In developing and administering the categorical exclusion under paragraph (1), the Secretary concerned shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1fd4d4e75a1e478a9b937b6352bbab54"><enum>(A)</enum><text display-inline="yes-display-inline">comply with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id657b0390b144463ea3f9a34d031338ad"><enum>(B)</enum><text display-inline="yes-display-inline">apply any applicable extraordinary circumstance under section 46.215 of title 43, Code of Federal Regulations (or successor regulations), in determining whether to use the categorical exclusion.</text></subparagraph></paragraph></subsection><subsection id="HD3C66E5BEC854566AF1F0F9C33FF1BDB"><enum>(c)</enum><header>Process</header><paragraph id="H4CCF88986342419199E92D7B460ACE7E"><enum>(1)</enum><header>Requirement to provide notice</header><text display-inline="yes-display-inline">A leaseholder shall provide notice to the Secretary concerned of the intent of the leaseholder to carry out a geothermal observation test project at least 60 days before the start of drilling under the project.</text></paragraph><paragraph id="H99EF2753BA7B4161B606C42692A4DE4E"><enum>(2)</enum><header>Review and determination</header><text display-inline="yes-display-inline">Not later than 30 days after receipt of a notice of intent under paragraph (1) that contains sufficient information to evaluate the qualifications of the project for an applicable categorical exclusion, the Secretary concerned shall, with respect to the project described in the notice of intent—</text><subparagraph id="H08DF3362533B480AB9C4C4A158366F45"><enum>(A)</enum><text display-inline="yes-display-inline">determine if the project qualifies for a categorical exclusion under subsection (b);</text></subparagraph><subparagraph id="H34D637B5B609444F865AFE9AFA3D42F8"><enum>(B)</enum><text display-inline="yes-display-inline">notify the leaseholder of such determination; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide554a42808ee4ae8b8d41103bfee30d8"><enum>(C)</enum><text>administer the categorical exclusion for a geothermal observation test project, subject to the condition that—</text><clause commented="no" display-inline="no-display-inline" id="id23f54320cba04585b81bccb6958c35a6"><enum>(i)</enum><text display-inline="yes-display-inline">the project meets the specified criteria for the categorical exclusion; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id04521acdcd18401ea800e184381b7d8b"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary determines that no extraordinary circumstance exists under which a normally excluded action or project may have a significant effect. </text></clause></subparagraph></paragraph><paragraph commented="no" id="H1881C0D9FE02497D8F524CBC8D218346"><enum>(3)</enum><header>Opportunity to remedy</header><text display-inline="yes-display-inline">If the Secretary concerned determines under paragraph (2)(A) that the project does not qualify for a categorical exclusion under subsection (b), the Secretary concerned shall—</text><subparagraph id="H9941A98D30CF469299F5C713F297F7CE"><enum>(A)</enum><text>include in such notice clear and detailed findings on any deficiencies in the project that resulted in such determination; and</text></subparagraph><subparagraph id="H1BF1D5E0EEA5465F903F4E9971F63F1B"><enum>(B)</enum><text display-inline="yes-display-inline">allow the leaseholder not less than 60 days after receiving notice under subparagraph (A) to remedy any deficiencies and resubmit the notice of intent under paragraph (1).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ide164bffbd86d42d4b5767e95a490d644"><enum>3.</enum><header>Review of geothermal exploration or development activities</header><text display-inline="no-display-inline">Section 390 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15942">42 U.S.C. 15942</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idc52b4ae641434e1d990ab03f4006d1f3"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id86e829a684a140efb576d43188f007b1"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) or the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>)</quote> after <quote>Mineral Leasing Act</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5d3b739aa05b4d9b9b9c21f1b529df28"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>oil or gas</quote> and inserting <quote>oil, gas, or geothermal energy resource well</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7880d8ae40e940918b89300a4ac44611"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida5234c265ea840afbd8cbe65ed82f6ae"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>, and less than 10 acres for the purposes of geothermal,</quote> after <quote>less than 5 acres</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4a13ae4418644da6941b1fb899552ced"><enum>(B)</enum><text>in paragraph (2), by striking <quote>oil or gas well</quote> and inserting <quote>oil, gas, or geothermal resource well</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6f7f14563f164f8eb038d67dc91edb43"><enum>(C)</enum><text>in paragraph (3), by striking <quote>oil or gas well within a developed field</quote> and inserting <quote>oil, gas, or geothermal energy resource well within a developed field or area</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id640839fe714d44038d619ea60a752527"><enum>(D)</enum><text display-inline="yes-display-inline">by redesignating paragraph (5) as paragraph (6); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id01d989de93fd4ff6bf8973265a2564e9"><enum>(E)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8E21D35EA1524F15994AF7C1025456C9"><paragraph commented="no" display-inline="no-display-inline" id="idb980befe047b45cab886331a8895d0c5"><enum>(5)</enum><text>For the purposes of geothermal, placement of an electrical transmission line or a distribution line of not more than 20 miles in length in an approved right-of-way corridor, so long as the corridor was approved within 5 years prior to the date of placement of the transmission or distribution line.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id45da207879fa415199651ef868d56347"><enum>4.</enum><header>Leasing procedures under the Geothermal Steam Act</header><text display-inline="no-display-inline"><italic></italic>Section 4 of the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1003">30 U.S.C. 1003</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide827ac90ac1d4da6a89e4d6f85f8954e"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idda3f737a7c3b48cc91882892ea61ca17"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>every 2 years</quote> and inserting <quote>every year</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id385e585f1a794eefa4bb7e291f930c18"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id280D23EB5844473EB3D1017677EAFCF8"><paragraph commented="no" display-inline="no-display-inline" id="id0947dba24d184a22a0b954757e2efac8"><enum>(5)</enum><header>Replacement sales</header><text>If a lease sale under this section for a year is cancelled or delayed, the Secretary shall conduct a replacement sale during the same year.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc2d5d7b9eace4643b0a163e231fca0fb"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id623660071C4843329557CCC1AD3E7689"><paragraph commented="no" display-inline="no-display-inline" id="id9357b9da089c4f88a663227706306ce0"><enum>(3)</enum><header>Deadline</header><text>The Secretary, and the Secretary of Agriculture with respect to National Forest System land, shall issue a decision for a submitted application described in paragraph (1) not later than 60 days after the application is submitted.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idf9048105c79a42e193a58fa76d5b31ff"><enum>5.</enum><header>Geothermal Ombudsman and Strike Team</header><subsection commented="no" display-inline="no-display-inline" id="idee11379296f445dfbaeb089bcff8a7fc"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id15a71541a5234874a8bae59c7ad80833"><enum>(1)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Bureau of Land Management.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbd0f80953e2c4ff59a963ee4d4c4ae28"><enum>(2)</enum><header>Geothermal Ombudsman</header><text>The term <term>Geothermal Ombudsman</term> means the Geothermal Ombudsman appointed under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbb0cec6947914c42ab8112949a5ff58f"><enum>(3)</enum><header>Geothermal Strike Team</header><text>The term <term>Geothermal Strike Team</term> means the Geothermal Strike Team established under subsection (c). </text></paragraph><paragraph id="id4c5c0e801c224cafbfffcaba4ff8fcef" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida8814484e0d44a28be1e23132118de63"><enum>(b)</enum><header display-inline="yes-display-inline">Geothermal ombudsman</header><paragraph commented="no" display-inline="no-display-inline" id="id564c5662acbd496182b0e9a570eb872d"><enum>(1)</enum><header display-inline="yes-display-inline">Appointment</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary shall appoint within the Bureau of Land Management a Geothermal Ombudsman to report directly to the Director.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaf29887c80234c2caf46172d03539be7"><enum>(2)</enum><header>Duties</header><text>The Geothermal Ombudsman shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id293a6408f5244369acc01071cd7c252b"><enum>(A)</enum><text>act as a liaison between the individual field offices of the Bureau of Land Management and the Director;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8eb5563420b4fdbb7af1f2932a6e83f"><enum>(B)</enum><text>improve—</text><clause commented="no" display-inline="no-display-inline" id="id57d08895971b44a490c66aa03bd0e49c"><enum>(i)</enum><text display-inline="yes-display-inline">the performance of the permitting process for geothermal energy resource wells; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id8d739a8c1f5d4dbd91eae0da669c7895"><enum>(ii)</enum><text display-inline="yes-display-inline">regional coordination of the field offices of the Bureau of Land Management;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id26cbf20e0e6a46989ac6e3c883b64405"><enum>(C)</enum><text>provide dispute resolution services between the individual field offices of the Bureau of Land Management and applicants for drilling geothermal energy resource wells;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9fb9611a5ff9484c832433ff6b1cf616"><enum>(D)</enum><text>help Federal, State, and Tribal departments and agencies make the permitting and leasing process for geothermal energy resource wells efficient, orderly, and responsive;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id931da1d4f0424075b6b0dc84369edb6a"><enum>(E)</enum><text display-inline="yes-display-inline">develop best practices and templates for the permitting and leasing process for geothermal energy resource wells;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id180a6de2733246d08c9be287320da275"><enum>(F)</enum><text display-inline="yes-display-inline">coordinate with the Federal Permitting Improvement Steering Council established by section 41002 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-1">42 U.S.C. 4370m–1</external-xref>) and other task forces, as needed, on overlapping duties and responsibilities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5b96003bdc924e67b3bc069e3aebcb62"><enum>(G)</enum><text display-inline="yes-display-inline">identify potential statutory and regulatory changes based on input from the individual field offices of the Bureau of Land Management, the Geothermal Strike Team, and other stakeholders, as determined by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92b737ed716a419688d0c5f1ecfc34d9"><enum>(3)</enum><header>Limitation</header><subparagraph commented="no" display-inline="no-display-inline" id="ida16659ea00744fef81f46796d69a1d47"><enum>(A)</enum><header display-inline="yes-display-inline">Support</header><text>In carrying out the duties of the Geothermal Ombudsman under paragraph (2), the Geothermal Ombudsman shall use personnel, funding, logistics, and other resources of the Bureau of Land Management, to the extent determined by the Director.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e18dde1f2354253af8195ca4a1ea826"><enum>(B)</enum><header>Effect</header><text>Nothing in this subsection replaces, alters, or diminishes the activities of any ombudsman or similar office of any other agency.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id76e5866b114d4f66b71f729ad9293a11"><enum>(c)</enum><header>Geothermal Strike Team</header><paragraph commented="no" display-inline="no-display-inline" id="idB117225D982146EBB5562C466C7A4A1B"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary shall establish within the Bureau of Land Management a task force, to be known as the <quote>Geothermal Strike Team</quote>, which shall report directly to the Director.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id986a23c6020042ea9baaac90ae7fd18f"><enum>(2)</enum><header>Duties</header><text>The Geothermal Strike Team shall support the Geothermal Ombudsman—</text><subparagraph id="iddb36baa1cd354ca480decf1c008d9562"><enum>(A)</enum><text>with implementation and continuous improvement of best practices relating to permitting for and leasing of geothermal energy resource wells;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3526dc643e7f40749677c2a87edd2952"><enum>(B)</enum><text display-inline="yes-display-inline">with providing direct technical assistance to applicants in field offices of the Bureau of Land Management, as requested; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id377aa63ea22245ab9394c1bafb40e468"><enum>(C)</enum><text>with coordinating with Federal, State, Tribal, and local governments, and among State agencies, on project review, permitting, and approvals for geothermal energy resource wells.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf24cc864982343faac019476144edd61"><enum>(3)</enum><header>Members</header><text>The Geothermal Strike Team shall be composed of members of the Bureau of Land Management selected by the Director, in consultation with the Secretary, who may consult with—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc8dc7161b8854c52b8769f03716bc2c2"><enum>(A)</enum><text>institutions of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>));</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd32d24399ab542eba8ef37f85c545285"><enum>(B)</enum><text display-inline="yes-display-inline">members from the National Laboratories (as defined in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>));</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbd05f09a0174421393f1c749564fd1e0"><enum>(C)</enum><text>private entities, as determined by the Director, with expertise in data modeling and analysis; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd833e271b7e744139db3c14f181526bb"><enum>(D)</enum><text>other experts, as determined by the Director.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04F71DDEC8A444818B11507E829BF1B2"><enum>(4)</enum><header>Limitation</header><subparagraph commented="no" display-inline="no-display-inline" id="id2D13FAF655474FE3922EF5D5C10D8DC0"><enum>(A)</enum><header display-inline="yes-display-inline">Support</header><text>In carrying out the duties of the Geothermal Strike Team under paragraph (2), the Geothermal Strike Team may use personnel, funding, logistics, and other resources of the Bureau of Land Management, to the extent determined by the Director.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50C636234CA54220BFD8B51CB3345A03"><enum>(B)</enum><header>Effect</header><text>Nothing in this subsection replaces, alters, or diminishes the activities of any similar office of any Federal agency.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8EF3B90BABFF4B9081BAA7F304802339"><enum>(d)</enum><header>Reports</header><paragraph commented="no" display-inline="no-display-inline" id="id3E95D2D671F948968C68119E58F95D73"><enum>(1)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Geothermal Ombudsman and the Geothermal Strike Team shall jointly submit to the Committee on Energy and Natural Resources of the Senate, the Committee on Energy and Commerce of the House of Representatives, and the Director an annual report that describes the activities and evaluates the effectiveness of the Geothermal Ombudsman and Geothermal Strike Team during the preceding 1-year period.</text></paragraph><paragraph id="idABB770B91C03456B9AFB496ACE5FC420" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Additional reports</header><text>In addition to the annual report required under paragraph (1), the Geothermal Ombudsman and Geothermal Strike Team shall submit to the Director any additional reports, as determined by the Director.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1deb4045cde24ad0bfcf39e6361dcafc"><enum>(3)</enum><header>Request</header><text>The Geothermal Ombudsman and the Geothermal Strike Team shall, on request, submit the reports described in paragraphs (1) and (2) to any Member of Congress.</text></paragraph></subsection></section></legis-body></bill>
