Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Federal Energy Regulatory Commission to establish a shared savings incentive to return a portion of the savings attributable to an investment in grid-enhancing technology to the developer of that grid-enhancing technology, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Grid-Enhancing Technologies Act of 2024</short-title></quote> or the <quote><short-title>Advancing GETs Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idec4a4fdde5b74874a10eede853f6596c"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id6c28214404914ffbb6c69482848b8d61"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfb7fc8afa40d475ead7565c6dce076c1"><enum>(2)</enum><header>Grid-enhancing technology</header><text>The term <term>grid-enhancing technology</term> means any hardware or software that—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida8db31b5c77c4a37ad116d9926634625"><enum>(A)</enum><text display-inline="yes-display-inline">increases the capacity, efficiency, reliability, resilience, or safety of transmission facilities and transmission technologies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53ef64cd172b47c2add4e2c6814602f1"><enum>(B)</enum><text>is installed in addition to transmission facilities and transmission technologies—</text><clause commented="no" display-inline="no-display-inline" id="idd5c5c4de9fef43fbb672f69a26ca71f9"><enum>(i)</enum><text display-inline="yes-display-inline">to give operators of the transmission facilities and transmission technologies more situational awareness and control over the electric grid;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf54f8b7f7f9945a1ac17a0172e617c93"><enum>(ii)</enum><text>to make the transmission facilities and transmission technologies more efficient; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id00f63c92d92f424298ce6e74b3f09e60"><enum>(iii)</enum><text>to increase the transfer capacity of the transmission facilities and transmission technologies.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3b5de20ce520456f859bb0ce1e271cca"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id92039387cf9547e4a257c9f6c7ddf07b"><enum>3.</enum><header>Shared savings incentive for grid-enhancing technologies</header><subsection commented="no" display-inline="no-display-inline" id="id0e9fa4a1a008488e93bb2a22f1bc78bd"><enum>(a)</enum><header>Definition of developer</header><text display-inline="yes-display-inline">In this section, the term <term>developer</term>, with respect to grid-enhancing technology, means the entity that pays to install the grid-enhancing technology.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idaba1b049df894272a0d37b5ecb1da62f"><enum>(b)</enum><header>Establishment of shared savings incentive</header><text>Not later than July 1, 2025, the Commission shall promulgate a final rule to implement section 219(b)(3) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824s">16 U.S.C. 824s(b)(3)</external-xref>) by providing a shared savings incentive that returns a portion of the savings attributable to an investment in grid-enhancing technology to the developer of that grid-enhancing technology, in accordance with this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4b2edb8318fe458ab46f52e3b3ea8ac3"><enum>(c)</enum><header>Requirements</header><paragraph commented="no" display-inline="no-display-inline" id="idc481d212a2f640ebb66b856367870145"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall determine the percentage of savings attributable to an investment in grid-enhancing technology that can be returned to the developer of that grid-enhancing technology pursuant to the shared savings incentive established under subsection (b), subject to the condition that the percentage is not less than 10 percent and not more than 25 percent.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0c66c986425142a28bd7d852dc2631fb"><enum>(2)</enum><header>Time period for recovery</header><text display-inline="yes-display-inline">The shared savings incentive established under subsection (b) shall return a percentage, determined in accordance with paragraph (1), of the applicable savings to the developer of the applicable grid-enhancing technology over a period of 3 years.</text></paragraph></subsection><subsection id="id994bec09db024ffa948ab4dc98052909"><enum>(d)</enum><header>Eligibility</header><text>Subject to subsection (e), the shared savings incentive established under subsection (b) shall apply with respect to—</text><paragraph commented="no" display-inline="no-display-inline" id="id70bb133895d54b42b20e25f6b61ffbe1"><enum>(1)</enum><text display-inline="yes-display-inline">any developer, with respect to the investment of that developer in grid-enhancing technology that is installed as described in section 2(2)(B); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19f35446f0894eb199a252ff1cf1b7ea"><enum>(2)</enum><text>any grid-enhancing technology, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7f325974a5464bb4a6e5fce198680258"><enum>(A)</enum><text display-inline="yes-display-inline">grid-enhancing technology that relates to new transmission facilities or technologies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3cf3619d484d437f85232e2c77bed332"><enum>(B)</enum><text>grid-enhancing technology that relates to existing transmission facilities or technologies.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idec7240eea0454b679609b07768a0a782"><enum>(e)</enum><header>Limitations</header><paragraph commented="no" display-inline="no-display-inline" id="idf5e8cb769f7f42f6ae0f138c530fe656"><enum>(1)</enum><header>Minimum savings</header><subparagraph commented="no" display-inline="no-display-inline" id="id22ba4bea5da04c1a96bc96254ec8773e"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The shared savings incentive established under subsection (b) shall apply with respect to an investment in grid-enhancing technology only if the expected savings attributable to the investment over the 3-year period described in subsection (c)(2), as determined by the Commission, are at least 4 times the cost of the investment.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id076b2c29c0174fe3b01b9a68a6c76f8a"><enum>(B)</enum><header>Determination</header><clause commented="no" display-inline="no-display-inline" id="id00c2b5c9457949ce893f17722e469cf9"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall determine how to quantify the cost of an investment and the expected savings attributable to an investment for purposes of subparagraph (A).</text></clause><clause commented="no" display-inline="no-display-inline" id="id1eb01f91e4864a3d81a70cff2bdf741f"><enum>(ii)</enum><header>Costs</header><text>For purposes of subparagraph (A), the cost of an investment may include any costs associated with the permitting, installation, or purchase of the applicable grid-enhancing technology.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbf938ad4f0ea4886944b5d0b32e8a182"><enum>(2)</enum><header>Already installed GETs</header><text>The shared savings incentive established under subsection (b) may not be applied with respect to grid-enhancing technology that is already installed as of the date of enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8946b75ef09f4db78a8747a1e366d647"><enum>(3)</enum><header>Consumer protection</header><text display-inline="yes-display-inline">The Commission shall determine appropriate consumer protections for the shared savings incentive established under subsection (b). </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idb63ec342444d49bd8c838cdfbbc3cb13"><enum>4.</enum><header>Congestion reporting</header><subsection commented="no" display-inline="no-display-inline" id="id19800dd6cb1549579f44035f5d34eb57"><enum>(a)</enum><header>In general</header><text>Beginning on the date that is 1 year after the effective date of the rule promulgated under subsection (b), all operators of transmission facilities or technologies shall submit to the Commission annual reports containing data on the costs associated with congestion management with respect to the transmission facilities or technologies.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idb705995a61254d64a4d67276015ab805"><enum>(b)</enum><header>Rulemaking</header><text>Not later than July 1, 2025, the Commission shall promulgate a final rule establishing a universal metric and protocol for the measuring and reporting of data under subsection (a).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1c9148ed222c4d829eb91c67043f4602"><enum>(c)</enum><header>Uses of data</header><paragraph commented="no" display-inline="no-display-inline" id="idc95864dc738448e48df0c86e74c66434"><enum>(1)</enum><header>Analyses</header><subparagraph commented="no" display-inline="no-display-inline" id="id1c4e889705e7418ca9515f8680355a53"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission and the Secretary shall each use the data submitted under subsection (a) to conduct analyses, as the Commission or the Secretary, as applicable, determines to be appropriate.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e8e44a0178b40f1931a3ec3e6f50875"><enum>(B)</enum><header>Coordination</header><text>The Commission and the Secretary may coordinate with respect to any analyses conducted using the data submitted under subsection (a).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7234db089aba4878a14eea3c06aae71d"><enum>(2)</enum><header>Map</header><text>The Commission and the Secretary, acting jointly, shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id36e88b705e2643fe9e1edcc6ad8182d8"><enum>(A)</enum><text display-inline="yes-display-inline">use the data submitted under subsection (a) to create a map of costs associated with congestion management in the transmission system; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id00dfb03ea518433ebc06eba5a892d972"><enum>(B)</enum><text display-inline="yes-display-inline">update that map not less frequently than once each year.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id74057f29253b4ae3a35f26395336c557"><enum>(d)</enum><header>Publication of data and map</header><text>The Commission and the Secretary shall make the data submitted under subsection (a) and the map described in subsection (c)(2) publicly available on the websites of—</text><paragraph commented="no" display-inline="no-display-inline" id="id677a1296d7f54c9f841289e669f69696"><enum>(1)</enum><text display-inline="yes-display-inline">the Commission; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1255aeddb9344e318710d0a3fba93386"><enum>(2)</enum><text display-inline="yes-display-inline">the Department of Energy.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id7e49e2045af14a669b6bcaf04b9a2dea"><enum>5.</enum><header>Grid-enhancing technology application guide</header><subsection commented="no" display-inline="no-display-inline" id="id5947baddc9014f77a20700bc8b84a573"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of developer</header><text>In this section, the term <term>developer</term> means a developer of transmission facilities or transmission technologies, including a developer of transmission facilities or transmission technologies that pays to install grid-enhancing technology with respect to those transmission facilities or transmission technologies.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0b1a1718138641419c5cb585ad1a3a92"><enum>(b)</enum><header>Establishment of application guide</header><text>Not later than July 1, 2025, the Secretary shall establish an application guide for utilities and developers seeking to implement grid-enhancing technologies.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id22da6e527c364b16a5fc09a0b727f237"><enum>(c)</enum><header>Updates</header><text>The guide established under subsection (b) shall be reviewed and updated annually.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="iddaa475f3e15a4e3d9d7755763b1b334b"><enum>(d)</enum><header>Technical assistance</header><paragraph commented="no" display-inline="no-display-inline" id="idabc89d6c8c494f9aa13058d1772be131"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On request of a utility or developer using the guide established under subsection (b), the Secretary shall provide technical assistance to that utility or developer with respect to the use of grid-enhancing technologies for particular applications.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6ca65cde4d8446b28b55b82930ccc074"><enum>(2)</enum><header>Clearinghouse</header><text>In carrying out paragraph (1), the Secretary shall establish a clearinghouse of previously completed grid-enhancing technology projects that the Secretary, utilities, and developers may use to identify issues and solutions relating to the use of grid-enhancing technologies for particular applications.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id41b73ec79e7b4d0783b7d39c421a824f"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section, to remain available until expended—</text><paragraph commented="no" display-inline="no-display-inline" id="idb95d728d77a8485d8df5e55880f4e518"><enum>(1)</enum><text display-inline="yes-display-inline">$5,000,000 for fiscal year 2024; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id37f0370c66d74c51a7481c1bdc011c5b"><enum>(2)</enum><text display-inline="yes-display-inline">$1,000,000 for each of fiscal years 2025 through 2035.</text></paragraph></subsection></section></legis-body></bill>
