which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title I of the National Housing Act to increase the loan limits and clarify that property improvement loans may be used for construction of accessory dwelling units.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Property Improvement and Manufactured Housing Loan Modernization Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" id="id8932F8D11D15489295F15A6F170CD40D"><enum>2.</enum><header>National Housing Act amendments</header><subsection id="id18BD91A9D22E41C89464B0E8D106F3A4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703</external-xref>) is amended—</text><paragraph id="HDF20B61789B145D381512C4EDDB49CCE"><enum>(1)</enum><text>in subsection (a), by inserting <quote>construction of additional or accessory dwelling units, as defined by the Secretary,</quote> after <quote>improvements,</quote>; and</text></paragraph><paragraph id="H16A13362ADD649769D15D1D87948FA37"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HEE2CCEB71ECE4EE6A1E1D057F6629BCE"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H4BCDFD3A0BF34E5184D639BE358CB4AC"><enum>(i)</enum><text>by striking subparagraph (A) and inserting the following new subparagraph:</text><quoted-block style="OLC" id="HDA8C0A7E7BE3455C93EC0BF4CDFD0734" display-inline="no-display-inline"><subparagraph id="H1F8AAC2BCF3C4C92891D4442AEF129C1" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">$75,000 if made for the purpose of financing alterations, repairs and improvements upon or in connection with an existing single-family structure, including a manufactured home;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="HFBE611A7D86941D3B852E178F27587CC"><enum>(ii)</enum><text> in subparagraph (B)—</text><subclause id="HE33B63314AA24CC599264DF21635FD98"><enum>(I)</enum><text>by striking <quote>$60,000</quote> and inserting <quote>$150,000</quote>;</text></subclause><subclause id="H16C2BE97202B40DD99259346564B5919"><enum>(II)</enum><text>by striking <quote>$12,000</quote> and inserting <quote>$37,500</quote>; and</text></subclause><subclause id="HE1E02D3DDAF747C19A0AFC547D950041"><enum>(III)</enum><text>by striking <quote>an apartment house or</quote>;</text></subclause></clause><clause id="H04DEFC0A5E2C4192AA3E3783D288200A"><enum>(iii)</enum><text display-inline="yes-display-inline">by striking subparagraphs (C) and (D) and inserting the following:</text><quoted-block style="OLC" id="H0720A66EDA804CCE983CA1F3A9491822" display-inline="no-display-inline"><subparagraph id="HE1F999698B284D129967B7C6D078B4A4" indent="up1"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H07569DEB3B6849D7B84B0A6995A51D4F"><enum>(i)</enum><text display-inline="yes-display-inline">$106,405 if made for the purpose of financing the purchase of a single-section manufactured home; and</text></clause><clause id="HF1C3296B55B44C8D9191A87982A45D61" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">$195,322 if made for the purpose of financing the purchase of a multi-section manufactured home;</text></clause></subparagraph><subparagraph id="H78C288A93E644FB4BCAFF53743E4DB50" indent="up1"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="HB92C84788E244B55831F709F4989AB54"><enum>(i)</enum><text display-inline="yes-display-inline">$149,782 if made for the purpose of financing the purchase of a single-section manufactured home and a suitably developed lot on which to place the home; and</text></clause><clause id="H9220A47134CA4F7093A9E789F1F46EF9" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">$238,699 if made for the purpose of financing the purchase of a multi-section manufactured home and a suitably developed lot on which to place the home;</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="H09779C1DDAB049BD83789D2BE7E4F425"><enum>(iv)</enum><text display-inline="yes-display-inline">in subparagraph (E)—</text><subclause id="H54E506E24D164EF7AB6A20461AAC8F84"><enum>(I)</enum><text>by striking <quote>$23,226</quote> and inserting <quote>$43,377</quote>; and</text></subclause><subclause id="H228BD4BFED084B7E97F11A66782E016C"><enum>(II)</enum><text>by striking the period at the end and inserting a semicolon;</text></subclause></clause><clause id="HC597BC5974BA419EBA68B26950CE1BF9"><enum>(v)</enum><text>in subparagraph (F), by striking <quote>and</quote> at the end;</text></clause><clause id="HFD1FF1827D3948B498C935E2ECF513CA"><enum>(vi)</enum><text>in subparagraph (G), by striking the period at the end and inserting <quote>; and</quote>; </text></clause><clause id="HCFFF84B1F5B04D028EC2814D415E4884"><enum>(vii)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (G) the following: </text><quoted-block style="OLC" id="H8AFCD5FCB0B8458FA33EE59D83BF9B16" display-inline="no-display-inline"><subparagraph id="HF87F35932805487E8DE3F8F061CCADAB" indent="up1"><enum>(H)</enum><text display-inline="yes-display-inline">such principal amount as the Secretary may prescribe if made for the purpose of financing the construction of an accessory dwelling unit.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idC5ED8D7A00DB446AA26D97771AB7A283"><enum>(viii)</enum><text>in the matter preceding paragraph (2)—</text><subclause id="id0A1F0DA8F8204E7AA0E44FBDD482E5CF"><enum>(I)</enum><text>by striking <quote>regulation</quote> and inserting <quote>notice</quote>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id70f7fa19dc5b40398fa723dab4b72968"><enum>(II)</enum><text>by striking <quote>increase</quote> and inserting <quote>set</quote>;</text></subclause><subclause id="idFBA973DD3F434D56B4F8332EA147E8E5"><enum>(III)</enum><text>by striking <quote>(ii), (C), (D), and (E)</quote> and inserting <quote>through (H)</quote>;</text></subclause><subclause id="H01485C39D023408E8D75A29921C17801"><enum>(IV)</enum><text>by inserting <quote>, or as necessary to achieve the goals of the Federal Housing Administration, periodically reset the dollar amount limitations in subparagraphs (A) through (H) based on justification and methodology set forth in advance by regulation</quote> before the period at the end; and</text></subclause><subclause id="id965C0C0DE36949F7A97615F6AA03B221"><enum>(V)</enum><text>by adjusting the margins appropriately;</text></subclause></clause></subparagraph><subparagraph id="H873C9EF50A3243CEB7CB38192A4AEDCD"><enum>(B)</enum><text>in paragraph (3), by striking <quote>exceeds—</quote> and all that follows through the period at the end and inserting <quote>exceeds such period of time as determined by the Secretary, not to exceed 30 years.</quote>; </text></subparagraph><subparagraph id="id7CB6A40141BC4B1A83B78983C680D7CE"><enum>(C)</enum><text>by striking paragraph (9) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCC9557FB20C84BE5933B5462ECD46B39"><paragraph id="id08AC039450D14940A42F45F79734DD6D" indent="up1"><enum>(9)</enum><header>Annual indexing of certain dollar amount limitations</header><text>The Secretary shall develop or choose 1 or more methods of indexing in order to annually set the loan limits established in paragraph (1), based on data the Secretary determines is appropriate for purposes of this section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H792BC846027546DA9F5DDD398237E020" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (11), by striking <quote>lease—</quote> and all that follows through the period at the end and inserting <quote>unless such lease meets the terms and conditions established by the Secretary</quote>.</text></subparagraph></paragraph></subsection><subsection id="id8DD18969474447A4B52887278FB42AF8"><enum>(b)</enum><header>Deadline for development or choice of new index; interim index</header><paragraph id="idAFB5FDF76AB246579969FD10132CF964"><enum>(1)</enum><header>Deadline for development or choice of new index</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Housing and Urban Development shall develop or choose 1 or more methods of indexing as required under section 2(b)(9) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703(b)(9)</external-xref>), as amended by subsection (a) of this section.</text></paragraph><paragraph id="id86984715924D4B5C956624538D030401"><enum>(2)</enum><header>Interim index</header><text>During the period beginning on the date of enactment of this Act and ending on the date on which the Secretary of Housing and Urban Development develops or chooses 1 or more methods of indexing as required under section 2(b)(9) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703(b)(9)</external-xref>), as amended by subsection (a) of this section, the method of indexing established by the Secretary under that section before the date of enactment of this Act shall apply.</text></paragraph></subsection></section><section id="id717156333b2840a2b252adf81c7f5064"><enum>3.</enum><header>Hud study of factory-built housing</header><subsection id="id470b466b813f4abfa6531fc5655acbaf"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idb29cd263e79f4c9fb1d900a3482905e6"><enum>(1)</enum><header>Factory-built housing</header><text display-inline="yes-display-inline">The term <term>factory-built housing</term> includes manufactured homes and modular homes.</text></paragraph><paragraph id="idd7ca9c44de4d4cd1bf61d8c150f27209"><enum>(2)</enum><header>Manufactured home</header><text>The term <term>manufactured home</term> means any home constructed in accordance with the construction and safety standards established under the National Manufactured Housing Construction and Safety Standards Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5401">42 U.S.C. 5401 et seq.</external-xref>).</text></paragraph><paragraph id="id60cc377a2d6a42b3813ba0b51d00958c"><enum>(3)</enum><header>Modular home</header><text>The term <term>modular home</term> has the meaning given the term in section 1027(c) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5517">12 U.S.C. 5517(c)</external-xref>).</text></paragraph></subsection><subsection id="id58fe5003491e43779e4135e9011b1f46"><enum>(b)</enum><header>Study</header><text>The Secretary of Housing and Urban Development shall conduct a study and submit to Congress a report on the cost effectiveness of factory-built housing, that includes—</text><paragraph id="id96871ebf50984b478243a77a64717d56"><enum>(1)</enum><text>an analysis of the reductions in costs from the centralization of manufacturing compared to the expense of transferring the unit from the factory to its final location;</text></paragraph><paragraph id="idc74bd76c81644b7ab776e0ce1aa58609"><enum>(2)</enum><text>the advantages in precision and reduction of materials waste associated with factory-built housing;</text></paragraph><paragraph id="idf6db36858d9e4c118306080d34abb0c0"><enum>(3)</enum><text>the expected replacement and maintenance costs over the first 40 years of life of factory-built homes; and</text></paragraph><paragraph id="iddb09aedf54ef4ad4843240f1b5429d35"><enum>(4)</enum><text>opportunities for use beyond single-family housing, such as applications in accessory dwelling units, two- to four-unit housing, and large multifamily housing. </text></paragraph></subsection></section></legis-body></bill>
