which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Administrator of the Environmental Protection Agency to provide for the generation of Renewable Identification Numbers under the renewable fuel program for electricity from renewable biomass, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H289A3D7A2A6A46C6A4B9A328D681A975"><section commented="no" section-type="section-one" id="H0401858CC94940609E5B8A1FBF6F0942"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Biomass for Transportation Fuel Act</short-title></quote>.</text></section><section id="HFB15B8EFD657455D9D29DF97F2D7970A"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H7205ACB32A854FA5B24D8DE4D1E15F8A"><enum>(1)</enum><header>Electric utility</header><text display-inline="yes-display-inline">The term <term>electric utility</term> has the meaning given the term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph><paragraph id="H9AF7173B79C14F4DBC51B1AC8DA92DFF"><enum>(2)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term in section 302 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7602">42 U.S.C. 7602</external-xref>).</text></paragraph><paragraph id="HA386DAADE9CE4B0499229590E9E3599D"><enum>(3)</enum><header>Pathway petition</header><text display-inline="yes-display-inline">The term <term>pathway petition</term> means a petition for approval of a fuel pathway that has electricity from renewable biomass as a fuel type under the renewable fuel program.</text></paragraph><paragraph id="H19B4F7C0E6EB4D8CB44101CF61269574"><enum>(4)</enum><header>Registration request</header><text display-inline="yes-display-inline">The term <term>registration request</term> means a request for registration of a facility producing electricity from renewable biomass under an approved fuel pathway under the renewable fuel program.</text></paragraph><paragraph id="HE2E647DF280446309A97C929C092E0CB"><enum>(5)</enum><header>Renewable biomass</header><text display-inline="yes-display-inline">The term <term>renewable biomass</term> has the meaning given the term in section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>). </text></paragraph><paragraph id="H6C244B3D265148D0ACF9FECA9D59116A"><enum>(6)</enum><header>Renewable fuel program</header><text display-inline="yes-display-inline">The term <term>renewable fuel program</term> means the renewable fuel program under section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)</external-xref>).</text></paragraph><paragraph id="HA064FFF2BC674E0897C4D879AE777477"><enum>(7)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 302 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7602">42 U.S.C. 7602</external-xref>).</text></paragraph><paragraph id="HAFC942EE28D845ED85993C76B50FC9F1" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header>Transportation fuel</header><text display-inline="yes-display-inline">The term <term>transportation fuel</term> has the meaning given the term in section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>). </text></paragraph></section><section id="H33571D00F6DC47DD92DCD6553367C746"><enum>3.</enum><header>Renewable electricity under the renewable fuel program</header><subsection id="H5AFCBD1BB8C247C5B72A00F3395BDB6D"><enum>(a)</enum><header>Timely review of petitions and registrations</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency (referred to in this section as the <quote>Administrator</quote>) shall review and make a determination for pathway petitions and registration requests—</text><paragraph id="HD4F2FAF863614D0481F5A4AF7212A4B6"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of a complete pathway petition or registration request, by not later than the date that is 365 days after the date of submission of the pathway petition or registration request; and</text></paragraph><paragraph id="H56905960BA2C4EA0814458FCA51FED19"><enum>(2)</enum><text>in the case of other pathway petitions and registration requests, in a timely and expeditious manner.</text></paragraph></subsection><subsection id="HAE425B3F884A4A7AA2322E01EB4AB627"><enum>(b)</enum><header>Public disclosure</header><text display-inline="yes-display-inline">The Administrator shall publish on the public internet website of the Environmental Protection Agency, and update on a quarterly basis, the following:</text><paragraph id="H0D165F661D3B442DA2C7DDAE792354C7"><enum>(1)</enum><text display-inline="yes-display-inline">With respect to each pathway petition that is pending, approved, or denied on or after the date of enactment of this Act—</text><subparagraph id="H6EB41D324CBD43E1A46FD368B7FA4A5C"><enum>(A)</enum><text>the date on which the pathway petition is submitted to the Environmental Protection Agency;</text></subparagraph><subparagraph id="HAE39FF2E099041D384A9955F8D815225"><enum>(B)</enum><text>the date on which any fee assessed pursuant to subsection (c) is collected by the Environmental Protection Agency;</text></subparagraph><subparagraph id="H986EFD7923274A718E3D3820BB5C85F8"><enum>(C)</enum><text>the date on which the Administrator determines that the pathway petition is complete; and</text></subparagraph><subparagraph id="H12F0C7811B534983AF32EF10D1F1E257"><enum>(D)</enum><text>the date on which the pathway petition is approved or denied by the Administrator.</text></subparagraph></paragraph><paragraph id="HD46AC71F18DC4DE591F5FB379CB7E2F5"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to each registration request that is pending, approved, or denied on or after the date of enactment of this Act—</text><subparagraph id="H3198519BD31F478387012E1B97882843"><enum>(A)</enum><text>the date on which the registration request is submitted to the Environmental Protection Agency;</text></subparagraph><subparagraph id="H3601CCAA561849E5B236BA93B90D9272"><enum>(B)</enum><text>the date on which any fee assessed pursuant to subsection (c) is collected by the Environmental Protection Agency;</text></subparagraph><subparagraph id="H935D2085C36044ACB60B9FEB50EB57BB"><enum>(C)</enum><text>the date on which the Administrator determines that the registration request is complete; and</text></subparagraph><subparagraph id="HFEF9816AFD2D4F8385ADECFC0644688B"><enum>(D)</enum><text>the date on which the registration request is approved or denied by the Administrator.</text></subparagraph></paragraph></subsection><subsection id="H7D0FBFBA33344CB2888262177D786851"><enum>(c)</enum><header>Fees</header><paragraph id="H144BDC64997A4D099F413928CD2BB1AE"><enum>(1)</enum><header>Assessment and collection</header><text display-inline="yes-display-inline">The Administrator may assess and collect a fee, in amounts determined by the Administrator necessary to cover the costs described in paragraph (2), from the operator of a facility that submits, updates, or renews—</text><subparagraph id="HAB137E626CB74A9EB0D40D655382C219"><enum>(A)</enum><text display-inline="yes-display-inline">a pathway petition; or</text></subparagraph><subparagraph commented="no" id="H70921E4932C94046A175ECB29E35FA52"><enum>(B)</enum><text display-inline="yes-display-inline">a registration request.</text></subparagraph></paragraph><paragraph commented="no" id="H4CC69EDC8CDD4500A2F60160E787D323"><enum>(2)</enum><header>Use of fees</header><text>A fee assessed and collected pursuant to paragraph (1) shall be available, without further appropriation or fiscal year limitation, for use by the Administrator for the costs of—</text><subparagraph commented="no" id="H7504F8E04FC540E9945638792F097A34"><enum>(A)</enum><text>reviewing pathway petitions, including any associated costs for personnel;</text></subparagraph><subparagraph commented="no" id="HED673A2B336849688A03BE5B5EB26144"><enum>(B)</enum><text>reviewing registration requests, including any associated costs for personnel; and</text></subparagraph><subparagraph id="H0BF34229C2D04143BBFF24347341C276"><enum>(C)</enum><text display-inline="yes-display-inline">otherwise carrying out this Act.</text></subparagraph></paragraph><paragraph id="H8AF97A405FEF4632A6959CA7912D6F2B"><enum>(3)</enum><header>Refund</header><text>If the Administrator has not completed a review of a complete pathway petition or registration request for which a fee has been assessed and collected pursuant to paragraph (1) by the date that is 18 months after the date of that collection—</text><subparagraph id="H17C7762DB4ED4FBE9417551585DFE6C0"><enum>(A)</enum><text>the operator of a facility that submitted the pathway petition or registration request may request a refund of the fee;</text></subparagraph><subparagraph id="H9515A05894AC41AA83D674D09D9C1FBE"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 90 days after receiving a request under subparagraph (A), the Administrator shall issue a full refund of the fee; and</text></subparagraph><subparagraph id="H7A2FCAC7AA184C7EAD53B8511CC80B18"><enum>(C)</enum><text>the Administrator shall complete review and disposition of the pathway petition or registration request without imposing any further fee under this section for that process.</text></subparagraph></paragraph><paragraph id="HD331F90741C948348DFA2D3595B52377"><enum>(4)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Administrator may, at the discretion of the Administrator, waive the fee under paragraph (1)—</text><subparagraph id="H1A02829CE3D842C99A1109ADA47BA006"><enum>(A)</enum><text display-inline="yes-display-inline">for an electric utility that is wholly owned by a State (including any political subdivision thereof) or an Indian Tribe; or</text></subparagraph><subparagraph id="H86383FDA16694F0EB7DDC40BBA058669"><enum>(B)</enum><text>if the Administrator determines that the waiver is in the public interest.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HFA4D4E64077F4056B249265F894D547A"><enum>(d)</enum><header>Rulemaking on generation of credits (eRINs) for electricity from renewable biomass</header><paragraph commented="no" display-inline="no-display-inline" id="id2ed23e22742a4ce09834c498736567ca"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of registered party</header><text>In this subsection, the term <term>registered party</term> means an electric utility with—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc6bbade9334245b5b08ec6b2b14e66e1"><enum>(A)</enum><text display-inline="yes-display-inline">a fuel pathway approved by the Administrator under the renewable fuel program; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id64b72c0df93c46d3abbcf3329f97fce5"><enum>(B)</enum><text>a facility that—</text><clause commented="no" display-inline="no-display-inline" id="idcb95bbd235b049ec8fe40c25102145fb"><enum>(i)</enum><text display-inline="yes-display-inline">produces electricity from renewable biomass; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb129b1f287fa4a7fb5238b6afcb8a77b"><enum>(ii)</enum><text>is registered under the renewable fuel program.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HCD8E7AF5F04E4A679225B37B953851A2"><enum>(2)</enum><header>Regulation required</header><text>Subject to paragraph (4), the Administrator shall—</text><subparagraph commented="no" id="H44D0E5DD0C114CF1AB6FBBC6B99656D5"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 90 days after the date of enactment of this Act, promulgate a regulation providing for the generation of credits under section 211(o)(5) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(5)</external-xref>) for electricity produced from renewable biomass that is sold, distributed, or used as transportation fuel; and</text></subparagraph><subparagraph commented="no" id="H9C953682048B4E8688A4557920D5239E"><enum>(B)</enum><text>not later than 1 year after the date of enactment of this Act, finalize that regulation.</text></subparagraph></paragraph><paragraph commented="no" id="H44DD6CF3B69B43DEA509D23BF85B3FFF"><enum>(3)</enum><header>Contents</header><text display-inline="yes-display-inline">The regulation under paragraph (2) shall prescribe and clarify—</text><subparagraph display-inline="no-display-inline" id="H54B0B8DC6B5B4180A2D5E0277067E8D1"><enum>(A)</enum><text display-inline="yes-display-inline">which registered parties can generate the credits and associated Renewable Identification Numbers;</text></subparagraph><subparagraph id="H777E7B01016D4D4EA150E495DDCB8900"><enum>(B)</enum><text display-inline="yes-display-inline">how to prevent the credits from resulting in double-counting for purposes of the renewable fuel program; and</text></subparagraph><subparagraph id="HC832B11A4D7444378B207C8702DF2795"><enum>(C)</enum><text display-inline="yes-display-inline">data requirements for valid generation of the credits and associated Renewable Identification Numbers.</text></subparagraph></paragraph><paragraph id="H3D7496A703974EE99CC35D1E01DD6C98"><enum>(4)</enum><header>Option to finalize prior proposed rule</header><text display-inline="yes-display-inline">In lieu of promulgating a regulation pursuant to paragraph (2), the Administrator may choose to modify and finalize the proposed rule of the Environmental Protection Agency entitled <quote>Renewable Fuel Standard (RFS) Program: Standards for 2023-2025 and Other Changes</quote> (87 Fed. Reg. 80582 (December 30, 2022)) to include—</text><subparagraph id="HA3996D40A98B4071B5C23AA44BDAA2D1"><enum>(A)</enum><text>provisions for the generation of credits as described in paragraph (2); and</text></subparagraph><subparagraph id="H19D186D0188348CF979F08E03A10832A"><enum>(B)</enum><text>each requirement and clarification listed in paragraph (3).</text></subparagraph></paragraph></subsection></section><section id="HE8705D663961474999262889EBCB3D37"><enum>4.</enum><header>Elimination of certain restrictions on renewable biomass from forestlands</header><text display-inline="no-display-inline">Section 211(o)(1)(I) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)(I)</external-xref>) is amended—</text><paragraph id="HC434496CF7EE4B25B257E718D74FC2C1"><enum>(1)</enum><text>by striking clause (ii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2547D8798E5D4B01B59DCEC3F130FF8B"><clause id="H6EDC019B7934469FB87F48201B16A07A"><enum>(ii)</enum><text display-inline="yes-display-inline">Trees and tree residue from forestlands (including forestlands belonging to an Indian Tribe or an Indian individual, that are held in trust by the United States or subject to a restriction against alienation imposed by the United States).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H4B55C743471744B38E9C918F715849A7"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (iv)—</text><subparagraph id="H595647D03A1C4BC5A79FD073D0B50F08"><enum>(A)</enum><text>by striking <quote>Slash and pre-commercial thinnings that are from non-federal forestlands</quote> and inserting <quote>Slash and thinnings from forestlands</quote>; and</text></subparagraph><subparagraph id="HC5AE757751264A3C84E2BB78375CF8A8"><enum>(B)</enum><text>by inserting <quote>, unless the slash and thinnings are derived off those forests or forestlands for restoration purposes following a natural disturbance event</quote> after <quote>or late successional forest</quote>.</text></subparagraph></paragraph></section><section id="H422D579884E343A198BD548633D74141"><enum>5.</enum><header>Federal data reporting on renewable electricity from biomass</header><subsection id="HB5040EF15516455F8580E2122A3E3DF2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Energy Information Administration (referred to in this section as the <quote>Administrator</quote>) shall include in the Electric Power Monthly, Electric Power Annual, Annual Energy Outlook, and any other relevant report of the Energy Information Administration, data on electricity generated from renewable biomass. </text></subsection><subsection id="HF9E0D83BE5AF481E93E80527AEA1BAC8"><enum>(b)</enum><header>Separate line item</header><text display-inline="yes-display-inline">In carrying out subsection (a), the Administrator shall include data on electricity generated from renewable biomass as a separate line item or in a manner that otherwise identifies such data as a separate subtotal of electricity generated.</text></subsection><subsection id="H4B5FE267CF9B40F6AD8C3253AEB678B6"><enum>(c)</enum><header>Consultation</header><text>In carrying out this section, the Administrator shall consult with the Administrator of the Environmental Protection Agency.</text></subsection></section><section id="H71CC770A991344D4A022C5E0CB498D6E"><enum>6.</enum><header>Technical corrections</header><subsection id="H07D43A99E16D419A9826E2F311DA7616"><enum>(a)</enum><header>Definitions</header><text>Section 211(o)(1)(G) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)(G)</external-xref>) is amended, in the first sentence, by inserting <quote>and</quote> before <quote>sulfur hexafluoride</quote>.</text></subsection><subsection id="HC93F13F0AAFA4420A790A60CDEC29F24"><enum>(b)</enum><header>Periodic reviews</header><text display-inline="yes-display-inline">Section 211(o)(11) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(11)</external-xref>) is amended by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAF71582BD6BA4D6EB0894D0092398115"><subparagraph id="H960ACF8DB1F145CCBCA8EA4071EA378C"><enum>(C)</enum><text>the impacts of the requirements described in paragraph (2)(B) on—</text><clause id="H2214DBE4D72647F5905F076D7DA508F3"><enum>(i)</enum><text>refineries, blenders, distributors, and importers referred to in paragraph (2)(A)(iii)(I); and</text></clause><clause id="HE446795CE32948C0A341AA5F1B10C489"><enum>(ii)</enum><text>consumers described in subparagraph (A)(iv) or (B)(ii)(V) of paragraph (2).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA57528CC53784A538D049F8ED0F05FCB"><enum>(c)</enum><header>Blending of Compliant Reformulated Gasolines</header><text display-inline="yes-display-inline">Section 211(t)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(t)(1)</external-xref>) is amended, in the matter preceding subparagraph (A), by striking <quote>this subtitle</quote> and inserting <quote>this part</quote>.</text></subsection></section></legis-body></bill>
