which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Assets Sale and Transfer Act of 2016 to make improvements to that Act, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H54C38DD9C98443479A90F9AE315AEE8E"><section section-type="section-one" id="H5A7A1672DC1943DC851A80A0C80C39FA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>FASTA Reform Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" id="H7400FE2264C440FAB96F04F46589CD9F"><enum>2.</enum><header>Amendments to the Federal Assets Sale and Transfer Act of 2016</header><subsection id="HAB25501379CE4EF1825DBFEE5B786D7E"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">Section 2 of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended—</text><paragraph id="HD2C383BA7BE042DE8F4621DC3CC76369"><enum>(1)</enum><text>in paragraph (9), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HBF90F16E5FFB41EFBC201E1DC60F0C52"><enum>(2)</enum><text>in paragraph (10), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HC0606009F88F4CA4B10ABE41327DCF33"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7959EC2D916342F68684693AD59D6258"><paragraph id="HA1781BFFFF594409A02DFEC4F036813D"><enum>(11)</enum><text display-inline="yes-display-inline">implementing innovative methods for the sale, redevelopment, consolidation, or lease of Federal buildings and facilities, including the use of no cost, nonappropriated contracts for expert real estate services to obtain the highest and best value for the taxpayer.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="HB02BB5D1D984446FB90423240C92EE54"><enum>(b)</enum><header>Definitions</header><text>Section 3(5)(B)(viii) of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended by inserting <quote>, other than office buildings and warehouses,</quote> after <quote>Properties</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id2d0b3c92f45143319e9411d6251e2e00"><enum>(c)</enum><header>Board meetings</header><text>Section 5(b) of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended by striking <quote>Five Board members</quote> and inserting <quote>4 Board members</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id43bc753a1dfe4d45ba9c4626b4da045c"><enum>(d)</enum><header>Executive Director</header><text>Section 7 of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDADC1DC68D9847DE84605108B2882E7A"><subsection id="HC2FF156FDC3444CDB66F8AEFB08ED314"><enum>(c)</enum><header>Return to civil service</header><text display-inline="yes-display-inline">An Executive Director selected from the civil service (as defined in section 2101 of title 5, United States Code) shall be entitled to return to the civil service (as so defined) after service to the Board ends if the service of the Executive Director to the Board ends for reasons other than misconduct, neglect of duty, or malfeasance.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id7b439f0776514bd2b9acc332b73598d5"><enum>(e)</enum><header>Staff</header><text>Section 8 of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended—</text><paragraph id="H71FFE11C2E1B49FF8387F65EFA053D39"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H7ED9B58094C84A94ACFF725448279E93"><enum>(A)</enum><text>by striking <quote>and the Director of OMB</quote>; and</text></subparagraph><subparagraph id="H3B8650C32A60443BA33B5003E08B363D"><enum>(B)</enum><text>by inserting <quote>for a period of not less than 1 year</quote> before <quote>to assist the Board</quote>;</text></subparagraph></paragraph><paragraph id="H4510161460EE42328CBCFB5A02FA6A12"><enum>(2)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph id="H8CDA71B9D28C4310A399F3D861120BD3"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1920499ABFD6420ABECF549EE8797908"><subsection id="H86C275B894604DE293156665A25E194B"><enum>(c)</enum><header>Hiring of term employees</header><text display-inline="yes-display-inline">The Executive Director, with approval of the Board, may use the Office of Personnel Management to hire employees for terms not to exceed 2 years pursuant to the Office of Personnel Management guidance for nonstatus appointments in the competitive service.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3a42a70431e74528b3a1c8fc8c84600c"><enum>(f)</enum><header>Termination</header><text>Section 10 of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended by striking <quote>6 years after the date on which the Board members are appointed pursuant to section 4</quote> and inserting <quote>on December 31, 2026</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0ed85ab845d542d3ad443c7654ff5310"><enum>(g)</enum><header>Development of recommendations to Board</header><text>Section 11 of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idbbc9f8a0c8b647deae55e108ff1b30de"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H3B1607B58D754BA8AD29C707C76A86F0"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>the Administrator and the Director of OMB</quote> and inserting <quote>the Administrator, the Director of OMB, and the Board</quote>;</text></subparagraph><subparagraph id="H6E7A4BB04857468AA947F20E69E6FBDA"><enum>(B)</enum><text>in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="idd153b0a1df7e47ab80cb65ef53545253"><enum>(i)</enum><text>by striking <quote>and square</quote> and inserting <quote>number of Federal employees physically reporting to the respective property each work day, square</quote>; and</text></clause><clause id="HBE6356D12A4A48CABC5DD37104CCD64E"><enum>(ii)</enum><text>by inserting <quote>, amount of acreage associated with the respective property, and whether the respective property is on a campus or larger facility</quote> before the period at the end; and</text></clause></subparagraph><subparagraph id="H179FAE2E5FA94874B865231D36164EF6"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE0340B7FC1F549EF82B64F5A728999F9"><paragraph id="H60819CE235F944C1AC17403B910B8FF5"><enum>(3)</enum><header>Consolidation plans</header><text display-inline="yes-display-inline">Any Federal agency plans to consolidate, reconfigure, or otherwise reduce the use of owned and leased Federal civilian real property of the Federal agency.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc9809b407fd49bfa501a91a145a23bc"><enum>(2)</enum><text>in subsection (b)(3)(J), by inserting <quote>, including access by members of federally recognized Indian Tribes,</quote> after <quote>public access</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id86d91e04894a41e692df427c186e100c"><enum>(h)</enum><header>Board duties</header><text>Section 12 of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended—</text><paragraph id="H293E93D123E44CE69D0FE403B17067FC"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(2), by striking the second sentence and inserting the following: <quote>In the case of a failure by a Federal agency to comply with a request of the Board, the Board shall notify the committees listed in section 5(c), the relevant congressional committees of jurisdiction for the Federal agency, and the inspector general of the Federal agency of that failure.</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide5a469fff22f4d59b474150e4ef0422a"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida54924f56cc044758dcef2ecec9a37d0"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>, Tribal,</quote> after <quote>State</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc852f6692eb440dcbd95137eed599610"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>, Tribal,</quote> after <quote>State</quote>;</text></subparagraph></paragraph><paragraph id="HC9099A794ED14EB1851750EE2A5C365C"><enum>(3)</enum><text>by redesignating subsections (d) through (i) as subsections (e) through (j), respectively;</text></paragraph><paragraph id="H8AD5DC16AFC44614BE83735AC53C1178"><enum>(4)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB7037B1FB9AB47E5AD6CF9ECF090FA92"><subsection id="HCB2CC58CDD5F4D50A514903F6A937CD5"><enum>(d)</enum><header>Preparation of properties for disposal</header><text display-inline="yes-display-inline">At the request of, and in coordination with, the Board, a Federal agency may undertake any analyses and due diligence as necessary to prepare a property for disposition so that the property may be included in the recommendations of the Board under subsection (h), including completion of the requirements of section 306108 of title 54, United States Code, for historic preservation and identification of the likely highest and best use of the property subsequent to disposition.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H0972064A3E5C4099A469B573656FF562"><enum>(5)</enum><text>in subsection (h) (as so redesignated)—</text><subparagraph id="H4DEFE34899244EFE86BC0FDF5E340D95"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H1953EA4CD3764D28B45D0121DB35F983"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></clause><clause id="H1435603264A14FB6A0FEF640AA6D544E"><enum>(ii)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></clause><clause id="H34D3E7C0E5A941618E1F7E0A70C88C53"><enum>(iii)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H77874BBFAE854735B81E76DC5F5229C9"><subparagraph id="H0FB764E1F88B42B6B7736F8BF23DF076"><enum>(B)</enum><text display-inline="yes-display-inline">the process to be followed by Federal agencies to carry out the actions described in subparagraph (A), including the use of no cost, nonappropriated contracts for expert real estate services and other innovative methods, to obtain the highest and best value for the taxpayer; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H85FCEC6D138848FDB2E073C0E944DFB8"><enum>(B)</enum><text>in paragraph (2), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H72BB6AC2DAAE4752A3A81967CB042827"><subparagraph id="H5AF96CA7B3A8483687717313E1D1E045"><enum>(C)</enum><header>Third round</header><text display-inline="yes-display-inline">During the period beginning on the day after the transmittal of the second report and ending on the day before the date on which the Board terminates under section 10, the Board shall transmit to the Director of OMB a third report required under paragraph (1).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id147ea7d2080449c5a9df2b68ba36e27c"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE8C74A9D07134F329E7CA25588529B98"><paragraph commented="no" display-inline="no-display-inline" id="id70ed003dd7d444b1b730ebcc2deedb91"><enum>(4)</enum><header>Community notification</header><text>7 days before the date on which the Board transmits the third report required under paragraph (1), the Board shall notify—</text><subparagraph commented="no" display-inline="no-display-inline" id="id896da117d8fb49849f7b08b878df9d4f"><enum>(A)</enum><text display-inline="yes-display-inline">any State or local government of any findings, conclusions, or recommendations contained in that report that relate to a Federal civilian real property located in the State or locality, as applicable; and</text></subparagraph><subparagraph id="id1626348958e244ad984bd4dd89c4a8bb"><enum>(B)</enum><text>any federally recognized Indian Tribe of any findings, conclusions, or recommendations contained in that report that relate to a Federal civilian real property that—</text><clause commented="no" display-inline="no-display-inline" id="idb90d01ccb9f04c20aebd3a7829c9ecc5"><enum>(i)</enum><text display-inline="yes-display-inline">is in close geographic proximity to a property described in section 3(5)(B)(v); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idd3b5f49e784543feaf1c12a057f97aef"><enum>(ii)</enum><text display-inline="yes-display-inline">relates to a Federal civilian real property that is known to be accessed at regular frequency by members of the federally recognized Indian Tribe for other reasons.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HDDA3FBFAFC5444DCA50C0F18E5810BD0"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1FE09BB83CC041F8BDF0372D220668D4"><subsection id="H03FC6C7965174E7986954BEBC10764FC"><enum>(k)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">The Board shall periodically submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report containing any recommendations on consolidations, exchanges, sales, lease reductions, and redevelopments that are not included in the transmissions submitted under subsection (h), or approved by the Director of OMB under section 13, but that the majority of the Board concludes meets the goals of this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6b81aad3e0c947ccad1286e8970c2bf2"><enum>(i)</enum><header>Review by OMB</header><text>Section 13 of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended—</text><paragraph id="H8D49B601A8A043A58C0C42F17BE7283B"><enum>(1)</enum><text>in subsection (a), by striking <quote>subsections (b) and (g)</quote> and inserting <quote>subsections (b) and (h)</quote>; and</text></paragraph><paragraph id="H8BB252ADC4994BB88E0252DC7E9942A5"><enum>(2)</enum><text>in subsection (c)(4)—</text><subparagraph id="HBA47E4C4F1AD41F1B99106A575C167C7"><enum>(A)</enum><text>by inserting <quote>, in whole or in part,</quote> before <quote>received under paragraph (3)</quote>; and</text></subparagraph><subparagraph id="HABA17856EB4C44C3985B97852D752B17"><enum>(B)</enum><text>by striking <quote>revised</quote> the second place it appears.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id37f3c54b9c274ad2a2165bad766ee3ad"><enum>(j)</enum><header>Agency retention of records</header><text>Section 20 of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H28E9B824ECA24E81A05049E800699AAF"><subsection id="H09105397D7AD41F6AA0D6F528AB5A564"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The provisions of this section, including the amendments made by this section, shall take effect on the date on which the Board transmits the second report under section 12(h)(2)(B) and shall apply to proceeds from—</text><paragraph id="H6AFBB3A70AD9470098DC3681A09E5B03"><enum>(1)</enum><text>transactions contained in that report; and</text></paragraph><paragraph id="H0CD127377DE24473BC1A6CDB74A6436D"><enum>(2)</enum><text>any transactions conducted after the date on which the Board terminates under section 10.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id04ab389d5dc34dba91413c1a2a026ea0"><enum>(k)</enum><header>Federal real property database</header><text>Section 21(b) of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5AFC2E2DA8744B6E9C2C92D6D2148A02"><paragraph id="H39C840EB148B47829C388C3AB13943D6"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idc14e6365d06d47f59b7dc1d236f74b83"><enum>(A)</enum><text display-inline="yes-display-inline">Whether the Federal real property is on a campus or similar facility; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79bef5b9450943428eb9902cebc8e594" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">if applicable, identification of the campus or facility and related details, including total acreage of the campus or facility.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id4d2aed27e8f64f56a61b539ae8151009"><enum>(l)</enum><header>Access to Federal Real Property Council meetings and reports</header><paragraph commented="no" display-inline="no-display-inline" id="id49c01fe34c4842348601ecabca2706e4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8E740E8D0F5B4C8CA47A0C2FD1102CAC"><section id="HEF3ECCC9F4564D1AA78360B52C9728DD"><enum>26.</enum><header>Access to Federal Real Property Council meetings and reports</header><text display-inline="no-display-inline">The Federal Real Property Council established by subsection (a) of section 623 of title 40, United States Code, shall ensure that the Board has access to any meetings of the Federal Real Property Council and any reports required under that section. </text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H290326E203A946F6A5225AD0BABB0EC2"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>; 130 Stat. 1463) is amended by inserting after the item relating to section 25 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H762302B8D5BF4C21B2011F2B6A79BDCB"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 26.
