rules of origin of the United States-Mexico-Canada Agreement in order to qualify for certain Federal programs.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Subsidies for American Autos Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id3bc8eb8699a941a98de5f0f3d1feffba"><enum>2.</enum><header display-inline="yes-display-inline">Requirement for vehicles to comply with United States-Mexico-Canada Agreement to qualify for certain Federal programs</header><subsection id="id5036128f6e014873987e7219b58a860b"><enum>(a)</enum><header>Tax credits for clean vehicles</header><paragraph commented="no" display-inline="no-display-inline" id="id4c3e23323c6e4b67b9d8cf3fee6aa8fa"><enum>(1)</enum><header>Clean vehicle credit</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/30D">Section 30D(d)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id17eaa9656d2043079b1e94ef3ac53523"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(G), by striking <quote>the final assembly of which occurs within North America</quote> and inserting <quote>which qualifies as an originating good under section 202 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4531">19 U.S.C. 4531</external-xref>)</quote>, and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1e665eee684d463fb8310df8368fd0c9"><enum>(B)</enum><text>by striking paragraph (5).</text></subparagraph></paragraph><paragraph id="idf29bd360fc1f4364a48adf82b9bca058"><enum>(2)</enum><header>Credit for qualified commercial clean vehicles</header><text>Paragraph (1) of section 45W(c) of such Code is amended by striking <quote>section 30D(d)(1)(C)</quote> and inserting <quote>subparagraphs (C) and (G) of section 30D(d)(1)</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida57801af086e42f986eb368ca0800bc7"><enum>(3)</enum><header>Previously-owned clean vehicles</header><text>Clause (i) of section 25E(c)(1)(D) of such Code is amended by inserting <quote>(G),</quote> after <quote>(F),</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id489ac1fa7f764df0af54b3fba3cb1ce9"><enum>(4)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply to vehicles acquired after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="idd924e554bfe04be9b9f399f03245370b"><enum>(b)</enum><header>Public school energy improvement program</header><text>Section 40541(f) of the Investment Infrastructure and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18831">42 U.S.C. 18831(f)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF1063D5C89B349FFA62FFF007B4902E1"><paragraph id="id2db3f06703af4fc2b6c4cccb55d4eb66"><enum>(5)</enum><header>USMCA-compliant vehicle requirement</header><subparagraph commented="no" display-inline="no-display-inline" id="idd8a1a27b1bf64fcda59d8b48cb50ea2a"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of USMCA-compliant vehicle</header><text>In this paragraph, the term <quote>USMCA-compliant vehicle</quote> means a vehicle that qualifies as an originating good under section 202 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4531">19 U.S.C. 4531</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc6a618a6e14c4b4aa532c9d9324272d2"><enum>(B)</enum><header>Requirement</header><text>Any alternative fueled vehicle purchased using a grant under this section shall be required to be a USMCA-compliant vehicle.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id65dce63fbf494962961585c89b59ea1b"><enum>(c)</enum><header>State energy program</header><text>Section 362 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2E7CEEDCB71C437BAD96628F86E34A4F"><subsection commented="no" display-inline="no-display-inline" id="ida82d2b2e39a741269f7d665e15e0801f"><enum>(h)</enum><header>USMCA-Compliant vehicle requirement</header><paragraph commented="no" display-inline="no-display-inline" id="id6B7DABA4187340BC8ECECCA43ECBEDFF"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of USMCA-compliant vehicle</header><text>In this subsection, the term <quote>USMCA-compliant vehicle</quote> means a vehicle that qualifies as an originating good under section 202 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4531">19 U.S.C. 4531</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71817b5196b447a2887d6f7de1addfd6"><enum>(2)</enum><header>Requirement</header><text>Subject to paragraph (3), any vehicle purchased as part of a State energy conservation plan shall be required to be a USMCA-compliant vehicle.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62f9883dc0ca4948a69647406f630f4a"><enum>(3)</enum><header>More stringent State law</header><text display-inline="yes-display-inline">The requirement under paragraph (2) shall not apply in the case of a State energy conservation plan that requires vehicles purchased under the plan to be produced in the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id62fc23859b7641a9b27f314ec39ed449"><enum>(d)</enum><header>Bus and bus facilities grant program</header><text>Section 5339(b) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide3e0637a1df24d55a07800ceb89707b7"><paragraph id="id0c2202ed868e454b82b9873d0400b76d"><enum>(12)</enum><header>USMCA requirement</header><subparagraph id="idf9e88ccca1224ae5b91a77ec601a660a"><enum>(A)</enum><header>USMCA-compliant vehicle</header><text>In this paragraph, the term <term>USMCA-compliant vehicle</term> means a vehicle that qualifies as an originating good under section 202 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4531">19 U.S.C. 4531</external-xref>).</text></subparagraph><subparagraph id="id3ad064f5a11347669f79c69a95236844"><enum>(B)</enum><header>Requirement</header><text>Any bus replaced, purchased, or leased using a grant under this subsection shall be a USMCA-compliant vehicle.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idbf7b8e03a3a24883b29998dbd4df1664"><enum>(e)</enum><header>Low or no emission public transportation funding program</header><text>Section 5339(c) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id476D07B1F0A64BF9BEFD0AD8FD50209B"><paragraph id="idD4221D51E2C94B6291B8DA8D2D0D9C4F"><enum>(9)</enum><header>USMCA requirement</header><subparagraph id="id18F56CEB468842B0BD6AEAF060A490EB"><enum>(A)</enum><header>USMCA-compliant vehicle</header><text>In this paragraph, the term <term>USMCA-compliant vehicle</term> means a vehicle that qualifies as an originating good under section 202 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4531">19 U.S.C. 4531</external-xref>).</text></subparagraph><subparagraph id="id061D9A311DAC47D991B0225EB3BD2A66"><enum>(B)</enum><header>Requirement</header><text>Any vehicle acquired or leased using a grant under this subsection shall be a USMCA-compliant vehicle.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idbfad0366ff5b40d1bb7d782a47054a80"><enum>(f)</enum><header>Clean school bus program</header><text>Section 741(a) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16091">42 U.S.C. 16091(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id6e5f0668c92e4fd68ac6145d409df469"><enum>(1)</enum><text>in paragraph (3)—</text><subparagraph id="id2cfca9854a53400b909a872b48d20f32"><enum>(A)</enum><text>by redesignating subparagraph (B) as clause (ii);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2e2a9f880af941178caee76b44504166"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>(A) the Administrator</quote> and inserting the following:</text><quoted-block id="idADFA1D58CB0942E99A5E1AB6B37FFC89" style="OLC" act-name=""><subparagraph id="id0D0B0C197D7149DE9DFB60708C16F6A1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id1bf131a76a3444819d4161d636811fcd"><enum>(i)</enum><text>the Administrator</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9ace7fa01e1b469b8a9f7b7fe67602bf"><enum>(C)</enum><text>by inserting before subparagraph (B) (as so redesignated) the following:</text><quoted-block id="id133B606EBAC647ED903FFFF8CD705787" style="OLC" act-name=""><subparagraph id="idFF25350D51E2426DAD7A9F82A37F1838"><enum>(A)</enum><text>qualifies as an originating good under section 202 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4531">19 U.S.C. 4531</external-xref>); and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0e744cc9fd4740fc889bbae9f45545c9"><enum>(2)</enum><text>in paragraph (8)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf80d2517f54145229136e36a6c1c3471"><enum>(A)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8dfd5075a9f14e83b71fa5728311f3bd"><enum>(B)</enum><text>in the matter preceding clause (i) (as so redesignated), by striking <quote>that is certified</quote> and inserting the following: </text><quoted-block id="idF6722834C0B74B6BBCAAAD002ACB4D2A" style="OLC" act-name="" display-inline="yes-display-inline"><text>that—</text><subparagraph id="id3FC5B8E76D3042D785B0C0658B777AFE"><enum>(A)</enum><text>qualifies as an originating good under section 202 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4531">19 U.S.C. 4531</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id150c4fc9fc154f88aa8277584b89a234"><enum>(B)</enum><text display-inline="yes-display-inline">is certified</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id250d53e3b83845999db38fc0233cd8e9"><enum>(g)</enum><header>Clean heavy-Duty vehicles program</header><text>Section 132(d)(5) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7432">42 U.S.C. 7432(d)(5)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide7d335a81fb54d518c9011d9186a8932"><enum>(1)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5cad6eabebf84ebbba127cbe32122d27"><enum>(2)</enum><text>in the matter preceding clause (i) (as so redesignated), by striking <quote>vehicle that has</quote> and inserting the following: </text><quoted-block id="idDD6864EA6BD14CB594C3E219F79080A6" style="OLC" act-name="" display-inline="yes-display-inline"><text>vehicle that—</text><subparagraph id="id37B051745728471ABF1E72ED908AD8BF"><enum>(A)</enum><text>qualifies as an originating good under section 202 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4531">19 U.S.C. 4531</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1c9f59cd79214ac68e71413fe6eb3b37"><enum>(B)</enum><text display-inline="yes-display-inline">has</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
