which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To interconnect the Electric Reliability Council of Texas to its neighbors, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H88CFB7DAB27A424DBAC07CF532B543B2"><section section-type="section-one" id="HBCD021BEF3C94A3E848E6E3D79E8BE84"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Connect the Grid Act of 2024</short-title></quote>.</text></section><section id="H7031FF08A8454316AFDE57A5BA5BDEAC"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" id="HF6CC10A1942F4DE9868F259CC4FC015F"><enum>(1)</enum><header>Abandoned mine land</header><text display-inline="yes-display-inline">The term <term>abandoned mine land</term> means land, water, or a watershed that is contaminated or scarred by extraction, beneficiation, or processing of ores or minerals (which may include phosphate, but does not include coal).</text></paragraph><paragraph id="H9A215D60E66C47FCA9459FE0930EA8B8"><enum>(2)</enum><header>Brownfield site</header><text display-inline="yes-display-inline">The term <term>brownfield site</term> has the meaning given the term in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph><paragraph id="H5581D98F554A4D54870C14008B72C121"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></paragraph><paragraph id="H143B27CC016B4135B01D457A92989AF1"><enum>(4)</enum><header>Electric Reliability Organization</header><text display-inline="yes-display-inline">The term <term>Electric Reliability Organization</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph><paragraph id="H07A0EC2B9AE3414FB435E3C66725977E"><enum>(5)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means a community with significant representation of communities of color, low-income communities, or Tribal and Indigenous communities that experiences, or is at risk of experiencing, higher or more adverse human health or environmental effects.</text></paragraph><paragraph commented="no" id="HED4E5B5EDE8F412C89D727D8070BA7BF"><enum>(6)</enum><header>ERCOT</header><text display-inline="yes-display-inline">The term <term>ERCOT</term> means the Electric Reliability Council of Texas.</text></paragraph><paragraph id="H1AB1D96FFC3A432A9A5D826AF899F3D3"><enum>(7)</enum><header>Grid-enhancing technology</header><text display-inline="yes-display-inline">The term <term>grid-enhancing technology</term> means a solution that increases the transfer capability of high-voltage transmission facilities.</text></paragraph><paragraph commented="no" id="HB6EE03A3197247C8B77454FAADFCF758"><enum>(8)</enum><header>MISO</header><text display-inline="yes-display-inline">The term <term>MISO</term> means the Midcontinent Independent System Operator transmission organization. </text></paragraph><paragraph id="HB873CCA394FE42639BB0FC4CA9EF6693"><enum>(9)</enum><header>National Priorities List</header><text display-inline="yes-display-inline">The term <term>National Priorities List</term> means the National Priorities List developed by the President in accordance with section 105(a)(8)(B) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605(a)(8)(B)</external-xref>).</text></paragraph><paragraph id="HA3BC7CCF0D6E4F35BB30214E851E7A9A"><enum>(10)</enum><header>Registered apprenticeship program</header><text display-inline="yes-display-inline">The term <term>registered apprenticeship program</term> means an apprenticeship program registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>), that meets the standards of subpart A of part 29, and part 30, of title 29, Code of Federal Regulations (or successor regulations). </text></paragraph><paragraph id="HA02A861D64584FA5836F7942DDB00A46"><enum>(11)</enum><header>Reliability standard</header><text display-inline="yes-display-inline">The term <term>reliability standard</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph><paragraph id="H998CE242D0D646958DA251BFA2818C65"><enum>(12)</enum><header>SPP</header><text display-inline="yes-display-inline">The term <term>SPP</term> means the Southwest Power Pool transmission organization.</text></paragraph><paragraph commented="no" id="H14D9D63B93E14AADAD9A2DFC7ABCBE0D"><enum>(13)</enum><header>Total transfer capability</header><text display-inline="yes-display-inline">The term <term>total transfer capability</term> has the meaning given the term in section 37.6(b)(1)(vi) of title 18, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></paragraph><paragraph id="H39C554F55F6D498AB88B355C3F2F9ED3"><enum>(14)</enum><header>Transmission facility</header><text display-inline="yes-display-inline">The term <term>transmission facility</term> means a facility that is used for the transmission of electric energy in interstate commerce, including a transmission line. </text></paragraph><paragraph id="H06ED334038AF4C6DA5E6DAC789837415"><enum>(15)</enum><header>Transmission organization</header><text>The term <term>transmission organization</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph><paragraph commented="no" id="H4567DCAB239B44B3A829BCD2078D136E"><enum>(16)</enum><header>Tribal and Indigenous community</header><text display-inline="yes-display-inline">The term <term>Tribal and Indigenous community</term> means a population of people who are members of—</text><subparagraph commented="no" id="H8F9CB3735CAA4E4EBA7387E510B783DA"><enum>(A)</enum><text>a federally recognized Indian Tribe;</text></subparagraph><subparagraph commented="no" id="H678045A34D31496A879F112015AD6D9E"><enum>(B)</enum><text>a State-recognized Indian Tribe;</text></subparagraph><subparagraph commented="no" id="HFEF250713A9D489CAB50665A11C6CBD8"><enum>(C)</enum><text>an Alaska Native or Native Hawaiian community or organization; or</text></subparagraph><subparagraph commented="no" id="H0C9BB030CC324267A885220DA2771B06"><enum>(D)</enum><text>any other community of Indigenous people located in a State.</text></subparagraph></paragraph><paragraph id="HF035A5B69AAB43DCBEC6B0279E336492" commented="no" display-inline="no-display-inline"><enum>(17)</enum><header>Tribal government</header><text>The term <term>Tribal government</term> means the governing body of an Indian Tribe.</text></paragraph><paragraph id="HCC32BF95694D4322963343BD750BC5D4"><enum>(18)</enum><header>Western Interconnection</header><text display-inline="yes-display-inline">The term <term>Western Interconnection</term> means the synchronously operated electric transmission grid located in the western part of North America, including parts of Montana, Nebraska, New Mexico, South Dakota, Texas, Wyoming, and Mexico, and all of Arizona, California, Colorado, Idaho, Nevada, Oregon, Utah, Washington, and the Canadian Provinces of British Columbia and Alberta. </text></paragraph></section><section id="H87F9C511E5D04161839146AEB5B1476A"><enum>3.</enum><header>Jurisdiction with respect to ERCOT</header><subsection commented="no" id="H19A59529D4AD4C28A90BE8D004E96C95"><enum>(a)</enum><header>Application of part II of the Federal Power Act</header><text display-inline="yes-display-inline">Section 201(b)(2) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824(b)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id98bcace7c6914c1fa90e93c27ba45b6e"><enum>(1)</enum><text>in the first sentence, by striking <quote>section 201(f)</quote> and inserting <quote>subsection (f)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id33d9f287a7934a569f8277cd41faeec8"><enum>(2)</enum><text display-inline="yes-display-inline">in the second sentence—</text><subparagraph commented="no" id="H67A0F8FCA38B4A3695B4D13C87C4AC62"><enum>(A)</enum><text> by striking <quote>210, 211, 211A, 212,</quote>; and</text></subparagraph><subparagraph commented="no" id="HA2A2B77962E741CFAB1D3E754C616A68"><enum>(B)</enum><text>by striking <quote>an electric utility or other entity</quote> and inserting <quote>any entity that is otherwise exempt under subsection (f)</quote>. </text></subparagraph></paragraph></subsection><subsection id="H65F2F8202EF2453483BBED9CD474D799"><enum>(b)</enum><header>Definition of public utility</header><text display-inline="yes-display-inline">Section 201(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824(e)</external-xref>) is amended by striking <quote>210, 211, 211A, 212,</quote>. </text></subsection><subsection id="H32B8D77C9A994022ABAA12D1E7B5A168"><enum>(c)</enum><header>Repeal of ERCOT Exemptions</header><paragraph id="HA3E47FD12E1249A7BF2D1EC282EB3CA9"><enum>(1)</enum><text display-inline="yes-display-inline">Section 212 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824k">16 U.S.C. 824k</external-xref>) is amended by striking subsection (k).</text></paragraph><paragraph id="HDA8390A78F9C4EB18D238C622E8E9879"><enum>(2)</enum><text>Section 216 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p</external-xref>) is amended by striking subsection (k).</text></paragraph><paragraph id="H427884675FD74ABF8A44AE4A2A73832C"><enum>(3)</enum><text display-inline="yes-display-inline">Section 217 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824q">16 U.S.C. 824q</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7a45506b35c7467aac38aa045b5c6283"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subsection (h); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id87441fbdf0f143f3867e6cc96a1cebb4"><enum>(B)</enum><text>by redesignating subsections (i) through (k) as subsections (h) through (j), respectively.</text></subparagraph></paragraph><paragraph id="H56567B6D1571420199591E666DB1B5C2"><enum>(4)</enum><text display-inline="yes-display-inline">Section 220 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824t">16 U.S.C. 824t</external-xref>) is amended by striking subsection (f).</text></paragraph></subsection><subsection id="H43ABE80CA61E4A2AB621EAD57BF1EFBE"><enum>(d)</enum><header>Technical conference</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Commission shall convene a technical conference to assist entities affected by the amendments made by this section with compliance with any requirements made applicable to those entities pursuant to those amendments, including by publishing the steps necessary for such compliance.</text></subsection></section><section id="HE5AE3F16D02C4888A3622D0DD2540028"><enum>4.</enum><header>Electric reliability</header><subsection id="H30E882BD30B0490E994850C3329A4DCF"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 215 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o</external-xref>) is amended—</text><paragraph commented="no" id="H8B1490D8341F448E938DD99BF987878A"><enum>(1)</enum><text>in subsection (a)(3), in the second sentence, by striking <quote>enlarge such facilities or to construct new transmission capacity or generation capacity</quote> and inserting <quote>construct new generation capacity</quote>; and </text></paragraph><paragraph commented="no" id="HEA0469528B5A4EADB96AFB4D75A5D76D"><enum>(2)</enum><text>in subsection (i)(2), by striking <quote>or transmission</quote>.</text></paragraph></subsection><subsection id="H2B2F7D57046F4663AFDFE887E7A0D0D9"><enum>(b)</enum><header>Reliability standard for total transfer capability</header><paragraph id="HDECFC4797AC14DA780E36E4C11352559"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Commission shall order the Electric Reliability Organization to submit to the Commission a proposed reliability standard that requires minimum total transfer capability of—</text><subparagraph id="HEBD1A9E0CECE46E6BFCB3BB55A8DACC8"><enum>(A)</enum><text display-inline="yes-display-inline">between 4.3 and 12.6 gigawatts between the area under functional control of ERCOT and the area under functional control of SPP;</text></subparagraph><subparagraph id="HD44D399564C04562867EFE9BE5106781"><enum>(B)</enum><text display-inline="yes-display-inline">between 2.5 and 16.2 gigawatts between the area under functional control of ERCOT and the area under functional control of MISO; and</text></subparagraph><subparagraph id="HEC6683D95D3740F4BC33D581BD2C882A"><enum>(C)</enum><text display-inline="yes-display-inline">between 2.6 and 7.9 gigawatts between the area under functional control of ERCOT and the Western Interconnection.</text></subparagraph></paragraph><paragraph id="HABDC0BD795974C92BA42B3222158BE6F"><enum>(2)</enum><header>Contents</header><text>The Commission may only approve a proposed reliability standard described in paragraph (1) if that reliability standard—</text><subparagraph id="HFD3F8DC6B97847B8ABE61549C520C2F8"><enum>(A)</enum><text>requires minimum total transfer capability as described in paragraph (1); and</text></subparagraph><subparagraph id="HA9564BB9C2CE40DB9DD4497C943A1057"><enum>(B)</enum><text display-inline="yes-display-inline">requires each of ERCOT and SPP, ERCOT and MISO, and ERCOT and 1 or more neighboring balancing authorities in the Western Interconnection (as determined by the Electric Reliability Organization) to jointly submit, not later than 1 year after the date of enactment of this Act, a plan that—</text><clause id="HEBAE6607DD3F46D2BCC2C8B2608FCED7"><enum>(i)</enum><text display-inline="yes-display-inline">designates 1 or more entities to site and construct new transmission facilities, or modify existing transmission facilities, to achieve the applicable minimum total transfer capability; and</text></clause><clause id="H52DCB9B901FA4354BB299B98EE2F2FB2"><enum>(ii)</enum><text>includes a timeline for that siting and construction or modification, which timeline shall include that such siting and construction or modification be completed by January 1, 2035.</text></clause></subparagraph></paragraph><paragraph id="H480A226C07804D3CB17DA848088BF132"><enum>(3)</enum><header>Priority</header><text display-inline="yes-display-inline">Any plan for the siting and construction or modification of transmission facilities described in paragraph (2)(B) shall prioritize—</text><subparagraph id="H1FC77D49FFEA427AA9361CF69B3141AB"><enum>(A)</enum><text display-inline="yes-display-inline">the use of grid-enhancing technologies; </text></subparagraph><subparagraph id="H92EC0931BBBD43E9B6E028B2A05FB79A"><enum>(B)</enum><text>the use of existing rights-of-ways, such as highways and railroads, to site and construct new transmission facilities;</text></subparagraph><subparagraph id="HEEC56D3A1EB04BA99A570E5A1AE6394A"><enum>(C)</enum><text display-inline="yes-display-inline">the siting and construction of new transmission facilities on degraded land, including sites on the National Priorities List, brownfield sites, landfills, abandoned mine land, and contaminated or abandoned agricultural land; </text></subparagraph><subparagraph id="H6BB381DD7A364E74A8237EEF328A93AC"><enum>(D)</enum><text display-inline="yes-display-inline">the siting and construction of new transmission facilities in a manner that expands access to renewable energy sources, including wind, solar, and geothermal sources;</text></subparagraph><subparagraph commented="no" id="H745FAFA3ECBE48FB9D1DFE132C5C8CFD"><enum>(E)</enum><text display-inline="yes-display-inline">providing meaningful community involvement opportunities, including by conducting outreach to—</text><clause commented="no" id="HCED2E6C1E7D04A9296FD9EC96B065F9A"><enum>(i)</enum><text>environmental justice communities, including by conducting planning meetings, set at times and places to maximize the number of community members who can conveniently attend, with appropriate services, including translation and interpreting services and virtual attendance, in those environmental justice communities;</text></clause><clause id="H36C4BF7541BF4CD9BA40FC580CF2F285"><enum>(ii)</enum><text display-inline="yes-display-inline">Tribal and Indigenous communities; </text></clause><clause id="H8C306A400060456DA11FB2247592CFD3"><enum>(iii)</enum><text>Tribal governments; and</text></clause><clause commented="no" id="HF2CCD74221B7461E80F085405DFC9339"><enum>(iv)</enum><text>relevant labor organizations; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7f3658f4b03f41a6b078d16f6faf0a66"><enum>(F)</enum><text>the use of registered apprenticeship programs and prevailing wages, as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code.</text></subparagraph></paragraph><paragraph commented="no" id="H576EB93A5F2E4B1ABD9166207D531997"><enum>(4)</enum><header>Environmental review</header><text>Any project to site, construct, or modify transmission facilities that is conducted to comply with the reliability standard described in paragraph (1) shall be subject to the requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph><paragraph id="id67581eadde58462a8949ecd9f65f375d"><enum>(5)</enum><header>Savings provision</header><text>Nothing in this subsection overrides or inhibits the authority of the Commission to require minimum interregional transfer between regions in a pair or grouping of regions other than a pair or grouping of regions described in subparagraph (A), (B), or (C) of paragraph (1).</text></paragraph></subsection><subsection commented="no" id="H48FC53BEEA10480B82C03E72CB152EA7"><enum>(c)</enum><header>Consideration for national interest electric transmission corridors</header><text display-inline="yes-display-inline">In carrying out section 216 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p</external-xref>), the Secretary of Energy shall consider designating as a national interest electric transmission corridor any area in which transmission facilities will be sited and constructed or modified pursuant to this section.</text></subsection></section><section commented="no" id="H1550F3561CFA41F39E0A835C201D1B27"><enum>5.</enum><header>Increased borrowing authority under the Transmission Facilitation Program</header><text display-inline="no-display-inline">Section 40106(d)(2) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18713">42 U.S.C. 18713(d)(2)</external-xref>) is amended by striking <quote>$2,500,000,000</quote> and inserting <quote>$13,500,000,000</quote>.</text></section><section id="H4149DF9815ED49229F62F2B747B0BF06"><enum>6.</enum><header>Study and report on benefits of interconnection with Mexico</header><subsection commented="no" display-inline="no-display-inline" id="iddb6af219be6c49259cc169d119dc3d65"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of covered facility</header><text>In this section, the term <term>covered facility</term> means a facility for the generation, transmission, or sale of electric energy.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1c80ca14645a4697a4806fc91f5ef4f0"><enum>(b)</enum><header display-inline="yes-display-inline">Study and report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Energy shall conduct a study and submit to Congress a report on—</text><paragraph commented="no" display-inline="no-display-inline" id="idd22e85f2e01548bb92546c68c9f4e60d"><enum>(1)</enum><text display-inline="yes-display-inline">the reliability, climate, and cost benefits of the interconnection of covered facilities in the United States with covered facilities in Mexico; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6d309629b6234b839880bbda485e3a4a"><enum>(2)</enum><text display-inline="yes-display-inline">the siting and construction, or modification, of covered facilities that will bring the most cumulative benefits.</text></paragraph></subsection></section></legis-body></bill>
