which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20231220">December 20, 2023</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To establish the Springfield 1908 Race Riot National Monument in the State of Illinois, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H9DBC1F9C84E94DB185431F7DA3A53699"><section section-type="section-one" id="H4674A40308B84374927709431FADCEFF" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Springfield 1908 Race Riot National Monument Act</short-title></quote>.</text></section><section id="H0D6E1E2EDCE745FE9FF15D6EFCDFFF1F" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id8B14528AA74448978AAA8504EBF9B444"><enum>(1)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Springfield 1908 Advisory Commission established by section 3(g)(1).</text></paragraph><paragraph id="idCB5AF6E890C94311864D089D8C9F777D"><enum>(2)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Springfield 1908 Race Riot National Memorial Proposed Boundary</quote>, numbered 687/148588, and dated February 2023. </text></paragraph><paragraph id="id41025b0b6db04b32adc92c11241dd8aa"><enum>(3)</enum><header>Memorial</header><text>The term <term>Memorial</term> means the memorial required to be constructed under section 3(a)(1)(B), including the structure, interpretive signage, and associated infrastructure. </text></paragraph><paragraph id="idf41135031e1447608af04a63592105f5"><enum>(4)</enum><header>National monument</header><text>The term <term>National Monument</term> means the Springfield 1908 Race Riot National Monument established by section 3(a)(1). </text></paragraph><paragraph id="id25b4db4f922d4cbc958922e0ca8cac31"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the National Park Service. </text></paragraph><paragraph id="id4f77d50e2cad4de3a0364f9d8f7966a3"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means the State of Illinois.</text></paragraph></section><section id="H7508A590AB8D41EA832DE4908D642BB9" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>3.</enum><header>Establishment of Springfield 1908 Race Riot National Monument</header><subsection id="H36C98F2033344367BB33987D11DBF2F8"><enum>(a)</enum><header>Establishment</header><paragraph id="H28A80F49B4D94919A88D83025767BCA4"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), there is established in the State the Springfield 1908 Race Riot National Monument as a unit of the National Park System—</text><subparagraph id="id481DB98BA6C14B72A6C61C8B8C76F05F"><enum>(A)</enum><text>to preserve, protect, and interpret for the benefit of present and future generations resources associated with the Springfield Race Riot of 1908 and the role of the Riot in the formation of the National Association for the Advancement of Colored People; and</text></subparagraph><subparagraph id="id0a6aa785dd884cd3886f86f0293912e2"><enum>(B)</enum><text>that shall include the construction of a permanent memorial, within the boundary of the National Monument, to—</text><clause id="id0D515F047B8E4CF58B7A338E4364D491"><enum>(i)</enum><text>the victims, survivors, and descendants of survivors of the Springfield Race Riot of 1908; and</text></clause><clause id="id2A69CBBA78104408998F1E521F1A8F24"><enum>(ii)</enum><text>the Springfield community. </text></clause></subparagraph></paragraph><paragraph id="H39726F4C9C28473A8B9B9476066F7E6C"><enum>(2)</enum><header>Conditions</header><text>The National Monument shall not be established until the date on which the Secretary acquires sufficient land within the boundary of the National Monument to constitute a manageable unit.</text></paragraph></subsection><subsection id="H9DF71190E4AB4DCC86696FA9EF9867B7"><enum>(b)</enum><header>Boundaries</header><paragraph id="id0F8BA083EEB4492781DCA9D85E7EED57"><enum>(1)</enum><header>In general</header><text>The boundary of the National Monument shall be the boundary generally depicted on the Map.</text></paragraph><paragraph id="idF872C8836A5447049EE3D80BDBCAB331"><enum>(2)</enum><header>Correction of errors</header><text>The Secretary may correct minor errors in the Map.</text></paragraph></subsection><subsection id="HB15BCC20E0164D2ABE6F749E3272F947"><enum>(c)</enum><header>Acquisition authority</header><text>The Secretary may acquire any land or interest in land located within the boundary of the National Monument by—</text><paragraph id="H70B85D02D6054593A6CE510F2455AA9E"><enum>(1)</enum><text>donation;</text></paragraph><paragraph id="H48E5E4C5352D4273BA9DFD14DF0DAD4C"><enum>(2)</enum><text>purchase with donated or appropriated funds; or</text></paragraph><paragraph id="H5EB7EC4126CC4AE08949BE4F5DA16011"><enum>(3)</enum><text>exchange.</text></paragraph></subsection><subsection id="id17bfb67013f8491bb684ca5f5662a497"><enum>(d)</enum><header>Administrative sites and visitor facilities</header><text>To facilitate the administration of the National Monument, the Secretary may expend appropriated funds to acquire or lease essential facilities for the administration of the National Monument and visitor services outside the boundary, but within the vicinity, of the National Monument.</text></subsection><subsection id="ide6de9eb5956f471d95a03da1a1c3c988"><enum>(e)</enum><header>Memorial</header><text>In accordance with subsection (a)(1)(B), the Secretary shall, using donated or appropriated funds, construct a Memorial within the boundary of the National Monument. </text></subsection><subsection id="H346A8A957F49470FB18DFC45FD12B450"><enum>(f)</enum><header>Agreements</header><text>The Secretary may enter into agreements with—</text><paragraph id="id1e1e15d900fc4b8f9875aa815e2abffa"><enum>(1)</enum><text>the city of Springfield or other public or private entities for the purpose of establishing, managing, and operating within or outside of the boundary of the National Monument facilities for administration and visitor services authorized under subsection (e); and</text></paragraph><paragraph id="id02ED0DD718294A489CDD1DF02E47ADA2"><enum>(2)</enum><text>other public or private entities for—</text><subparagraph id="idA94A65191801468FA5140A98665C0E66"><enum>(A)</enum><text>the construction of the Memorial;</text></subparagraph><subparagraph id="id0AAA390BAD494279B801E843F7176F8A"><enum>(B)</enum><text>the interpretation of sites associated with the Springfield Race Riot of 1908 located within or outside the boundary of the National Monument; and</text></subparagraph><subparagraph id="idBF74181A6E8B41979ECBBACCF3BC06D6"><enum>(C)</enum><text>other purposes of this Act. </text></subparagraph></paragraph></subsection><subsection id="id06545d72d0314d5798c968c0f3e9cbe8" commented="no"><enum>(g)</enum><header>Springfield 1908 Advisory commission</header><paragraph commented="no" id="idBE2E7D9CC6FB425E95816DD17654977B"><enum>(1)</enum><header>Establishment</header><text>There is established an advisory commission, to be known as the <quote>Springfield 1908 Advisory Commission</quote>, to advise the Secretary with respect to the management and development of the National Monument.</text></paragraph><paragraph id="idb357cb7bf79d4744abd70619546fe8f0" commented="no"><enum>(2)</enum><header>Membership</header><text>The Commission shall be composed of 11 members, to be appointed by the Secretary, of whom—</text><subparagraph id="id89218d5b038440c0bc30ef5ad95a03ee"><enum>(A)</enum><text>3 members shall reside in the city of Springfield or Sangamon County in the State;</text></subparagraph><subparagraph id="id01b2350d7d4b430db4f502dc0e9ebe28"><enum>(B)</enum><text>3 members shall be appointed after consideration of recommendations submitted by the Governor of the State;</text></subparagraph><subparagraph id="id31b60963f9614f009c8f9d1cf96bbb6f"><enum>(C)</enum><text>3 members shall be appointed after consideration of recommendations submitted by the Mayor of the city of Springfield in the State; and</text></subparagraph><subparagraph id="id104afd23352f4dbf8706cf9a9b9047d8"><enum>(D)</enum><text>2 members shall be appointed who have experience in the field of historic preservation or the purposes for which the National Monument was established.</text></subparagraph></paragraph><paragraph id="idc8488d54e08a47e99a0e4b687cdd423f" commented="no"><enum>(3)</enum><header>Term</header><subparagraph commented="no" id="idD0779C5D918B47E7842C552ED056F067"><enum>(A)</enum><header>In general</header><text>A member of the Commission shall be appointed for a term of 5 years.</text></subparagraph><subparagraph id="id0753f00aba594d34bb81301eb5704216"><enum>(B)</enum><header>Successors</header><text>Notwithstanding the expiration of a 5-year term of a member of the Commission, a member of the Commission may continue to serve on the Commission until the date on which—</text><clause id="ide51f04695582449784b97fdaa1fbfedb"><enum>(i)</enum><text>the member is reappointed by the Secretary; or</text></clause><clause id="iddcdb02ca0a2c45e5861e373cc65726bc" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>a successor is appointed by the Secretary. </text></clause></subparagraph></paragraph><paragraph id="id649ac8fa2f384601a2f2db5c7a360941" commented="no"><enum>(4)</enum><header>Chairperson</header><text>The Commission shall have a Chairperson, who shall be elected by the members of the Commission.</text></paragraph><paragraph id="id29361d94ea8245558511765043f78f60"><enum>(5)</enum><header>Bylaws</header><text>The Commission shall adopt such bylaws as the Commission considers necessary to carry out the duties of the Commission under this subsection.</text></paragraph><paragraph id="id352a359ca87644578e0688125a72aafb"><enum>(6)</enum><header>Vacancies</header><text>A vacancy on the Commission shall be filled in the same manner in which the original appointment was made.</text></paragraph><paragraph id="idf3da3fef1eb1496986d5579ed383e590"><enum>(7)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum.</text></paragraph><paragraph id="id54c13c861ee94438bf24feea20cd03b3" commented="no"><enum>(8)</enum><header>Compensation</header><text>Members of the Commission shall serve without compensation, except that the Secretary may pay the expenses incurred by the Commission in carrying out the duties of the Commission under this subsection.</text></paragraph><paragraph id="id54c464467a5d491e8de02b7429781b40"><enum>(9)</enum><header>FACA nonapplicability</header><text>Section 1013(b) of title 5, United States Code, shall not apply to the Commission.</text></paragraph><paragraph id="idb3bb9aa2ddcd4e358404243d1fc06e36" commented="no"><enum>(10)</enum><header>Termination</header><text>The Commission shall terminate on the date that is 12 years after the date of enactment of this Act. </text></paragraph></subsection><subsection id="HF1FF5C4062DE4F9DB63ABF62ED0454E2"><enum>(h)</enum><header>Administration</header><paragraph id="H9FE917315BA94819B4661B2B206CFF9E"><enum>(1)</enum><header>In general</header><text>The Secretary shall administer the National Monument in accordance with—</text><subparagraph id="H18E7ECB276B34CAC82DD357C7358D223"><enum>(A)</enum><text>this Act; and</text></subparagraph><subparagraph id="H5DC44F5BB0124FC788370A52ECA73DD8"><enum>(B)</enum><text>the laws generally applicable to units of the National Park System.</text></subparagraph></paragraph><paragraph id="H687E80E9C24046789B1EF39ABCC08A32"><enum>(2)</enum><header>Management plan</header><subparagraph id="H621007CD0B864A7FBD27F8507CB716BE"><enum>(A)</enum><header>Deadline for completion</header><text>Not later than 3 years after the date on which funds are first made available to the Secretary for the preparation of a general management plan for the National Monument, the Secretary shall prepare a general management plan for the National Monument in accordance with section 100502 of title 54, United States Code.</text></subparagraph><subparagraph id="HAD84606AB92645C1A75FAF7BC4FF06BC"><enum>(B)</enum><header>Submission to Congress</header><text>On completion of the general management plan under subparagraph (A), the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives the general management plan prepared under that subparagraph.</text></subparagraph></paragraph><paragraph id="idc43021104d2f403fb60c73f7a12917a3" commented="no"><enum>(3)</enum><header>Required consultation</header><text>The Secretary shall consult with the Commission on matters relating to the management and development of the National Monument, including the construction of—</text><subparagraph commented="no" id="idE19138B8BC13497A9F61DBE94458C7AD"><enum>(A)</enum><text>the Memorial; and</text></subparagraph><subparagraph commented="no" id="idD8688A683074474FA93FCD132C5018BF"><enum>(B)</enum><text>visitor service facilities and infrastructure. </text></subparagraph></paragraph></subsection></section></legis-body><legis-body style="OLC" display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="id3675702f-31e8-4d27-98a1-e9160495f4fd" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Springfield 1908 Race Riot National Monument Act</short-title></quote>.</text></section><section id="id84fe2eb4-9dc5-4bed-b8a5-86b8138356c9" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id8ee906ff-3a02-4473-8a9c-f70ab62ac6b2"><enum>(1)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Springfield 1908 Advisory Commission established by section 3(h)(1).</text></paragraph><paragraph id="id228c1eb4-3bce-4806-9e56-026fa3addd43"><enum>(2)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Springfield 1908 Race Riot National Memorial Proposed Boundary</quote>, numbered 687/148588, and dated February 2023. </text></paragraph><paragraph id="id1794fc59-1f93-4c1a-957c-3972098a7e9c"><enum>(3)</enum><header>National monument</header><text>The term <term>National Monument</term> means the Springfield 1908 Race Riot National Monument established by section 3(a)(1). </text></paragraph><paragraph id="id1c9ee026-e6db-481f-ae2d-09d419b54e00"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior. </text></paragraph><paragraph id="idea90b6b4-6aeb-4396-b1ba-a53a3ffd6c7b"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means the State of Illinois.</text></paragraph></section><section id="id005283c6-fba6-47d1-9683-c78fec0937da" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>3.</enum><header>Establishment of Springfield 1908 Race Riot National Monument</header><subsection id="id6a95cbf8-5db3-402d-b363-608ac61f0b5f"><enum>(a)</enum><header>Establishment</header><paragraph id="id9a794ce6-2ae1-4559-974a-ada5394c6084"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), there is established in the State the Springfield 1908 Race Riot National Monument as a unit of the National Park System to preserve, protect, and interpret for the benefit of present and future generations resources associated with the Springfield Race Riot of 1908 and the role of the Riot in the formation of the National Association for the Advancement of Colored People.</text></paragraph><paragraph id="id5e007416687b45b8a00bfd8448ab0217"><enum>(2)</enum><header>Conditions</header><text>The National Monument shall not be established until the date on which the Secretary determines that sufficient land has been acquired within the boundary of the National Monument to constitute a manageable unit. </text></paragraph></subsection><subsection id="idd363735e-aa01-4efe-8b76-7a960d42812f"><enum>(b)</enum><header>Boundaries</header><paragraph id="id6bdfde05-ea80-4bd0-9c6f-949233792200"><enum>(1)</enum><header>In general</header><text>The boundary of the National Monument shall be the boundary generally depicted on the Map.</text></paragraph><paragraph id="ida359bb0ea4ab4183816a924cb1169459"><enum>(2)</enum><header>Availability of Map</header><text>The Map shall be on file and available for public inspection in the appropriate offices of the National Park Service. </text></paragraph></subsection><subsection id="id21a5195a-1f9e-4345-a18e-f262485ff22d"><enum>(c)</enum><header>Acquisition authority</header><text>The Secretary may acquire land or interests in land located within the boundary of the National Monument by—</text><paragraph id="ide011365f-aa64-4db0-b44a-44fc0484886b"><enum>(1)</enum><text>donation;</text></paragraph><paragraph id="id1ceff73d-6055-4e8e-88fb-9a7254d8a7c5"><enum>(2)</enum><text>purchase with donated or appropriated funds; or</text></paragraph><paragraph id="id62bde190-82e1-46b4-8ae3-cce4b57eac5e"><enum>(3)</enum><text>exchange.</text></paragraph></subsection><subsection id="id5654bed2945d4b9baa0f0b0b7b1aa268"><enum>(d)</enum><header>Administrative sites and visitor facilities</header><text>To facilitate the administration of the National Monument, the Secretary may acquire or lease facilities for the administration of the National Monument and to provide visitor services outside the boundary, but within the vicinity, of the National Monument.</text></subsection><subsection id="idde8eb916a3454d69866e36a807fed2f9"><enum>(e)</enum><header>Administration</header><paragraph id="id2d2d09005a0f444389c714b33765d203"><enum>(1)</enum><header>In general</header><text>The Secretary shall administer the National Monument in accordance with—</text><subparagraph id="id3b272257bb544fd8a9114e366f8e0914"><enum>(A)</enum><text>this Act; and</text></subparagraph><subparagraph id="idc9e583ae4d594bffb937880a73e088ad"><enum>(B)</enum><text>the laws generally applicable to units of the National Park System.</text></subparagraph></paragraph><paragraph id="id319d595164a34071a0076490973b7a7c"><enum>(2)</enum><header>Management plan</header><text>Not later than 3 years after the date on which funds are first made available to the Secretary for the preparation of a management plan for the National Monument, the Secretary shall prepare a management plan for the National Monument in accordance with section 100502 of title 54, United States Code.</text></paragraph></subsection><subsection id="id6dc5b21a117a4e82b81de82777064ff1"><enum>(f)</enum><header>Memorial</header><text>The Secretary may accept the donation of a permanent memorial to the victims, survivors, and descendants of survivors of the Springfield Race Riot of 1908, to be located within the boundary of the National Monument.</text></subsection><subsection id="id54c017385b314fcaafea0bba306ab75c"><enum>(g)</enum><header>Agreements</header><text>The Secretary may enter into agreements with—</text><paragraph id="idfae3567d5eb94c7e8942ce9b5a13df31"><enum>(1)</enum><text>the city of Springfield in the State or other public or private entities for the purpose of managing and operating National Monument facilities for administration and visitor services authorized under subsection (d); or</text></clause><clause id="id3b6b230c-727e-4c03-b753-95e0b2cbed02" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>a successor is appointed by the Secretary. </text></clause></subparagraph></paragraph><paragraph id="idf24b12d8-9c25-4478-b4df-098961476521" commented="no"><enum>(4)</enum><header>Chairperson</header><text>The Commission shall have a Chairperson, who shall be elected by the members of the Commission.</text></paragraph><paragraph id="id33a9e28c-cd7f-474f-a149-0d5195b3acf9"><enum>(5)</enum><header>Bylaws</header><text>The Commission shall adopt such bylaws as the Commission considers necessary to carry out the duties of the Commission under this subsection.</text></paragraph><paragraph id="id601c76ef-5ab4-4ae6-8139-dfa96f55d9af"><enum>(6)</enum><header>Vacancies</header><text>A vacancy on the Commission shall be filled in the same manner in which the original appointment was made.</text></paragraph><paragraph id="idfe0efad6-d7ed-4991-b7ac-59f57d2ee4b1"><enum>(7)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum.</text></paragraph><paragraph id="id2a6c2530348848bdb4343da7ad0ff0f7"><enum>(8)</enum><header>Compensation</header><subparagraph commented="no" display-inline="no-display-inline" id="id1e9dc3c01a2e4f1a8f59cc72ce80a83c"><enum>(A)</enum><header>In general</header><text>Members of the Commission shall serve without compensation.</text></subparagraph><subparagraph id="idc2f236514d0c4f4cb6d54990f2cb6ef7"><enum>(B)</enum><header>Travel expenses</header><text>Members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duty of the Commission. </text></subparagraph></paragraph><paragraph id="id66ab485d-5146-44b2-b17e-1bd90e002ee6"><enum>(9)</enum><header>FACA nonapplicability</header><text>Section 1013(b) of title 5, United States Code, shall not apply to the Commission.</text></paragraph><paragraph id="id09487450-3b94-47ac-bda6-7615c9ded278" commented="no"><enum>(10)</enum><header>Termination</header><text>The Commission shall terminate on the date that is 12 years after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body><endorsement><action-date date="20231220">December 20, 2023</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
