which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Director of the Office of Personnel Management to revise job classification and qualification standards for positions in the competitive service regarding educational requirements for those positions, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H4356366F16BA4DA0BDF695658D8170AA"><section commented="no" section-type="section-one" id="H2FE2ECEA7A0A48AFA284D452B124EDE9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Skills Act of 2023</short-title></quote>. </text></section><section id="HCA5D194B78C4498BB13130F00FA8C29B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="idc8406174725e49e18a924539af8431e7"><enum>(1)</enum><text>the term <term>agency</term> means an agency that appoints individuals to positions in the competitive service;</text></paragraph><paragraph id="idA49BBECC99434186BE44C402BF40E64D"><enum>(2)</enum><text>the term <term>competitive service</term> has the meaning given the term in section 2102 of title 5, United States Code;</text></paragraph><paragraph id="id7ae399e7d4a44ec9819b1dbee29550f5"><enum>(3)</enum><text>the term <term>Director</term> means the Director of the Office of Personnel Management;</text></paragraph><paragraph id="id1418ED0FDA9F4239BE8043F292706AB7"><enum>(4)</enum><text>the term <term>education</term> means the completion or attainment of a postsecondary degree or other credential at an institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>));</text></paragraph><paragraph id="id3766d55051904c71a167761c255aed6b"><enum>(5)</enum><text>the term <term>personnel assessment</term> means a method of collecting information regarding an individual for the purposes of making a selection decision with respect to the individual; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc80ac2d9e8c64257bfa21edcc0b69b20"><enum>(6)</enum><text>the term <term>qualification standards</term> means the minimum requirements with respect to education, training, and experience that an applicant for employment would need to possess in order to make it likely that the applicant would perform satisfactorily in the position or occupational series that is the subject of the application for employment; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0FD1C0B4590648A99AE81849F703F23E"><enum>(7)</enum><text>the term <term>selection decision</term> includes a decision regarding an individual with respect to— </text><subparagraph commented="no" display-inline="no-display-inline" id="id7689749D77714F2E97636E238F5A8E4B"><enum>(A)</enum><text>appointment; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id683253D1050248759A0B3BB47878EF03"><enum>(B)</enum><text>placement; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ED6CA7FBB9745C7B16CD5554F54D3DD"><enum>(C)</enum><text>promotion; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6930AF3FAD3647C5802D15A3EB68E3D7"><enum>(D)</enum><text>referral; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA4AC181C5F77447B9295B18F57765DEB"><enum>(E)</enum><text>retention; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6D62103853F14DB2B2C0C7CD91A04615"><enum>(F)</enum><text>entry into a program leading to career advancement, such as an apprenticeship program, a training program, or a career development program.</text></subparagraph></paragraph></section><section id="HF664993D5A9A465A9E2D7C9D75180A26"><enum>3.</enum><header>Revision of job classification and qualification standards</header><subsection id="H3C8951E473FC4556A353EAB18B5B3573"><enum>(a)</enum><header>Review</header><paragraph id="id6764C8161AB543FBB83CB48F20FBE412"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Consistent with the requirements of this section, the Director, in consultation with the Director of the Office of Management and Budget and the head of each agency, shall review and revise all job classification and qualification standards for positions in the competitive service, as necessary. </text></paragraph><paragraph id="idDEE017847D1745189704E9B9E6E49BFA"><enum>(2)</enum><header>Publication; effective date</header><text display-inline="yes-display-inline">With respect to any change to a job classification or qualification standard made under paragraph (1)— </text><subparagraph id="idA00EC5271D7248EF829F86D0C7048205"><enum>(A)</enum><text display-inline="yes-display-inline">the Director shall, not later than 120 days after the date of enactment of this Act, make that change available to the public; and</text></subparagraph><subparagraph id="idC719F93EAE414074BFAB330BF3A144B6"><enum>(B)</enum><text display-inline="yes-display-inline">the change shall take effect not later than 180 days after the date of enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="H9414D3EDAD704A9994543C82DB2A7D40"><enum>(b)</enum><header>Education requirement</header><text display-inline="yes-display-inline">The head of an agency may prescribe a minimum requirement with respect to education for a position in the competitive service only if a minimum qualification with respect to education is legally required to perform the duties of a comparable position in the State or locality where those duties are to be performed.</text></subsection><subsection id="H10C29A8F5B17457982A6A3F2465DAED9"><enum>(c)</enum><header>Consideration of education</header><text display-inline="yes-display-inline">Unless the head of an agency is determining the satisfaction of a legally required minimum requirement with respect to education for an applicant for employment with the agency, the agency head may consider the education of the applicant in determining the satisfaction by the applicant of another minimum qualification only if the education of the applicant directly reflects the competencies necessary to satisfy that qualification and perform the duties of the position.</text></subsection><subsection id="H5CE4FCA386314769A315275B971E3B27"><enum>(d)</enum><header>Position listing</header><text display-inline="yes-display-inline">A position description and job posting published by an agency for a position in the competitive service shall be based on the specific skills and competencies required to perform that position, as established in the position classifications and qualification standards of the Office of Personnel Management.</text></subsection></section><section id="HD6078EDFB5014BC9BAAD7C979F45AFB1"><enum>4.</enum><header>Improving the use of assessments in the Federal hiring process</header><subsection id="H44228CB77E254DB9B766CB9CD3C0BB81"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall work with the head of each agency to ensure that, not later than 180 days after the date of enactment of this Act, for a position in the competitive service, the head of an agency assesses an applicant for employment in a manner that does not rely solely on the education of the applicant to determine the extent to which the applicant possesses relevant knowledge, skills, competencies, and abilities for the position.</text></subsection><subsection id="idBE4EEC9EA8DF40609BC4D3A15DC810CB"><enum>(b)</enum><header>Other requirements</header><text display-inline="yes-display-inline">With respect to the assessment practices described in subsection (a)—</text><paragraph id="id1ED5A1623E2847D5ADC96AB0D8F46A73"><enum>(1)</enum><text display-inline="yes-display-inline">the head of each agency shall develop or identify those assessment practices; and</text></paragraph><paragraph id="id2A0A2B11BC3E46C88BF82850AAA5750F"><enum>(2)</enum><text display-inline="yes-display-inline">those assessment practices— </text><subparagraph id="idFA6E69676AF345E88F25D5ABA1474BF4"><enum>(A)</enum><text display-inline="yes-display-inline">may not be substantively equivalent to competencies only attainable through education; and</text></subparagraph><subparagraph id="id1CE918542E8A4BCE9D85CE68665B1077"><enum>(B)</enum><text display-inline="yes-display-inline">shall be published by the applicable agency in the human resources manual of the agency.</text></subparagraph></paragraph></subsection><subsection id="HBB10EEB583A3443BA66F773BF4E08D66"><enum>(c)</enum><header>Consideration of self-Evaluation</header><paragraph id="id9D8224C97D2A4EDB92BB1B8A1A322AEB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In assessing an applicant for employment— </text><subparagraph id="idDF03421CA01344678930656B4536721E"><enum>(A)</enum><text display-inline="yes-display-inline">the head of an agency may not rely solely on the self-evaluation of the stated abilities of the applicant; and</text></subparagraph><subparagraph id="id2FD41397EF5F4775A9263D9C5AE9C102"><enum>(B)</enum><text display-inline="yes-display-inline">the applicant shall fulfill other assessment standards in order to be certified for consideration, as established by the Chief Human Capital Officer of the applicable agency (or an equivalent official). </text></subparagraph></paragraph><paragraph id="idDDD62C6FE759436AA30C1D52043C1C5A"><enum>(2)</enum><header>Publication</header><text display-inline="yes-display-inline">The standards described in paragraph (1)(B) shall be published in the human resources manual of the applicable agency.</text></paragraph></subsection><subsection id="H0B789DE8B90941D58A7F8CEB4E29E4D8"><enum>(d)</enum><header>Evaluation</header><text display-inline="yes-display-inline">The head of each agency shall continually evaluate the effectiveness of different assessment strategies to promote and protect the quality and integrity of the appointment processes of the agency, which shall be reviewed by the Chief Human Capital Officer of the agency (or an equivalent official), who shall make any necessary changes or take any necessary remedial actions concurrent with the review. </text></subsection></section><section id="H38AC174CD7504A43B4601250FB57F135"><enum>5.</enum><header>Application</header><subsection id="HB6665A09AF16492E838B5CAFBCE4FEDD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this Act may be construed to impair or otherwise affect—</text><paragraph id="H552E3037F9A1415D81ABDEC6FC1A6BF6"><enum>(1)</enum><text display-inline="yes-display-inline">the authority granted by law to an executive department or agency, or the head thereof; or</text></paragraph><paragraph id="H17E2327F1DAF4DF99DF73A9B4A2834F8"><enum>(2)</enum><text display-inline="yes-display-inline">the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.</text></paragraph></subsection><subsection id="H8AEF61B87E8F4AF8A86D877C6E231B97"><enum>(b)</enum><header>Rights or benefits</header><text display-inline="yes-display-inline">This Act is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.</text></subsection></section><section id="id44FCA8E697B04683AED3E2671E522E76"><enum>6.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed to eliminate or otherwise affect the student loan forgiveness or student loan cancellation options available to borrowers under Federal law, as such options are in effect on the day before the date of enactment of this Act.</text></section></legis-body></bill>
