which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act to revise the treatment of certain resilience actions and natural disasters, to limit the issuance of new standards for criteria pollutants, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="id17b841b391d94921b44685dbb97744cf" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modernizing Clean Air Permitting Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" id="id6a17dbdfca884efeae8e1ee8fdd9c343"><enum>2.</enum><header>Treatment of natural background levels and activity</header><subsection id="ide6f2e3629d034f9e841cbbed0338f37d"><enum>(a)</enum><header>Treatment of natural background levels</header><text>Section 107(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7407">42 U.S.C. 7407(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id207dd080eddc49a580cd51b90bc0b391"><paragraph id="idd8e49046598a4854a1adf619ffade8c4"><enum>(8)</enum><header>Treatment of naturally occurring events, wildfires, and resilience actions</header><text>In determining whether an area meets national primary or secondary ambient air quality standards for a pollutant under this subsection, the Administrator shall not take into consideration any emissions of the pollutant that result from—</text><subparagraph id="id7b2e0c921e494c989e3093da8f2fcbb5"><enum>(A)</enum><text>prescribed fires or wildfires on public or private land, regardless of the cause of those fires;</text></subparagraph><subparagraph id="id39e0f46864004023b32be2ee16e9a8f3"><enum>(B)</enum><text>actions determined by the Governor to increase resilience to natural disasters;</text></subparagraph><subparagraph id="ide59ab745ab1b49c796b1e7bcdd585153"><enum>(C)</enum><text>natural disasters; or</text></subparagraph><subparagraph id="iddd27d433bc37410ea9d1ae027b9c7e63"><enum>(D)</enum><text>naturally occurring events that cause an increase in the pollutant over the expected naturally occurring levels in a given year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ide3441e0276434e39b97b6b11e60e15ac"><enum>(b)</enum><header>Existing compliance of previous standards</header><text>Section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id009913670470429493b55771dc1c64de"><subsection id="id3ed5bfc75bfe40bdbcd7df4ed9f97f39"><enum>(e)</enum><header>Revisions related to naturally occurring background levels</header><text>For national primary and secondary ambient air quality standards revised after the date of enactment of this subsection, if a revision of a standard by the Administrator would require a State to lower the emissions of a criteria pollutant in an area of that State below a level consistent with levels observed naturally in that area, as determined by the State, in an average year, the State shall not be required to lower the levels of that criteria pollutant below locally uncontrollable levels, including interstate, international, and local mobile emissions in areas that have implemented a basic vehicle emission inspection and maintenance program and clean-fuel vehicle program to comply with the requirements of section 182.</text></subsection><subsection id="iddeb06462183248ce8bbfe69f054b9554"><enum>(f)</enum><header>Existing compliance</header><text>For national primary and secondary ambient air quality standards revised after the date of enactment of this subsection, the Administrator shall take into consideration—</text><paragraph id="idf62dce2791da4142b2a8d5ff2c1434f6"><enum>(1)</enum><text>existing rates of compliance with previous national primary and secondary ambient air quality standards;</text></paragraph><paragraph id="ida05ae4b332cf452f9c808849ecebee66"><enum>(2)</enum><text>technological feasibility of complying with the proposed national primary or secondary ambient air quality standard revision; and</text></paragraph><paragraph id="idea8911b166d548abb5439a73c50c6d1d"><enum>(3)</enum><text>the costs of complying with the proposed national primary or secondary ambient air quality standard revision.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id641fe1c085d74bc09a906982e4b975dd"><enum>(c)</enum><header>Treatment of mobile sources</header><text>Section 110(a) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7410">42 U.S.C. 7410(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcb12f7fa21fc4720ae8acd80b2014b73"><paragraph id="ide174645faaae40939436b1fe2b857fdc"><enum>(7)</enum><header>Treatment of mobile sources</header><text>In developing or revising a State implementation plan under this section, the Governor of a State may—</text><subparagraph id="idfc57c5d62d2d4b449ebe938e8253b58b"><enum>(A)</enum><text>make a determination as to the quantity of a criteria pollutant that is created as a result of mobile sources traversing any area designated as a nonattainment area as a part of multi-region or interstate transport; and</text></subparagraph><subparagraph id="id489491267e614acabfae2e003ca5896a"><enum>(B)</enum><text>in addition to mitigation methods developed for an area designated as a nonattainment area for which a determination was made under subparagraph (A), develop methods for new major sources in the nonattainment area to mitigate or offset the quantity of mobile source pollution in the nonattainment area determined under subparagraph (A) through the reduction of mobile source pollution outside of that nonattainment area.</text></subparagraph></paragraph><paragraph id="idf8bd2e6c122340969e86d1d46f215681"><enum>(8)</enum><header>Treatment of international emissions</header><subparagraph id="id1dee07040e824e8a927df9d0709a1b71"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this paragraph, the Administrator, in consultation with the States, shall submit to Congress a report that describes—</text><clause id="id91c763c030e54b2ba1d428deb0eec9d7"><enum>(i)</enum><text>the extent to which foreign sources of air pollution, including emissions from sources located outside of North America, impact—</text><subclause id="id0fbee9e6a56e48b7a6f3342e86b48659"><enum>(I)</enum><text>the designation of areas (or portions of areas) as nonattainment, attainment, or unclassifiable under section 107(d); and</text></subclause><subclause id="id318ae1210bff4481b179d1632d31b2ab"><enum>(II)</enum><text>the attainment and maintenance of national ambient air quality standards;</text></subclause></clause><clause id="id190dfab733f64c7f99cda8d6d53b3931"><enum>(ii)</enum><text>the procedures and timelines of the Administrator for the disposition of petitions submitted under section 179B(b);</text></clause><clause id="id56cb529421514bb58e1496c62a1cb548"><enum>(iii)</enum><text>the total number of petitions received by the Administrator under section 179B and, with respect to each petition—</text><subclause id="id432b078982374695aa978144960a4835"><enum>(I)</enum><text>the date on which the petition was initially submitted to the Administrator; and</text></subclause><subclause id="id0b068f19c6ab49fc8baa64b265af9fe3"><enum>(II)</enum><text>the date of final disposition of the petition by the Administrator; and</text></subclause></clause><clause id="idc3a2179205a0432a9cc47d38df132aa9"><enum>(iv)</enum><text>whether the Administrator recommends any statutory changes to facilitate—</text><subclause id="id88d4d4723d0a46b5ab1d717f54277918"><enum>(I)</enum><text>the more efficient review and disposition of petitions submitted under section 179B; and</text></subclause><subclause id="idb0bc4f24de604902b538b33aefd43b97"><enum>(II)</enum><text>the ability to discount the emissions of foreign sources in calculating the emissions levels and attainment of an area.</text></subclause></clause></subparagraph><subparagraph id="idfe0a57fae16b4246ba9c79c9d440c7db"><enum>(B)</enum><header>Rulemaking required</header><text>Not later than 3 years after the date of enactment of this paragraph, the Administrator, in consultation with the States, shall complete a rulemaking that details any additional flexibility that is to be provided to Governors of States in the creation of State implementation plans under this section with respect to the facilitation of the ability described in subparagraph (A)(iv)(II).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="ida8f3796bc38d4f7cbdc3b6d6abd97a84"><enum>3.</enum><header>Review and revision criteria for applicable standards</header><text display-inline="no-display-inline">Section 109(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbdadaa9206eb416bada2dac22cc95f75"><paragraph id="id6198a8244e1145418edfdb54b91da1fb"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id969b459d325a453ab7da8721a0bdcd6f"><enum>(A)</enum><text>Notwithstanding paragraph (1), the Administrator may not issue new standards relating to a criteria pollutant if more than 15 percent of total air quality control regions that were in nonattainment for that criteria pollutant as a result of a previous revision of standards still remain in nonattainment.</text></subparagraph><subparagraph id="id42b3e0d62daf4c408d6ebd7a51199734" indent="up1"><enum>(B)</enum><text>If fewer than 15 percent of the total number of air quality control regions initially in nonattainment for a criteria pollutant remain in nonattainment for that criteria pollutant, the Administrator may issue new standards relating to that criteria pollutant.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idcc142a1743f240b1b89a08ab7bc68944"><enum>4.</enum><header>Reclassification of major sources as area sources</header><text display-inline="no-display-inline">Section 112 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ideaf678c352334f80ab5fe3b10bc69dc0"><subsection id="id2b7b4964472f459699f02f2d94ccf7ac"><enum>(t)</enum><header>Reclassification of major sources as area sources</header><paragraph id="id7557b4e5977f4739b309b9870164f0d6"><enum>(1)</enum><header>In general</header><text>At any time that a stationary source demonstrates to the Administrator that the actual or potential emissions of hazardous air pollutants of a major source fall below the standards described in subsection (a)(1) for a period of 6 consecutive months, the Administrator shall reclassify the major source as an area source under this section.</text></paragraph><paragraph id="idc48a89e8d21f4b0098f6d81aa4829235"><enum>(2)</enum><header>Requirements</header><text>Beginning on the date of a reclassification of a major source as an area source under paragraph (1)—</text><subparagraph id="id908c6a74bc19478eaaa7d87eb7c662e9"><enum>(A)</enum><text>any requirements previously applicable to the reclassified source under a major source standard under this section shall no longer apply to that reclassified source;</text></subparagraph><subparagraph id="idb783ee46b4f84a1fa331688bbb0796fc"><enum>(B)</enum><text>the requirements of any applicable area source standard under this section shall apply to that reclassified source; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3424a6a686b4cd392897d7013768a08"><enum>(C)</enum><text display-inline="yes-display-inline">the owner or operator of the reclassified source shall annually supply monitoring data of the reclassified source to reconfirm the reclassification.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id3a92cf7164b74dcebca5f93f85360c2d"><enum>5.</enum><header>Standards of performance for new stationary sources</header><subsection id="id8a55db04288d453f8b8416dca6d88828"><enum>(a)</enum><header>In general</header><text>Section 111 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411</external-xref>) is amended—</text><paragraph id="idfb0647d9c8f44e1aa09999bddfcb58dc"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id711be59dffe5494c95b58699214dfffa"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="idfc1f33e041d2402ebd389a5236db8ddb"><enum>(i)</enum><text>in subparagraph (B), in the first sentence, by inserting <quote>and subject to subparagraph (C)</quote> after <quote>subparagraph (A)</quote>; and</text></clause><clause id="id30f0e9893b3c4486a0f517cf89566a83"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8561ac4337394219953ced53bec84986"><subparagraph id="id5ffb220d01b9429e98508832ea632639"><enum>(C)</enum><header>Limitation</header><text>The Administrator may not establish a new Federal standard of performance for a new source until such time as the technology proposed to serve as the best system of emission reduction under the proposed new standard of performance—</text><clause id="id3d47ae786346456c91413bc8f3a5ff9d"><enum>(i)</enum><text>represents not less than 5 percent of the deployed systems already in use at the time the new standard of performance is proposed; and</text></clause><clause id="id86028a91fb1f4b56bee221838d8b615c"><enum>(ii)</enum><text>has been demonstrated to fully achieve the emission standards of the proposed standard of performance.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idce30a916ddca4395b468572642553814"><enum>(B)</enum><text>in paragraph (6), by striking <quote>subsection (a)(1)(A)(i) and (ii)</quote> and inserting <quote>subsection (a)(1)</quote>;</text></subparagraph></paragraph><paragraph id="id54fa9ad1430d453280bc3f7c226676aa"><enum>(2)</enum><text>in subsection (d), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id237ff3b106714f089a605d71d4cc8ceb"><paragraph id="id392503d8bffa461687c05997b48f0eb3"><enum>(3)</enum><header>Limitation of authority</header><text>In prescribing regulations under paragraph (1) and otherwise carrying out this subsection, the Administrator may not direct a State—</text><subparagraph id="id371d7a81037d4e3ab4084f4dbe82af21"><enum>(A)</enum><text>to establish standards of performance for any air pollutants at a location that is not the location of an existing source; or</text></subparagraph><subparagraph id="id071123b4d0094398b7810a02fe80aff3"><enum>(B)</enum><text>to meet any specific substantive emissions criteria established by the Administrator other than for a criteria air pollutant.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id10e1bc45a1da459292070d22b09fa6d9"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5852a03eceeb43b18180cd53bea2fb8e"><subsection id="idb9b75b81ce014c2190f5f39ccf483671"><enum>(k)</enum><header>Treatment of modifications</header><paragraph id="id05259d1a9f9241078407937e504eb5e2"><enum>(1)</enum><header>In general</header><text>For purposes of this section but subject to paragraphs (2) and (3), a modification shall be considered to be a new source only if—</text><subparagraph id="id736435b0732f462da33dec670d47d5ba"><enum>(A)</enum><text>the modification expands the capacity or production capability of the source; and</text></subparagraph><subparagraph id="id09330e4a17c34a5f824c582b8afc9803"><enum>(B)</enum><text>the maximum hourly emission rate of an air pollutant that is achievable by such source after the change is higher than the maximum hourly emission rate of such air pollutant that was achievable by such source during any hour in the 10-year period immediately preceding the change.</text></subparagraph></paragraph><paragraph id="ida7f42dea059f4328be23363f005e1f90"><enum>(2)</enum><header>Exceptions</header><text>If a modification expands the capacity or production capability of a source, the modification shall not be considered to be a new source for purposes of this section if the modification is designed—</text><subparagraph id="id91ae7f2ede0c4346ab88f9ca79a69583"><enum>(A)</enum><text>to reduce any air pollutant emitted by the source per unit of production;</text></subparagraph><subparagraph id="id0742304a052940de97d2731a91b1f523"><enum>(B)</enum><text>to reduce any greenhouse gas emitted by the source per unit of production; or</text></subparagraph><subparagraph id="id2d94793b41594312b0ddb326489288bb"><enum>(C)</enum><text>to enhance or restore the safety or reliability of operations at the source.</text></subparagraph></paragraph><paragraph id="idec2e3dd68c694094b9009bacdc6007f2"><enum>(3)</enum><header>Application of exceptions</header><text>A modification that meets an exception described in paragraph (2) shall not be considered to be a modification for purposes of—</text><subparagraph id="id3229fc96105b4328aa64b1f62146af63"><enum>(A)</enum><text>the term <term>construction</term> (as defined in section 169(2)) or any provision that uses that term; or</text></subparagraph><subparagraph id="id4782bf1ad52b4eb9b061070254161cdd"><enum>(B)</enum><text>the term <term>modification</term> (as defined in section 171) or any provision that uses that term.</text></subparagraph></paragraph></subsection><subsection id="id5eb1be0f3c954ee09ebdf73749d57de2"><enum>(l)</enum><header>Treatment of offsets</header><text>A proposed new source shall be exempt from the requirements of a proposed new source in an area designated as in nonattainment if the proposed new source emits not more than 0.5 percent of the periodic emissions inventory of the criteria pollutant for the area within which the proposed new source will be located.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idb3758512541843b0a23040fdc337c4d5"><enum>(b)</enum><header>Rule of construction</header><text>The amendments made by subsection (a) shall not treat any change as a modification for purposes of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) if such change would not have been so treated as of the day before the date of enactment of this Act.</text></subsection></section><section id="idb10828a96e064f638a2a341dd425e437"><enum>6.</enum><header>Treatment of pending permits</header><subsection id="idd565df87b51644b98b4c53bff6cb7d9f"><enum>(a)</enum><header>Preconstruction requirements</header><text>Section 165(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7475">42 U.S.C. 7475(b)</external-xref>) is amended—</text><paragraph id="ide0574d0dcf9a4f8bb188604be8b7a387"><enum>(1)</enum><text>by striking <quote>(b) The demonstration</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf795db78beee4d3fa9ff92119cc05b60"><subsection id="id5aa853e8bd994d93867afbc52a9186ef"><enum>(b)</enum><header>Exceptions</header><paragraph id="idb50a396d36da4faf8e705eaffb55b9bd"><enum>(1)</enum><header>Maximum allowable increases</header><text>The demonstration</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id77cf10418efe4acb81a4e0049bb57144"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0ecc1ba0ce834fefb3087bd3d5f2dae6"><paragraph id="id95bf0daf3c8c45e6bcda22912b6846bd"><enum>(2)</enum><header>Pending draft permits</header><text>The requirements of this section shall not apply to a new, expanded, or modified major emitting facility if, on the date on which a new national ambient air quality standard or maximum allowable increase is promulgated, the developer of a proposed major emitting facility has received a draft permit from the applicable permitting authority that demonstrates compliance with the applicable standard or maximum allowable increase in effect before the promulgation of the new national ambient air quality or maximum allowable increase.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id073e628e54c741e3881dd3c1719fe07d"><enum>(b)</enum><header>Permit requirements</header><text>Section 173 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7503">42 U.S.C. 7503</external-xref>) is amended—</text><paragraph id="id9ecf2794879944e491fc63efd8231694"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1), by striking <quote>The permit program required by section 172(b)(6)</quote> and inserting <quote>Except as provided in subsection (f), the permit program required by section 172(c)(5)</quote>; and</text></paragraph><paragraph id="iddac40b9fbefe4336b9d26174656f1523"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="id81f24c9283b24c6994af454fa1d8f26d" display-inline="no-display-inline" style="OLC"><subsection id="idfc63d82dddec40f18e94afcd33321d50"><enum>(f)</enum><header>Pending draft permits</header><paragraph id="id729ec7c000ab4184bee70e1e3a9ef693"><enum>(1)</enum><header>In general</header><text>The requirements of this section shall not apply to a new or modified major source if, on the date on which a nonattainment area is first designated as in nonattainment with respect to a pollutant or on the date on which an area is reclassified, by operation of law or by another method, to a higher classification of nonattainment—</text><subparagraph id="id059fbf54a6c74054abace4ded2f9c735"><enum>(A)</enum><text>the major source has received a draft permit from the applicable permitting authority that demonstrates compliance with the standards in effect on the day before that date; and</text></subparagraph><subparagraph id="idaef0d9361d174b1786cb317c33a1ce97"><enum>(B)</enum><text>the final permit is ultimately issued to the new or modified major source under the standards for which the draft permit was considered.</text></subparagraph></paragraph><paragraph id="id7ff22be3c58243f48b5c45e33b7932fb" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Applicability</header><text>Any subsequent modification to a major source described in paragraph (1) that requires a new permit and is made after the applicable date described in that paragraph shall be subject to the standards applicable at the time of the request for the new permit.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
