<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 381</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230209">February 9, 2023</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> (for himself, <cosponsor name-id="S411">Mr. Marshall</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, <cosponsor name-id="S416">Mrs. Britt</cosponsor>, and <cosponsor name-id="S318">Mr. Wicker</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to include a criminal penalty and a ground of removability for financing the unlawful entry of an alien into the United States.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Coyote Cash Act</short-title></quote>.</text></section><section id="id8C9973B8EFD449EAAAEDA9550F54FDB8"><enum>2.</enum><header>Criminal penalty and removability for financing unlawful entry</header><subsection id="id4786914D4E444855A8759FD9BF398A77"><enum>(a)</enum><header>In general</header><text>Chapter 8 of title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1321">8 U.S.C. 1321 et seq.</external-xref>) is amended by inserting after section 274D the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAD878D9ED1CD4EF1AB6A535764D6B7A1"><section id="idC8AD98853EC7414A8F69BABEFE950CB8"><enum>274E.</enum><header>Financing unlawful entry</header><text display-inline="no-display-inline">Any person who transmits money, property, or any item of value through interstate commerce with the intent to finance a violation of section 273, 274, 275, 276, or 277 shall be fined the value of the transmitted money, property, or item of value, imprisoned not more than 1 year, or both.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id81F89D9F6AF64CB39EB399D075B28D16"><enum>(b)</enum><header>Inadmissibility</header><text>Section 212(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7C52A983796F47A19BF4B428E36E1C35"><subparagraph id="idA8199B6CDD094CDC8A120758AA088170"><enum>(J)</enum><header>Financing unlawful entry</header><text>Any alien who has been convicted of, admits having committed, or admits committing acts that constitute the elements of an offense under section 274E is inadmissible.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0DE636FD77FF4C5CA6F96A54D955DE9E"><enum>(c)</enum><header>Deportability</header><text>Section 237(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA4D22F243F2642219F09F5D1DCDF6034"><subparagraph id="id4885F418A62E4ADFA2D56B72233EB994"><enum>(G)</enum><header>Financing unlawful entry</header><text>Any alien who has been convicted of, admits having committed, or admits committing acts that constitute the elements of an offense under section 274E is deportable.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8CB0CF628CCF4516B61FE67063DF46A1"><enum>(d)</enum><header>Conforming amendment</header><text>The table of contents for the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended by inserting after the item relating to section 274D the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5D8C8457376540EF9B930B11986A34E9"><toc><toc-entry level="section" bold="off">Sec. 274E.
