which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to punish the distribution of fentanyl resulting in death as felony murder.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="ida9727903606b451f943bffa5f9301cce"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Felony Murder for Deadly Fentanyl Distribution Act of 2023</short-title></quote>.</text></section><section section-type="subsequent-section" id="id54F00F30936242EDB3B62F393BAF48FC"><enum>2.</enum><header>Fentanyl distribution resulting in death punished as felony murder</header><text display-inline="no-display-inline">Section 1111 of title 18, United States Code, is amended—</text><paragraph id="id61472F6B58DC4E99A0444D3A40F931FB"><enum>(1)</enum><text>in subsection (a), in the second sentence, by inserting <quote>, distributing fentanyl</quote> after <quote>child abuse</quote>;</text></paragraph><paragraph id="idFEE52387FBFB4AF589FF27A08AB4294E"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id268A629368B2475C999400FD0FABE82E"><enum>(A)</enum><text>by striking <quote>(b) Within</quote> and inserting <quote>(b) (1) Within</quote>; and</text></subparagraph><subparagraph id="id8E7F8DBC5A75430786187DD82EAD13BD"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3BB25B80366947B9BD4A57CEC2C6FACD"><paragraph id="id7EDA4A41614A420A9ACBCE3353659949" indent="up1"><enum>(2)</enum><text>Whoever is guilty of murder in the first degree by distributing fentanyl shall be punished by death or by imprisonment for life.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id438BFCFA21E546D2A44C3BDDE04FA155"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="idDABD5D7ACCC249B89C28FCDDA96E93FB"><enum>(A)</enum><text>by redesignating paragraphs (4) through (6) as paragraphs (6) through (8), respectively; and</text></subparagraph><subparagraph id="idEE919708D1E74F1C80F358CA9FE2DD04"><enum>(B)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id488164270A7C414290104BDA98BEDA92"><paragraph id="id00FE278D585C4010BCCC467B32183F13"><enum>(4)</enum><text>the terms <term>controlled substance</term> and <term>distribute</term> have the meanings given the terms in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>);</text></paragraph><paragraph id="idB9F7A72C1D064F26823B2F353E6AAB0E"><enum>(5)</enum><text><term>distributing fentanyl</term> means to distribute a controlled substance—</text><subparagraph id="id61E8B636664B4F5080BAB527791BE735"><enum>(A)</enum><text>involving 2 grams or more of a mixture or substance containing a detectable amount of N-phenyl-N-[1-(2-phenylethyl)-4-piperidinyl] propanamide or .5 grams or more of a mixture or substance containing a detectable amount of any analogue of N-phenyl-N-[1-(2-phenylethyl)-4-piperidinyl] propanamide;</text></subparagraph><subparagraph id="id5EECA0354555418B80090D500719B7E2"><enum>(B)</enum><text>that results in death from the use of a mixture or substance described in subparagraph (A); and</text></subparagraph><subparagraph id="idC593C8503AF142A69DD5CBFC4A2D72BF"><enum>(C)</enum><text>knowing or having reason to know that the controlled substance contains a detectable amount of a mixture or substance described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
