<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3801</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240226">February 26, 2024</action-date><action-desc><sponsor name-id="S355">Mr. Cruz</sponsor> (for himself, <cosponsor name-id="S407">Mr. Hagerty</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S417">Mr. Budd</cosponsor>, and <cosponsor name-id="S398">Mr. Cramer</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Reserve Act to prohibit the Federal Reserve banks from offering certain products or services directly to an individual, to prohibit the use of central bank digital currency for monetary policy, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2AA3523BE95246CD8E41E93AAA384AAB"><section section-type="section-one" id="HA2298DCA581D41429767259BE3967147"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CBDC Anti-Surveillance State Act</short-title></quote>.</text></section><section id="H49307FCC43924ADABF1ADC787E83014E"><enum>2.</enum><header>Prohibition on Federal reserve banks relating to certain products or services for individuals and prohibition on directly issuing a central bank digital currency</header><text display-inline="no-display-inline">Section 16 of the Federal Reserve Act (<external-xref legal-doc="usc" parsable-cite="usc/12/411">12 U.S.C. 411 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6A10FB3115EF4ECCAFA0677966A3C2B7"><subsection id="idb2c285964ed0436e854afaf15a7b35bf"><enum/><text>No Federal Reserve bank shall offer products or services directly to an individual, maintain an account on behalf of an individual, or issue a central bank digital currency, or any digital asset that is substantially similar, under any other name or label, directly to an individual.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HA708BE2B22A34A73B4BDD10EC67D311B"><enum>3.</enum><header>Prohibition on Federal reserve banks indirectly issuing a central bank digital currency</header><text display-inline="no-display-inline">Section 16 of the Federal Reserve Act (<external-xref legal-doc="usc" parsable-cite="usc/12/411">12 U.S.C. 411 et seq.</external-xref>), as amended by section 2 of this Act, is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1E89A087E0A64038B260EABF922F298D"><subsection id="idfc2b373c160346e3a1891ca9e394e737"><enum/><text>A Federal Reserve bank shall not offer a central bank digital currency, or any digital asset that is substantially similar under any other name or label, indirectly to an individual through a financial institution or other intermediary. The preceding sentence is not to be construed to prohibit any dollar-denominated currency that is open, permissionless, private, and fully preserves the privacy protections of United States coins and physical currency.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H21B3B3D7F512438F8E8BC767880A39A2"><enum>4.</enum><header>Prohibition on the use of central bank digital currency for monetary policy</header><text display-inline="no-display-inline">Section 16 of the Federal Reserve Act (<external-xref legal-doc="usc" parsable-cite="usc/12/241">12 U.S.C. 241 et seq.</external-xref>) is amended by inserting before the twelfth undesignated paragraph the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0A7C6BC046614AA9A219038DE07C5B1B"><subsection id="id11e8df42c08f4ef2a59f2b247ec5a5cd"><enum/><text>The Board of Governors of the Federal Reserve System and the Federal Open Market Committee shall not use any central bank digital currency, or any digital asset that is substantially similar under any other name or label, to implement monetary policy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HBB95B418B22D44B5AD434F36E0518FD9"><enum>5.</enum><header>Central bank digital currency</header><subsection id="H6277F5BA396A426FBCF45944074B1379"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal Reserve Act (<external-xref legal-doc="usc" parsable-cite="usc/12/221">12 U.S.C. 221 et seq.</external-xref>) is amended by inserting after section 16 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCA6DFFC00BF3458FADFCDD7CB353DBE6"><section id="H47E66F825C9248589B3B8FF20306F579"><enum>16A.</enum><header>Central bank digital currency</header><subsection id="H7997553057B24676BFA958EA63134198"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Board of Governors of the Federal Reserve System may not, absent Congressional authorization, issue a central bank digital currency.</text></subsection><subsection id="HE8F5E51A5DB5453F94210322CB903DAF"><enum>(b)</enum><header>Central bank digital currency defined</header><text display-inline="yes-display-inline">In this section, the term <term>central bank digital currency</term> means a form of digital money or monetary value, denominated in the national unit of account, that is a direct liability of the Federal Reserve System.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H120FFE2C932C4AC4B4CCECFEAF0A9EFD"><enum>(b)</enum><header>Treasury</header><paragraph commented="no" display-inline="no-display-inline" id="ide9e01b4b6ed646dc90f0a3b6cb2c55da"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/3">Chapter 3</external-xref> of title 31 of the United States Code is amended by inserting after section 316 the following:</text><quoted-block style="OLC" id="H260318561BF144FCAC517AEC4304B412" display-inline="no-display-inline"><section id="H09FF818616E24FFF8A358968FDECB36E"><enum>317.</enum><header>Central bank digital currency</header><subsection id="HF8CE9E6F330A466FAA3E19725B8C854C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury may not, absent Congressional authorization, direct the Board of Governors of the Federal Reserve System to issue a central bank digital currency.</text></subsection><subsection id="H6A314A6A59224B4893DEA3550F934A69"><enum>(b)</enum><header>Central Bank Digital Currency defined</header><text display-inline="yes-display-inline">In this section, the term <term>central bank digital currency</term> means a form of digital money or monetary value, denominated in the national unit of account, that is a direct liability of the central bank.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="ide4b51dbf40114267813249cee50164c7"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/3">chapter 3</external-xref> of title 31, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/31/316">section 316</external-xref> the following:</text><quoted-block style="USC" id="idf098c42d-d0b3-43c4-859c-c27f4411b5f2"><toc><toc-entry level="section">317. Central bank digital currency.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HCAE62FD4BA2C4BD8BD834351D910DB9F"><enum>6.</enum><header>Protection for open, permissionless, and private currency</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall not apply to any dollar-denominated currency that is open, permissionless, and private, and fully preserves the privacy protections of United States coins and physical currency.</text></section></legis-body></bill>
