which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the standardization, publication, and accessibility of data relating to public outdoor recreational use of Federal waterways, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modernizing Access to Our Public Oceans Act</short-title></quote>.</text></section><section id="id99c30f4f67c642438c5d1d9534af98c7"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idee62e0ec8c4a45a5ba2681f6474ffdd6"><enum>(1)</enum><header>Federal fishing restriction area</header><text>The term <term>Federal fishing restriction area</term> means a defined area in which all or certain fishing activities are temporarily or permanently banned or restricted by the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="id2f67681432d94c10b854eb7f4d47d016"><enum>(2)</enum><header>Federal waterway</header><text>The term <term>Federal waterway</term> means any portion of a body of water managed in part or in entirety by the Secretary.</text></paragraph><paragraph id="id660dd549f731489e99e056fb83aa65d6"><enum>(3)</enum><header>Federal waterway restriction</header><text>The term <term>Federal waterway restriction</term> means a restriction on access to or use of a Federal waterway applied under applicable law by the Secretary.</text></paragraph><paragraph id="idb550ec525e7848898a350ce16ce5763f"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph></section><section id="idc615354057a443ddb79bc28bb9ecd7d5"><enum>3.</enum><header>Data standardization</header><text display-inline="no-display-inline">Not later than 30 months after the date of the enactment of this Act, the Secretary, in consultation with relevant stakeholders, shall develop and adopt standards with respect to the collection and dissemination of geospatial data relating to public outdoor recreational use of Federal waterways and Federal fishing restriction areas, including such data made available under section 4.</text></section><section id="id78b0bafe2315495397601d50f1e3eb93"><enum>4.</enum><header>Data publication and accessibility</header><subsection id="id9d50926af010435aa87fb11169a67072"><enum>(a)</enum><header>Federal waterway fishing access data</header><text>Not later than 4 years after the date of the enactment of this Act, the Secretary, to the maximum extent practicable, shall make available on a publicly accessible website geographic information system data that—</text><paragraph commented="no" display-inline="no-display-inline" id="idbb7ec55b81614240b89bf06bd9115715"><enum>(1)</enum><text display-inline="yes-display-inline">includes, with respect to Federal waterway restrictions—</text><subparagraph id="id22e83555495f4c9a8c17ba5bce11ef43"><enum>(A)</enum><text>information with respect to the conditions under which Federal waterways are open or closed to entry, watercraft, low-elevation aircraft, or diving;</text></subparagraph><subparagraph id="id1e1a983c62a447f89ef8c205b9d2f7e0"><enum>(B)</enum><text>the areas of Federal waterways with restrictions on motorized propulsion, horsepower, or gasoline fuel;</text></subparagraph><subparagraph id="id98d02d4ed10c40bb90db33a223dcc2bd"><enum>(C)</enum><text>the areas of Federal waterways with anchoring restrictions, no-wake zones, or vessel speed restrictions; and</text></subparagraph><subparagraph id="id2a6a295ac1864c878cd87d0eaa0427e1"><enum>(D)</enum><text>the types of watercraft that are restricted on each area of a Federal waterway, including the permissibility of—</text><clause id="idcaaacc80890d453c8903ca7aa98a96fb"><enum>(i)</enum><text>motorboats;</text></clause><clause id="id3b35420462484390bbc3242a251002b7"><enum>(ii)</enum><text>non-motorized watercraft;</text></clause><clause id="id8f978eb552a24025ae4fd7732c476f4f"><enum>(iii)</enum><text>personal watercraft;</text></clause><clause id="idc318cbb1be4146ee9a7e517dd56259fe"><enum>(iv)</enum><text>airboats;</text></clause><clause id="id39242ef460ad44709df207aa05a647f6"><enum>(v)</enum><text>amphibious aircraft; and</text></clause><clause id="id130fd60360bd4fe18d53e7f497559309"><enum>(vi)</enum><text>oceangoing ships; and</text></clause></subparagraph></paragraph><paragraph id="idc1edbfc5ca2849378f477011be69f7e3"><enum>(2)</enum><text>describes—</text><subparagraph id="idb4360e7df09f4723a433a60b156bae82"><enum>(A)</enum><text>the location and geographic boundaries of Federal fishing restriction areas, including—</text><clause id="id51a47d13fa594f6d9d00eb4d62a0c058"><enum>(i)</enum><text>any zones where, and periods when, fishing is limited under paragraphs (2), (3), and (4) of section 303(b)(2) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1853">16 U.S.C. 1853(b)(2)</external-xref>);</text></clause><clause id="idf9aa7f7fb8484e4ea17c67b078514500"><enum>(ii)</enum><text>full and partial closures, in terms of both area and duration, as well as seasonal closures;</text></clause><clause id="idc6cc795e005f42cc993816b8c61d27fd"><enum>(iii)</enum><text>no-catch zones; and</text></clause><clause id="idd066b522a0cd4a18b637d40f853c5c52"><enum>(iv)</enum><text>Federal fishing restrictions within or surrounding marine protected areas, including National Marine Sanctuaries; and</text></clause></subparagraph><subparagraph id="id9cbec29007bd44bea94318de9e421198"><enum>(B)</enum><text>to the maximum extent practicable, restrictions imposed by the National Oceanic and Atmospheric Administration on method of catch, such as requirements relating to the use of circle hooks, descending devices, and trolling.</text></subparagraph></paragraph></subsection><subsection id="id7528cff9906d47a9a9121eb15888dc31"><enum>(b)</enum><header>Federal waterway access and navigation information</header><paragraph commented="no" display-inline="no-display-inline" id="idabc2ec8a60f545f2859b3eab8b12cad9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, to the maximum extent practicable, continue to make available digitized geographic information system data that includes, with respect to access to Federal waterways—</text><subparagraph id="id678116fe6e49453c84f189bb1272f601"><enum>(A)</enum><text>navigation information;</text></subparagraph><subparagraph id="id9d3f48aa4e8b46be9e8b74e538687cc7"><enum>(B)</enum><text>bathymetric information; and</text></subparagraph><subparagraph id="id1ca1c74ae25942b6b0af7ba3977d31fe"><enum>(C)</enum><text>depth charts.</text></subparagraph></paragraph><paragraph id="ide520cddada8c4124a0ca1fd5127a3a4b"><enum>(2)</enum><header>Website</header><text>The Secretary shall make the data described in paragraph (1) available on the website on which the Secretary makes the data described in subsection (a) available.</text></paragraph></subsection><subsection id="idb76c73af55324b49b51b1f8f4c6fb5ef"><enum>(c)</enum><header>Data accessibility</header><text>The Secretary shall ensure that the website on which the Secretary makes the data described in subsections (a) and (b) available—</text><paragraph commented="no" display-inline="no-display-inline" id="idbaedadb8195e4267827cc68dd0f86752"><enum>(1)</enum><text display-inline="yes-display-inline">organizes that data so that the data is findable, accessible, interoperable, and reusable; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a5fa1c3301d47f5986d79c7b2da97d3"><enum>(2)</enum><text display-inline="yes-display-inline">includes a mechanism by which users can be easily updated when new data becomes available. </text></paragraph></subsection><subsection id="id5ab8cfbc246a4164984bb4b7d2f7fbcf"><enum>(d)</enum><header>Public comment</header><text>The Secretary shall develop a process to allow members of the public to submit questions or comments regarding the data described in subsections (a) and (b) and the accessibility of that data under subsection (c).</text></subsection><subsection id="idc285008ef4fd42d9b8abd8e2f29c0cd7"><enum>(e)</enum><header>Updates</header><text>The Secretary, to the maximum extent practicable, shall update—</text><paragraph id="idf97e42eebc824515b60968164b6a47ae"><enum>(1)</enum><text>the data described in subsections (a)(1) and (b) not less frequently than 2 times each year; and</text></paragraph><paragraph id="id6794e56d18be42d79cf7a97b8f44fee8"><enum>(2)</enum><text>the data described in subsection (a)(2) in real time as changes to Federal fishing restriction areas take effect.</text></paragraph></subsection><subsection id="id4234e572609440049a6a1c4b40cf6cdb"><enum>(f)</enum><header>Nondisclosure of certain information</header><text>The Secretary may not disclose, in any geographic information system data made publicly available under this section, information regarding the nature, location, character, or ownership of historic, paleontological, cultural, or archaeological resources, consistent with applicable law.</text></subsection></section><section id="id525bb6ed8b82453898f7cabf497c2085"><enum>5.</enum><header>Cooperation and coordination</header><subsection id="id5258867532f14abfa52471192d64e1e4"><enum>(a)</enum><header>Community partners and third-Party providers</header><text>For purposes of carrying out this Act, the Secretary may—</text><paragraph id="id6c7bffdc49874a4daea3f55e33339866"><enum>(1)</enum><text>coordinate and partner with non-Federal entities, including—</text><subparagraph id="id001834651eb649878a5181c61ecfe1aa"><enum>(A)</enum><text>State agencies;</text></subparagraph><subparagraph id="id84aac6aedcbb4be7b865092468347fd7"><enum>(B)</enum><text>interstate marine fisheries commissions;</text></subparagraph><subparagraph id="id39a3c5b12b764809864b8f54fa08a169"><enum>(C)</enum><text>Regional Ocean Partnerships;</text></subparagraph><subparagraph id="idfca1bad737fe46e781cf17a76559914b"><enum>(D)</enum><text>experts in data science, analytics, and operations research; </text></subparagraph><subparagraph id="id9ced26f9000f42bbaa4d656ef295ecec"><enum>(E)</enum><text>the private sector, including technology or geospatial data industries; and</text></subparagraph><subparagraph id="id0b53f49fb79047ad83d2d5f82f6aa9bd"><enum>(F)</enum><text>nonprofit organizations; and</text></subparagraph></paragraph><paragraph id="id85a64c149fa8418d9962963836a7a6a4"><enum>(2)</enum><text>enter into agreements with experts described in subparagraph (D) of paragraph (1), or experts within entities described in subparagraph (A), (B), (C), (E), or (F) of that paragraph, to carry out any of the provisions of this Act. </text></paragraph></subsection><subsection id="id4b7c0181ee18435abdc6b6af4b1dc983"><enum>(b)</enum><header>Interagency coordination</header><text>The Secretary shall, to the maximum extent practicable, work with the relevant offices of the Department of the Interior, the Department of Agriculture, the Coast Guard, the Army Corps of Engineers, and the Interagency Working Group on Ocean and Coastal Mapping codified by section 12203 of the Ocean and Coastal Mapping Integration Act (<external-xref legal-doc="usc" parsable-cite="usc/33/3502">33 U.S.C. 3502</external-xref>) to ensure compatibility and interoperability among applicable Federal databases with respect to the collection and dissemination of geospatial data relating to public outdoor recreational use of Federal waterways and Federal fishing restriction areas.</text></subsection><subsection id="id1b5d2e7483c84c558510cc13e950cbc3" commented="no"><enum>(c)</enum><header>Applicability of Federal, State, and Tribal regulations</header><text>The Secretary, in developing and distributing geospatial data under this Act, shall make clear that the data are subject to—</text><paragraph commented="no" display-inline="no-display-inline" id="id6b3e258f6ea4484ea1a2c19c7c2b505e"><enum>(1)</enum><text display-inline="yes-display-inline">applicable Federal regulations; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7fa2bfd4547d4600bba535aa127b2bb9"><enum>(2)</enum><text display-inline="yes-display-inline">applicable State and Tribal regulations.</text></paragraph></subsection></section><section id="id019f0bff3be54de19c1f37f21817234a"><enum>6.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed—</text><paragraph id="idc2961327a3b5439f8349de754b26184b"><enum>(1)</enum><text>to modify or alter the definition of the term <term>navigable waters</term> under any provision of Federal law;</text></paragraph><paragraph id="id230b54cdcc26486088ec5fc6eab1f9b2"><enum>(2)</enum><text>to affect the jurisdiction or authority of Federal or State agencies to regulate navigable waters; or</text></paragraph><paragraph id="id824bd7560cdb415798c2c8eb482f4fd0"><enum>(3)</enum><text>to increase or diminish the responsibility or authority of Federal or State agencies to manage fisheries. </text></paragraph></section></legis-body></bill>
