<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3776</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240208" legis-day="20240207">February 8 (legislative day, February 7), 2024</action-date><action-desc><sponsor name-id="S341">Mr. Blumenthal</sponsor> (for himself, <cosponsor name-id="S345">Mr. Johnson</cosponsor>, <cosponsor name-id="S364">Mr. Murphy</cosponsor>, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S354">Ms. Baldwin</cosponsor>, and <cosponsor name-id="S416">Mrs. Britt</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a safe-to-report policy within the Coast Guard, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H06679EE089E24C459F517775FCA3DB15"><section section-type="section-one" id="idb87947d2186442d6aa727c45864fba2a"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coast Guard Academy Safe-to-Report Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HB838D9F90AD44D789A01C3266F474FF5"><enum>2.</enum><header>Coast Guard safe-to-report policy</header><subsection id="H60A7124A03FB45B4BDEAAE2D0DB70D7B"><enum>(a)</enum><header>In general</header><text>The Commandant of the Coast Guard shall prescribe regulations to establish a safe-to-report policy that—</text><paragraph commented="no" display-inline="no-display-inline" id="idaa580386e15f443bb8451607529c0ff8"><enum>(1)</enum><text display-inline="yes-display-inline">applies to—</text><subparagraph id="HE956D4B3E8BE48C687DF97AFB0AFCC2E"><enum>(A)</enum><text>all members of the Coast Guard (including members of the reserve component of the Coast Guard); and</text></subparagraph><subparagraph id="H66791CB7DF524865AE3348F5403C883E"><enum>(B)</enum><text>cadets at the United States Coast Guard Academy; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd965f79d6c43406b8ff5526100d2891d"><enum>(2)</enum><text>is consistent with the safe-to-report policy prescribed by the Secretary of Defense under section 539A of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/1561">10 U.S.C. 1561</external-xref> note).</text></paragraph></subsection><subsection id="H40C9F9B24983435B9077729F7B08991E"><enum>(b)</enum><header>Safe-to-Report policy</header><text>The safe-to-report policy established in accordance with the regulations prescribed under subsection (a) shall set forth a procedure for the handling of minor collateral misconduct involving any individual described in paragraph (1) or (2) of that subsection who is the alleged victim of sexual assault or sexual harassment.</text></subsection><subsection id="H0BE9A7C7B9C44EA6BCAC0542FCE1A9B9"><enum>(c)</enum><header>Aggravating circumstances</header><text>The regulations under subsection (a) shall specify aggravating circumstances that increase the gravity of minor collateral misconduct or the impact of such misconduct on good order and discipline.</text></subsection><subsection id="H7C8762389F934613B9A2675460025E45"><enum>(d)</enum><header>Tracking of collateral misconduct incidents</header><text>In conjunction with the issuance of regulations under subsection (a), the Commandant shall develop and implement a process to track incidents of minor collateral misconduct that are subject to the safe-to-report policy.</text></subsection><subsection id="H42C2E1FA559F44D99C9AF49FE32056DC"><enum>(e)</enum><header>Definition of minor collateral misconduct</header><text>In this section, the term <term>minor collateral misconduct</term> means any minor misconduct that is potentially punishable under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice), that—</text><paragraph id="H4AA35D3213C84C9FA4C198CF2C6676E5"><enum>(1)</enum><text>is committed close in time to or during a sexual assault or instance of sexual harassment, and directly related to the incident that formed the basis of the allegation of sexual assault or sexual harassment;</text></paragraph><paragraph id="HB4F60F9E10474DC786F3913FCB22B576"><enum>(2)</enum><text>is discovered as a direct result of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id78b984dfeb454fcc8dc7c2df6560962c"><enum>(A)</enum><text display-inline="yes-display-inline">the report of sexual assault or sexual harassment; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2af3dc9b979e476e92bd5f74a167d24d"><enum>(B)</enum><text display-inline="yes-display-inline">an investigation into a sexual assault or an instance of sexual harassment; and</text></subparagraph></paragraph><paragraph id="H1CB1C987859E4E16AD38968093065D81"><enum>(3)</enum><text>does not involve aggravating circumstances (as specified in the regulations prescribed under subsection (c)) that increase the gravity of the minor misconduct or the impact of such misconduct on good order and discipline.</text></paragraph></subsection></section></legis-body></bill>
