<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3762</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240207">February 7, 2024</action-date><action-desc><sponsor name-id="S364">Mr. Murphy</sponsor> (for himself, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, and <cosponsor name-id="S247">Mr. Wyden</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit certain discrimination against athletes on the basis of sex by State athletic associations, intercollegiate athletic associations, and covered institutions of higher education, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Play for Women Act</short-title></quote>.</text></section><section id="id626dcad63d704e37abdac14b1f65632b"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id5F6847DDB00E4C4294711951B6425A20"><enum>(1)</enum><text display-inline="yes-display-inline">50 years ago, Congress passed title IX of the Education Amendments of 1972 (referred to in this section as <quote>title IX</quote>), helping to transform participation in and support for women’s sports by barring discrimination on the basis of sex in all schools that receive Federal funding, including in their athletic programs.</text></paragraph><paragraph id="idFD1D6824D7AB4008AD70E8D64C6AD21D"><enum>(2)</enum><text display-inline="yes-display-inline">Since the passage of title IX, millions more women and girls have had the opportunity to compete in interscholastic, collegiate, or intercollegiate athletics. In high school athletics, athletic participation opportunities have increased from nearly 300,000 in 1972 to more than 3,400,000 in 2019. In intercollegiate athletics, opportunities have increased from nearly 30,000 in 1972 to 215,000 in 2020 on teams sponsored by institutions who are members of the National Collegiate Athletic Association (referred to in this section as the <quote>NCAA</quote>).</text></paragraph><paragraph id="id60D5554ACE134259972A0F92A77C3D36"><enum>(3)</enum><text display-inline="yes-display-inline">Despite progress, women and girls still face unequal opportunities. In high school athletics, girls have over 1,000,000 fewer athletic opportunities than boys, with schools providing girls with 43 percent of all athletic opportunities while girls represent nearly half of all students. In intercollegiate athletics, colleges would need to provide women with an additional 148,000 sports opportunities to match the same ratio of sports opportunities per student as is offered to men.</text></paragraph><paragraph id="id75C196F3B6BA4F8381EF60F130D701B5"><enum>(4)</enum><text display-inline="yes-display-inline">Girls of color are often most impacted by inequitable opportunities. At high schools predominantly attended by White students, girls have 82 percent of the opportunities that boys have to play sports, while at high schools predominantly attended by students of color, girls have only 67 percent of the opportunities that boys have to play sports.</text></paragraph><paragraph id="idffe1b5a7b28c412b8a1e1dfc84c0596e"><enum>(5)</enum><text>Transgender, nonbinary, and intersex students also experience sex-based discrimination in sports, with transgender women and girls being least likely to participate in sports. Transgender, nonbinary, and intersex students are consistently denied opportunities to play, often due to policies restricting them from playing sports. The addition of policies that exclude transgender students from athletic opportunities correlates with an overall decrease in sports participation. According to the Centers for Disease Control and Prevention’s Youth Risk Behavior Survey, States with policies that exclude transgender students from participation in athletics saw a decrease in overall girls’ participation in sports from 2011 to 2019, whereas States with inclusive policies did not see a decrease in that participation during that same timeframe. </text></paragraph><paragraph id="idb009473e08704df4ba074d59e80bfe18"><enum>(6)</enum><text>The magnitude of current gaps in intercollegiate athletics participation opportunities is likely undercounted, as investigations of intercollegiate athletics data have found that the majority of NCAA member institutions inflate the number of women participating in sports by double- and triple-counting women athletes who participate in more than one sport more often than the institutions double- and triple-count their counterparts who are men, counting men who are practice players on women’s teams as women athletes, and packing women’s teams with extra players who never end up competing.</text></paragraph><paragraph id="idCEEAC13150ED466A9C4DEF7C8973739B"><enum>(7)</enum><text display-inline="yes-display-inline">Women and girls in sports also face unequal treatment. They are frequently provided worse facilities, equipment, and uniforms than men and boys, and they receive less financial support and publicity from their schools, as women receive $240,000,000 less than men in athletic-based scholarships annually. For every dollar colleges spend on recruiting, travel, and equipment for men’s sports, they spend 58 cents, 62 cents, and 73 cents, respectively, for women’s sports.</text></paragraph><paragraph id="id0C396BE3636B42DD840D4F2C01B7F718"><enum>(8)</enum><text display-inline="yes-display-inline">Amid ongoing inequitable treatment, athletes and athletics-related staff too often are unaware of the rights and obligations that are described in or come from title IX. In surveys of children and their parents, the majority report not knowing what title IX is. A study conducted by the Government Accountability Office in 2017 found that the majority of high school athletic administrators were unaware of who their title IX coordinator was or felt unsupported by their title IX coordinator. In intercollegiate athletics, the majority of coaches report that they never received formal training about title IX as part of the preparation for their jobs.</text></paragraph></section><section id="id1310861d168249978b0d89761f07d7d0"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text><paragraph id="idFDE37EBA7B064BA9B21ACA5B5B03D4E6"><enum>(1)</enum><text display-inline="yes-display-inline">address inequitable and discriminatory treatment of women and girls in sports in elementary and secondary schools, as well as institutions of higher education; </text></paragraph><paragraph id="id46583C38252D40049C4F757CDA7B904A"><enum>(2)</enum><text display-inline="yes-display-inline">improve the collection and transparency of data pertaining to participation in and support for women’s and girls’ sports at schools receiving Federal financial assistance; </text></paragraph><paragraph id="id9fa113a20c57455eaa81045f49c1282a"><enum>(3)</enum><text>ensure all students participating in athletics, as well as those who work in school-sponsored athletics, are aware of and understand the nondiscrimination rights of students related to their athletic opportunities; and </text></paragraph><paragraph id="id55537ef228174f77b7c8b8cb9dfa126f"><enum>(4)</enum><text>ensure all students, regardless of gender, have equal access to high-quality and supportive athletic opportunities. </text></paragraph></section><section id="idFAFF789B7377480F93DD535F166EF1EC"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id701e27e81bbe4e5897f10c9162ca3c1f"><enum>(1)</enum><header>ESEA terms</header><text display-inline="yes-display-inline">The terms <quote>elementary school</quote> and <quote>secondary school</quote> have the meanings given those terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd6ae31bb1d8243a79ad7b8d445973eee"><enum>(2)</enum><header>Collegiate</header><text display-inline="yes-display-inline">The term <term>collegiate</term>, used with respect to athletics, means intramural and club-level athletics or other athletics, in which all participants attend the same covered institution of higher education.</text></paragraph><paragraph id="idDACC637E50274519AB1155219DD754AC"><enum>(3)</enum><header>Covered institution of higher education</header><text>The term <term>covered institution of higher education</term> means an entity that is described in section 908(2)(A) of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1687">20 U.S.C. 1687(2)(A)</external-xref>) and covered by section 908 of those Amendments (<external-xref legal-doc="usc" parsable-cite="usc/20/1687">20 U.S.C. 1687</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39a0f2b9aa6341b8b6ab1bbaa2bf3d3a"><enum>(4)</enum><header>Covered local educational agency</header><text>The term <term>covered local educational agency</term> means such an agency that is described in section 908(2)(B) of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1687">20 U.S.C. 1687(2)(B)</external-xref>) and covered by section 908 of those Amendments.</text></paragraph><paragraph id="idE27D1E58E4EE4FD8B55B9CBC3A3E04F8"><enum>(5)</enum><header>Intercollegiate athletic association</header><text>The term <term>intercollegiate athletic association</term> means any conference, association, or other group or organization, established by or comprised of 2 or more covered institutions of higher education, that—</text><subparagraph id="idBA4FB794A23A4F1B95A2374FE639CB9B"><enum>(A)</enum><text>governs competitions among, or otherwise exercises authority over intercollegiate athletics at, such institutions of higher education who are members of or under the authority of the intercollegiate athletic association; and</text></subparagraph><subparagraph id="idF21AE760C2A849D491E30A38424FD0E5"><enum>(B)</enum><text>is engaged in commerce or an industry or activity affecting commerce. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8b43bdfa4034bc2ab6291d0fd1dcbd0"><enum>(6)</enum><header>State athletic association</header><text display-inline="yes-display-inline">The term <term>State athletic association</term> means any association, organization, or other group, established by or comprised of 2 or more elementary schools or secondary schools that receive Federal funding, that governs competition among or otherwise exercises authority over elementary school, secondary school, or interscholastic athletics, at such federally funded elementary schools or secondary schools. </text></paragraph><paragraph id="id8428CAF621084BF7AC52BF3F50771BEC"><enum>(7)</enum><header>Title IX coordinator</header><text>The term <term>title IX coordinator</term> means the individual who coordinates the efforts of a covered school system to comply with and carry out the responsibilities of the covered local educational agency under title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>).</text></paragraph></section><section id="id370D38A6154C48D3BBFE9295D9904E49"><enum>5.</enum><header>Discrimination by State and intercollegiate athletic associations, local educational agencies, and covered institutions of higher education</header><subsection id="idd99d653049c14d88a233a640cf607dd4"><enum>(a)</enum><header>Elementary or Secondary School</header><text>No State athletic association<italic></italic> or covered local educational agency shall, on the basis of sex, subject any athlete to discrimination with respect to elementary school, secondary school, or interscholastic athletics, including discrimination through—</text><paragraph id="idcbe358a8ba3e4500bca167caea79eea9"><enum>(1)</enum><text>the rules it sets for elementary school, secondary school, or interscholastic athletics;</text></paragraph><paragraph id="ida3215fcb2bba4a26b5c1665a431d3bda"><enum>(2)</enum><text>the sports—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf4c960ebcfe44b818f7d4055335f7a0c"><enum>(A)</enum><text display-inline="yes-display-inline">required for membership in a State athletic association;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1e38e233457e474293098285a31950db"><enum>(B)</enum><text display-inline="yes-display-inline">competitions sponsored by the State athletic association or covered local educational agency, respectively; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6f4ff4a2b26c430286b13ba5c1661c4b"><enum>(C)</enum><text display-inline="yes-display-inline">championships sponsored by that association or agency; or</text></subparagraph></paragraph><paragraph id="id1424cdc52bc349b5b862fea5d1ddea36"><enum>(3)</enum><text>the location, facilities, or amenities provided for competitions or championships sponsored by that association or agency. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8d1b18efac8247fb9ad4b24744e177d9"><enum>(b)</enum><header>Higher education</header><paragraph commented="no" display-inline="no-display-inline" id="idf929ae46ed79464695c93c681ed03913"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No intercollegiate athletic association or covered institution of higher education shall, on the basis of sex, subject any athlete to discrimination with respect to intercollegiate or (subject to paragraph (2)) collegiate athletics, including discrimination through—</text><subparagraph id="id628EBB6A6B84472A8943B72817A8A928"><enum>(A)</enum><text>the rules it sets for intercollegiate athletics or collegiate athletics;</text></subparagraph><subparagraph id="id06F444567AA94393B0B713424CB6875F"><enum>(B)</enum><text>the sports—</text><clause commented="no" display-inline="no-display-inline" id="id94665CE1EAEF4EB595B07BF023E60B8A"><enum>(i)</enum><text display-inline="yes-display-inline">required for membership in an intercollegiate athletic association, or required for participation in collegiate athletics at a covered institution of higher education;</text></clause><clause commented="no" display-inline="no-display-inline" id="id07DB5AE4646B405A836A353A8406E3AD"><enum>(ii)</enum><text display-inline="yes-display-inline">competitions sponsored by the intercollegiate athletic association, or collegiate athletic competitions sponsored by the covered institution of higher education; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id74025CB02E724548B5F8CBC23A1400D1"><enum>(iii)</enum><text display-inline="yes-display-inline">championships sponsored by the intercollegiate athletic association, or collegiate athletic championships sponsored by the covered institution of higher education;</text></clause></subparagraph><subparagraph id="id9228386C8DFB40C8919921C0C14B706B"><enum>(C)</enum><text>the location, facilities, or amenities provided for competitions or championships sponsored by the intercollegiate athletic association, or for collegiate athletic competitions or championships sponsored by the institution;</text></subparagraph><subparagraph id="idEC6B1C6ECF194454B60A9B28A87431BD"><enum>(D)</enum><text>the provision or arrangement for the provision of goods or services (including benefits) for competitions or championships sponsored by the intercollegiate athletic association, or for collegiate athletic competitions or championships sponsored by such an institution; or</text></subparagraph><subparagraph id="id7FCC7A6929FE4F2EA2AB4EEB083F91E4" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>the distribution of revenues or other benefits to members of or such institutions under the authority of the intercollegiate athletic association, or to teams, clubs, or other entities participating in collegiate athletics at the institution.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id262ab88b5c0944abbc0aae2f089a3603"><enum>(2)</enum><header>Limitation</header><text>Only a covered institution of higher education may be considered to have committed a violation of paragraph (1) with respect to collegiate athletics.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4e7bf9e6bf9142758f9ccc8a3264863e"><enum>(c)</enum><header>Private right of action</header><paragraph commented="no" display-inline="no-display-inline" id="id906ac6cb6a1845259c3885f605782417"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An individual who seeks to participate, participates, or previously participated in athletics covered under subsection (a) or (b), offered under the authority of an intercollegiate athletic association or State athletic association, or by a covered institution of higher education or covered local educational agency, may bring an action in any Federal or State court of competent jurisdiction against the athletic association, institution, or agency involved, alleging a violation of this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5dc49e6db7f14f6aaccb8ecf8b77dff3"><enum>(2)</enum><header>Relief</header><text display-inline="yes-display-inline">The court may award all legal or equitable relief that may be appropriate for such a violation. The legal relief may include compensatory damages for all injuries, including financial injuries, unequal treatment, emotional distress, humiliation, and pain and suffering, as well as punitive damages, attorney’s fees, and expert fees.</text></paragraph></subsection><subsection id="ida14a909ac02444beac8334a69a5e0118"><enum>(d)</enum><header>Training</header><paragraph commented="no" display-inline="no-display-inline" id="id6e3d858600a9482ea5b5c2e11f3f73e0"><enum>(1)</enum><header>Associations</header><text display-inline="yes-display-inline">Each State athletic association or intercollegiate athletic association shall ensure that each employee of the State athletic association or intercollegiate athletic association receives, at least once per year, training on the provisions of this section, including the rights delineated under this section and the procedures for bringing actions under this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id371be491c7fd432e976d319e2dcf1037"><enum>(2)</enum><header>Covered institutions of higher education</header><text>Each covered institution of higher education shall ensure that each employee of the institution with an employment function relating to collegiate athletics receives, at least once per year, such training. </text></paragraph><paragraph id="id918b9e5536914e9a956214c33cab4760"><enum>(3)</enum><header>Covered local educational agency</header><text>Each covered local educational agency shall ensure that each employee of the local educational agency with an employment function relating to athletics receives, at least once per year, such training.</text></paragraph></subsection></section><section id="idC19A2B5917E64C81B1C1BD752A8B55FC"><enum>6.</enum><header>Expanding athletics disclosure requirements</header><subsection id="idB95B6A99C7314864866BEA3B200C7B96"><enum>(a)</enum><header>Institutions of higher education</header><text display-inline="yes-display-inline">Section 485(g) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(g)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id60ab9395d79345179fc4505929700d40"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id43df24426cea4bc7ab8a4b0f54e68b4b"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="id94cf967f11e5482ca5ba867022b95378"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>collegiate (including intramural and club-level) or</quote> before <quote>intercollegiate athletic program</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7654910a53104fd084d73553dc42fc34"><enum>(ii)</enum><text>by inserting <quote>collegiate and</quote> before <quote>intercollegiate athletics</quote>;</text></clause></subparagraph><subparagraph id="id1DB1A15DE6DE4847B36CBAA2738F989D" commented="no"><enum>(B)</enum><text>in subparagraph (B), by striking clause (i) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA059CA116D26459C959509E4EDE0BB5D"><clause id="id42D35CB272DE48BDA2C56B17970EAEF1"><enum>(i)</enum><text>The total number of participants, by team.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idCD0C9AC0D2DA4B98BAB7D03A45717580"><enum>(C)</enum><text>in subparagraph (C)—</text><clause id="idA5313AF6B00743A2926352D8481E1D84"><enum>(i)</enum><text>by striking <quote>The total amount</quote> and inserting the following: <quote>(i) The total amount</quote>; and</text></clause><clause id="id5C8D713E963C427E82AEA5D8AEC89D60"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id39A33ECE09F24D7C9EB9E36A592EBA76"><clause id="id5EA1727702474D0E8A332CE1DCD53F7F" indent="up1"><enum>(ii)</enum><text>For each men’s and women’s intercollegiate sport—</text><subclause id="id73DD9F2A1451438789FB70DF10273810"><enum>(I)</enum><text>the total amount of athletically related student aid;</text></subclause><subclause id="idD0761E7689554DE398BFAE138AC14501"><enum>(II)</enum><text>the total number of athletically related scholarships, and the average amount of such scholarships;</text></subclause><subclause id="id851751E4D12348F885F9FB09BF2C17D7"><enum>(III)</enum><text>the total number of athletically related scholarships that fund the full cost of tuition at the institution;</text></subclause><subclause id="id18c563b277cd4d01b1b9a0fbaf8994b9"><enum>(IV)</enum><text>the total number of athletically related scholarships that fund the full cost of attendance for the athlete;</text></subclause><subclause id="idb89a422a772742579bb7756829caa110"><enum>(V)</enum><text>the total number of athletically related scholarships awarded for a period equal to or less than one year; and</text></subclause><subclause id="idea7c2e7e51e64a20b34ee1548d0b2151"><enum>(VI)</enum><text>the total number of athletically related scholarships awarded for a period equal to or greater than 4 academic years.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id649A29A624B04FF7A6A5E83FF21D249D"><enum>(D)</enum><text>in subparagraph (E), by inserting <quote>and disaggregated by each men’s sport and each women’s sport</quote> before the period at the end;</text></subparagraph><subparagraph id="id38edf7220cdc447d8b3fd065e7d52a78"><enum>(E)</enum><text>in subparagraph (G), by inserting <quote>(which, for purposes of this subparagraph, includes compensation, bonuses, benefits, and buyouts paid to coaches and reportable by the institution or related entities, including booster clubs and foundations)</quote> before <quote>of the head coaches of men's teams</quote>;</text></subparagraph><subparagraph id="id09a897002405483e9402f8985dfc0dc7"><enum>(F)</enum><text>in subparagraph (H), by inserting <quote>(which, for purposes of this subparagraph, includes compensation, bonuses, benefits, and buyouts paid to coaches and reportable by the institution or related entities, including booster clubs and foundations)</quote> before <quote>of the assistant coaches of men's teams</quote>;</text></subparagraph><subparagraph id="id2D00389DE3E642E98486656CD6DC6950"><enum>(G)</enum><text>in subparagraph (I)—</text><clause id="id8BB7556742DF4C2ABE4516C7A144A8B5"><enum>(i)</enum><text>by striking clause (i) and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="idD48799897A6A4C569725A445DA00EFE2"><text>(i) The revenues from the institution’s intercollegiate athletics activities, in the aggregate and disaggregated by each men’s sport and each women’s sport, including—</text><subclause id="idA51296A6AFE142198F63662765243279" indent="up1"><enum>(I)</enum><text>total revenues; and</text></subclause><subclause id="idD879E882A8BC4C25B2E754635D13E9F3" indent="up1"><enum>(II)</enum><text>each category of revenues described in clause (ii).</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id050FFD1BCEAB43BD97EABA63F778C6C5"><enum>(ii)</enum><text>in clause (ii)—</text><subclause commented="no" display-inline="no-display-inline" id="iddeb9c7b570af43ecbb7bb79212abb31e"><enum>(I)</enum><text display-inline="yes-display-inline">by inserting <quote>collegiate and</quote> before <quote>intercollegiate</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id64b9fff075904d3b9f77527235002b38"><enum>(II)</enum><text display-inline="yes-display-inline">by striking <quote>, and advertising, but revenues</quote> and all that follows through the period at the end and inserting <quote>, advertising, and, to the extent practicable, student activities fees and alumni contributions.</quote>; </text></subclause></clause></subparagraph><subparagraph id="id4CE6ACBDAA824A9882E7F3CBF8D006CC"><enum>(H)</enum><text>by striking clause (i) of subparagraph (J) and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id59566AEAE4BF4378B38F011996C445C2"><text>(i) The expenses made by the institution for the institution’s intercollegiate athletics activities, in the aggregate and disaggregated by each men’s sport and each women’s sport, including—</text><subclause id="idEE7CAF8981C74B819AA78187B72B95E6" indent="up1"><enum>(I)</enum><text>total expenses; and</text></subclause><subclause id="idB917D0EB5D51448387D177DE9C317BF9" indent="up1"><enum>(II)</enum><text>each category of expenses as described in clause (ii).</text></subclause><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph><subparagraph id="id63D7A57A907B45CFA4F2A8CC4888E987"><enum>(I)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA961BE7773464B4089DA1ED6DD9E2C68"><subparagraph id="idBEF5439F23AE49CEB689DA9CA6525DF5"><enum>(K)</enum><text>The numbers of participants who participate in 1, 2, or 3 intercollegiate sports at the institution, in the aggregate and disaggregated by each men’s sport and each women’s sport.</text></subparagraph><subparagraph id="id86F56CB02B814DC7B85AC7EBA0AD9877"><enum>(L)</enum><text>The total number of men that practice on women’s intercollegiate teams, in the aggregate and disaggregated by each women’s sport.</text></subparagraph><subparagraph commented="no" id="idb321ad4c258f4b559b3aca29a9230e1f"><enum>(M)</enum><text>Information regarding race and ethnicity for athletes and coaches (including assistant coaches), in the aggregate and disaggregated by each men’s sport and each women’s sport.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29c37eea8ec34cf9adbcc2f72a0b49a9"><enum>(N)</enum><text>The number of male students, and the number of female students, participating in collegiate (including intramural and club) sports at the institution.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf11110a1dbc84d2ab43b5285c7e6774c"><enum>(O)</enum><text>A certification that the institution has verified the information submitted in the report under this paragraph. </text></subparagraph><subparagraph commented="no" id="id4A3DD7CBFC0644EF97AAF9B37F835626"><enum>(P)</enum><text>With respect to the sports participation opportunities requirements under title IX of the Education Amendments of 1972—</text><clause commented="no" id="idA2A1C7586ED64AC1B9D91699F53DD354"><enum>(i)</enum><text>a certification that the institution complies with such requirements by showing—</text><subclause id="id258a2900c72a40528ce41fc12f3960bb"><enum>(I)</enum><text>substantial proportionality; </text></subclause><subclause id="id96057F1194A64B60909E227221654330"><enum>(II)</enum><text>a history and continuing practice of expanding sports participation opportunities; or </text></subclause><subclause id="id6A92BB7791394213B032AA93F65554A0"><enum>(III)</enum><text>full and effective accommodation of athletics interests; and</text></subclause></clause><clause id="id15FF9741F50E4C51ACD8841DD5854AA5"><enum>(ii)</enum><text>an identification of the method of compliance described in subclauses (I) through (III) of clause (i) that the institution uses.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="id0CF8F54BC4D140EBB3B1084987AFEBF1"><enum>(2)</enum><text>in paragraph (2), by striking <quote>For the purposes of paragraph (1)(G)</quote> and inserting <quote>For the purposes of subparagraphs (G) and (H) of paragraph (1)</quote>;</text></paragraph><paragraph commented="no" id="idc4ee80837af24b41ab3da51fdfdfdcbc"><enum>(3)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF4EB98F257724F38A3CBA95EDD7DF6E2"><paragraph commented="no" id="id248E7856C160485EAF1389C24BEC3E74"><enum>(4)</enum><header>Submission; report; information availability</header><subparagraph commented="no" id="id481165867C764124A9F2F4B08F30A46E"><enum>(A)</enum><header>Institutional requirements</header><text>Each institution of higher education described in paragraph (1) shall—</text><clause commented="no" id="id766FF75E26814DE3A0B61FDCA03C1AA4"><enum>(i)</enum><text>by October 15 of each year, provide the information contained in the report required under such paragraph for such year to the Secretary; and</text></clause><clause commented="no" id="idBA9D066BCF8341199DB1CBD20364F4AD"><enum>(ii)</enum><text>by not later than February 15 of each year, publish such information on a public Internet website of the institution in a searchable format.</text></clause></subparagraph><subparagraph id="id30c2d67f3be3458dbdb06229c5c0b8a7"><enum>(B)</enum><header>Public availability</header><text>By not later than February 15 of each year, the Secretary shall make the reports and information described in subparagraph (A) for the immediately preceding academic year available to the public, which shall include posting the reports and information on a public Internet website of the Department in a searchable format.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="idEE4F9F930BBB40A7B4001712217AC055"><enum>(4)</enum><text>by redesignating paragraph (5) as paragraph (6);</text></paragraph><paragraph id="idC4BC311CABE947848C427A14A6A23BDC"><enum>(5)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id36D1D3AFFE9A49A48E1C77AE04CA268A"><paragraph id="idF581948958AC4FB4A031CF183D2F77A6"><enum>(5)</enum><header>Reports by the Secretary</header><subparagraph id="idED4D776135CD4B3E87D32428E16BC8D4"><enum>(A)</enum><header>In general</header><text>By not later than 2 years after the date of enactment of the <short-title>Fair Play for Women Act</short-title>, and every 2 years thereafter, the Secretary shall prepare and publish a report on gender equity using the information submitted under this subsection.</text></subparagraph><subparagraph id="idDBEBB84EFC994C79ABE11D0C6A9B439C"><enum>(B)</enum><header>Contents</header><text>The report required under subparagraph (A) shall, in the aggregate for all institutions of higher education described in paragraph (1) and disaggregated by each individual institution—</text><clause id="id16EF22CB30124E329749076CDD9D548F"><enum>(i)</enum><text>identify participant gaps, if any, by indicating the number of participants that need to be added in order for participants of the underrepresented sex at the institution to match the proportion of enrolled full-time undergraduate students of the underrepresented sex at the institution; </text></clause><clause id="id41AFDF6B724F40C8BE749BD9711C892C"><enum>(ii)</enum><text>identify funding gaps, if any, by showing the percentage differences, compared to proportions of enrollment of men and women at the institution, in expenditures for athletically related student aid, recruiting, promotion, and publicity in intercollegiate athletics; and </text></clause><clause commented="no" display-inline="no-display-inline" id="idD03C261A3C2146BF8B79EE9955BE9F13"><enum>(iii)</enum><text>identify any trends evident in such data that address relevant inequities in intercollegiate athletics participation and financial support.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idAA4E537B1FF34ABC8C62FFFCEF43D444"><enum>(6)</enum><text>in paragraph (6), as redesignated by paragraph (4)—</text><subparagraph id="id8E43C3E8B8C74E2DB9EB765F09A73EFD"><enum>(A)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">Definition</header-in-text>.—For the purposes of this subsection, the term</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id34D44B298DAC4CFBB215B4D51B3EA559"><text><header-in-text level="paragraph" style="OLC">Definitions</header-in-text>.—For purposes of this subsection:</text><subparagraph id="id5122051E6D284C408F5A17D791C121D2"><enum>(A)</enum><header>Operating expenses</header><text>The term</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idB49E06206EE04FBAAD0B756DCA9231C6"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB9634D2A5DB54FF5B79E6675397934D8"><subparagraph id="id73614376909642548B4257261AD9C9F2"><enum>(B)</enum><header>Participant</header><text>The term <term>participant</term> means an athlete in a sport who—</text><clause id="idf3dca0681316445e8aa2d72b1adcc6cc"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id2FAB277C2A384BB1BC49BE318773C5A6"><enum>(I)</enum><text>is receiving the institutionally sponsored support normally provided to athletes competing at the institution involved on a regular basis during the sport’s season;</text></subclause><subclause id="id47c6cdb979664e9da0027c4b7150d4af" indent="up1"><enum>(II)</enum><text>is participating in organized practice sessions and other team meetings and activities on a regular basis during the sport’s season; and</text></subclause><subclause id="ida1b992fe2bb744f8a6b6cd3ad8541967" indent="up1"><enum>(III)</enum><text>is listed on the eligibility or squad list maintained for the sport; or</text></subclause></clause><clause id="id875F1DE02B294BF7AB0ABB70A55D29FB"><enum>(ii)</enum><text>due to injury, does not meet the requirements of clause (i) but continues to receive financial aid on the basis of athletic ability in the sport.</text></clause></subparagraph><subparagraph commented="no" id="id57372CFE6B0B48C3B6D2EA1C653EE0AE"><enum>(C)</enum><header>Season</header><text>The term <term>season</term>, when used with respect to an intercollegiate team sport, means the period beginning on the date of a team’s first intercollegiate competitive event in an academic year and ending on the date of the team’s final intercollegiate competitive event in such academic year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H2B5EC68FF883456381277E540F3F675E"><enum>(b)</enum><header>Elementary school and secondary school athletic programs</header><paragraph id="idE462269D1632440AADC9DDC3D19BD0C0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart 2 of part F of title VIII of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7901">20 U.S.C. 7901 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id846860F0FA5348E9A3FFA17B21A850A8"><section id="id1A8B8E1A28DC470B8058238FBBABD850"><enum>8549D.</enum><header>Disclosure of statistics on equality in elementary and secondary education athletic programs</header><subsection commented="no" display-inline="no-display-inline" id="id68B3E8D56DFA4EB393BD2AE2B8CDA59C"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id73DE69401F5C482BA3CBF7E288065DEB"><enum>(1)</enum><header>Participant</header><text>The term <term>participant</term> means an athlete in a sport who participates in the sport in elementary school, secondary school, or interscholastic competitive events, organized practice sessions, and other team meetings and activities on a regular basis during the sport’s season.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79CE6AB20B1F4E77AEEC8AA195DAA7DC"><enum>(2)</enum><header>Season</header><text>The term <term>season</term>, when used with respect to a team sport, means the period beginning on the date of a team’s first athletic competition in an academic year and ending on the date of the team’s final interscholastic athletic competition in such academic year.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48de84ef8f0448a58139c25744600da0"><enum>(3)</enum><header>State athletic association</header><text>The term <term>State athletic association</term> has the meaning given the term in section 4 of the Fair Play for Women Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7531830B4D6A4C808D4481B13DFD6FA4"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall collect annually, from each coeducational elementary school and secondary school that receives Federal financial assistance and has an athletic program, a report that includes the following information for the immediately preceding academic year: </text><paragraph commented="no" display-inline="no-display-inline" id="ID4FB76230CFEA419DBAE0BFC65F8CF0E1"><enum>(1)</enum><text display-inline="yes-display-inline">The total number of students that attended the school, fully disaggregated and cross-tabulated by sex and race or ethnicity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC546332E71B44F54A300CF5796F5AA4B"><enum>(2)</enum><text display-inline="yes-display-inline">A listing of the school’s teams that competed in athletic competition and for each such team the following data:</text><subparagraph commented="no" display-inline="no-display-inline" id="IDA431CFE69F3D4A2CBED4936312497637"><enum>(A)</enum><text display-inline="yes-display-inline">The season in which the team competed. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA5D026CCDCD64374BE304F00322C7C54"><enum>(B)</enum><text display-inline="yes-display-inline">The total number of participants, fully disaggregated and cross-tabulated by sex and race or ethnicity and level of competition.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB745EA851CE34B5D8C459B2621F7564F"><enum>(C)</enum><text display-inline="yes-display-inline">The total expenditures for the team from all sources, including school funds and funds provided by any other entities, such as booster organizations, including the following data:</text><clause commented="no" display-inline="no-display-inline" id="IDB06FE505A9794535B24EC974A7A8D0ED"><enum>(i)</enum><text display-inline="yes-display-inline">The travel expenditures.</text></clause><clause commented="no" display-inline="no-display-inline" id="ID62F708ADA4AA4909001DBB4B74E44CA1"><enum>(ii)</enum><text display-inline="yes-display-inline">The equipment expenditures (including any equipment replacement schedule).</text></clause><clause commented="no" display-inline="no-display-inline" id="IDBC950E8A6283493E833CFF2B74E281D6"><enum>(iii)</enum><text display-inline="yes-display-inline">The uniform expenditures (including any uniform replacement schedule).</text></clause><clause commented="no" display-inline="no-display-inline" id="ID34F27D94D46040B6BBCD331969A63108"><enum>(iv)</enum><text display-inline="yes-display-inline">The expenditures for facilities, including medical facilities, locker rooms, fields, and gymnasiums.</text></clause><clause commented="no" display-inline="no-display-inline" id="IDC7D08808D0334F01A06BB8A206F98B67"><enum>(v)</enum><text display-inline="yes-display-inline">The total number of trainers and medical personnel, and for each trainer or medical personnel an identification of such individual’s—</text><subclause id="HC0BC6D58DB904E2F9EFB42DDBB4106F"><enum>(I)</enum><text>sex; and</text></subclause><subclause id="H8ABEF5168B45416A93938410C867C95B"><enum>(II)</enum><text>employment status (including whether such individual is assigned to the team full-time or part-time, and whether such individual is a head or assistant trainer or medical services provider) and duties other than providing training or medical services.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDD67A239F579648CEB636A173255600C0"><enum>(vi)</enum><text display-inline="yes-display-inline">The expenditures for publicity for competitions.</text></clause><clause commented="no" display-inline="no-display-inline" id="IDC449002E11A64D17BAF268FCAE063324"><enum>(vii)</enum><text display-inline="yes-display-inline">The total salary expenditures for coaches, including compensation, benefits, and bonuses, the total number of coaches, and for each coach an identification of such coach’s—</text><subclause id="H80BF603DB5D94F50AE331FC0CA3B98DC"><enum>(I)</enum><text>sex; and</text></subclause><subclause id="H096BEFEEB48C422AB951C62939135E48"><enum>(II)</enum><text>employment status (including whether such coach is assigned to the team full-time or part-time, and whether such coach is a head or assistant coach) and duties other than coaching.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD44521B9E7F7433BBFF118F3AEEFD3B3"><enum>(D)</enum><text display-inline="yes-display-inline">The total number of competitive events (in regular and nontraditional seasons) scheduled, and for each an indication of what day of the week and time the competitive event was scheduled.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID866053808FC1426C94F66000ECC1C0FF"><enum>(E)</enum><text display-inline="yes-display-inline">Whether such team participated in postseason competition, and the success of such team in any postseason competition.</text></subparagraph></paragraph></subsection><subsection id="H2EEC5036F4B9484CA4D853C53D3F8C54"><enum>(c)</enum><header>Disclosure to students and public</header><text>A school described in subsection (b) shall—</text><paragraph id="H1BE43832219F464797DCAC25AE6F5009"><enum>(1)</enum><text>by October 15 of each year, make available to students, potential students, and parents of students and potential students, upon request, and to the public, the report and information required of the school under such subsection for such year; and</text></paragraph><paragraph id="HBA96AC4F4CF742A9898B2349992B7FFE"><enum>(2)</enum><text>ensure that all students and parents at the school are informed of their right to request such report and information.</text></paragraph></subsection><subsection id="H35A5CA5A0CD141A2B301FCF1A4D2A151"><enum>(d)</enum><header>Submission; information availability</header><text>On an annual basis, each school described in subsection (b) shall provide the report required under such subsection, and the information contained in such report, to the Secretary not later than 15 days after the date that the school makes such report and information available under subsection (c).</text></subsection><subsection id="H71DB891E7AE74C5998CE001200A48CA"><enum>(e)</enum><header>Duties of the Secretary</header><text>The Secretary shall—</text><paragraph id="H51610DA4322646F2BCEEE9E50063BF8C"><enum>(1)</enum><text>ensure that reports and information submitted under subsection (d) are available on the same public website, and searchable in the same manner, as the reports and information made available under section 485(g)(4)(B) of the Higher Education Act of 1965; and</text></paragraph><paragraph id="H9519E86BC6D34C3BB676846CB138F61C"><enum>(2)</enum><text>not later than 180 days after the date of enactment of the <short-title>Fair Play for Women Act</short-title>—</text><subparagraph id="idaaddc57fbc9b4f56aac59ed07912e9e8"><enum>(A)</enum><text>notify all elementary schools, secondary schools, and State athletic associations in all States regarding the availability of the reports and information under subsection (c); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id169B753D7FF04CFB97C619F7E658EA47"><enum>(B)</enum><text>issue guidance to all such elementary schools, secondary schools, and State athletic associations on how to collect and report the information required under this section.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71C2A00061F144A7B2EB6584B25A4A9B"><enum>(2)</enum><header>Conforming amendment</header><text>The table of contents in section 2 of the Elementary and Secondary Education Act of 1965 is amended by inserting after the item relating to section 8549C the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id1D77CAC726FD4870A7E4BD9755250F10"><toc><toc-entry bold="off" level="section">Sec. 8549D. Disclosure of statistics on equality in elementary and secondary education athletic programs.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idB16133C568C0499AA050402C4C262003"><enum>7.</enum><header>Training and information for athletes and employees</header><subsection id="id5C80CF66C588470DB7F2B8DB957CADF2"><enum>(a)</enum><header>Training</header><paragraph id="idCBFB7E0CB3244F12AEDFAA4BE0443B00"><enum>(1)</enum><header>Covered local educational agency</header><subparagraph id="id6daa2209311f47f8b8a368acff01a2a3"><enum>(A)</enum><header>Employees</header><text>Each covered local educational agency shall ensure that each title IX coordinator, and each employee who works with athletics or teaches physical education or health, for the covered local educational agency receives, at least once per year, training on the rights under title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) of students at elementary schools or secondary schools, and procedures for submitting complaints of violations under title IX of the Education Amendments of 1972 to the Office for Civil Rights of the Department of Education.</text></subparagraph><subparagraph id="id15ed8f479abd4a44947867065dbae40a"><enum>(B)</enum><header>Elementary and secondary school athletes</header><text>Each covered local educational agency shall ensure that—</text><clause id="id376B64FF37844137A7B4669B03C5E044"><enum>(i)</enum><text>a title IX coordinator for the covered local educational agency provides training to athletes at elementary schools or secondary schools served by the covered local educational agency on the rights of the athletes under title IX of the Education Amendments of 1972, and procedures for submitting complaints of violations of that title to the Office for Civil Rights of the Department of Education; and</text></clause><clause id="idDBB6AAF8E84E405E971C2E3A43D6C2E0"><enum>(ii)</enum><text>each such athlete receives that training at least once per year.</text></clause></subparagraph></paragraph><paragraph id="id9352A3C81D244F9EB11F7B2478178DFB"><enum>(2)</enum><header>Covered institutions of higher education</header><subparagraph id="id3603C56CB90D477AA23E959BBDBD4D92"><enum>(A)</enum><header>Employees</header><text>Each covered institution of higher education shall ensure that each employee of the athletic department of the covered institution of higher education and each employee of the institution with an employment function relating to collegiate athletics receives, at least once per year, training on the rights under title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) of students at covered institutions of higher education, and procedures for submitting complaints of violations of title IX of the Education Amendments of 1972 to the Office for Civil Rights of the Department of Education. </text></subparagraph><subparagraph id="id330CA4BC888741E59AEEDC842E08C105"><enum>(B)</enum><header>Postsecondary school athletes</header><text>Each covered institution of higher education shall ensure that—</text><clause id="id36AE949A3C42432599C6E44A8DF16116"><enum>(i)</enum><text>an expert in matters relating to title IX of the Education Amendments of 1972, who is not an employee described in subparagraph (A) of the covered institution of higher education, provides training to athletes at the covered institution of higher education on the rights of the athletes under title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>), and procedures for submitting complaints of violations of that title to the Office for Civil Rights of the Department of Education; and</text></clause><clause id="id7DB4C83638A64722A4343ED4C2F02EF9"><enum>(ii)</enum><text>each such athlete receives that training at least once per year.</text></clause></subparagraph></paragraph></subsection><subsection id="id9C4D538D5F7C45C1BCEAAD2C0F2CE2CF"><enum>(b)</enum><header>Database</header><text>The Secretary of Education shall establish and maintain a database of title IX coordinators, which shall be separate from the civil rights coordinators data maintained by the Office for Civil Rights of the Department of Education. The database shall include, at a minimum, the name, phone number, and email address for each title IX coordinator. The Secretary shall make the information in the database available to the public with, and by the same means as, reports made available under section 485(g)(4)(B) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(g)(4)(B)</external-xref>). </text></subsection></section><section id="id340bb12ca9964f1e8ae6daf7aa694f43"><enum>8.</enum><header>Administrative enforcement through civil penalties</header><subsection id="id47b8cc8d810b4ace9524eb028460653a"><enum>(a)</enum><header>Noncompliance</header><text>The Secretary of Education shall determine, at the beginning of each year, each covered institution of higher education, covered local educational agency, elementary school, or secondary school that was found during the prior year to be in noncompliance with a requirement of section 7, or of title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>). Such administrative proceeding shall be conducted in the same manner as an administrative proceeding under section 902 of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1682">20 U.S.C. 1682</external-xref>).</text></subsection><subsection id="id9361bbb731a540c0b786cdccae1cea15"><enum>(b)</enum><header>Civil penalty</header><text>If the Secretary of Education determines under subsection (a) that a covered institution of higher education, covered local educational agency, elementary school, or secondary school was in such noncompliance during the prior year, the Secretary may impose a civil penalty on such institution, agency, or school.</text></subsection><subsection id="idba620ab7057b4dea8d157954f20a20e5"><enum>(c)</enum><header>Further noncompliance</header><text>If the Secretary of Education determines under subsection (a) that a covered institution of higher education, covered local educational agency, elementary school, or secondary school was in such noncompliance during 2 or more of the prior 5 years, the Secretary shall—</text><paragraph id="id0d2ffe82e38740c6b548511d5e4d37c5"><enum>(1)</enum><text>require such covered institution, covered local educational agency, elementary school, or secondary school to submit, not later than 120 days after receiving notice of the determination, a plan for coming into compliance with all requirements of section 7, and of title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>); and</text></paragraph><paragraph id="idc9126585064e4d07938046c58631452a"><enum>(2)</enum><text>make the report publicly available. </text></paragraph></subsection></section><section id="id49A51D225F0D47F599379270ED4BE550"><enum>9.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to imply that intercollegiate athletic associations, State athletic associations, covered institutions of higher education, or covered local educational agencies—</text><paragraph id="id18AD1AFC53984389904E435F06AF9439"><enum>(1)</enum><text>are not covered by title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>); or</text></paragraph><paragraph id="idA430CB5F4A154A31B12CB025B2DEC430"><enum>(2)</enum><text display-inline="yes-display-inline">were not covered by that title on the day before the date of enactment of this Act.</text></paragraph></section></legis-body></bill>
