which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To simplify the grant process for nonurbanized areas, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Simplifying Grants Act of 2023</short-title></quote>.</text></section><section id="id5C18FFE0ED4D426DBC09847E0511866C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id7DF6FA3D329344B7A87F4A5C3A08A993"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means an Executive department or independent establishment, as such terms are defined in sections 101 and 104 of title 5, United States Code, respectively.</text></paragraph><paragraph id="id0F2C929F22D24652BBF31FA472D4D4CC"><enum>(2)</enum><header>Covered local government</header><text>The term <term>covered local government</term> means a local government with jurisdiction over an area of which the population is less than the population required to be an urbanized area.</text></paragraph><paragraph id="id6E30284EF93F498F8719CC7736278395"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="idD96E78062D48421C90E09E0A05626264"><enum>(4)</enum><header>Local government</header><text>The term <term>local government</term> means a county, municipality, city, town, township, or other general purpose political subdivision of a State.</text></paragraph><paragraph id="idEB99526BC14B4375AC03DF3401E8AB09"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</text></paragraph><paragraph id="id3FB3E8DFF50A4F25AD98BCDDA8968E8F"><enum>(6)</enum><header>Urbanized area</header><text>The term <term>urbanized area</term> means an urbanized area, as determined by the Bureau of the Census for purposes of the most recent decennial census of population. </text></paragraph></section><section id="id804269ac0d5843c0a330b107de90e82f"><enum>3.</enum><header>Grant process simplification</header><subsection id="idBF1E1E22FF2849529F8CA7EB4BC3991A"><enum>(a)</enum><header>Existing grant programs</header><text display-inline="yes-display-inline">For each grant program of an agency in existence on the date of enactment of this Act under which covered local governments are eligible to receive grants, not later than 180 days after the date of enactment of this Act—</text><paragraph id="id848F41E926554F04B2DBF2C20ECEC415"><enum>(1)</enum><text display-inline="yes-display-inline">the Director shall— </text><subparagraph id="id85BBA77076584954AAA72DBF02687DF9"><enum>(A)</enum><text display-inline="yes-display-inline">conduct a review of the complexity of the requirements for a covered local government to receive funds under a grant under the program; and</text></subparagraph><subparagraph id="id582cfdee55ed4d47b31ddaf85c97e31f"><enum>(B)</enum><text>provide to the head of the agency instructions on how to simplify such requirements; and</text></subparagraph></paragraph><paragraph id="id19357DD54AE3424DA7516AD2DEB0CF78"><enum>(2)</enum><text display-inline="yes-display-inline">the head of the agency, in consultation with the Director, shall simplify such requirements.</text></paragraph></subsection><subsection id="idD991B4CA8C7F4C338337C8ECB7BC801F"><enum>(b)</enum><header>New grant programs</header><text display-inline="yes-display-inline">For each grant program of an agency established after the date of enactment of this Act under which covered local governments are eligible to receive grants, before the application for grants under the program becomes available— </text><paragraph id="id0ab695ba08054e04bb75cb515c6a1a6c"><enum>(1)</enum><text>the Director shall— </text><subparagraph id="idAA92719EB251471BBB8C164851DBB7DE"><enum>(A)</enum><text>conduct a review of the complexity of the proposed requirements for a covered local government to receive funds under a grant under the program; and </text></subparagraph><subparagraph id="id202A228F726540B8874A7282113618FB"><enum>(B)</enum><text>provide to the head of the agency instructions on how to simplify such requirements; and </text></subparagraph></paragraph><paragraph id="ida2c7667128ed4a1b97ae95a284c01259"><enum>(2)</enum><text>the head of each agency, in consultation with the Director, shall simplify such requirements. </text></paragraph></subsection><subsection id="idb1980484f2c845849082c005e518e62f"><enum>(c)</enum><header>Checklists</header><paragraph id="id1C6AFE58CDAF4D9F844C0EAEE4328FFF"><enum>(1)</enum><header>In general</header><text>In accordance with paragraph (2), the head of each agency shall make publicly available a checklist for covered local governments with respect to each grant program of the agency for which covered local governments are otherwise eligible that includes each requirement for each step of the grant process for a grant under the grant program.</text></paragraph><paragraph id="idD888AA3118D943EA960B0CA59D62ADB8"><enum>(2)</enum><header>Deadline</header><text>The head of an agency shall make publicly available a checklist under paragraph (1)—</text><subparagraph id="id9C03EED704904E3FB805AB11AF6556C2"><enum>(A)</enum><text>with respect to a grant program in existence on the date of enactment of this Act, not later than 180 days after the date of enactment of this Act; and</text></subparagraph><subparagraph id="idE7A4C5DC80D645BFAE2603D6CD003B2B"><enum>(B)</enum><text>with respect to a grant program established after the date of enactment of this Act, on the date on which the application for the grant program becomes available. </text></subparagraph></paragraph></subsection></section><section id="idc08d5e645d3f483294292f4f955fce4d"><enum>4.</enum><header>Reporting</header><subsection id="id425DADC764674BDFA0683359EF7982A6"><enum>(a)</enum><header>One-Time report</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Director shall submit to Congress a report evaluating, as of the date of submission of the report—</text><paragraph id="idbbbd7309d7bc4a7a9d4d631f56d7ed48"><enum>(1)</enum><text>the extent to which agencies have simplified the requirements for covered local governments under section 3(a); and</text></paragraph><paragraph id="idedc7de5882fd4112a6a5b1aa0692c19a"><enum>(2)</enum><text>the extent to which agencies made available checklists under section 3(c)(1) for each grant program in existence on the date of enactment of this Act.</text></paragraph></subsection><subsection id="id911c59bebe284025b2bd407919de3231"><enum>(b)</enum><header>Ongoing report</header><text>Not later than April 1 of the first year after the year during which this Act is enacted, and every April 1 thereafter, the Director shall submit to Congress a report evaluating—</text><paragraph id="id71af7d56bb414e5d8c3fd7eea941e848"><enum>(1)</enum><text>the amount of technical assistance provided to covered local governments during the previous fiscal year by agencies relating to the preaward, award, implementation, and closeout stages of grants awarded by the agencies; and </text></paragraph><paragraph id="id0c21c0005db14164b955bd7e072f11ff"><enum>(2)</enum><text>the amount of funds that were awarded by agencies during the previous fiscal year to—</text><subparagraph id="id4653FF5625C447039364849851F1ECDD"><enum>(A)</enum><text>covered local governments; and</text></subparagraph><subparagraph id="idCBF1DEF8B0814DC989FDFF428F7D3695"><enum>(B)</enum><text>local governments that are not covered local governments.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
