which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Omnibus Crime Control and Safe Streets Act of 1968 to reauthorize the residential substance use disorder treatment program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="S1"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Treatment and Recovery Over Narcotics for Growth, Empowerment, and Rehabilitation Act</short-title></quote> or the <quote><short-title>STRONGER Act</short-title></quote>. </text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id5ddd3b1264014b5b942aee884884bf32"><enum>2.</enum><header display-inline="yes-display-inline">Residential substance use disorder treatment program</header><subsection commented="no" display-inline="no-display-inline" id="idb20c409a68d54488b9d84fa985ebbee7"><enum>(a)</enum><header display-inline="yes-display-inline">Amendments</header><text display-inline="yes-display-inline">Part S of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10421">34 U.S.C. 10421 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idD731753F90D24300BFB52EA887027EC2"><enum>(1)</enum><text display-inline="yes-display-inline">in the part heading, by striking <quote><header-in-text level="part" style="OLC">substance abuse</header-in-text></quote> and inserting <quote><header-in-text level="part" style="OLC">substance use disorder</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id564ccafd3abc4d2692da869fdf52dd31"><enum>(2)</enum><text display-inline="yes-display-inline">in section 1901 (<external-xref legal-doc="usc" parsable-cite="usc/34/10421">34 U.S.C. 10421</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idA3DA59F282A743B2B7260917CF581BF1"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><clause commented="no" display-inline="no-display-inline" id="idD0D42CC5AD324CCCB90C614E03FFED8D"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subclause commented="no" display-inline="no-display-inline" id="id85BC07FB213F4C5CA5776469C96584F7"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>substance abuse</quote> each place it appears and inserting <quote>substance use disorder</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0AF6F208F8F14F33A87A79B18F5F178E"><enum>(II)</enum><text display-inline="yes-display-inline">by inserting after <quote>programs</quote> the following: <quote>, including medication-assisted treatment programs, which shall be permitted to use any type of medication that has been approved to treat substance use disorders pursuant to section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>), or any type of biological product licensed under section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>),</quote>; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3C3F9012E2A4471FB8E547419DB50C81"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>substance abuse</quote> each place it appears and inserting <quote>substance use disorder</quote>;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id882F5746692B478784CFF0D11F1412B3"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>substance abuse</quote> and inserting <quote>substance use disorder</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81E403C9B527442F8611FB59CF391CC9"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><clause commented="no" display-inline="no-display-inline" id="id27256FF5497E470587F5CE68F6175538"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>part for treatment</quote> and inserting “part for—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB2FCC65AC20045C9BC1084E9178E9FEB"><paragraph commented="no" display-inline="no-display-inline" id="idA04CCD5A1E6741C3B6A8AE695AF03FC6"><enum>(1)</enum><text display-inline="yes-display-inline">treatment</text></paragraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="idC6775393C4C04A53B390315566D73C56"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (1), as so designated, by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id11E5F60AB9F54C98AD6A76AD0A228010"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9AE45DFB6BA04119812497D27B67ED32"><paragraph commented="no" display-inline="no-display-inline" id="id75285639727749968D39A85395CB6178"><enum>(2)</enum><text display-inline="yes-display-inline">expanding residential substance use disorder treatment programs to use not less than 1 medication or treatment that has been approved to treat substance use disorders pursuant to section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>).</text></paragraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5EAD06B1FC48439EABD75CEC889709F3"><enum>(3)</enum><text display-inline="yes-display-inline">in section 1902 (<external-xref legal-doc="usc" parsable-cite="usc/34/10422">34 U.S.C. 10422</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idF19035CDB6024C45A91BEC11D9F6C3CA"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><clause commented="no" display-inline="no-display-inline" id="id76F6E17B0E02421BB92438984CA60CB3"><enum>(i)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">abuse</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">use</header-in-text></quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id968EAA623B714EF59B49F467AB081524"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>substance abuse</quote> each place it appears and inserting <quote>substance use disorder</quote>;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id72E45799CE33478EA83F3E35253762D6"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (c), by striking <quote>substance abuse</quote> each place it appears and inserting <quote>substance use disorder</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id635A68D7BBD54734B828BE14D9D9A4A9"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (d), by striking <quote>substance abuse treatment</quote> and inserting <quote>substance use disorder treatment</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5D4CBD0CA69947569BC5E693E00F0FA7"><enum>(D)</enum><text display-inline="yes-display-inline">in subsection (f), by striking <quote>substance abuse</quote> and inserting <quote>substance use disorder</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF64ED5F2223C4AEA8ADC2DFB6FBB3A87"><enum>(E)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0b9354ba1e5548f89b111b7c6f0a94d9"><subsection commented="no" display-inline="no-display-inline" id="id209A00AEB5584C5CBDD1576F83AC8009"><enum>(g)</enum><header display-inline="yes-display-inline">Training requirement</header><paragraph commented="no" display-inline="no-display-inline" id="id8F5C8F251DB54F44B908CFB28B53A08D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To be eligible to receive funds under this part, the chief medical officer of the prison or jail or appropriate staff overseeing the program shall complete training, before or within a reasonable amount of time after receiving the funds, on, at a minimum—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8FB7EE1443B54EFEBF10C34E348382A0"><enum>(A)</enum><text display-inline="yes-display-inline">the science of addiction;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id529CADF9BF68484B9F40104C75B41E1C"><enum>(B)</enum><text display-inline="yes-display-inline">the latest research and clinical guidance for detoxification and withdrawal management and the treatment of substance use disorders in criminal justice settings;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3F55C2E478B8458896F4826BEBE3731D"><enum>(C)</enum><text display-inline="yes-display-inline">strategies for continuity of care during and after incarceration; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFEE74DEC3CE54A11815883EC3E99F608"><enum>(D)</enum><text display-inline="yes-display-inline">an overview of—</text><clause commented="no" display-inline="no-display-inline" id="id17ECFE7E93B04B65B040D5CA9240F328"><enum>(i)</enum><text display-inline="yes-display-inline">all medications for the treatment of substance use disorders;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2AFFFECFF41B44C2BAE5E6EEE44AC448"><enum>(ii)</enum><text display-inline="yes-display-inline">how to obtain certification as an opioid treatment provider (OTP) or waivers under the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) for prescribing certain medications; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idAD58369DD6014CD58EA80BA0EE31EA67"><enum>(iii)</enum><text display-inline="yes-display-inline">evidence-based behavioral therapies used in addition to medication to improve medication adherence and treatment outcomes; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18DFD8851E644E23A4B8D70E6ADD32CB"><enum>(E)</enum><text display-inline="yes-display-inline">any other topic determined by the Attorney General, in coordination with the Secretary of Health and Human Services and in consultation with experts in addiction science, to be a core element for successful training under this paragraph. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30E991C3D1004C568F4422833CF1A778"><enum>(2)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">The training required under paragraph (1) shall include guidance on how to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idB4698635B7A84430AA21B44ECF84BF6E"><enum>(A)</enum><text display-inline="yes-display-inline">engage relevant stakeholders;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8089661FC74F43F9B9C9EDF057733B55"><enum>(B)</enum><text display-inline="yes-display-inline">identify available resources for, and gaps and barriers to, providing residential substance use disorder treatment; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id166DBE488CFD43EDBEAA47B8C5C1D055"><enum>(C)</enum><text display-inline="yes-display-inline">develop a plan to overcome obstacles to administering and offering medication-assisted treatment.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAA3B462A15474886A717847224A0E13C"><enum>(h)</enum><header display-inline="yes-display-inline">Provider affiliation</header><text display-inline="yes-display-inline">Any entity, including a prison or jail, that receives Federal funds for a program or activity that offers medication-assisted treatment shall have an affiliation with a provider that can—</text><paragraph commented="no" display-inline="no-display-inline" id="id8194E3D3719F4207A9090DCF1C697E60"><enum>(1)</enum><text display-inline="yes-display-inline">prescribe not less than 1 medication-assisted treatment to patients after release from the entity; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF949DDF44C246E8A99F972B62034BFF"><enum>(2)</enum><text display-inline="yes-display-inline">discuss the risks and benefits of, and alternatives to, medication-assisted treatment with patients.</text></paragraph></subsection><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf3809d23cc3c4f1aaf7df25c0146a2e3"><enum>(4)</enum><text display-inline="yes-display-inline">in section 1904 (<external-xref legal-doc="usc" parsable-cite="usc/34/10424">34 U.S.C. 10424</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idC5EB8429B4C94A3EBEBA12D17CEA2E19"><enum>(A)</enum><text display-inline="yes-display-inline">by amending subsection (c) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3D760E3A924D430B909852BD405ECD27"><subsection commented="no" display-inline="no-display-inline" id="id8FE03D0A2251417D8005D49942B3366F"><enum>(c)</enum><header display-inline="yes-display-inline">Local allocation</header><paragraph commented="no" display-inline="no-display-inline" id="ide8648b2606394efeb7d0e2139916285b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not less than 10 percent of the total amount made available to a State under subsection (a) for any fiscal year shall be used by the State to make grants to local correctional and detention facilities in the State (provided such facilities exist therein).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53c0c6c147554ee5bd72d4db1299ed98"><enum>(2)</enum><header display-inline="yes-display-inline">Jail-based substance use treatment programs</header><text display-inline="yes-display-inline">A jail-based substance use disorder treatment program described in paragraph (1) may be made available to any individual who is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id66c2b29cde5d4612830b1a75aa9ec99a"><enum>(A)</enum><text display-inline="yes-display-inline">awaiting trial or is otherwise in pre-trial detention; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id263666e969314d9680c70b25e13ab395"><enum>(B)</enum><text display-inline="yes-display-inline">serving a sentence of imprisonment in the jail.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE6BA952A823D4120B40B9F02F5B65034"><enum>(B)</enum><text display-inline="yes-display-inline">by amending subsection (d) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc71249f98b8948bdb10be82635a14591"><subsection commented="no" display-inline="no-display-inline" id="id27903635cfdc4ab1beea4260424ce95d"><enum>(d)</enum><header display-inline="yes-display-inline">Evidence-Based treatments</header><paragraph commented="no" display-inline="no-display-inline" id="id1D71FFFE35F842E586133487E1092C45"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State may use amounts received under this part to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7f871dc7cf5542f3afacc2771ccda43b"><enum>(A)</enum><text display-inline="yes-display-inline">provide any type of medication-assisted treatment that has been approved to treat substance use disorders pursuant to section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>), and any type of biological product licensed under section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>), and prescribe overdose reversal medications during the residential substance use disorder treatment program or after care;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0793f483fffc40f4ab358611f111602f"><enum>(B)</enum><text display-inline="yes-display-inline">cover costs associated with the training required under section 1902(g); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1c0cec6c008748a4a9a545c007e3d48f"><enum>(C)</enum><text display-inline="yes-display-inline">obtain certification as an opioid treatment provider (OTP) in accordance with part 8 of title 42, Code of Federal Regulations, or any successor thereto, or the prescription of medications to treat substance use disorders. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCDEBB701578447BD9D4BFD368A119627"><enum>(2)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>medication-assisted treatment</term> means a treatment plan that combines behavioral therapy with any type of medication that has been approved to treat substance use disorders pursuant to section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>), or any type of biological product licensed under section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>).</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2a3805d26bcc4273bfcc5158323f5f6d"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">Section 1001(a)(17) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10261">34 U.S.C. 10261(a)(17)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id69c3cee2960648d6bc03a99a730bc990"><paragraph commented="no" display-inline="no-display-inline" id="id8b6453143eb24e1abe4a5450e1a5ff96" indent="up1"><enum>(17)</enum><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out the projects under part S $40,000,000 for each of fiscal years 2025 through 2029.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id80CDE34A2BB24940850B989E1C2FA190"><enum>(c)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">Section 901(25) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251(25)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD520F756CA114ECFB5A8CF4A716CF3BD"><paragraph commented="no" display-inline="no-display-inline" id="id1C83B526F3554AC1A40F2EC7E24059B4"><enum>(25)</enum><text display-inline="yes-display-inline">the term <term>residential substance use disorder treatment program</term> means a course of comprehensive individual and group substance use disorder treatment services in residential treatment facilities that, to the greatest extent practicable, follow the guidance entitled, <quote>Promising Practice Guidelines for Residential Substance Abuse Treatment</quote>, published in November 2017 by the Bureau of Justice Assistance, or as thereafter amended to conform to current standards of care;</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
