which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To strengthen Federal data collection regarding the teacher and principal workforce.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Educator Workforce Data Act</short-title></quote>.</text></section><section id="id1dbedeb55cdd4efc9f351493c9d1d494"><enum>2.</enum><header>Civil rights data collection on the educator workforce</header><subsection commented="no" id="idff53b5812f2445618dc7c182b06e2c53"><enum>(a)</enum><header>Mandatory educator workforce data collection</header><text>In carrying out the civil rights data collection required under section 203(c)(1) of the Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3413">20 U.S.C. 3413(c)(1)</external-xref>), the Assistant Secretary for Civil Rights of the Department shall, as part of the data collection, collect and publish the data described in subsection (b) on the educator workforce with respect to teachers and principals. </text></subsection><subsection commented="no" id="id99699c54439e4f82bca69dbf6a362408"><enum>(b)</enum><header>Metrics</header><paragraph commented="no" display-inline="no-display-inline" id="idb31acb53ca3f45f0a2dcef46fa282ee5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A civil rights data collection described in subsection (a) shall include the following metrics from each local educational agency and public elementary school or secondary school that is required to respond to such data collection:</text><subparagraph commented="no" display-inline="no-display-inline" id="id6a197196988f45ddaa09042f65836f23"><enum>(A)</enum><header>Principal data</header><text>For each local educational agency, the following data regarding principals employed at public elementary schools and secondary schools served by the local educational agency: </text><clause commented="no" id="idd65bbabca562415487612d7605161b1e"><enum>(i)</enum><text>The number of full-time principals employed.</text></clause><clause commented="no" id="idBE3A7800173B496AA9270C0AB80479A3"><enum>(ii)</enum><text>Including the year of the data collection—</text><subclause commented="no" id="id7083B6A1AA8E46D6B288A324DC78076A"><enum>(I)</enum><text>the median number of years of principal experience of full-time principals employed; and</text></subclause><subclause commented="no" id="idEFD29B90791D4323A3299B352AF48A69"><enum>(II)</enum><text>the years of experience of the full-time principals employed, based on the following categories: </text><item commented="no" display-inline="no-display-inline" id="idA97489C40AAE4835A88A735E9756A872"><enum>(aa)</enum><text>Less than 1 year of principal experience.</text></item><item commented="no" display-inline="no-display-inline" id="id2718edcaf0ed49588cc329933461a3d0"><enum>(bb)</enum><text>At least 1 year but less than 3 years of principal experience. </text></item><item commented="no" display-inline="no-display-inline" id="idA2F9A46FFDA5438A80F935317EB3A373"><enum>(cc)</enum><text>At least 3 years but less than 7 years of principal experience.</text></item><item id="id38F4F625896E44CE8F648D7DE7AF927B"><enum>(dd)</enum><text>At least 7 years but less than 15 years of principal experience.</text></item><item commented="no" display-inline="no-display-inline" id="id3F62CA769B8644939FAAB07A092DDE05"><enum>(ee)</enum><text>15 or more years of principal experience. </text></item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7c40918acad144bc95b7635bce712d24"><enum>(B)</enum><header>Teacher data</header><text display-inline="yes-display-inline">For each local educational agency and public elementary school or secondary school, the following data regarding teachers employed at all public elementary schools and secondary schools served by a local educational agency, and each such school, respectively: </text><clause commented="no" id="idfd59da46e3c9464e83a3437089ea499a"><enum>(i)</enum><text>The number of full-time teachers employed. </text></clause><clause commented="no" id="id347dfa1bce37475cb997d2065ecc03ec"><enum>(ii)</enum><text>Including the year of the data collection, but excluding student teaching and similar teaching preparation experiences—</text><subclause commented="no" id="id6e82efde32f54d5cb0bcc1e7bce91a01"><enum>(I)</enum><text>the median number of years of teaching experience of full-time teachers employed; and</text></subclause><subclause commented="no" id="idf9ceb88b976d4c0f8720f6c5a7d4df08"><enum>(II)</enum><text>the years of experience of the full-time teachers employed, based on the following categories: </text><item commented="no" display-inline="no-display-inline" id="id01e05058ffc24dc58bd7a58f89fd390c"><enum>(aa)</enum><text>Less than 1 year of teaching experience.</text></item><item commented="no" display-inline="no-display-inline" id="id8dd56ee4887f4b3faea66ae939c6ad76"><enum>(bb)</enum><text>At least 1 year but less than 2 years of teaching experience.</text></item><item commented="no" display-inline="no-display-inline" id="id965ca0b2519a4a3384da9aa2b81c3dee"><enum>(cc)</enum><text>At least 2 years but less than 5 years of teaching experience.</text></item><item commented="no" display-inline="no-display-inline" id="idcb6692b7e79e469c8a2b09c01f78dbee"><enum>(dd)</enum><text>At least 5 years but less than 10 years of teaching experience.</text></item><item id="id368630705c644a1c8360fd498e85274c"><enum>(ee)</enum><text>At least 10 years but less than 20 years of teaching experience.</text></item><item commented="no" display-inline="no-display-inline" id="idd747ba0542784dc6b99d9f5c7c360a25"><enum>(ff)</enum><text>20 or more years of teaching experience. </text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id45f8bbe0a6354420ad4720097f8084f1"><enum>(iii)</enum><text>The number of full-time teachers employed who meet all State licensing and certification requirements.</text></clause><clause commented="no" display-inline="no-display-inline" id="id4bb71c2fa33943168816d337854ff0c2"><enum>(iv)</enum><text display-inline="yes-display-inline">The number of full-time teachers employed who do not meet all State licensing and certification requirements. </text></clause><clause commented="no" id="idf5d8e9b8c31c4e2d8d5f0f0378b98172"><enum>(v)</enum><text>The numbers of full-time teachers employed who meet all State license, certificate, and endorsement requirements in each of the following:</text><subclause commented="no" id="id52619964fe1c48e8974da9dfcaecdc42"><enum>(I)</enum><text>Mathematics.</text></subclause><subclause commented="no" id="idd12c5e6989164e37bbb6bf34d3a23032"><enum>(II)</enum><text>Science.</text></subclause><subclause commented="no" id="ide266ac64e947490a9afde61feca77aec"><enum>(III)</enum><text>English as a second language.</text></subclause><subclause commented="no" id="id14cfc865eecc4a5b95d24822ea3a0f8c"><enum>(IV)</enum><text>Special education.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="idf92919f756b04ac8ab64a587837a9639"><enum>(2)</enum><header>Disaggregation and cross-tabulation</header><text>The Secretary shall collect the data described in paragraph (1) in a manner that allows the disaggregation and cross-tabulation of each data category (including each subcategory) described in such paragraph by race, ethnicity, and sex, subject to subsection (d).</text></paragraph></subsection><subsection commented="no" id="idb48c7c26c8e546e68be642d0a1a66485"><enum>(c)</enum><header>Reporting requirements</header><paragraph commented="no" display-inline="no-display-inline" id="id24d459bda16a4decbb838f1001a6b69e"><enum>(1)</enum><header>Special report</header><text display-inline="yes-display-inline">Upon the conclusion of each civil rights data collection that includes the data required under subsection (b), the Secretary, acting through the Assistant Secretary for Civil Rights of the Department, shall prepare a special report regarding the educator workforce.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id628ee08acebc40f3a5867dfa371deb18"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The report required under paragraph (1) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2f08bcd1f29341239c589203388ccbf6"><enum>(A)</enum><text display-inline="yes-display-inline">be accessible through the website of the Office for Civil Rights of the Department; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5d5b152b9b1046f486ca19fcb56ff187"><enum>(B)</enum><text display-inline="yes-display-inline">include information on—</text><clause commented="no" id="id5f9245b3b11540f893aef77e058ed01e"><enum>(i)</enum><text>for each State, the total number of principals in the educator workforce, as calculated in the most recent civil rights data collection that includes the data required under subsection (b), based on a summary of the data collected in accordance with this section; and</text></clause><clause commented="no" id="id30ac7c11a2f8431ba4a97d7dbce80280"><enum>(ii)</enum><text>for each State, the total number of teachers in the educator workforce, as calculated in such data collection, based on a summary of the data collected in accordance with this section; and </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2196f378e1404a0da9757185525a792b"><enum>(C)</enum><text display-inline="yes-display-inline"> for each category described in subparagraph (B), present in an easily accessible manner, such as through percentages or a graph or other visual representation, the—</text><clause commented="no" display-inline="no-display-inline" id="id96d517f29e8e48d099bf4ab28ecff713"><enum>(i)</enum><text display-inline="yes-display-inline">disaggregated results based on race, ethnicity, and sex; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id7c941dc6dd864b49b6d907de2744c637"><enum>(ii)</enum><text display-inline="yes-display-inline">the disaggregated results based on the years of experience categories under subparagraph (A)(ii)(II) or (B)(ii)(II) of subsection (b)(1), as applicable. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ef3b91a7b0544bcabb8784788b4d07c"><enum>(3)</enum><header>Access to data</header><text display-inline="yes-display-inline">The Secretary shall make the underlying data used for the report under paragraph (1) accessible to the public through the website of the Office for Civil Rights of the Department.</text></paragraph></subsection><subsection id="id6720e5dee33a415cae15973b25371638"><enum>(d)</enum><header>Data privacy</header><text>In carrying out data collection, disaggregation, cross-tabulation, and reporting in accordance with this section and under section 203(c)(1) of the Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3413">20 U.S.C. 3413(c)(1)</external-xref>), the Assistant Secretary for Civil Rights of the Department shall coordinate with the Chief Privacy Officer of the Department to ensure that teacher and principal privacy is protected and that individually identifiable information about teachers and principals remains confidential.</text></subsection><subsection id="id1bff433da5ad4614a8f299e0f2e7ccb7"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id7551ccff72c84d38b7e24384277e3066"><enum>(1)</enum><header>ESEA definitions</header><text display-inline="yes-display-inline">The terms <term>Department</term>, <term>elementary school</term>, <term>local educational agency</term>, <term>secondary school</term>, and <term>State</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf09d93cc78cc4be18109adc0da707a40"><enum>(2)</enum><header>Teacher</header><text>The term <term>teacher</term> means an individual employed as a teacher, including a preschool teacher, at a public elementary school or secondary school. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8cb2bcd473c04b27ae9e52aa03141880"><enum>(f)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section shall apply with respect to each civil rights data collection required under section 203(c)(1) of the Department of Education Organization Act that begins on or after the date of enactment of this Act. </text></subsection></section></legis-body></bill>
