<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3694</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240130">January 30, 2024</action-date><action-desc><sponsor name-id="S247">Mr. Wyden</sponsor> (for himself, <cosponsor name-id="S413">Mr. Padilla</cosponsor>, <cosponsor name-id="S366">Ms. Warren</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, and <cosponsor name-id="S386">Ms. Duckworth</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Marine Mammal Protection Act of 1972 and the Animal Welfare Act to prohibit the taking, importation, exportation, and breeding of certain cetaceans for public display, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HAF509789748E4896A870916530348CC0"><section section-type="section-one" id="HA48C3B2E9E9C4FC29215730AE9FA977B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Welfare in Marine Settings Act of 2024</short-title></quote> or as the <quote><short-title>SWIMS Act of 2024</short-title></quote>.</text></section><section id="HBAA95890D5984FD380492FDABFA3E5E2"><enum>2.</enum><header>Findings; Sense of Congress</header><subsection id="HA92A7B1B11824FEFAD623C1276BFD8C9"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text><paragraph id="HD046696BA95940E8BCE61F77570F1B3B"><enum>(1)</enum><text display-inline="yes-display-inline">Certain cetaceans, namely orcas, beluga whales, false killer whales, and pilot whales are large-brained mammals who engage in creative problem solving, intentional communication, show signs of empathy for others and complex emotions, and form lifelong bonds.</text></paragraph><paragraph id="HC75E588949EA471F915927B4EC79F3D3"><enum>(2)</enum><text display-inline="yes-display-inline">Science increasingly supports that the species listed in paragraph (1) suffer in captivity. They die prematurely, engage in stereotypic behavior that is indicative of suffering and distress, are held in barren tanks, and are sometimes isolated from members of their own species, among other harms.</text></paragraph><paragraph id="H0F4941DECC7B472D84BF458EE0021053"><enum>(3)</enum><text display-inline="yes-display-inline">Current Federal laws allow the species listed in paragraph (1) to be confined in concrete tanks that fail to meet their basic psychological, physical, and social needs.</text></paragraph></subsection><subsection id="H623E8F1F07984AEBA95474932B63D14C"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the species listed in paragraph (1) of subsection (a) should not be subject to restraint, coercion, or control by any person for purposes of public display.</text></subsection></section><section id="HCEAB4415595845988D7C8F96706043A3"><enum>3.</enum><header>Prohibition on exportation, taking, and importation of certain cetaceans</header><subsection id="HA72CD7CD0C534239A9699094C7EC733B"><enum>(a)</enum><header>Prohibition on Exportation</header><text>Section 102 of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1372">16 U.S.C. 1372</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H12A4532D7148479592A61F77F291DFD2"><subsection id="H119C615900AF4160B193F076C66427AF"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H391A05C77A5B48CC921C39689AF29B29"><enum>(1)</enum><text>Notwithstanding any other provision of law, it is unlawful to export any orca, beluga whale, false killer whale, or pilot whale except for the transport of such species—</text><subparagraph id="HB60799E9A7C24D44A73633F37E50A9F4" indent="up1"><enum>(A)</enum><text>to a marine mammal sanctuary with a determination by the Secretary that the transportation to such sanctuary is in the best interest of the individual marine mammal; or</text></subparagraph><subparagraph id="H9832A5C194D24904A7CBCBFCDA9F15EB" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">for release to the wild.</text></subparagraph></paragraph><paragraph id="H33F3B464830343439019B4BC85762ABF" indent="up1"><enum>(2)</enum><text>In this subsection, the term <term>sanctuary</term> means a place of refuge where marine mammals—</text><subparagraph id="H8CD9D009B15944C5B48142E81A51060A"><enum>(A)</enum><text>live in a captive setting as close as possible to their natural environment;</text></subparagraph><subparagraph id="H55347E9065924F43BCB7ACFAD30E6CEE"><enum>(B)</enum><text>are prioritized individually with respect to well-being and autonomy; and</text></subparagraph><subparagraph id="H4144D5B141964BFF9ADA2872460696DB"><enum>(C)</enum><text>are not used for profit or breeding for the purpose of public display.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H95B9AC9DB1F54EBDBB15B99CA42C7E73"><enum>(b)</enum><header>Prohibition on permits for taking or importation</header><text display-inline="yes-display-inline">Section 104(a) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1374">16 U.S.C. 1374(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H255C175D4E7B4D129EF663AFBCBA2300"><subsection id="HC02E8830BF6340E4832021D7169AEF02"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HC51A97CE44384BFE9F26296417B6E2EB"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (2), the Secretary may issue permits which authorize the taking or importation of any marine mammal.</text></paragraph><paragraph id="H2E0840F2E60F4C1ABF3EA71379AAFFCB" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary may not issue any permit that authorizes the taking or importation of any orca, beluga whale, false killer whale, or pilot whale for the purpose of public display.</text></paragraph><paragraph id="H35C9D79D7C2341E0ACCEC4570A575B41" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary may issue permits for the incidental taking of marine mammals in the course of commercial fishing operations only as specifically provided for in section 101(a)(5) or 306, or subsection (h) of this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H3F4DC52525804E94824A17F1E3661C81"><enum>4.</enum><header>Prohibition on breeding of certain cetaceans</header><text display-inline="no-display-inline">The Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/17/2131">17 U.S.C. 2131 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC6096BEE173543339A7027C62C1A30EC"><section id="H2251C3715D9341B4B47707FB0DEDAE2C"><enum>30.</enum><header>Breeding of certain cetaceans</header><text display-inline="no-display-inline">It shall be unlawful for any person to breed or artificially inseminate any orca, beluga whale, false killer whale, or pilot whale for purposes of using the progeny of such species for public display.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
