<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3690</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240130">January 30, 2024</action-date><action-desc><sponsor name-id="S318">Mr. Wicker</sponsor> (for himself and <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Communications Act of 1934 to prohibit the application of certain private land use restrictions to amateur station antennas, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC530F2180211445F8E213EFFAE92263F"><section section-type="section-one" id="HD65747015D964287A275304C4FF9BC1F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Amateur Radio Emergency Preparedness Act</short-title></quote>.</text></section><section id="H7E09BE5C7AAA4F3E86AE2EFB5BF51C45"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HF0AEE5D297A84B6DA7FBC31A688E0D43"><enum>(1)</enum><text>More than 770,000 amateur operators in the United States are licensed by the Federal Communications Commission (in this section referred to as the <quote>Commission</quote>) in the amateur radio services, and, by treaty, amateur operators licensed by other countries are authorized to operate within the United States.</text></paragraph><paragraph id="HD495596899F942E68027D46F9426C1E9"><enum>(2)</enum><text>Amateur radio, in addition to providing life-saving emergency communications at no cost to taxpayers, provides a fertile ground for technical self-training in modern telecommunications, electronics technology, and emergency communications techniques and protocols.</text></paragraph><paragraph id="H5B59E7DDA4284075B905CC1BA93F6F6A"><enum>(3)</enum><text>There is a strong Federal interest in the effective performance of amateur stations established at the residences of amateur operators. Among other reasons, when an emergency arises, it can be too late, and too dangerous, to erect an effective antenna. However, amateur stations have been shown to be frequently and increasingly precluded by unreasonable private land use restrictions, including restrictive covenants.</text></paragraph><paragraph id="HE9E702AE38A44E24B38CA1513280E4D4"><enum>(4)</enum><text>Commission regulations have for more than 3 decades prohibited State and local regulation of amateur station antenna structures that precludes or fails to reasonably accommodate amateur service communications, or that does not constitute the minimum practicable regulation to accomplish a legitimate State or local purpose. The policy of the Commission has been and is to require States and localities to permit erection of a station antenna structure at heights and dimensions sufficient to reasonably accommodate amateur service communications. The Commission struck an appropriate balance by enabling effective use of the amateur service without burdening localities and adjoining properties.</text></paragraph><paragraph id="HF2DAA4105C5C4F8D8F92819C14B84296"><enum>(5)</enum><text>The Commission has sought guidance and direction from Congress with respect to the application of the Commission’s limited preemption policy regarding amateur service communications to private land use restrictions, including restrictive covenants.</text></paragraph><paragraph commented="no" id="H2B24970394F84486BE7E0C2CD535C6ED"><enum>(6)</enum><text>In section 207 of the Telecommunications Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/47/303">47 U.S.C. 303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/104">Public Law 104–104</external-xref>), Congress provided guidance, direction, and authority to the Commission by directing the Commission to promulgate regulations that have preempted all private land use restrictions applicable to exterior communications facilities that impair the ability of citizens to receive television broadcast signals, direct broadcast satellite services, or multichannel multipoint distribution services, or to transmit and receive wireless internet services.</text></paragraph><paragraph id="H4C4552415B884F27840945DD10A75183"><enum>(7)</enum><text>To further the public interest benefits that amateur radio brings to society, private land use restrictions that prohibit, restrict, or impair amateur operators from operating, installing, or maintaining effective outdoor amateur station antenna structures should also be preempted.</text></paragraph></section><section id="HDB9D9D4B694E4C718D92887D348F900B"><enum>3.</enum><header>Application of private land use restrictions to amateur station antennas</header><subsection id="H2493CE93E76B46BEA0B4224ECD0962B7"><enum>(a)</enum><header>In general</header><text>Part I of title III of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC7F95182D65C4F0B8DF6104F3EA7E32F"><section id="HF332A98DBB89421EB0809EA60CBADB85"><enum>346.</enum><header>Application of private land use restrictions to amateur station antennas</header><subsection id="HF38524221284463A8665A0152D21C4C8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HCEB5D469C9234E038047949A31D460B5"><enum>(1)</enum><header>Amateur operator</header><text>The term <quote>amateur operator</quote>—</text><subparagraph id="H9975651B9E5E4C7CA138DE5D33AA72D7"><enum>(A)</enum><text>has the meaning given such term in section 97.3 of title 47, Code of Federal Regulations, or any successor regulation; and</text></subparagraph><subparagraph id="HD4D7CCE2978344A187850E8040E0A860"><enum>(B)</enum><text>includes any other person authorized to operate an amateur station in the United States.</text></subparagraph></paragraph><paragraph id="H39E42696AB6944EBAA3A939CE5B05874"><enum>(2)</enum><header>Amateur station</header><text>The term <quote>amateur station</quote> has the meaning given such term in section 97.3 of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph id="HB3C4B62A893440CF9FED9BCEE05FA84B"><enum>(3)</enum><header>Antenna</header><text>The term <quote>antenna</quote> includes—</text><subparagraph id="H864F4F5F277B47BBBA733AE06C10B515"><enum>(A)</enum><text>the transmitting and receiving elements;</text></subparagraph><subparagraph id="HA071BF347F0448CA91B531AE290755C3"><enum>(B)</enum><text>any feedline, control enclosures, or electrical enclosures necessary for effective transmission or reception; and</text></subparagraph><subparagraph id="H52C666A61250473AA90B45832BED094B"><enum>(C)</enum><text>any support structure, guy wire, anchor, or tie-off.</text></subparagraph></paragraph><paragraph id="H341A9FE5285B4774B437683AF47A452A"><enum>(4)</enum><header>Community association</header><text>The term <quote>community association</quote> means—</text><subparagraph id="H455A4815438244FBAA7719670DE6D3BE"><enum>(A)</enum><text display-inline="yes-display-inline">a condominium association (as defined in section 604 of the Condominium and Cooperative Abuse Relief Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3603">15 U.S.C. 3603</external-xref>));</text></subparagraph><subparagraph id="H912EC8C89E724F7F827BE2E17C998C70"><enum>(B)</enum><text>a cooperative association (as defined in such section); and</text></subparagraph><subparagraph id="HF5BA2436A5A04A8F9DF3D749AA86B6AF"><enum>(C)</enum><text>a residential real estate management association (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/528">section 528</external-xref> of the Internal Revenue Code of 1986).</text></subparagraph></paragraph><paragraph id="H9A499F66EB05497CB9A8B0B21E99F2B7"><enum>(5)</enum><header>Lessee</header><text>The term <quote>lessee</quote> means a person who, in exchange for payment—</text><subparagraph id="H8FFB6D7141954208B4A9ECCDA724201D"><enum>(A)</enum><text>takes temporary possession of residential real estate through a lease; or</text></subparagraph><subparagraph id="H33F8561DB2124BB5BEEF3A5CA659A3B9"><enum>(B)</enum><text>takes possession, in whole or in part, by lease or purchase, of residential real estate subject to a ground lease.</text></subparagraph></paragraph><paragraph id="H1161690DCC6645F882C7B8B0BC3977EE"><enum>(6)</enum><header>Private land use restriction</header><text>The term <quote>private land use restriction</quote> means—</text><subparagraph id="H51C2CC4DE5454849964D977F16C88832"><enum>(A)</enum><text display-inline="yes-display-inline">a publicly recorded provision (whether such provision is denoted as a covenant, deed restriction, declaration, use restriction, covenant that runs with the land, or otherwise) that—</text><clause id="H846346D8065F4A73A21EBA5F9A163656"><enum>(i)</enum><text>touches or concerns the real estate to which the provision applies; and</text></clause><clause id="H276803D4D6D2418AB2A6B00B3891313D"><enum>(ii)</enum><text>limits or restricts the use of the real estate or imposes conditions on the use of the real estate; or</text></clause></subparagraph><subparagraph id="H569DD621A0744B8EB45F5DD3688FD383"><enum>(B)</enum><text>a rule or regulation of a community association, whether publicly recorded or not, that limits or restricts the use of real estate or imposes conditions on the use of real estate.</text></subparagraph></paragraph></subsection><subsection id="H30490D485BCC41D0A2203DA3C15D36C1"><enum>(b)</enum><header>Certain restrictions prohibited</header><text>A private land use restriction that prohibits, restricts, or impairs, or has the effect of prohibiting, restricting, or impairing, an amateur operator from operating, installing, or maintaining any amateur station antenna on property subject to the control of the amateur operator may not be adopted or enforced, except as permitted by subsection (c).</text></subsection><subsection id="H8B20297698C44F7D852566225134A06A"><enum>(c)</enum><header>Permissible restrictions</header><paragraph commented="no" id="H48609C91657D4032B20556374F461B2D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the following private land use restrictions applicable to amateur station antennas may be adopted or enforced:</text><subparagraph commented="no" id="H12688EDBA0A8418B852A5CA9D252D44D"><enum>(A)</enum><text>A restriction that requires an amateur station antenna to be installed in compliance with the specifications of the manufacturer of the antenna, applicable zoning ordinances, amateur radio tower ordinances (if any), and governmentally adopted building codes.</text></subparagraph><subparagraph commented="no" id="H7C3F5281A52C472F8B997B98C0F83E51"><enum>(B)</enum><text display-inline="yes-display-inline">A restriction that requires an amateur station antenna to be maintained in a structurally safe condition.</text></subparagraph><subparagraph commented="no" id="HCE3C4B9E62694F02A53507A58539BE93"><enum>(C)</enum><text display-inline="yes-display-inline">A restriction that requires any deteriorated or structurally unsafe component of an amateur station antenna to be repaired, replaced, or removed.</text></subparagraph><subparagraph commented="no" id="H0990A294C595407981C3434DEEC2B895"><enum>(D)</enum><text display-inline="yes-display-inline">A restriction that requires an amateur station antenna to be removed if the property on which the antenna is located ceases to be subject to the control of an amateur operator.</text></subparagraph><subparagraph commented="no" id="H7BF71F1C257F493A82C553C63CE3BD60"><enum>(E)</enum><text display-inline="yes-display-inline">A restriction that requires an amateur station antenna ground-mounted electrical enclosure, ground-mounted control enclosure, or guy wire anchor to be visually screened if such enclosure or anchor—</text><clause id="H2D9D9FAF11A743D7BFC27A2C9BA883E1"><enum>(i)</enum><text>is visible from the street faced by the dwelling; or</text></clause><clause id="H28E7547F4DDA44ADBF938EB6C59F9BD1"><enum>(ii)</enum><text>is located in an unfenced side or rear yard and is visible from an adjoining property.</text></clause></subparagraph></paragraph><paragraph id="HF365847C082E48A6A9D0B00326ACB099"><enum>(2)</enum><header>Reasonable application and enforcement</header><text>A private land use restriction permitted by paragraph (1) shall be reasonably applied and enforced.</text></paragraph></subsection><subsection id="H77E651C2F38B4101ADE4FB33F92191DB"><enum>(d)</enum><header>Limitations on prior approval</header><paragraph id="H9796FAD4C8174EE984F78EDD5DE18E8F"><enum>(1)</enum><header>Requirement not present in land records at time of purchase or lease</header><text>A requirement in a private land use restriction for an amateur operator to obtain prior approval for the installation of an amateur station antenna may not be adopted or enforced if such requirement for prior approval was not present in the publicly recorded land records prior to the purchase or lease of the property by the amateur operator.</text></paragraph><paragraph id="H6E2E3E1AE2634FF3A2B0EE918D5A36A9"><enum>(2)</enum><header>Information required for prior approval</header><text display-inline="yes-display-inline">A private land use restriction that requires an amateur operator to submit an application for approval of an amateur station antenna prior to installation may not be adopted or enforced if the information required to be submitted as part of the application is greater or more detailed than the information required to be submitted as part of an application for any other improvement.</text></paragraph><paragraph id="H938C24EAE9B648A5929008F0F53B7FF8"><enum>(3)</enum><header>Deemed approval</header><text>If a community association or other person authorized to enforce a private land use restriction applicable to an amateur station antenna does not approve or deny an application of an amateur operator for approval of the installation of an amateur station antenna by the day that is 45 days after the date on which the application is submitted, the application shall be deemed to be approved on the 45th day.</text></paragraph><paragraph id="HE14085ABE03F417F8EAE3159A161C949"><enum>(4)</enum><header>Existing approval</header><text>If a private land use restriction requires an amateur operator to submit an application for approval of an amateur station antenna prior to installation, after a community association or other person authorized to enforce the restriction approves the application, no further approval of the antenna may be required, unless there is a material change in the dimensions or structural integrity of the antenna.</text></paragraph></subsection><subsection id="HFB1A1C4050814B9C99E74669DCC07B77"><enum>(e)</enum><header>Antennas that do not require prior approval</header><text>A requirement in a private land use restriction for an amateur operator to obtain prior approval for the installation of an amateur station antenna may not be adopted or enforced with respect to any of the following types of amateur station antennas:</text><paragraph id="H15DC69BD773B4AD5A01E9936707CB2BA"><enum>(1)</enum><header>1 meter or less in diameter or diagonal measurement</header><text>An antenna for use by an amateur operator that is less than 1 meter in diameter or diagonal measurement, or having other measurements prescribed by the Commission.</text></paragraph><paragraph id="H1FF54EBD95AE427890D2F69F8EFFB60F"><enum>(2)</enum><header>Flagpole antennas</header><text>A flagpole, capable of dual use as a flagpole and an amateur station antenna, not greater than 43 feet in height above ground.</text></paragraph><paragraph id="HD9188F60EA4D4958B5E5D141B33890F7"><enum>(3)</enum><header>Wire antennas</header><text>Minimally obtrusive wire antennas, of a length necessary for the frequency of use intended.</text></paragraph><paragraph id="HCB8F391F0C934A9BB953DF4FACBE28E4"><enum>(4)</enum><header>Vertical antennas</header><text>Vertical antennas, not to exceed 43 feet in height above ground, including collapsible whip and tilt-over antennas.</text></paragraph></subsection><subsection id="HF91F0AB2D3AA4374B8532EABAE651CEB"><enum>(f)</enum><header>Rules of construction</header><paragraph commented="no" id="H3E043DA68FE944B6825D5F2F9414B790"><enum>(1)</enum><header>Control of property</header><text>For purposes of this section, property is subject to the control of an amateur operator if the amateur operator is an owner, lessee, or legal resident of the property.</text></paragraph><paragraph commented="no" id="HB311BC6FD22745EF9D7D3AFB625EAC5C"><enum>(2)</enum><header>Impairment of installation, maintenance, or operation</header><text display-inline="yes-display-inline">For purposes of this section, a private land use restriction prohibits, restricts, or impairs the installation, maintenance, or operation of an amateur station antenna if the restriction—</text><subparagraph commented="no" id="H776E477F34BB457FA5371860EBF1CCBB"><enum>(A)</enum><text>unreasonably delays or prevents installation, maintenance, or operation of the antenna;</text></subparagraph><subparagraph commented="no" id="H92EA0A58475841C5B979EE84DDCBB531"><enum>(B)</enum><text>unreasonably increases the costs or difficulty of installation, maintenance, or operation of the antenna; or</text></subparagraph><subparagraph commented="no" id="H75DA5809262E423789E369EEA282A0D0"><enum>(C)</enum><text>prevents or degrades reception or transmission of a signal acceptable to the amateur operator.</text></subparagraph></paragraph><paragraph id="HA1B5CAAF1D5145DF8C4E9DAB5184A114"><enum>(3)</enum><header>Limited common area</header><subparagraph id="HC1529C7858AC44C7A20A7C0430BBD4D8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this section, if there exists, within the property for which a community association is responsible, a limited common area to which an amateur operator has the right to exclude use by others, the limited common area shall be treated as property under the control of the amateur operator.</text></subparagraph><subparagraph id="H96104044836A44AB934F34DFAB1E65E2"><enum>(B)</enum><header>Permission access</header><text>For purposes of subparagraph (A), access by a community association for roof repairs, landscaping, or other maintenance activities shall be treated as a permission, or authorized access, which does not limit or destroy the control of the amateur operator.</text></subparagraph></paragraph></subsection><subsection id="H3255F0E1A8F2467082030E1FDC787485"><enum>(g)</enum><header>Enforcement</header><paragraph id="HF2A2BC917A9544ACBD25D0CA6C90CA23"><enum>(1)</enum><header>Stay of enforcement</header><text>If an action is initiated to seek a declaratory ruling from the Commission or a court of competent jurisdiction regarding whether a private land use restriction complies with this section, any community association or other person seeking to enforce the restriction shall suspend all enforcement efforts with respect to the restriction until a ruling in the action has become final.</text></paragraph><paragraph id="H679E15C1550946F4B466423947F8708E"><enum>(2)</enum><header>Prohibition on accrual of penalties or other costs</header><text>No penalty or other cost related to an amateur station antenna may accrue against an amateur operator under a private land use restriction while an action described in paragraph (1) is pending to determine whether the restriction complies with this section.</text></paragraph><paragraph id="H617467A2CEE24A3CAE6A6A472FDB8301"><enum>(3)</enum><header>Burden of proof</header><subparagraph id="H76BE5A719FFA448BB2BBD573FCF245A7"><enum>(A)</enum><header>Regarding compliance with this section</header><text display-inline="yes-display-inline">In any action before the Commission or a court of competent jurisdiction involving the interpretation of any provision of this section, the burden of demonstrating that a particular private land use restriction complies with this section shall be on the party that seeks to impose, maintain, or enforce the restriction.</text></subparagraph><subparagraph id="HEAED656F2DCD4D6393192C47267EDC14"><enum>(B)</enum><header>Regarding violation of private land use restriction</header><text display-inline="yes-display-inline">In any action before the Commission or a court of competent jurisdiction to determine whether an amateur station antenna violates a private land use restriction, the party alleging the violation bears the burden of proof.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H9EBC2992017F4482A0593642FE429F20"><enum>(h)</enum><header>Private right of action</header><text display-inline="yes-display-inline">A person harmed by a violation of this section may bring an action against the person alleged to have committed the violation in an appropriate district court of the United States without first exhausting remedies under State law.</text></subsection><subsection id="HC39A2704CD5746FEBAD283761C85D50F"><enum>(i)</enum><header>Affirmation of limited preemption of State and local land use regulation</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to modify or otherwise limit the applicability of section 97.15(b) of title 47, Code of Federal Regulations, or any successor regulation.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEE08CDF5110642ACAF7EAED76F2045BA"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Federal Communications Commission shall promulgate regulations to implement the amendment made by subsection (a).</text></subsection></section></legis-body></bill>
