<committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 to create an innovation zone initiative, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Innovation Zone Act</short-title></quote>.</text></section><section id="id1D6979B0E52F4D6FA8ECC4182B6A98A6"><enum>2.</enum><header>Innovation zone initiative authority</header><text display-inline="no-display-inline">Section 487A of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094a">20 U.S.C. 1094a</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id60D6FC886D37488994F856F0E2D1319F"><section id="id45d9746c9c914f46bfc922ea05344a5c"><enum>487A.</enum><header>Innovation zone initiative</header><subsection id="id06ec2ccf74d747feb3e026b49cd0cbf0"><enum>(a)</enum><header>Innovation zone initiative</header><paragraph id="id3b6bffd6570543569beacee4abe35689"><enum>(1)</enum><header>In general</header><text>The Secretary is authorized to establish an innovation zone initiative consisting of voluntary experiments under which the Secretary and institutions of higher education are permitted to test the effectiveness of statutory and regulatory flexibility that aims to increase student success, which may be defined as 1 or more of the following:</text><subparagraph id="id9affe6356ebe4c21af0f46310ea79a2c"><enum>(A)</enum><text>Reduction in student loan debt.</text></subparagraph><subparagraph id="id14dd013e093b4bb3a24129097f791c41"><enum>(B)</enum><text>Increase in student retention and program completion at institutions of higher education, especially for historically underrepresented students.</text></subparagraph><subparagraph id="id7B0FCBB389BC4B709927737BC3630F8D"><enum>(C)</enum><text>Decrease in student time to program completion.</text></subparagraph><subparagraph id="idE6C94A0A83EE4A79A45ED7271C1BFDD7"><enum>(D)</enum><text>Closing of gaps in enrollment and completion between historically underrepresented students and students who are not historically underrepresented students.</text></subparagraph><subparagraph id="id198d0cb939714b11a89fd263af31a929"><enum>(E)</enum><text>Increase in student employment outcomes upon graduation.</text></subparagraph><subparagraph id="id48927fe73dfa4a3eb16ddef38b6afa31"><enum>(F)</enum><text>Improved financial aid disbursement and service to students.</text></subparagraph><subparagraph id="id987CAEDB239C44FFA19A3A1D4B522816"><enum>(G)</enum><text>Increase in student safety, wellness, or food and housing security.</text></subparagraph><subparagraph id="idff4565ddcf87423b842647a774a9476f"><enum>(H)</enum><text>Other innovative practices that benefit students.</text></subparagraph></paragraph><paragraph id="id8986db2298e94897a24cfe17ba130b21"><enum>(2)</enum><header>Reduction of regulatory burden</header><text>Where appropriate, the Secretary may establish experiments, that, in addition to meeting the requirements of paragraph (1), lead to a reduction of regulatory burden on institutions of higher education or the Department, without harm to students.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA4D8D473F7C14C87B2225C88B04525F0"><enum>(3)</enum><header display-inline="yes-display-inline">Waivers</header><subparagraph commented="no" display-inline="no-display-inline" id="idE6A596B29ACF4B829CDC965958D16138"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the Secretary is authorized to waive, for any institution of higher education participating in an innovation zone experiment under paragraph (1), one or more requirements of title I or IV, including regulations promulgated under title I or IV.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id34362D5024A643ABBE5C5BD859BE8737"><enum>(B)</enum><header>Limitations</header><text>The Secretary may not grant a waiver with regard to the following:</text><clause commented="no" display-inline="no-display-inline" id="id29881BFE5A3E49488689A9ACB027B126"><enum>(i)</enum><text>The definition of an institution of higher education under section 101 or 102.</text></clause><clause commented="no" display-inline="no-display-inline" id="idD8EA2FF2075F4ED2B3C99F93574FA81B"><enum>(ii)</enum><text>Antidiscrimination provisions under section 111.</text></clause><clause commented="no" display-inline="no-display-inline" id="idA531278A42C24F90B91AEA6849629FED"><enum>(iii)</enum><text>Student speech rights provisions under section 112.</text></clause><clause commented="no" display-inline="no-display-inline" id="id7FA7ED2A53344A91B3306AEFF522080F"><enum>(iv)</enum><text>Campus safety provisions under section 119 or 120.</text></clause><clause commented="no" display-inline="no-display-inline" id="id11828A4203BB475EB289BF4DA427C699"><enum>(v)</enum><text>Preferred lender arrangements under section 152.</text></clause><clause commented="no" display-inline="no-display-inline" id="id0A3DBF1A88984B9F8C6FC0BBEC7958FA"><enum>(vi)</enum><text>Grant or student loan maximums under title IV.</text></clause><clause commented="no" display-inline="no-display-inline" id="id43A4EC2E24BC47BC921C00701FDB569D"><enum>(vii)</enum><text>The needs analysis under part F of title IV.</text></clause></subparagraph></paragraph></subsection><subsection id="id0ca3a97669fd48fea63026dba4dc0fdc"><enum>(b)</enum><header>Solicitation of experiment suggestions</header><paragraph id="id5CA7FEE0632B4E118B61B97EF4632EF6"><enum>(1)</enum><header>Solicitation of suggestions</header><text>Not less frequently than every 2 years, the Secretary shall provide an opportunity, through the Department of Education’s website, for the public, institutions of higher education, and other stakeholders to submit suggestions for potential experiments under this section.</text></paragraph><paragraph id="idA4587A0CBA7848EC9D146CF0FC35DF3F"><enum>(2)</enum><header>Contents of suggestions</header><text>Any person that wishes to submit a suggestion under paragraph (1) shall include—</text><subparagraph id="id70C8AD13540549859810DBB28FC8334F"><enum>(A)</enum><text>the goals or objectives of the proposed experiment, and how statutory or regulatory flexibility could allow the institution of higher education to increase student success, as required under subsection (a)(1);</text></subparagraph><subparagraph id="idE0F5C297E0E345B9B512A61DC7D75F29"><enum>(B)</enum><text>a description of how the experiment would be conducted, including participation protections or mechanisms in place to ensure that students participating in the experiment will not be negatively impacted, such as by facing additional barriers to completion or losing credit as a result of the experiment;</text></subparagraph><subparagraph id="id5D2270A0D05F47B9989F1B189712018B"><enum>(C)</enum><text>the specific statutory or regulatory requirements for which a waiver would be requested;</text></subparagraph><subparagraph id="idC62022A9E0124F00BCE597FC15E300FC"><enum>(D)</enum><text>an examination of the current need or interest, as of the date of the submission, for the experiment; and</text></subparagraph><subparagraph id="idB0A42D07A7CC4508AE509E82CA77CEC3"><enum>(E)</enum><text>a description of how the suggested experiment contributes to building the evidence base and how evaluation could be used to generate that evidence.</text></subparagraph></paragraph></subsection><subsection id="idB87F772697C548D396C4B973B7428B1A"><enum>(c)</enum><header>Selection of experiments and designation of participating institutions</header><paragraph id="id05571A300AF2423DA18317A970124467"><enum>(1)</enum><header>Selection considerations</header><text>After considering any suggestions submitted under subsection (b), the Secretary may select experiments to be carried out under subsection (a). The Secretary shall base any such selection on the following:</text><subparagraph id="id84013bdcc86b44b087920a792fffe5d1"><enum>(A)</enum><text>Sufficient interest in the experiment among institutions of higher education, researchers, and practitioners.</text></subparagraph><subparagraph id="idec345a0a7c454db79c6236cbc7dd830a"><enum>(B)</enum><text>Research suggesting promise of fulfilling outcomes described in subsection (a)(1).</text></subparagraph><subparagraph id="id68AB9E68FFB443D88919411BD37CB5C6"><enum>(C)</enum><text>A clear link between how the desired statutory and regulatory flexibility could allow the institution of higher education to increase student success, as required under subsection (a)(1).</text></subparagraph><subparagraph id="id5D26A0258F3A4CBE98DAD89892A87342"><enum>(D)</enum><text>The ability for the Secretary to identify policy-relevant questions for the experiment and design an experiment that can credibly answer those questions, and contribute to the evidence base of innovative practices.</text></subparagraph><subparagraph id="ida0b7ad73c0fa48d28ffb2614a3ead1db"><enum>(E)</enum><text>Other general interest, as supported by evidence.</text></subparagraph></paragraph><paragraph id="id84eca10db5924c1ba535bd680ee8253c"><enum>(2)</enum><header>Determination of evaluation plans</header><text>After selecting an experiment under this section, but before any participating institutions for such experiment are chosen, the Secretary, in consultation with the Director of the Institute of Education Sciences, shall complete the following:</text><subparagraph id="idd201b29c0787418a92177f6c452b0513"><enum>(A)</enum><text>Identify policy-relevant questions for the experiment and design an experiment that can credibly answer those questions.</text></subparagraph><subparagraph id="id5fd15be910f242bd89dae24c7f19e8cf"><enum>(B)</enum><text>Identify the methodology of data collection for the experiment, including, to the extent practicable, a methodology that allows for disaggregation of data for historically underrepresented students.</text></subparagraph><subparagraph id="id4b600e805c294e41a9ff78508332ebb8"><enum>(C)</enum><text>Identify rigorous evaluation methods for determining the impact of the experiment, including whether the experiment has differential impacts for historically underrepresented students. These methods may include rapid cycle evaluation and behavioral insights and are informed by—</text><clause id="id01AD2BC980A24DE5B02891276490B299"><enum>(i)</enum><text>responses to requests from the Department for information; and</text></clause><clause id="idCA3CFC0F934B4C28B263F5FB07705F96"><enum>(ii)</enum><text>feedback from external researchers and other stakeholders.</text></clause></subparagraph><subparagraph id="idac56e7a180744cccad757420a43f62ee"><enum>(D)</enum><text>Establish a timeframe for conducting the experiment that shall not exceed 4 years from the award year in which Federal financial aid is first disbursed to students participating in the experiment, at which time the Secretary may opt to extend the experiment for an additional 2 years.</text></subparagraph><subparagraph id="id2bf7a9fe27d64c6c99354f320080d486"><enum>(E)</enum><text>Estimate the cost of conducting the experiment, to the extent practicable.</text></subparagraph><subparagraph id="idF39392BD3F45462DA552895503D62F24"><enum>(F)</enum><text>Estimate the size of the study sample (such as the number of participating students or institutions) needed to determine if the experiment has statistically significant effects.</text></subparagraph></paragraph><paragraph id="id4775ADC585C8406487CCE8E369A1898F"><enum>(3)</enum><header>Dissemination of information</header><text>The Secretary shall notify institutions of higher education, through the website of the Department or other means, of the experiments selected by the Secretary under this section and the steps necessary to participate in an experiment. Such notice shall include the information described in subparagraphs (A) through (F) of paragraph (2) for the experiment.</text></paragraph><paragraph id="id392AEEA1368D4151B7254A457406F0D4"><enum>(4)</enum><header>Commencement of experiment</header><text>The Secretary may carry out an experiment, in accordance with the requirements of this section, only if the Secretary has entered into agreements with not less than 5, and not more than 100, institutions of higher education, under which the institutions agree—</text><subparagraph id="id6B55C72F9FBB43A590ED893EBBA74818"><enum>(A)</enum><text>to participate in the experiment described in the applicable evaluation plan under paragraph (2);</text></subparagraph><subparagraph id="id25C1482D80F945378C872AA096D51693"><enum>(B)</enum><text>to comply with the data collection requirements under subsection (d)(1) and any other reporting requirements determined by the Secretary; and</text></subparagraph><subparagraph id="id87E2BC59B6BE4CBDA27D914323A01620"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id8680CE24F85145DB90DD7DB21061D175"><enum>(i)</enum><text>to the methodology for data collection established by the Secretary under paragraph (2)(B) for the experiment; or</text></clause><clause id="id5A54391F6EAE4B9FB0475376F29F5A0F" indent="up1"><enum>(ii)</enum><text>upon the request of the institution and if the Secretary determines appropriate, to an alternative methodology for data collection.</text></clause></subparagraph></paragraph><paragraph id="id22B5790CCDF9480BAD277E40CF1A120D"><enum>(5)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance to institutions of higher education that are not participating in an experiment but have an interest in potentially participating in an experiment.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC1991E31ED4946FDA7AEE34B3E9D880B"><enum>(6)</enum><header display-inline="yes-display-inline">Fast-track process to comply with information collection requirements</header><text display-inline="yes-display-inline">Notwithstanding section 3507 of title 44, United States Code, the Secretary shall be deemed to have the authority to approve, for purposes of such section 3507, any proposed collection of information related to an experiment conducted under this section, in the same manner and to the same extent as such authority is provided to a senior official by the Director of the Office of Management and Budget under section 3507(i) of such title.</text></paragraph></subsection><subsection id="id1AD9DBEAB49146C99984989E70CF0CB6"><enum>(d)</enum><header>Outcomes reporting</header><paragraph id="id8C51D5438AF44D1DB39F89EB2C6FBED6"><enum>(1)</enum><header>Data submission</header><text>Each institution of higher education participating in an experiment under this section shall timely submit to the Secretary, on a periodic basis to be determined by the Secretary, data on outcomes relating to the experiment.</text></paragraph><paragraph id="id329e5d913825413fb2c2192a5d71defd"><enum>(2)</enum><header>Report</header><subparagraph id="idE138E09EA2264AAEA9DB08EE769D1F3C"><enum>(A)</enum><header>In general</header><text>The Secretary shall—</text><clause id="idA20300EADC3240D793CCF61495B15B37"><enum>(i)</enum><text>review the experience of and rigorously evaluate, according to a methodology approved by the Institute of Education Sciences, the activities of all institutions participating in each experiment carried out under this section; and</text></clause><clause id="idDB1D9BCF85594F59B6CD08B2A650E5D0"><enum>(ii)</enum><text>beginning 2 years after the date of enactment of the <short-title>Innovation Zone Act</short-title>, and every 2 years thereafter—</text><subclause id="idB1425F730EDC4278B9C56B301E71AFF1"><enum>(I)</enum><text>prepare and submit a report regarding the innovation zone initiative under this section to the authorizing committees; and</text></subclause><subclause id="id29DAB53C96034078841F2B14F6BAEE57"><enum>(II)</enum><text>post the report on the public website of the Department.</text></subclause></clause></subparagraph><subparagraph id="idF73CF07C8ABB45F7867DF75E0927DF3C"><enum>(B)</enum><header>Contents of report</header><text>The report required under subparagraph (A)(ii)(I) shall include, for each experiment supported as of the date of the report—</text><clause id="idD8AE577404754EC6BC30D0A2C2BB1F36"><enum>(i)</enum><text>a summary of the status of the experiment;</text></clause><clause id="idC042779F026E47E0A6C2119640806025"><enum>(ii)</enum><text>a summary and analysis of the findings, to date, of the experiment, including the evaluation described in subsection (c)(2)(C);</text></clause><clause id="idDC002CC2FF104032B1EE03150E6CF057"><enum>(iii)</enum><text>the methodology of data collection;</text></clause><clause id="idAA602F4C15D04E8DBAB661BB196EA9DB"><enum>(iv)</enum><text>an analysis of the value of continuation of the experiment;</text></clause><clause id="idCA39D54E5993486A96B090EF03268BE5"><enum>(v)</enum><text>an explanation of any current or foreseen barriers to conducting the experiment; and</text></clause><clause id="idA5098C5E15A746B4970AD9D5D944A9D3"><enum>(vi)</enum><text>an evaluation of the quality of data and intended results.</text></clause></subparagraph><subparagraph id="id294F226200664E7C9DBCA21B55D83EC2"><enum>(C)</enum><header>Completed experiment report</header><text>By not later than 60 days after the completion of the timeframe established under subsection (c)(2)(D) or (e)(2)(B)(ii) for an experiment, the Secretary shall—</text><clause id="idD57B68D8E04C4D2783E42C1ECE3450AE"><enum>(i)</enum><text>prepare a report that includes—</text><subclause id="id20A954CE6DC84AD69CCC1719FCE35B61"><enum>(I)</enum><text>the findings of the experiment, including, to the extent practicable, disaggregation of data for historically underrepresented students; and</text></subclause><subclause id="id02E691F2B56E4C0A959ECEABAB05B521"><enum>(II)</enum><text>in the case of an experiment for which the Secretary determines there is sufficient value in continuing the experiment past the established timeframe, adequate documentation to justify such continuation; and</text></subclause></clause><clause id="id3B64E184B5084B96967388699EB7BB24"><enum>(ii)</enum><text>publish the report on the public website of the Department and submit the report to the authorizing committees.</text></clause></subparagraph><subparagraph id="id00280F85AD22473288B4801A53F6892D"><enum>(D)</enum><header>Collection of additional data</header><text>The Secretary may collect additional data after the conclusion of an experiment under this section to assess the long-term outcomes of participants.</text></subparagraph></paragraph></subsection><subsection id="id8f1fcfcaa96b4268bffb55d75f0f6e9d"><enum>(e)</enum><header>Transition; review</header><paragraph id="id74BEBD330A1B440CB17520B7F3F7D888"><enum>(1)</enum><header>Continuation of existing experiments</header><text>The Secretary may continue any experiment commenced under this section before the date of enactment of the <short-title>Innovation Zone Act</short-title> (referred to in this subsection as an <term>existing experiment</term>). Any such existing experiment shall be subject to the requirements of this section, as amended by the <short-title>Innovation Zone Act</short-title>, except for the requirements of subsection (c).</text></paragraph><paragraph id="idE73A020934FC4752B5336AB106AD110B"><enum>(2)</enum><header>Review of existing experiments</header><text>By not later than 90 days after the date of enactment of the <short-title>Innovation Zone Act</short-title>, the Secretary shall—</text><subparagraph id="id9F3B9819A92D408B9A6537D32C51C908"><enum>(A)</enum><text>conduct an extensive review and assessment of existing experiments still in effect; and</text></subparagraph><subparagraph id="id894571530FCC4B0CB007F80ED0616E96"><enum>(B)</enum><text>prepare and submit to the authorizing committees, and publish on the public website of the Department, a report of the status of the existing experiments, which shall include, for each such experiment—</text><clause id="idea5bfdf919f647fa9515baee1e9b597e"><enum>(i)</enum><text>the total cost to date and the projected cost of continuation, to the extent practicable;</text></clause><clause id="id02b165425c7040ada40d7e1fc84a3487"><enum>(ii)</enum><text>an established timeframe for completion;</text></clause><clause id="id688734296da14f5bb6b15057b2428dad"><enum>(iii)</enum><text>the current methodology of data collection;</text></clause><clause id="id3c77be6a290c4b3f9158c61bc67453ae"><enum>(iv)</enum><text>an analysis of findings, as of the date of the report;</text></clause><clause id="id97ce9dd6e9ec42f1931f48ef8bb44ab8"><enum>(v)</enum><text>an analysis of the value in continuation of the existing experiment; and</text></clause><clause id="id9E398723ACB74992BDCB0827EA161ABA"><enum>(vi)</enum><text>an analysis of whether the assessment of the experiment could be restructured to answer other policy questions.</text></clause></subparagraph></paragraph></subsection><subsection id="idE8F504FED1A845079EAFCDCD6F5B0E6A"><enum>(f)</enum><header>Definition of historically underrepresented student</header><text>In this section, the term <term>historically underrepresented student</term>—</text><paragraph id="idd8c8ecdf4a25428caadf75f6d5e8de5d"><enum>(1)</enum><text>means a student, or prospective student, at an institution of higher education who is at risk of educational failure or otherwise in need of special assistance and support; and</text></paragraph><paragraph id="ida463a3c6bf24413ba5fd2ce21f387c71"><enum>(2)</enum><text>may include an adult learner, working student, part-time student, student from a low-income background, student of color, Native youth, single parent (including a single pregnant woman), student who is a homeless child or youth (as defined in section 725 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a</external-xref>)), youth who is in, or has aged out of, the foster care system, first generation college student (as defined in section 402A(h)), and student with a disability.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
